AND THE ACTS IN AMENDMENT THEREOF

1. The name of the Association is Hockey Newfoundland & Labrador Inc. affiliated with the Canadian Hockey Association. 2. The registered office of the Association will be situated in Grand Falls-Windsor in the Province of Newfoundland & Labrador. 3. The objects for which the Association is founded are: (a) To foster and encourage the sport of hockey throughout the Province of Newfoundland & Labrador. (b) To promote, supervise and regulate competition in all the recognized categories of Amateur Hockey within the Province of Newfoundland & Labrador and to determine the various championship teams annually. (c) To lay down and secure the adoption of uniform rules in Newfoundland and Labrador to act as the legislative authority. (d) To decide on and adjust any doubtful or disputed matters relating to the game within the jurisdiction of the Association. (e) To encourage the game of hockey in our Universities, Colleges and Schools and to assist where possible in arranging playoffs for such teams. 4. The income and property of the Association when-so-ever derived, shall be applied solely towards the promotion of the objects of the Association as set forth in the Articles of Incorporation; and no portion thereof shall be paid or transferred, directly or indirectly, by way of dividend, bonus or otherwise howsoever by way of profit, to the members of the Association, provided that nothing herein contained shall prevent the payment in good faith, of remuneration to any member of the Association or other person in return for any services actually rendered or goods delivered to the Association.

5. The liability of the members is limited. The fourth paragraph of the Articles of Incorporation contains conditions under which a license is granted by the Minister of Provincial Affairs to the Association in pursuance of Section 253 of the Companies Act, Chapter 54 of the Revised Statues of Newfoundland, 1970, as amended.



6. Every member of this Association undertakes to contribute to the assets of the Association in the event of the same being wound up during the time he is a member, or within one year afterward, for payment of the debts and liabilities of the Association contracted before the time at which he ceased to be a member, and of the costs, charges and expenses of winding up of same, and for the adjustments of the right of the contributories amongst themselves not exceeding the sum of two dollars ($2.00).

7. If on the winding up or dissolution of the Association there remains after the satisfaction of all its debts and liabilities any property whatsoever, the same shall not be paid to or distributed among the members of the Association but shall be given or transferred to some other institution or institutions having objects similar to the objects of this Association to be determined by the members of the Association at or before the time of dissolution or, in default thereof, by such judge of the Supreme Court as may have or acquire jurisdiction in the matter. 8. True account shall be kept of the sums of money received and expended by the

Association and the manner in respect of which such receipt and expenditure takes place, and of the property credits and liabilities of the Association and subject to any reasonable restrictions as to the time and manner of inspecting the same that may be imposed in accordance with the regulations of the Association for the time being, shall be open to the inspection of the members. Once at least in every year the accounts of the Association shall be examined and the correctness of the balance sheet ascertained by one or more auditor or auditors.

We, the several persons whose names and addresses are subscribed hereto, are desirous of being formed into an Association in pursuance of the Articles of Incorporation.

SHARE CAPITAL AND DISTRIBUTION OF CORPORATE PROPERTY

OF

HOCKEY NEWFOUNDLAND & LABRADOR INC.

(a) The Corporation has no authorized share capital. (b) The Corporation is to be carried on without pecuniary gain to its members. (c) Any profits or other accretions to the Corporation are to be used only in furthering its undertakings. (d) Upon the incorporation of the Corporation each first director shall become a member thereof. (e) Upon dissolution of the Corporation and after payment of all its debts and liabilities, all remaining property shall be distributed or disposed of to organizations in the Province, the undertaking of which is charitable or beneficial to the community.

SECTION ONE – ARTICLES

ARTICLE ONE

NAME OF THE ASSOCIATION For legal purposes, the name of the Association is Hockey Newfoundland and Labrador Inc. but for all other purposes, this Association shall be known as Hockey NL.

ARTICLE TWO

AUTHORITY (a) Hockey NL is the governance body of, and has full and complete jurisdiction over all organized amateur hockey in the Province of Newfoundland and Labrador.

(b) Hockey NL is a member of the Canadian Hockey Association, and is subject to

the Constitution, By-Laws, Regulations and playing rules of Hockey Canada.

ARTICLE THREE

GOVERNANCE OF THE ASSOCIATION (a) The governance of the Association will be under the direction of a President and Board of Directors as set out in the Articles of Incorporation, By-Laws and Regulations, hereinafter referred to as the “Constitution”. (b) This Association may, at its annual meeting, amend, revise or repeal By-Laws,

Regulations or Constitution for the governing of this Association and then only by a two-thirds majority of the Board of Directors present and voting.

(c) The Hockey NL Policy Manual forms part of Hockey NL’s governance and is

in full force and effect when adopted by a two-thirds majority of the

Officers of Hockey NL present and voting.

ARTICLE FOUR

DEFINITION OF AN AMATEUR

An amateur hockey player is one who is not participating in organized professional hockey.

ARTICLE FIVE

MEMBERSHIP (a) (i) Hockey NL shall be open to membership from the following:

(ii) Applications for membership must be made, on the application form

provided, to the Executive Director of Hockey NL. Each application shall be accompanied by a membership fee of $5.00. Membership will be renewed annually on payment of the $5.00 annual membership fee.

(iii) The membership year will be from September 1 to the following August 31.

The Executive Director will maintain a membership roll of members in good standing.

(b) The Association shall have the right to approve affiliate memberships. Affiliate

memberships shall be acquired by application in writing, and representatives of affiliate members shall be entitled to attend meetings of the Association at the expense of the affiliate member but shall not be entitled to vote at such meeting. The fee for affiliate membership shall be set at $50.00 annually.

(c) Wherever used in the Constitution, the word "member" shall be deemed to include where the context permits, any person, club or team participating in games or activities of any kind sponsored or organized by the Association (whether or not such person, club or team is in fact a member of the Association) and the word "Individual" shall include, where the context permits, any person, parent/guardian, player, coach, manager or official affiliated with or associated with, in any capacity whatsoever, any club or team participating in games or activities of any kind sponsored or organized by the Association and shall also include game officials. Throughout the Constitution, the masculine includes the feminine and the neuter, and the neuter includes the masculine and the feminine, the singular includes the plural and the plural includes the singular, whenever the context requires or permits.

(d) Wherever used in the Constitution, the word “member” shall be deemed to

include: (i) Life Members; (ii) individuals elected in accordance with the Association’s By-Laws and

Regulations; and

(iii) individuals appointed in accordance with the Association’s By-Laws and Regulations.

ARTICLE SIX

AMENDMENTS (a) The Constitution may be amended or altered only at the annual meeting of the

Association and then only by a two-thirds majority of the Board of Directors present and voting. Any amendment or change which is passed will become effective after the conclusion of the annual meeting.

(b) No amendment or addition to the Constitution shall be considered unless it has

been submitted in writing to the Executive Director by a member of the Board of Directors at least thirty (30) days prior to the date of the meeting.

(c) It shall be the duty of the Executive Director to submit all such proposed

amendments to each member of the Board of Directors at least two weeks before the date of the meeting at which they are to be considered.

(d) The Hockey NL Policy Manual can be amended or changed (except for

Sections 1.08 – Conflict of Interest Policy and 2.02 – Executive Committee

Honoraria) by a two-third majority of the Executive Committee present and

voting. In the case of an amendment or change to Sections 1.08 or 2.02,

then a two-thirds majority of the Board of Directors present and voting is

required to make the amendment or change.

SECTION TWO – BY-LAWS

BY-LAW ONE

MEMBERSHIP 100. Membership shall be acquired by written application to the Executive Director by December 1st of each year expressing compliance with, and adherence to the Constitution. 101. All games played by members, and the qualifications of all persons competing at such games as members of its teams, shall be in conformity with the Constitution of Hockey NL. 102. (a) Any Association or League affiliated with Hockey NL, as condition precedent to membership in Hockey NL, shall adopt Articles, By-Laws, Regulations, Policies and Playing Rules that conform with the Constitution of Hockey NL, and shall not at any time make any amendments of its Articles, By-Laws, Regulations, Policies or Playing Rules conflicting with the Constitution, Policies or Playing Rules of Hockey NL. (b) Any member shall be subject to the Constitution, Policies and Playing Rules of Hockey NL, including exercising all rights of appeal and making any complaints or grievances through Hockey NL, before proceeding outside the Association. 103. Any violation of the Constitution of this Association, or of decisions of the Executive Committee, by any member of this Association shall render such member liable to suspension. Any suspension shall mean that the suspended member shall not be permitted to take part in any activity of this Association at any level during the period of the suspension. 104. (a) Membership in the organizations listed in Articles 5 and 7 of HC and By- Law 1 of the Hockey NL Constitution by the constituent bodies, players, members and individuals is purely voluntary, but application or acceptance of membership entails acceptance by such constituent bodies, players, members and individuals of the final and binding authority of all rules and decisions of the Board of Directors of HC and Hockey NL and acceptance of the governing authorities of HC or Hockey NL, and acceptance and subscription of such insurance coverage and participant membership fees as may be approved and made mandatory from time to time by the Board of Directors of HC and Hockey NL. (b) Any recourse of the Courts of any jurisdiction by any member, before all rights of appeal and all the rights and remedies of the Constitution and

By-Laws of HC and Hockey NL have been exhausted, shall be deemed to be a violation and breach of the Constitution and By-Laws of HC and Hockey NL. This violation and breach shall result in the automatic indefinite suspension of such member from HC and Hockey NL, including all activities and games played under the jurisdiction of HC and Hockey NL or any of its members as defined in Article 5 (full members) and Article Seven (associate members) of HC and By-Law 1 of the Hockey NL Constitution. (c) Any Association, club, league, team, player, coach, manager, trainer, and referee who have sought court action before exhausting all proper procedures of appeal shall be liable for all legal costs and disbursements incurred by HC and Hockey NL.

(d) Until full legal costs are paid, at the discretion of the President, the right of membership of the said party will be suspended. (e) Any Association, club, league, team, player, coach, manager, trainer or referee who, having exhausted the appeal procedures, proceeds with Court action, will be liable for all legal costs and disbursements

incurred by HC and Hockey NL should the Courts rule in favour of HC or Hockey NL, prior to reinstatement of said party’s membership with HC or Hockey NL.

200. A membership entry fee shall be assessed each member, Association, or league, annually as decided at the annual meeting by the Council under whose jurisdiction the team will operate. 201. The membership fee in all cases must be paid to the Executive Director of the Association and no player registrations will be issued until such membership fees are paid.

BY-LAW THREE

BOARD OF DIRECTORS OF THE ASSOCIATION

300. The Board of Directors of the Association shall be: a President, a Vice-President, a Chair responsible for Senior Hockey, a Chair responsible for Junior Hockey, a Chair responsible for Minor Hockey, a Female Hockey Chair, a Referee-in-Chief, a Hockey Development Chair and an Immediate Past President. These officers will be the Executive Committee of the Association. Other members of the

Board of Directors consist of the Senior Council Executive Committee as specified in By-Law 602 (a), the Junior Council Executive Committee as specified in By-Law 603(a) and Minor Council Executive Committee as specified in By-Law 604(a).

301. Elections

(a) At the semi- annual meeting a Nominating Committee must be formed, chaired by the Past President, with one representative from each of the Minor, Junior and Senior Councils. In the absence of the Past President, or if for some reason the Past President declines this position, the Chair of the Nominating Committee shall be appointed by the President. This committee will be responsible for nominations for the various positions of office within the Association. Their report will be circulated 60 days prior to the annual meeting. This will give those who are eligible to make nominations the next 30 days to make further nominations. All such nominations must be sent to the Nominating Committee Chair by registered mail dated at least 30 days prior to the annual meeting and no nominations will be permitted after that period either in writing, or from the floor at the annual meeting. There is an exception to allow nominations from the floor when there is no nomination received.

(b) At the first general session of the annual meeting, the Chair of the

Nominating Committee shall present the report of the Nominating Committee, which shall name one nominee for each position on the Board of Directors and one nominee for each position on the Female Committee. The Chair of the Nominating Committee shall also present to the meeting any additional nominations forwarded to him following the circulation of the Committee's report as specified in By-Law 301(a).

(c) Nominations for the position of President shall be from among the present

incumbent officers, past officers, present or past members of the council executives responsible for the different divisions of hockey. Nominations for the position of Referee-in-Chief shall be from among the present and past members of the Referee Division Committee or present and past registered officials. Nominations for the position of Hockey Development Chair shall be from among the present and past members of the Hockey Development Committee or present or past members of Associations, leagues or teams. Nominations for the remaining Executive Committee positions shall be from among the present incumbent officers, past officers, present or past members of the council executives responsible for the different divisions of hockey or Presidents and Past Presidents of member Associations or leagues in good standing and present and past members of the Hockey Development Committee, Female Committee and Referee Division Committee. Nominations for the Senior, Junior and Minor Council and Female Committee Executive Committee positions

shall be from present or past members of Associations, leagues and/or teams.

(d) Nominations may be made only by those entitled to vote at the Plenary Sessions as specified in By-Law 800(a) or only by those entitled to vote at Council and Female Committee meetings as specified in By-Law 801 other than those made by the Nominating Committee. Any such nomination must be accompanied by written authorization from the nominee. In the event no nominations are forthcoming, the Executive Committee may appoint.

(e) The Divisional Chairs and Council Executive Committee members shall

be elected at their own annual divisional meetings by accredited delegates to their respective divisional meetings as described in By-Law 801. They shall take office immediately following their election and they shall be eligible to vote at any general session of the annual meeting, which follows their election. Each Area Director will be elected by only accredited delegates representing the elected area. All incumbents will

be entitled to vote. The Divisional Chairs shall be elected in odd numbered years for a term of two (2) years.

(f) The election of the President, the Vice-President, Hockey Development

Chair, and the Referee-in-Chief will take place at the closing general session of the annual meeting in odd numbered years and they will take office immediately after the session in which they are elected for a term of two (2) years.

302. President (a) The President or in his absence, the Vice-President or his designate, shall

preside at all meetings of the Association, and of the Executive Committee. He shall perform the usual duties and functions of the presiding officer of an organization and may, at his discretion, call meetings of the Association or any of its Committees.

(b) The President or in his absence, the Vice-President or his designate,

shall exercise, in addition to his own powers, all duties and powers of the Executive Committee when it is impossible, in cases of emergency, for him to obtain a vote of the Executive Committee.

(c) The President or in his absence, the Vice-President or his designate, shall

have the power to suspend summarily any member, player or coach, any manager or officer of member teams, any referee or linesman or any officer of member Associations in the following circumstances:

for abusive or threatening language to any official;

for circumventing, ignoring or avoiding compliance with provisions of the Constitution of Hockey NL or the decisions of its committees;

for falsifying proof of age; for falsifying player registration; for having been a party to removing a team from the ice; for any infraction of the Regulations or playing rules which call

for a report to the President; for any other conduct in connection with a hockey related

function or activity, may be disciplined and sanctioned for conduct unbecoming of the reputation of Hockey NL, or the game generally;

for failing to comply with the Rules, Regulations or Guidelines of a Provincial, inter-Provincial or national tournament representing Hockey NL.

(d) Copies of notices of suspensions, together with copies of pertinent correspondence or game reports shall be circulated to members of the Appeals Committee to permit study prior to the consideration of appeals. (e) The President or in his absence, the Vice-President or his designate, shall

be the official representative of Hockey NL at the annual meeting of HC.

(f) The President or in his absence, the Vice-President or his designate, shall receive an advanced expense allowance annually as determined by the Executive Committee.

(g) Upon each President of the Branch completing his tenure of Office it will be the privilege of this Association to confer upon him, in recognition of his service, a ring, duly made by die for this Association only.

303. Vice-President

The Vice-President shall be a member of the Executive Committee and as such shall participate in the overall administration of the Association. In the absence of the President shall have all the powers and duties of the President. The Vice-President shall also:

(i) act as a Chair of the Audit & Finance Committee;

(ii) be responsible for Risk & Safety Management Programs of Hockey NL;

(iii) review all hockey council and committee budgets before presentation to the Board of Directors;

(iv) make recommendations to the Board of Directors and/or Registration Committee concerning fee structure;

(v) in consultation with the Board of Directors carry out the duties

as the President may, from time to time, delegate.

304. Chairs The Chairs elected by the Senior, Junior, and Minor Hockey Councils shall be

responsible for the administration of their division. Each Chair shall also be a member of the Executive Committee and as such shall participate in the overall administration of the Association.

305. Female Chair The Female Chair shall be responsible for the administration of the Female program. The Female Chair shall also be a member of the Executive Committee and as such shall participate in the overall administration of the Association.

306. Referee-in-Chief The Referee-in-Chief shall be responsible for the administration of the Officials

program. The Referee-in-Chief shall also be a member of the Executive Committee and as such shall participate in the overall administration of the Association.

307. Hockey Development Chair The Hockey Development Chair shall be responsible for the administration of the Hockey Development program. The Hockey Development Chair shall also be a member of the Executive Committee and as such shall participate in the overall administration of the Association.

308. Immediate Past President The Immediate Past President shall be a member of the Executive Committee

and as such shall participate in the overall administration of the Association.

BY-LAW FOUR

DUTIES AND POWERS OF THE EXECUTIVE COMMITTEE 400. The Executive Committee shall have, in addition to the powers allotted elsewhere in the Constitution, the following powers specifically.

(a) To approve or refuse applications for membership in this Association in any category or division or affiliation and/or program under the jurisdiction of an Association.

(b) To impose and enforce penalties for any violation of this Constitution, or

of decisions of the Executive Committee or of the Senior, Junior or Minor Hockey Councils, by a majority vote, taken if necessary by mail, e-mail, fax or telephone.

(c) To appoint sub-committees from among its members or from the public

generally, for the handling of any special or specified business. (d) To supervise the collection of dues and funds of this Association and the expenditure of revenues. (e) To establish the rules and regulations of hockey.

(f) To establish and implement the provisions of the Policy Manual.

(g) To set direction for the association and to establish and monitor a

strategic plan. To supervise and monitor performance, accountability

and compliance.

BY-LAW FIVE

DUTIES AND POWERS OF THE EXECUTIVE DIRECTOR 500. (a) The Executive Director is a full time employee of the Association engaged

by the Executive Committee to direct the day-to-day operation of the Branch office with authority as delegated by the President and the Executive Committee.

(b) The Executive Director will carry out administrative, secretarial and clerical

duties as required, including the direction of any additional staff members, which may be employed when necessary.

(c) The Executive Director shall not be an officer of the Association and shall not have a vote at any meeting.

(d) The Executive Director shall be responsible for keeping minutes of all

meetings of the Association and the Executive Committee and conducting Branch correspondence as required.

(e) The Executive Director shall be responsible for accepting applications for membership, for having them processed, and for keeping various records.

(f) The Executive Director shall see that player certificates are issued in accordance with the registration procedures of Hockey NL and HC and that the necessary records pertinent to registration of all players, coaches and managers are kept. (g) The Executive Director will be the person responsible for the interpretation of Hockey NL or HC Regulations. Any challenge to any interpretation given by the Executive Director may be done only in accordance with the Hockey NL appeals procedure.

(h) The Executive Director shall be responsible for keeping accurate financial records of the Association, and producing reports on the financial position within one week when requested by the President, and for preparing

a year end financial statement, as of May 31st, annually.

(i) The Executive Director shall serve on the Audit and Finance Committee

as specified in By-Law 609.

COMMITTEES AND COUNCILS 600. The standing Committees and Councils of Hockey NL shall be:

601. Executive Committee

(a) The Executive Committee shall consist of the President of the Association, the Vice-President, the Chair for Senior Hockey, the Chair for Junior Hockey, the Chair for Minor Hockey, the Chair for Female Hockey,

the Chair for Hockey Development, the Referee-in-Chief, and the Immediate Past President. (b) The Executive Committee and the members of the various Council

Executive Committees shall comprise the Board of Directors of Hockey NL.

602. Senior Council

(a) The Senior Council Executive Committee shall consist of the Chair for

Senior Hockey, a Vice-Chair, a Secretary, and four Directors. (b) The Senior Council shall conduct the affairs of Senior and Recreational Hockey as set out in the Regulations.

(c) In the absence of the Senior Council Chair, the Vice-Chair for Senior Hockey will act as Chair until the Hockey NL annual general meeting, at which time the election of Chair will take place.

603. Junior Council

(a) The Junior Council Executive Committee shall consist of the Chair for Junior Hockey, a Vice-Chair, the Secretary and four Directors. (b) The Junior Council shall conduct the affairs of Junior Hockey as set out in the Regulations.

(c) In the absence of the Junior Council Chair, the Vice-Chair will act as Chair until the Hockey NL annual general meeting, at which time the election of Chair will take place.

604. Minor Council

(a) The Minor Council Executive Committee shall consist of the Chair for Minor Hockey, a Vice-Chair, five Directors and a Secretary (elected and non-voting).

(b) The Minor Council shall conduct the affairs of Minor Hockey as set out in the Regulations.

(c) In the absence of the Minor Hockey Chair, the Vice-Chair will act as Chair

until the Hockey NL annual general meeting, at which time the election of Chair will take place.

605. Female Committee

(a) The Female Committee shall consist of an Executive Committee and the Female representatives of our Minor Hockey Associations.

(b) The Executive Committee shall consist of a Chair and Zone Co-ordinators

for Avalon, Central, Western and Northern and a Secretary.

(c) The Female Committee shall conduct the affairs of Female hockey as set out in the Regulations.

(c) The Chair will automatically become an Officer of the Association and a

member of the Executive Committee of the Association. .

606. Development Committee

(a) A Development Committee will be appointed by the Executive Committee, to administer development programs within the Branch.

(b) Membership on the Development Committee will consist of Hockey

Development Chair, Technical Director, National Coach Certification

Program Coordinator, Initiation Program Coordinator, Grassroots

Coordinator, Referee-in-Chief, Female Committee representative

and Minor Council representative. (c) The Development Committee will be under the authority of the Branch

Executive Committee.

607. Officiating Committee (a) The Officiating Committee shall consist of a Chair who shall be the

Referee-in-Chief, a duly appointed officer of Hockey NL, the Hockey Development Chair, and the Supervisor of Officials. Zone Co-ordinators and the Development Co-ordinator for Female officials shall also be appointed to this Committee as required by the Referee-in-Chief.

(b) The Officiating Committee shall conduct the affairs of the Officiating

Division as set out in Regulation Thirteen. (c) In the absence of the Referee-in-Chief, the Supervisor of Officials will act

as Referee-in-Chief until the Hockey NL annual meeting, at which time the election of Referee-in-Chief will take place.

608. Nominating Committee (a) The Nominating Committee shall consist of the Past President, with one

representative from each of the Minor, Junior and Senior Councils. (b) The Nominating Committee shall be responsible for nominations for the

various positions of office within the Association.

(c) In the absence of the Past President, or if for some reason the Past President declines this position, the Chair of the Nominating Committee shall be appointed by the President.

609. Finance Committee

(a) The Audit and Finance Committee is responsible for the oversight

related to Hockey NL’s auditing and reporting, financial policies and

strategies, and financial risk management.

(b) The Audit and Finance Committee shall consist of a chair who shall

be the Vice President, the Executive Director and two other members

to be appointed by the Executive Committee.

610. Appeals Committee

(a) The Appeals Committee shall consist of a Chair and two other members to be appointed by the President and approved by the Executive Committee. The appointments will be for one year and may be extended at each annual meeting. (b) The Appeals Committee will deal with appeals against the imposition and severity of suspensions or other penalties and will also be empowered to rule on the eligibility of players where a Branch ruling on residence or import status is contested. The committee shall not be allowed to reduce a suspension to less than the minimum suspension as set out in the Association’s automatic minimum suspensions.

(c) All appeals must be made in writing to the Chair of the Appeals Committee and must be accompanied by a fee of $200 and by copies of the applicable information on the incident and any previous rulings or decisions must also be forwarded to the Chair of the Appeals Committee. All decisions of the Appeals Committee will be sent in writing to all parties concerned.

(d) The decision of the Appeals Committee is the final step in the Branch appeals procedure and any further appeal where applicable, must be made to HC within seven (7) days.

611. Registration Committee The Registration Committee shall be the Executive Committee of the

Association.

612. Rules Committee

(a) The Rules Committee shall consist of the Executive Committee of the Association.

(b) The Rules Committee shall be responsible for the submission of all

Hockey NL rule changes put forth on behalf of the Branch to HC.

613. Hall of Fame Committee

(a) Nominations to the Hockey NL Hockey Hall of Fame shall be administered by a Nominating Committee. The Nominating Committee shall be appointed by the Executive Committee of Hockey NL and chaired by the President. This committee will consist of a maximum of five members and a minimum of three, with two at large. The Committee will be comprised of a representative from each region of the Branch with at least one media person, if available.

(b) Selections to the Hockey NL Hockey Hall of Fame shall be administered by a Selections Committee. The Selection Committee, consisting of five members, shall be appointed by the Executive Committee of Hockey NL and chaired by the Past President. The other four members on the Committee will be selected from each of the four areas in the Branch.

(c) The affairs of the Hockey NL Hall of Fame shall be administered to by a Board of Directors consisting of ten members appointed by the Executive Committee of Hockey NL.

614. The Championship & Trophy Committee The Championship and Trophy Committee shall be the Chair for Senior Hockey, the Chair for Junior Hockey and the Chair for Minor Hockey.

615. Constitution Committee (a) The Constitution Committee shall consist of a maximum of four members.

The Chair shall be appointed by the President and approved by the Executive Committee. The other members of the committee shall be appointed by the Executive Committee. The appointments will be for one year and may be extended at each annual meeting. (b) It shall be the duty of the Constitution Committee to: (i) make recommendation changes to the Constitution and policies of

Hockey NL;

(ii) review for conflict and verify all Hockey NL notice of motions within ten days after the notice of motion submission deadline.

616. Awards Committee

(a) The Awards Committee shall consist of a maximum of five members. The

Chair shall be appointed by the President and approved by the Executive Committee. The other members of the committee shall be appointed by the Executive Committee with one member from each division. The appointments will be for one year and may be extended at each annual meeting.

(b) It shall be the duty of the Awards Committee to:

(i) encourage nominations from Hockey NL members for submission to Sport Newfoundland and Labrador Annual Awards Program;

(ii) review submitted nominations for the purpose of selecting at least one nomination for submission for each of the Sport Newfoundland and Labrador Annual Awards Program;

(iii) encourage members to recognize deserving individuals, teams and Associations from within their Division for their achievements in hockey by nominating them for an Annual Award available through Hockey NL.

BY-LAW SEVEN

EXPENSES

700. The reasonable expenses will be paid by the association as per Hockey

NL Policy Manual Section 2.03

BY-LAW EIGHT

VOTING 800. (a) At any general meeting of the Association at the election of the President, Vice-President, Female Hockey Chair, Hockey Development Chair, Referee-in-Chief and each member of the Board of Directors shall have one vote. The Board consists of members of the Executive Committee, and members of the Senior, Junior and Minor Hockey Councils to a maximum of six votes for each Council.

(b) At all plenary sessions those entitled to vote at the various Council meetings held by the different divisions of hockey shall be entitled to debate and discuss the various subjects which shall arise. However, motions can be made or seconded and the questions can be voted on

only by those described as eligible to vote in By-Law 301(d) and By-Law 800 (a).

(c) At all Executive Committee meetings, each Officer of this Association,

except as elsewhere provided, shall be entitled to one (1) vote. (d) Following voting in accordance with clause (c) above, in the event of a tie,

the President shall cast the deciding vote.

(e) At the Resolutions Meeting during the annual meeting, the Board of Directors will review all resolutions or amendments to the Constitution. Any Article, By-Law or Regulation pertaining specifically to a particular division of hockey shall be given to that Council’s Chair for discussion and ultimate decision by the respective Councils, providing that such changes are not in conflict or interfere with any other division of hockey within the branch as determined by the Board of Directors. Then at the Plenary Session of the annual meeting, the divisional Chair, in giving his report, will present the resolution or amendment to the Board of Directors along with the decision of the Council for Board adoption. Such adoption will be officially recorded in the minutes of the Plenary Session of the annual meeting.

801. (a) At all meetings of the Senior Hockey division each league in good standing for the preceding hockey season shall have one vote and each team in good standing for the preceding hockey season shall have one vote. The voting delegates must be members in good standing with their team or league. The Council Chair and each Council Executive member shall also be entitled to one vote.

(b) At all meetings of the Junior Hockey division each league in good

standing for the preceding hockey season shall have two votes and each team in good standing for the preceding hockey season shall have one vote. The voting delegates must be members in good standing with their

team or league. The Council Chair and each Council Executive member shall also be entitled to one vote. (c) At all meetings of the Minor Hockey division each Association in good

standing for the preceding season shall be entitled to two voting delegates. The voting delegates must be members in good standing with their home Association. The Council Chair and each Council Executive member shall also be entitled to one vote.

(d) At all meetings of the Female Committee, each Association in good standing with their home Association for the preceding season shall be entitled to one (1) vote by their Female representative. To be eligible to vote at the Female Committee meetings, delegates must be registered with Hockey NL as a female voting delegate by their home Association.

Members of the Executive Committee are entitled to one (1) vote only. If the members of the Executive Committee are the female representative for their respective Association, they are not entitled to more than one (1) vote.

(e) There shall be no proxy votes and a delegate may represent one member only.

802. (a) In the event that three or more persons are nominated for any elective position within Hockey NL, the successful candidate shall be required to

poll more than half the eligible votes counted.

(b) If no candidate has the eligible number of votes, the candidate with the least number of votes is dropped. In the case of a tie in the candidates with the least number of votes, there will be a random draw to determine the candidate removed from the next ballot.

(c) When there are only two (2) remaining candidates and there is a tie, a

second vote will take place. If a tie remains after the second vote, the selection will be by random draw.

(d) All candidates officially nominated or wish to be nominated for a position

on the Board of Directors must attend the Hockey NL annual general meeting where elections will take place. A candidate unable to attend the annual general meeting due to hospitalisation or death in the immediate family, the Executive Committee will make an exception and allow a letter of interest to have their name placed on the ballot.

BY-LAW NINE CONFLICT OF INTEREST 900. The Hockey NL Board of Directors shall avoid any conflict of interest in the performance of their duties as a member of Hockey NL. 901 A ‘conflict of interest’ is any situation whereby: i. an individual’s personal monetary interests; ii. the monetary interests of an immediate family member, business

associate, corporate or partnership in which an individual holds an interest;

iii. a person to whom an individual owes a monetary obligation; or

iv. the suspension or discipline of an immediate family member is an issue;

could influence the individual’s decision making and impair his or her ability to

act in Hockey NL’s best interests, or represent Hockey NL fairly, impartially and without bias.

For the purpose of ii and iv above, immediate family members include parent,

spouse, child or sibling. 902. A Hockey NL Board of Director recognizing a conflict of interest in any matter with Hockey NL or applicable Hockey Council, shall declare a Conflict of Interest and identify the same, and immediately withdraw from the meeting without participating in the consideration of the matter at hand. 903. (a) Any challenge of a Hockey NL Board of Director as having a conflict of interest, shall immediately be given the opportunity to identify and make representations regarding the challenge to the Hockey NL Board of Directors. The person being challenged shall leave the meeting after having made his/her submission. (b) A vote shall be taken by the Officers of the respective Council, Board, or Officers of Hockey NL meeting in which the challenge is made. A majority vote shall render a decision on whether a conflict of interest exists. In the event of a tie, the challenge shall be defeated.

(b) No appeal will be entertained from a vote taken in determination of a conflict of interest challenge.

904. A member of the Hockey NL Board of Directors may be associated with a team or league in the division in which he is serving on a Provincial Council. As an Officer of Hockey NL this member may not act as the delegate to the Hockey NL annual or semi-annual meetings. At Council Meetings of Hockey NL this member would not be permitted to vote on issues that would directly affect his particular team or league unless given permission by the Executive Committee of that particular Council.

BY-LAW TEN MEETINGS 1000. The annual meeting shall be held as near as possible to the second Saturday of June each year. Invitations from groups wishing to host the meeting will be accepted at each annual meeting in order to give the host a full year to complete arrangements.

1001. A pre season general meeting, known as the fall meeting, shall be held as near

as possible to the third Saturday in September at a site to be determined at the annual meeting. 1002. Meetings of the Association may be called by the President at any time or upon a written request from any ten of the voting members as described in By-Law 800 (a). 1003. Meetings of the Councils are called by the Council Chairmen with the approval of the President. 1004. Notices of the annual and fall meetings shall be circulated from the Branch office thirty (30) days prior to the date of the meeting. 1005. A prepared agenda should be circulated for all meetings of the Association or the Councils and applicable items should be dealt with according to the following order of business:

Any written communication to be circulated at any meeting must be submitted to the Chair at least two weeks prior to the meeting. 1006. (a) A quorum for any Council Executive meeting will require a majority of the members of the Council Executive Committee with the Chair or his or her designate attending. (b) A quorum for any general meeting will require attendance of a majority of the Board of Directors as described in By-Law 800(a). 1007. (a) Each registered team of the Senior and Junior Leagues shall be required

to have one (1) voting delegate in attendance at the Annual General Meeting and Fall Meeting. Failure to do so shall be subject to a sanction to be determined by the respective Council.

(b) Each Minor Hockey Association shall be required to have at least one (1) voting delegate in attendance at the Annual General Meeting and Fall Meeting. Any Association not represented without just cause will be charged a penalty of $5.00 for each registered player for the first time

absent and double this amount for the second time absent. If an Association does not pay their fine, then they will not be permitted to participate in the Provincial Tournaments.

BY-LAW ELEVEN

BROADCASTING AND TELEVISION

1100. Fees In all Hockey NL games, including all Branch league games and Provincial playoffs in all categories of hockey, Hockey NL reserves all radio and television rights, motion picture rights, internet rights, digital rights, website rights and still photography rights in Newfoundland and Labrador. Only Hockey NL shall have the authority to assign rights. For the purpose of these regulations, television rights shall include live or delayed telecasts and closed circuit television in whole or in part. 1101. All business pertaining to the above shall be conducted under the authority of the Officers of Hockey NL. 1102. In all HC games, including all inter-branch playoffs leading to National Championships, and International matches, HC reserves all radio and television rights and such rights for HC playoffs will be awarded by HC. 1103. Radio and television revenue from games played will remain with Hockey NL who will decide how these revenues will be spent after negotiation with the divisions involved.

BY-LAW TWELVE

AMENDMENTS

1200. These By-Laws shall be amended only by a two-thirds majority of the Board of Directors present and voting at the annual meeting. 1201. (a) No amendments or additions to these By-Laws shall be considered unless

it has been submitted in writing to the Executive Director by a member of the Board of Directors at least 30 days prior to the date of the Hockey NL annual meeting. (b) It shall be the duty of the Executive Director to submit all such proposed amendments to each member of the Board of Directors at least two weeks before the date of the meeting at which they are to be considered.

REGULATIONS


SECTION THREE – REGULATIONS

REGULATION ONE

REGISTRATION

100. (a) Registration of players shall be governed by the registration regulations of Hockey NL and HC and every player must be registered before he takes part in any game. (b) No player will be registered or insured until the registration is validated by

the designated Branch official. 101. (a) Each team, in order to be officially recognized must have at least fifteen

players registered, at least two of whom must be goaltenders. (b) In Minor and Female Hockey only, a team which does not participate in

either a Regional or a National Championship Competition must have a minimum of twelve registered players, at least one of whom must be a goaltender. In Associations where players are available, teams must have a minimum of seventeen players, two of whom must be goaltenders.

(c) A recognized league is one which has at least three teams, with each

team playing a minimum of twenty-four games (12 home and 12 away). 102. Player registrations will be completed and forwarded to the designated branch

official for approval following which the registration will be promptly returned to the team.

103. In all cases for Junior and Minor players, where the player was not previously

registered, a Birth Certificate or other acceptable proof of age, must accompany the player certificate.

104. To assist in player identification all registrations will show the birth date of the

player and the player's M.C.P. number, where available. 105. Each team will retain title to all players who were registered with the team in the

previous season and appeared on the team’s protected list, unless such players have been released or are otherwise not eligible to play for their last season's team.

106. (a) Minor and Female teams are limited to 19 registered players at any one

time including two goaltenders.

REGULATIONS


(b) Junior teams are limited to 25 registered players at any one time up to December 1st, when they must reduce the number of registered players and unused registrations to 25.

(c) On January 10th all Junior teams must reduce their number of registered

players to 23, at least two (2) must be goaltenders. In addition, each team will be permitted two (2) alternates who would be eligible to play within the

Province only. All Senior teams below AAA must reduce their

number of registered players to 28, including at least two goaltenders, and one alternate goaltender who would be eligible to play within the Province only.

(d) On January 10th all teams must forward their protected list of registered players in writing to the Hockey NL Office. No player on this protected list may be dropped to make room for another, and where a team has listed fewer than its maximum, any player registered after January 10th and before February 10th will be added to their protected list up to the maximum allowed.

107. All players not included on the official team list of January 10th, including any players from the previous year's registration, are considered to be released, and they become free to register with any other team if they are otherwise eligible and if the team wishing to register them has not already listed the maximum number of players allowed and has unused registrations. 108. Players not listed on January 10th may re-register with their former team if the team still has unused registrations. 109. A player may not be released after January 10th to make room for registering another player, and a player released after January 10th may not register with another team for that season. 110. Although the deadline for final registration of players is February 10th, a player is not eligible to play any game until he is registered and a team which does not submit its list of at least fifteen registered players on January 10th shall be ineligible for further competition. 111. Any player proven guilty by Hockey NL of falsifying a birth certificate, or of having had the knowledge that the same had been falsified, or of playing on other than his own birth certificate, shall be suspended from playing hockey with any team affiliated with HC for a period of not less than one year and not more than three years from the date of suspension. 112. Any officer, executive member of a team, club, union or Association, proven guilty by Hockey NL of having been party to, or having had such knowledge of such falsification, referred to in Regulation 111, shall be suspended for a period

of not less than three years from playing or holding office with any team, club, union or Association affiliated with HC. 113. (a) Every team and club of Hockey NL shall be responsible for the representation made to the Association regarding the eligibility of players. (b) In the event that a team used an ineligible player in a game and this had been brought to the attention of the League or Hockey NL and the ineligibility of the player has been confirmed, the offending team will automatically forfeit the game or games in which the ineligible player participated and any points involved will be awarded to the non offending team. If both teams are at fault in the game, no points will be awarded to either team. (c) The ineligible player or players will be dropped immediately and further disciplinary action to the offending team(s) will be decided within five days from the date the player(s) is determined to be ineligible. (d) A request for a ruling on the eligibility of a player is not considered to be a "protest." 114. Any player refused a release by a team with which he is registered, may appeal to the Registration Committee of Hockey NL to be granted such release. When a ruling in this case is not accepted, the next step is to submit an appeal directly to the Appeals Committee as described in By-Law 610. 115. In addition to the players, each coach, assistant coach, manager, and trainer of any registered team, before being permitted to coach, manage or train a team, shall also require a registration validated by the designated branch official. 116. Every player, coach, assistant coach, manager and trainer by acceptance of registration in HC and the issuance of a certificate as aforesaid, acknowledges the authority of HC and Hockey NL and undertakes to abide by the rules and regulations of HC and Hockey NL.

117. Replacement Goaltender: The signing officers of a team may submit a

written letter of request to the respective League Executive member or

divisional chair for consideration. Such a request must include:

(a) The circumstances that led to the need for relief.

(b) The name of the replacement Goaltender they propose to use

(c) Written permission from said Goaltenders registered team

If permission is granted for the Replacement Goaltender, it shall include an

understanding that the Replacement Goaltender will act under such terms

and conditions as determined by the respective League Executive member;

unless the starting Goaltender becomes injured. This permission will have

a timed duration. In situations where there is less than twenty four (24)

hours between games and the respective League Executive member or

Chair of each Council cannot be contacted, then the respective Hockey NL

representative would provide the required permission to the team. This

permission would only be granted provided that all the required conditions

as listed above are met. The respective League Executive representative

would still be notified, but in this case notification would be after the fact.

The respective League Executive representative will provide all

documentation to the League President following approval being granted.

REGULATION TWO

RESIDENCE RULE 200. (a) In Minor and Female Hockey, except as hereinafter provided, no player shall be registered as a member of, or compete for, a team if his parents have not been a bona fide resident of the city, town, or rural area or zone which has been established by the Branch, to which his team belongs.

(b) Notwithstanding Regulation 200(a), a player may be permitted to register as a member of, or compete for, a team from outside his parent’s place of residence. In order to do so the following rules apply: (i) the player must first register with their home Association in which they reside; (ii) a written request must be provided to the home Association requesting to compete in the other Association. Should both Associations agree, a letter confirming the same must be obtained; (iii) both letters must be forwarded to the respective Minor Council Director or Female Zone Coordinator in Female, who will make recommendation to the respective Chair, who will determine whether a circumstance exists to authorize the request under such terms and/or conditions that may be provided.

201. Notwithstanding any other regulation, a player who is a student or school teacher who is absent from home and registered and in actual and regular attendance at a preparatory school, university or affiliated college or trade school may, at his discretion, play for a team where such preparatory school, university or college or trade school is situated or for the town or city in which he is ordinarily resident.

202. (a) A player must compete with the team nearest his place of residence, which is entered in a division for which he is qualified to play. Distance to be by highway and not as the crow flies. (b) When more than 19 players have been registered in a division of hockey within a Minor Hockey Association, and there are not enough players to form two teams, the player(s) not able to formulate a team may, with approval of their respective Director or Co-ordinator, move to the nearest Association able to provide hockey for them in that Division without having to remove or drop their own member players. 203. There shall be no residential qualifications for players registered with Junior or Senior teams except insofar as the import rule governs leagues. 204. In Minor or Female Hockey proof of residency will require, but not limited to, the following documentation: (i) a valid driver’s license;

(ii) copies of two current utility bills; and (iii) an affidavit from the parent(s) or court appointed guardian(s).

REGULATION THREE

DISCIPLINE 300. All team managers, coaches and trainers shall be subject to the discipline, supervision and control of the Hockey NL Executive and must be registered on HC registration certificates or on approved team registration forms. 301. Any club officer, or member, or team official who allows a player to take part in any game without an approved registration certificate or entry on an approved team registration form, shall be suspended for a period up to one year. 302. Any club officer, or member, team official, or team member, or player found guilty of allowing false information to appear on a registration certificate or registration form, or who knowingly makes false representation to the Association shall be suspended for a period to be determined by the President of Hockey NL. Further, the offending team shall forfeit to the non-offending team all previously played games in which the name of the offending official or player appears on the game report. The points for all such games will be awarded to the non-offending team. 303. Any player or team official who, under HC playing rules of hockey, has been assessed a gross misconduct or match penalty or other penalty where the rule so indicates, shall be reported to the President of Hockey NL for disciplinary

action. All such infractions should be ruled on within 7 days after receipt of game report from the game official. 304. Leagues may establish rules providing specific penalties for certain infractions in addition to those provided in the HC rules. Any such specific rules must be placed on record with the Hockey NL office at the start of the season in order that they may be taken into consideration in the event of any appeal against a suspension. 305. Any suspension in any league at any level must be reported to the Hockey NL office. The Hockey NL office will circulate notice of such suspensions, either electronically or by mail, which must be honoured by all members of Hockey NL. 306. The President of Hockey NL is empowered under By-Law 302 (c) to impose suspensions under the circumstances therein described. 307. (a) A suspended player, club, or team official, must not play or take part in any scheduled league tournament or exhibition game until after the termination of the suspension. (b) Team officials are responsible to ensure that without further notice, players or team officials must serve the suspension as per the Minimum Suspensions. Any violation may result in disciplinary action to the coach. 308. Any player or team official incurring a "match penalty" or “gross misconduct” will not be permitted to take part in any further games until his case has been dealt with by the President of Hockey NL. A ruling is called for within 7 days after receipt of game report from the game official. 309. A coach suspended by Hockey NL will not be permitted to direct the team during a game for the duration of the suspension. A suspended manager, coach, playing coach, or trainer, must not be in, or about the dressing room, before or during any game, nor between periods of any game during his suspension, nor be situated in the arena in a position to direct his team. The penalty for violation of this rule shall be dealt with by the President of Hockey NL. A playing coach, suspended for any action loses his rights as a player and as a coach. 310. Further, in Senior A, Senior B or lower, Recreational and Junior hockey, any suspension must be served only in the league in which the suspension was issued. 311. Suspensions imposed in Minor Hockey must be served only in scheduled Minor league or tournament play. 312. Any parent of a HC or Hockey NL player, whose conduct in an arena is legitimately deemed to be disruptive and not conducive to the well being of the

game, may be banned from such arena(s) as determined by the jurisdiction / Branch/Association for a specified period of time.

313. Any member, as defined in Article 5, Sections (c) and (d) of the

Constitution, or any fan, attendee, or person present at a Hockey NL

sanctioned event, shall be subject to the Policy Manual of Hockey NL,

including the Code of Conduct. Any contravention is subject to discipline.

The Policy Manual forms part of Hockey NL’s governance and is in full

force and effect when adopted by the Officers.

REGULATION FOUR

PROTEST OF GAMES 401. Protests of games may be made only in regard to interpretation of the rules of competition, and not in regard to the judgement of a referee or other official. 402. (a) Verbal protest must be registered by the Captain of the aggrieved team to the referee at the first reasonable opportunity after the action or decision complained of, but in all cases must be made within five minutes after the cease of the period or overtime period in which such action or decision is made. The referees shall note such protest on the game report. Such verbal protests shall be ignored if not followed up as hereinafter described. (b) Any protest of a game regarding matters outside the game officials' jurisdiction (such as, but not limited to, scheduling and player eligibility) may be made without the verbal notice required in (a) above. 403. All protests and all evidence in support thereof, must be made in writing in duplicate and must be signed by two authorized representatives of the protesting team, league or Association and must be accompanied by the applicable protest fee. 404. (a) At Provincial Minor Tournaments any protest must be presented in writing to the Provincial Representative at the tournament at the conclusion of the game for which the protest is being made, and it must be accompanied with a $50 non-refundable protest fee, payable to Hockey NL Minor Council. No protest will be entertained on the outcome of any final championship game. (b) In Minor League competition, any protest must be presented in writing to the President of the League within 48 hours of the conclusion of the game for which the protest is being made. In all other Provincial minor hockey competition, any protest must be accompanied with a $50 non-refundable protest fee, payable to Hockey NL Minor Council.

(c) In Junior League competition any protest must be presented in writing to the President of the League within 48 hours of the conclusion of the game for which the protest is being made. (d) In Provincial Junior Competition any protest must be presented in writing to the respective Director of Hockey NL Junior Council, or the Hockey NL Chair for Junior Hockey, within 16 hours of the conclusion of the game for which the protest is being made, and must be accompanied with a $100 non-refundable protest fee, payable to Hockey NL. (e) In all Senior Hockey League competition, any protest must be presented in writing to the President of the League within 48 hours of the conclusion of the game for which the protest is being made. (f) In all Provincial Senior Hockey competitions any protest must be presented in writing to the respective Director of the Hockey NL Senior Council responsible for that division of Senior Hockey or to the Hockey NL Chair for Senior Hockey, within 16 hours of the conclusion of the game for which the protest is being made, and such protest must be accompanied with a $100.00 non-refundable protest fee, payable to Hockey NL. 405. Where necessary a decision on any protest must be given at least 6 hours prior to the next game in which the protesting team is to compete. 406. The decision on a protest will be made by the official named above to receive the protest, who will solicit advice or information from any source, which he feels, will be of assistance in rendering a decision. 407. The Chair of the division concerned and the President of Hockey NL shall be informed as soon as possible of any protests. 408. Where the protest has been ruled on by a League President or minor tournament representative, an appeal may be made to the Chair of the division concerned, and where the protest has been ruled on by the respective Director or the respective Hockey NL Chair, an appeal may be made to the Chair of the Appeals Committee of Hockey NL. Appeals to the Hockey NL Appeals Committee must be accompanied with a $200.00 appeal fee made payable to Hockey NL. $100.00 will be refundable if the appellant is successful in their appeal. 409. In all divisions of hockey, any such appeal must be made in writing within 48 hours of the original decision being given, and must be accompanied by a payment of $200.00. A decision on the appeal must be given within a further 48 hours. The decision of the Appeals Committee shall be final.

REGULATION FIVE

APPEALS PROCEDURE 500. Rights of Appeals (a) All rights of appeals available to the player or member must be exhausted

before an appeal may be filed with the Hockey NL Appeals Committee. (b) Matters that may be appealed are: (i) protests in accordance with Regulations 408 and 409; (ii) for a player’s release; (iii) a suspension/sanction imposed by a league, team, Association or the President, but no appeal will be permitted based on suspensions pursuant to the Minimum Suspensions; (iv) eligibility of players where the Branch ruling on residence or import status is contested; (v) any member from the Officiating Division who has been terminated or suspended from this Division in accordance with Regulation 1207(c); or (vi) any ruling that is contrary to the Constitution of Hockey NL, after having appealed to the Chair of the Division concerned.

501. Form and Timing of Appeal Submissions (a) For a player release an appeal may be filed at any time up to January 10th. (b) Any appeal made under 500(b) shall be filed using the following procedure: (i) When the decision has been given out by a local Minor

Hockey Association, or a Junior, or Senior League, the appeal must be accompanied with a $100.00 fee, payable to Hockey NL and must be made to the Chair of the Provincial Council responsible for the division of hockey concerned. The appeal shall be investigated and a final decision made by the respective Council Appeals Committee consisting of not less than two (2) Executive Members from the Council concerned.

(ii) When a ruling on an appeal under 501(b)(i) above is not accepted, the next step is to submit an appeal directly to the Hockey NL Appeals Committee.

(iii) When a suspension has been given by the President of Hockey NL any appeal must be submitted directly to the Appeals Committee as described in Regulation 501(b)(ii). (c) All appeals must be filed within 14 calendar days of receipt of notification. (d) All appeals to the Hockey NL Appeals Committee must be in written form, stipulating the grounds of appeal and any supporting documentation and rationale for the appeal, accompanied by a payment of $200.00. Cheques should be made payable to Hockey NL. $100.00 will be refunded if the appellant is successful in their appeal. (e) The appellant is not entitled to an oral hearing or the calling of witnesses unless deemed necessary and permitted to do so by the Appeals Committee. (f) Any individual who files an appeal remains suspended and is not eligible to participate in games until such time as the appeals process is completed.

502. Hearing and Disposition of Appeals (a) Appeal hearings shall be heard within 7 days from the date the appeal is

received by the Executive Director of Hockey NL.

(b) If it is not practicable to schedule an appeal hearing within 7 days, as set

forth in Regulation 502 (a), a hearing date may be set beyond the 7 day period and such does not constitute grounds for an appeal to HC.

(c) Should the Appeals Committee determine that the proposed appeal does not come within the requirements for an appeal hearing under Section 500 – Rights of Appeal, the appeal application fee, less a $50.00 administration fee, will be returned to the applicant. (d) All parties involved in the appeal shall be notified of the time, date, place and mode of the appeal determination. (e) The appellant or the respondent, may request to make oral submissions or representations to the Appeals Committee and the Appeals Committee shall determine if such submissions or representations are necessary, and if so, advise the parties of the time, date, place and mode of the hearing. The hearing may be held by acceptable electronic format.

REGULATIONS


(f) The Appeals Committee has the authority to (1) allow the appeal; (2) dismiss the appeal; or (3) decrease the length of the suspension or penalty that was imposed, except for Hockey NL minimum suspension guidelines. (g) The Appeals Committee shall be charged with submitting, in writing, its decision and the rationale, no later than 48 hours following the appeal determination, to Hockey NL Executive Director who shall, in turn, advise the parties involved of the decision.

503. Final Appeal The decision of the Appeals Committee shall be final and binding for all parties involved except for any rights of appeal that may be entertained by HC.

REGULATION SIX

TOURNAMENT REGULATIONS

600. (a) No Association, team or player registered with Hockey NL shall compete in any tournament unless the tournament has been granted sanctioned by Hockey NL. (b) No sanctioned tournament shall accept entries from any team that is not a registered member of Hockey NL or HC. (c) Associations shall give a minimum of two (2) weeks’ notice to Hockey NL prior to the event.

(d) Teams competing in tournaments shall request a copy of the approved sanction permit prior to tournament registration.

(e) All games in a sanctioned tournament shall be officiated by referees and linesmen registered with Hockey NL.

(f) Teams participating in tournaments shall provide the host centre with a letter of approval from their Association president.

(g) No team shall be permitted to play in any inter branch competition unless it has been given written permission by its members Association and Hockey NL.

(h) No team or player registered with Hockey NL shall compete in a tournament in another Branch unless the tournament has been granted a

sanction permit by the Branch in whose territory the tournament is to be conducted which is recognized by Hockey NL. (i) All Game Reports are to be sent to the respective Director after the conclusion of all exhibition tournaments/games by the home team. (j) Failure to comply with these regulations will result in disciplinary action by Hockey NL.

REGULATION SEVEN

CHAMPIONSHIP TROPHIES & ASSOCIATION AWARDS 700. Trophies recognized by the Association for Senior, Junior, Minor and Female Competitions are as listed in Section Four – Record of Recognized Trophies & Awards. 701. All trophies that are recognized for Senior and Junior Hockey will be on permanent display in the Hockey Hall of Fame in Corner Brook. Regular season keeper awards for senior hockey will be presented at the beginning of the championship series. Provincial championship keeper trophies will be presented at the conclusion of the championship series. Team replica trophies for senior hockey will be presented at the conclusion of the championship series and must be returned to the Hockey NL Branch Office within 30 days of the next season’s championship series. Championship plaques will be presented to the winning teams during Hockey NL’s annual meeting. 702. Prior to, during, or subsequent to any Hockey NL contest, no award presentation other than those recognized by Hockey NL will be made. 703. At the conclusion of any championship series, the trophy for which the series has been played shall be presented to the winning team. 704. (a) Nominations for awards recognized by a Council or Committee shall be submitted to the Chair, or his designate, of the respective Council or Committee. (b) Candidates nominated for awards but unsuccessful, will be automatically nominated for the same award the following year where applicable.

705. Gold Stick Award (a) Hockey NL established in 1977 a Gold Stick Award to individuals for services rendered to hockey.

(b) To be eligible for this award an individual must have served for a total of ten years as an Officer of Hockey NL or as Director of one of the Councils' Committees or be deemed by the Officers of Hockey NL to have made an outstanding contribution to Hockey NL meriting this special recognition. (c) A maximum of two awards annually may be made outside those qualifying by reason of ten years service.

REGULATION EIGHT

SENIOR HOCKEY OPERATION

800. Senior Organization

(a) Senior and Recreational Hockey will be operated by the Senior Council within the framework of the Constitution of Hockey NL and HC.

(b) The Senior Council may, at each fall meeting, decide on which leagues are accepted as members for Senior A, Senior B, and Recreational competition for this division. All teams shall meet all eligibility requirements and agree to comply with all required conditions for competition as established by this Council.

(c) Each Senior and Recreation team must pay an annual registration fee and must also pay such player registration fees as may be established by the Registration Committee (Registration Committee as defined in By-Law 611.) No players will be registered until such fees are paid.

(d) Senior A teams must be organized by November 30th and Senior B and

lower teams shall be organized into leagues for regular season play in areas and categories recognized, organized or established to the satisfaction of the Senior Council not later than December 1st of each year. This is in order to make it possible to have plans made for Provincial competition and to have the teams and players registered properly.

(e) Recreational teams shall be organized into leagues for regular season play in time to permit the Council to make plans for tournaments, which may be organized.

(f) The Senior Council Executive shall act as an advisory committee to the President of Hockey NL on matters pertaining to Senior and Recreational Hockey within the Branch. (g) The Senior Council shall settle all questions concerning Senior and Recreational Hockey, which are not specially covered in the Constitution. .

(h) The Senior Council may recommend to the Executive Committee the suspension or expulsion of any team, member, official or player refusing to obey or accept the rulings of the Council.

801. Senior and Recreational Team Registration

(a) Each Senior A, B, and lower teams shall be required to register at least fifteen players on HC registration cards in order to obtain recognition as a team. Two of these fifteen players must be designated as goaltenders.

(b) Each Recreational team shall be registered on Recreational registration forms provided by the Hockey NL office.

(c) All player and team registration fees must be paid at the time of registration. The registration fee includes payment for the premium for insurance coverage, which becomes effective on the date of registration at the Hockey NL office.

(d) A senior or recreational team may not use an affiliate minor player prior to

receiving written consent from the following:

(i) Parents or legal guardian; (ii) President of the player’s member Association; (iii) Minor Council Director.

802. Senior A Leagues Playing Schedule

(a) Teams in Senior A Leagues will play a regular season schedule of not less than ten home games and not less than ten away games for each team. A Provincial playoff schedule will be prepared at the fall meeting.

(b) Each Senior A League will complete their schedules and league playoffs in time to declare a winner to compete in a Provincial championship playoff. A copy of the league schedule must be furnished to the Hockey NL Chair of Senior Hockey and to the Hockey NL office at the beginning of each season.

(c) Any team withdrawn from competition during the playing season will not be permitted to re-enter competition during that season or during the season immediately following unless there is a majority agreement on reinstatement among the Senior A Leagues and the Senior Council Executive. (d) In all Provincial playoff games, including tournament format games, a winner must be declared. If at the end of the series a tie exists between two or more teams, the HC tie-breaking procedure will be applied. These playoff games will be played according to the official playing rules of HC. If

at all possible, the Provincial playoff series will be the best four out of seven series. (e) Any team failing to appear and participate in any game of any series or deliberately delaying the start of any game may be suspended if found to be at fault by the Senior Council Chair. (f) The complete schedule for each playoff series will be finalized two weeks before the start of the series, in consultation between the participating teams and the Chair - Senior. No change will be made in this schedule after the series starts except in the case of an emergency recognized as such by the President of Hockey NL.

(g) All leagues and/or teams shall be responsible for compiling a complete and accurate record of statistics for regular season play and for having these statistics forwarded to the Hockey NL Chair, Senior Council, within 15 days after regular season play.

803. Financial Arrangements - Senior A

(a) For all Provincial Senior A playoff games (Herder), 11.5% of the certified net will be paid by the rink management to Hockey NL to be used toward the cost of administration of the Branch. Payment must be made to Hockey NL within fourteen days after each game.

(b) Payments to referees, linesmen and goal judges for officiating in Provincial Senior A playoff games will be made from the Hockey NL office after receipt of the game reports for the games in which the officials

worked. No payments will be made where no game report is received. (c) In any Provincial Senior A playoff series the host team will not be liable or responsible in any manner for any financial arrangements or obligations incurred by the visiting team. All arrangements pertaining to travel, board and lodging, etc., for a visiting team will rest entirely with the officials of that team.

(d) Venues being utilized for Provincial play shall sign a financial agreement

form as supplied by the Hockey NL Office and shall submit this signed form to the Hockey NL Office at least 15 days prior to commencement of Provincial play. Any venue failing to do so may not be considered for Provincial play.

804. Senior B and Lower Competition

(a) Regional Senior B and lower leagues may be organized and operated from teams, which are properly organized and registered members of the Senior division.

(b) The Senior Council Executive shall organize Provincial competition

between representative teams from the various organized Senior B and lower leagues, leading to Provincial Championship playoff in each category.

(c) The Senior Council Executive shall encourage the organization of leagues with the intent of having representative teams becoming eligible to participate in competition leading to Provincial Championship play.

(d) The Senior Council shall, in consultation with the participating teams, arrange such playoff series between league representatives as may be necessary to declare Provincial Champions in each category.

(e) The Senior Council may grade teams annually before registration is finalized, with respect to all participating teams, and they shall make every effort to establish competition in each category.

(f) In any total goal two-game series, no overtime shall be played until 120 minutes of hockey has been played. Any overtime necessary in any series will be played under the HC playing rules.

(g) Each Senior or Recreational Regional League shall furnish the Senior Council Secretary and Hockey NL with a copy of the schedule for their local league. All schedules are to terminate in sufficient time to allow competition in Provincial playoff competition. This date will be established by the Senior Council. (h) A copy of every game report from every official scheduled and playoff game in every Senior and Recreational League must be forwarded immediately after each game to the Hockey NL office.

REGULATIONS


805. Recreational Hockey

(a) Recreational teams will be organized into leagues for regular play and

when registered will have insurance coverage and will have access to referees.

(b) Recreational leagues may have league rules placing local restrictions on

players if such restrictions are not prohibited by HC or Hockey NL rules.

(c) In organizing tournaments between teams from various leagues, the organizers should determine that participating teams come to a mutual agreement about the application of any of these local restrictions.

(d) The Senior Council Directors will be available to assist where required in

the operation of a league or the organizing of a tournament.

806. Expenses - Senior B and Recreational Hockey

(a) All travelling expenses of teams participating in Provincial competition or in a tournament shall be the responsibility of the team concerned, except as approved by the Finance Committee of Hockey NL.

(b) For all Provincial Senior B, C, or lower, or Recreational tournament games, including quarter, semi or finals, 5% of the gross gate will be paid by the rink management to Hockey NL to be used toward the cost of administration of the Branch. Expenses for on-ice and off-ice Officials at these events are the responsibility of the "home" team.

807. Replacement Goaltender (a) A replacement may be permitted for a goaltender who is ill or injured, under the condition that the team either does not have an affiliated goaltender named or if the named affiliated goaltenders are unavailable. The replacement goaltender can only play if the other dressed goaltender becomes ill or injured during a game. Permission for the replacement goaltender must be granted by the Vice-President of Senior or his designate and upon further conditions and terms as may be provided. The goaltender must come from the area where the team is registered and must be registered and join the team within ten (10) days of the date of the last game in which the injured or medically unfit goaltender played, or prior to the next scheduled game of his team if his team is not scheduled to play within the ten (10) day period indicated above. The replacement goaltender cannot be replaced by another replacement goaltender unless the former is injured or medically unfit. (b) The ill or injured goaltender shall return to competition as soon as medical

evidence indicates that it is in order for him to do so.

(c) A team may use as a replacement a goaltender from a team of the same or lower division or category provided that permission is obtained from the Senior Chair, or his designate, and the goaltender’s team. A replacement from a team of a lower division or category shall be permitted to return to his original team regardless of the number of games played, provided that permission was originally obtained. In all instances, where possible, permissions for replacement goaltenders must be in written form.

(d) A team, before entering Provincial competition, shall be permitted to

select from among the goaltenders within its league, one additional standby goaltender. Once named, the stand by goaltender shall be eligible to dress only when the provision of Regulation 807(a) has been applied.

808. Imports

(a) Senior teams will be permitted to register imports only to the extent that the total number of such active imports does not exceed, at any one time during the current season, the numbers as prescribed by the Branch. This will be determined annually by the Executive Committee upon recommendation from the Senior Council Executive Committee by no later than fourteen (14) days after the Annual General Meeting. (b) For the purpose of in-Province play only, the definition of an import is the status assigned to a player who has obtained a transfer from another Hockey Canada Branch or from a Foreign Ice Hockey Federation to the Branch but excludes any player who was previously registered with a minor hockey team in the Branch for a minimum of five (5) seasons. (c) Such players shall retain their import status when registering with the

Branch for subsequent seasons unless the status is changed as per the respective league By-Laws concerning residence.

(d) Notwithstanding regulation 808 (a) to (c) inclusive, a player shall not be considered an import when he moves to the branch for reasons other than playing hockey (i.e. professional move). This status assignment shall be supported with compelling evidence.

809. Senior and Recreational Council Rules (a) The Senior Council may formulate additional rules for the operation of Senior and Recreational Hockey, provided that such rules are not in conflict with any provision of the Constitution of Hockey NL or HC and providing they do not permit any activity in conflict with any activity or custom of another part of Hockey NL.

(b) All such rules shall be recorded as such with the Executive Director.

REGULATION NINE

JUNIOR HOCKEY OPERATION

900. Junior Organization

(a) Junior Hockey will be operated by the Junior Council within the framework of the Constitution of Hockey NL and HC.

(b) The Junior Council may, at each fall meeting, decide on which teams are

to be accepted as members for Junior competition. All teams must meet all eligibility requirements and agree to comply with all required conditions for competition as established by the Junior Council.

(c) Junior teams shall be organized into leagues for regular season play in

areas recognized, organized or established to the satisfaction of the Junior Council not later than December 1st of each year. This is in

order to make it possible to have plans made for Provincial competition and to have the teams and players registered properly.

(d) Each Junior league and team must pay an annual registration fee and

must also pay such player registration fees as may be established by the Registration Committee (Registration Committee as defined in By-Law 611.) No players will be registered until such fees are paid.

(e) The Junior Council Executive shall act as advisory committee to the

President of Hockey NL on matters pertaining to Junior Hockey within the Branch.

(f) The Junior Council will settle all questions concerning Junior Hockey

which are not specifically covered in the Constitution.

(g) The Junior Council may recommend to the Executive Committee the suspension or expulsion of any team, member, official or player refusing to obey or accept the ruling of the Council.

901. Junior Team Registration

(a) Each Junior team is required to register not less than fifteen players, at least two of whom must be goaltenders, in order to obtain official recognition as a team.

(b) Protected lists for all teams will be submitted to the Hockey NL Office in writing by January 10th, as provided in Regulation 1.

(c) No All-Star Team made up of players registered for different teams will be

recognized.

REGULATIONS


902. Junior Competition

(a) Any Junior league must have an appointed or elected Executive Committee and be organized to play a regular schedule of not less than twelve games at home and twelve games away for each team.

(b) Junior leagues may be organized and operated from teams which are

properly organized and registered as members of the Junior Council for eligibility for participation in any Provincial championship.

(c) The Junior Council will, where no regional league is established, organize leagues for competition between teams at the equivalent level of a regional league with the intent of having representative teams becoming eligible to participate in competition leading to a Provincial championship in Junior Hockey.

(d) The Junior Council will, in consultation with the participating teams, arrange such playoff series between league representatives as may be necessary to declare Provincial champions in Junior Hockey. (e) Each Junior league shall furnish the Junior Council Secretary and the Hockey NL Chair and Administration with a copy of its schedule. All schedules are to terminate in sufficient time to allow competition in Provincial playoff competition. This date will be established by the Junior Council. (f) A copy of every game report from every official scheduled and playoff game in every Junior league must be forwarded immediately after each game to the Hockey NL office. (g) Effective 1999-2000, that non North American players not be permitted to play for any teams below major junior, any current international players that were registered in the 1998-1999 season with a HC and Hockey NL team, will be grandfathered for as many years as they are eligible.

(h) Any team participating in the Don Johnson Cup, or inter-Provincial competition, shall fully participate in all tournament events, such as, pre- game warm-ups; opening ceremonies; tournament banquet; closing ceremonies, etc., or be subject to sanctions.

903. Expenses - Junior All travelling expenses of teams participating in Provincial competition will be the responsibility of the team concerned, except as approved by the Finance Committee of Hockey NL.

REGULATION TEN

MINOR HOCKEY OPERATION

1000. Minor Organization

(a) Minor Hockey will be operated by the Minor Council within the framework of the Constitution of Hockey NL and HC.

(b) The Minor Council may, at each annual meeting, or at each fall meeting, decide which teams are to be accepted. All teams must meet all eligibility requirements and agree to comply with all required conditions for competition as established by the Minor Council.

(c) Minor Associations shall be organized for the season's activity to the

satisfaction of the Minor Council by January 10th of each year. This is in order to make it possible to have plans made for Provincial competition and to have the teams and players registered properly.

(d) Each Minor Association must pay an annual membership fee by

November 30th of each year in the amount set by Hockey NL and must also pay such player registration fees as may be required. No players will be registered until such fees are paid. Team registration fees to enter Provincial tournaments at Easter must be paid at the fall meeting each year.

(e) The Minor Council shall act as an advisory committee to the President of

Hockey NL on matters pertaining to Minor Hockey within the Branch. (f) The Minor Council will settle all questions concerning Minor Hockey which

are not specifically covered in the Constitution. (g) The Minor Council may recommend to the Executive Committee the suspension or expulsion of any team, member, official or player refusing to obey or accept the ruling of the Council.

(h) At each Minor Council annual meeting and at the fall meeting, each Minor

Association will be entitled to one vote per delegate in attendance up to a maximum of two votes per Association.

1001. Minor Registration

(a) Each Minor Association is required to register every person participating in the Association’s program at any level. This is in order to provide all these individuals with insurance coverage.

(b) By January 10th of each year, Minor Hockey Associations shall be required to register a minimum of twelve (12) players, at least one (1) of whom is to be designated as a goaltender. This is required in all Minor categories in order to obtain official recognition as a team in all sanctioned Hockey NL tournaments.

(c) All Minor players must be registered in their proper category according to

division. (d) All Minor registrations submitted for the first time to the Branch must be

accompanied by proof of age. Such proof of age will be by evidence of previous registration, by submission of a Birth Certificate, or other official document acceptable in Newfoundland and Labrador as proof of age. No documents showing any alterations or alleged corrections will be accepted.

1002. Minor Competition

(a) All Associations must officially notify the Minor Council, not later than January 10th of each season, of their intention to enter Provincial competition for any Minor category.

(b) The Minor Council will set up a Grading Committee who will submit a

report at the fall meeting to establish the various areas of competition for Provincial play. The Committee will grade the teams in various categories, establishing such levels of competition as the Council deems necessary. Other gradings will take place periodically throughout the year with an appeals process in place for these gradings. No appeals will be accepted once the final grading is approved by the Grading Committee.

(c) The Minor Council shall organize such Provincial Minor hockey tournaments, as the Council shall decide.

(d) A registered Minor Hockey player of a team of a lower division or category of the same club, or of an affiliated team, or a specially affiliated player, may affiliate to a team or teams of higher divisions or categories to a maximum of ten (10) games in a season. However, if the player’s

registered team completes its regular season and playoffs before the player’s affiliate team or teams, the player may thereafter affiliate an unlimited number of times. Exhibition and tournament games, which are not part of regular league games or playoff games, are excluded from the number of games referred to in this regulation.

1003. Expenses - Minor All travelling expenses of teams participating in Provincial competition will be the responsibility of the team concerned, except as approved by the Finance Committee of Hockey NL.

1004. Minor Council Rules

(a) The Minor Council may formulate additional rules for the operation of Minor Hockey, including Minor hockey tournaments, provided that such rules are not in conflict with any provision of the Constitution of Hockey NL or HC, and providing they do not permit any activity in conflict with any activity or custom of another part of Hockey NL.


(c) All male and female players participating in Provincial championships

must have played 50% of the total number of eligible games in their Association’s regular season. Games played under other Hockey NL registered league schedules, with the exception of high school hockey, will count towards the 50%.

REGULATION ELEVEN

FEMALE HOCKEY OPERATION

1100. Female Organization (a) Female will be operated by the Female Committee within the framework of the Constitution of Hockey NL and HC. (b) The Female Committee may formulate additional rules for the operation of female hockey, including Provincials, provided that such rules are not in conflict with any provision of the Constitution of Hockey NL or HC, and providing they do not permit any activity in conflict with any activity or custom of another part of Hockey NL. All such rules must be approved by the Executive Committee.

(c) All players on female teams, if not registered with a team in minor hockey, must pay player registration fees as established by the Registration Committee. (d) The Female Executive Committee shall act as an advisory committee to the President of Hockey NL on matters pertaining to Female hockey within the Branch. (e) The Female Executive Committee may recommend to the Executive Committee the suspension or expulsion of any team, member, official or player refusing to obey or accept the ruling of the Committee.

1101. Female Registration (a) Female players playing on female teams must register with their home Association. If female hockey is unavailable in their home Association they must register with the nearest association. If a player wishes to register in a female division such as Under 15 or Under 12, they may register with the nearest association offering that particular program, providing they are registered and playing with their home Association. For Provincial play, players must play with their home Association. Residency and registration will be determined as per the guidelines of the Female Committee and Hockey NL. (b) Each team will consist of a minimum of 12 players, one of whom to be designated a goaltender.

1102. Female Competition

(a) Female teams who wish to participate in Provincial tournaments must make application to the Female Committee no later than December 7th of each season. The Female representative and President of their respective Associations must sign all applications. Team registration fees to enter Provincial tournaments must be paid at the fall meeting each year. (b) The first draft of the female grading will be tabled for discussion purposes only at the fall semi-annual meeting of Hockey NL. This grading will be based on the team’s performance at their Provincial tournament in that calendar year. All divisions will consist of 6 teams wherever possible. (c) Request for changes to the grading must be submitted to the Female Director or Zone Coordinator no later than December 7th of each year and must be signed by the Female Representative and President of their Association.

REGULATIONS


(d) The Female Executive Committee will be responsible for organizing such Provincial Female tournaments, as the Committee shall decide.

(e) No player will be permitted to compete in any more than one Female Provincial tournament.

1103. Expenses - Female All travelling expenses of teams participating in Provincial competition will be the responsibility of the team concerned, except as approved by the Finance Committee of Hockey NL.

REGULATION TWELVE

OFFICIATING DIVISION

1200. Object

The object of this Division shall be to provide efficient, well-qualified officials for all levels and divisions of hockey within the jurisdiction of Hockey NL. It shall be the aim of the Division to assist in the betterment of hockey, to train and certify its officials, to maintain a good relationship between administrators, coaches, league officials and members of the various teams and leagues to which it provides its service.

1201. Jurisdiction

(a) The jurisdiction of this Division shall extend to all hockey within the province, which is registered by Hockey NL.

(b) No official shall be permitted to officiate in Inter-Branch competition or tournaments or games outside the province without the prior written permission and approval of Hockey NL through the Referee-in-Chief, or in his absence the Supervisor of Officials, or a duly appointed representative.

1202. Officiating Division Committee (a) All meetings of the Officiating Committee shall be called by the Referee-

in-Chief or his appointed representative as approved by the President of Hockey NL.

(b) A quorum for all meetings shall consist of a majority of the Officiating

Committee and must include either the Referee-in-Chief or his appointed representative.

(c) At all meetings of the Officiating Committee members present shall be entitled to one vote.

(d) No votes by proxy will be allowed at any time. (e) Voting shall be by a show of hands, unless the Chair decides upon a

secret ballot. (f) At all meetings of the Officiating Committee the "Roberts Rules of Order”

shall prevail.

1203. Duties

(a) Chair The Chair shall preside at all meetings of the Officiating Committee. He

shall perform the usual duties and functions of the presiding officer of the Committee.

(b) Referee-In-Chief (i) The Referee-in-Chief shall be the Chair of the Officiating

Committee. The Chair shall represent the Branch at any meetings of HC concerning rule changes or the HC Officials Program. The Referee-in-Chief shall be responsible to recommend to the Rules Committee any change to the HC rules. He will also be responsible, in consultation with the Officer member of the Officiating Committee and the Hockey Development Chair, for the supervision and development of all officials within the Branch and the administration of the HC Officials Program.

(ii) The Referee-in-Chief, or his appointed representative, shall have

the responsibility for the assignment of all officials. The Referee-in- Chief shall have the responsibility for convening any and all meetings of the Officiating Committee as is deemed necessary for the development or administration of officials. Furthermore he shall be responsible for the implementation of rule changes and the overall planning and administration of the Officiating Division.

(c) Supervisor of Officials The Supervisor of Officials shall be appointed by the Referee-in-Chief in

consultation with the Officers of Hockey NL. The Supervisor of Officials shall, in the absence of the Referee-in-Chief, have all the powers and duties of the Referee-in-Chief. He shall assist the Referee-in-Chief in the implementation and administration of the HC Officials Program, and the supervision of all the officials within the Branch. He shall be responsible

for maintaining accurate records of the history and performance of each official, with copies of such records being kept at the Branch Office.

(d) Zone Co-ordinators The Zone Co-ordinators shall be appointed by the Referee-in-Chief. They will be responsible for all clinics and the supervision of officials within their respective zones, as delegated by the Referee-in-Chief or the Supervisor of Officials. They shall be responsible for the assignment of officials to all games within their zones, as approved with, and in co-operation with the Referee-in-Chief, or his representative. They shall ensure that all officials operating within the zone are duly registered officials with Hockey NL, and will report to the Referee-in-Chief, or the Supervisor of Officials, on any and all matters concerning officials. Zone Co-ordinators shall maintain accurate records of all officials within their zones, and shall report in writing annually on the activities and progress of these officials. Zone Co-ordinators shall be responsible for the on-ice evaluation of officials and maintain accurate records of all progress of these officials.

(e) Zones Zones shall be determined by the Officiating Committee with the

respective boundaries being set in such a way as to ensure the proper and economical supervision of all officials within the Branch.

(f) Development Co-ordinator Female Officials

The Development Co-ordinator for Female Officials shall be appointed by

the Referee-in-Chief and report directly to the Referee-in-Chief. They will be responsible to develop additional resources (human, financial and material) to contribute to the development of Female Officials. Coordinate assignments, supervisions, and evaluation of female officials where possible. Assist in the coordination and execution of various Branch and National events involving female hockey officials. Assist the Referee-in-Chief in compiling annual ratings of female hockey officials. Work with the Referee-in-Chief to assist in development of female hockey officials and to recruit and support female officials in the Branch plus any other duties that the Referee-in-Chief feels necessary in the development of Female officials within the Branch.

1204. Membership (a) Membership in Hockey NL’s Officiating Division is on an annual basis and

the membership year ends on August 31st. (b) Activities of members will at all times be under Branch jurisdiction as

described in Section1301 and any local groups formed in various communities for local purposes will be limited to activities approved by the appointed members of the Officiating Division Committee and the Officers of Hockey NL. (c) Regular members in this Division shall be those who have actively served

in officiating or administration of officials during the previous year within the jurisdiction of this Division. Each member must have attended a Registration Clinic, or Rules Interpretation Clinic, during the year, and be certified within the HC Officials Program, or have transferred from another Branch, and be able to meet the standards of officiating established for this Division.

(d) Members shall be permitted to officiate at a level as achieved under the HC Officials Program, with the approval of the Referee-in-Chief, or in his absence, the Supervisor of Officials or a duly appointed representative. (e) With the exception of Recreation Hockey, no referee or linesmen,

including the Referee-in-Chief or the Supervisor of Officials, may coach or play with any team in Hockey NL during the current season in the division of hockey in which he is an official.

1205. Registration and Clinic Fees

(a) Registration fees for all members shall be those as set by the Officiating Committee on an annual basis at the time of Hockey NL’s annual meeting and approved by the Officers of Hockey NL.

(b) Registration fees for regular members shall be payable annually at a registration clinic, and shall include the cost of the clinic, plus other materials and equipment necessary for an official to be properly registered for that particular year.

(c) Registration fees for new members shall be paid at the time of application

for membership in this Division. (d) Money collected from registration and clinic fees is to be handled through

the Branch accounts and is to be applied to the cost of clinics, Officiating Division administration, the HC Officials Program, Branch overhead, insurance premiums, and the HC referees assessment.

. (e) Registration fees are payable according to the scale to be set at Hockey

NL’s annual meeting and to be circulated separately.

1206. Game Fees and Expenses (a) Game fees and expenses shall be those as laid down by the Officiating

Committee and approved by the Officers of Hockey NL on an annual basis, for all divisions of hockey, for regular season and playoff.

(b) Game fees for referees and linesmen may not exceed the Provincial rates approved annually by the Officers of Hockey NL.

(c) Referee expense allowances will be paid according to the standard rates

of By-Law 7 with the approval of the Officers of Hockey NL. (d) HC Officials Program Instructor Fees: The expenses of the HC Officials Program will be determined annually by the Officers of Hockey NL in consultation with the Referee-in-Chief.

1207. Conduct

(a) It shall be the duty of every referee to conduct himself at all times in such a manner as to further the best interests of the Officiating Division, to assist his fellow members whenever possible, to improve our standard of officiating and to assure the respect of all participants and fans alike. It shall be considered an offence against the Officiating Division to do otherwise. Any negligence by a referee in his duties shall be thoroughly investigated by the Officiating Committee.

(b) Termination and suspension: Membership may be terminated or suspended on recommendation of the Referee-in-Chief to the President of Hockey NL for any of the following reasons:

(i) any registered official who officiates without approval of Hockey NL

in any games involving a team which is not registered with Hockey NL shall be subject to suspension;

(ii) by unethical conduct towards other members of the Division, or the

disclosure of any discussion pertaining to game procedures by other officials;

(iii) by failure to fulfil an assignment, when properly notified, and

without sufficient reason;

(iv) by failure to maintain a standard of grooming and dress regulations in accordance with the HC Rule Book;

(v) by the consumption of any alcoholic beverages or illegal drug,

before or during an assignment; (vi) conduct, including the use of foul language, causing, or

contributing to, unnecessary controversy or criticism, involving players, coaches, other officials, the Officiating Committee or the

Officers of Hockey NL; (vii) by discussion of the Division business, and game reports that are of a confidential nature, or the release of the same to the media, without the approval of the Referee-in-Chief or, in his absence, the Supervisor of Officials, or a duly appointed representative.

(c) Any member who has been terminated or suspended from this Division

shall be allowed to submit a written appeal within thirty (30) calendar days of the termination or suspension to the Appeals Committee of Hockey NL.

1208. Dress and Equipment All officials of this Division are to be properly dressed at all times during assignments within the Branch. They shall be clean, neat and tidy in appearance and conform to the dress code as laid down by HC through the Referee-in-Chief.

1209. Reports (a) All original game reports where match penalties or gross misconduct

penalties have been assessed shall be forwarded by mail or by facsimile directly to the President of Hockey NL. If the game report was sent by facsimile, the original should be sent directly to the President of Hockey NL within twenty-four (24) hours of the game’s completion. The referee and linesman, where necessary, shall sign the report and include their respective phone numbers. Copies of all match and gross misconduct penalties are to be sent by facsimile to the Referee-in-Chief within twenty four (24) hours of the game’s completion.

(b) All written game reports shall be confidential. No discussion shall be

permitted by an official regarding the contents of any report, other than that approved by the Referee-in-Chief, the supervisor of Officials or the appropriate Officer of Hockey NL.

(c) The game officials in charge shall retain a copy of each game report for

the purposes of discussion or clarification to those persons authorized by Hockey NL.

REGULATION THIRTEEN

LIFE MEMBERSHIP

1300. In 1985 on the occasion of the fiftieth anniversary of the Association, the classification of Life Membership was established, to be conferred on those individuals who have rendered exceptional, distinguished service to the Branch. When determining if an individual should be designated as a Life Member, the

following criteria and procedures must be met and followed.

Selection Criteria: (a) The individual shall have been a member in good standing and rendered outstanding or meritorious service to the Branch for a minimum of ten (10) years; or

(b) The individual must have served the Branch in an Executive or Committee capacity for a minimum of five (5) years at the Association or Provincial Executive level.

Nomination Procedure: (a) Nominations for Life Membership must be forwarded, in writing, to the Executive Director at least sixty (60) days prior to the Annual General Meeting, for consideration by the Executive Committee. (b) The proposed individual can be nominated by any member in good standing with the Branch, but must be seconded by at least one other member. Such nomination should be supported with all relevant information supporting the nomination and addressing the criteria.

Selection Procedure: (a) The Executive Committee shall consider the nomination materials and any other relevant information. (b) Confirmation of the appointment of a Life Member will be made by majority vote of the Executive Committee, voting by secret ballot.

Privileges: Life Members shall have the privileges of the Board of Directors in an advisory capacity, but they shall not be permitted to vote. Hotel, meal expenses and a travel allowance, as deemed necessary and determined by the Finance Committee, for the Life Members shall be paid to the annual meeting only.

REGULATION FOURTEEN

HOCKEY HALL OF FAME

1400. (a) The Hockey Hall of Fame will have its own Constitution. Amendments to that Constitution can be made only at the annual meeting of Hockey NL as provided in Hockey NL Regulation 15, Amendments.

REGULATIONS


(b) Its objects will be: (i) to recognize, honour and pay tribute to all individuals, groups,

Associations, families or teams on the basis of playing ability, sportsmanship and character and who have achieved extraordinary distinction in hockey whether that distinction be achieved in amateur and/or professional hockey;

(ii) to recognize, honour and pay tribute to those individuals, groups,

Associations or families who have given distinguished services and who have made a major contribution to the development and advancement of amateur hockey in Newfoundland;

(iii) to encourage the development of all aspects of hockey by

permanently recording the achievements and history of such individuals, groups, Associations, families or teams.

(c) The Hall of Fame Selection Committee will process nominations for membership in the Hall of Fame and may also submit nominations to the Executive Committee for the various HC awards.

(d) The Hall of Fame Board of Directors shall govern the operations of the Hockey NL Hockey Hall of Fame under the guidance and advice of the Executive Committee.

REGULATION FIFTEEN

AMENDMENTS 1500. These Regulations may be amended only by a two-thirds majority of the Board of

Directors present and voting at the annual meeting.

1501. (a) No amendments or additions to these Regulations shall be considered unless it has been submitted in writing to the Executive Director at least 30 days prior to the date of the Hockey NL annual meeting. (b) It shall be the duty of the Executive Director to submit all such proposed amendments to each voting member of the Board of Directors at least two weeks before the date of the meeting at which they are to be considered.



SECTION FOUR- RECORD OF RECOGNIZED

TROPHIES & AWARDS

100. SENIOR The following trophies are recognized for Senior A Hockey Competition.

(a) The Herder Memorial Trophy Presented in 1935 by the Evening Telegram Limited in memory of

Douglas, Hubert, Arthur, William, Augustus, Ralph, James and Stephen Herder. Emblematic of the All-Newfoundland Senior Hockey Championship and for perpetual competition.

(b) The Evening Telegram Trophy Presented in 1954 by the Evening Telegram Limited for perpetual

competition as a Senior B championship Trophy and retired in 1960 when the Senior B division was dropped. Awarded in 1962 to winners in the Eastern Division of Senior A Hockey and retired in 1964. Since 1968, with the Newfoundland Senior League operating as one division, the trophy has been awarded to the first place finisher in the league. After the 1988- 89 season the league ceased to operate, and since 1992-93 the trophy is to be presented to the championship team in a recognized Senior A Hockey League which has the best winning average over the regular season among Senior A Leagues competing for the overall Senior Championship.

(c) The S.E. Tuma Memorial Trophy Presented in 1962 by S.E. Tuma Limited to be presented annually to the

winner in the Western division of Senior A Hockey and retired in 1964. Re-activated in 1969 for the leading scorer in the Newfoundland Senior Hockey League. The league ceased to operate after the 1988-89 season and since 1992-93 is to be presented annually to the leading point scorer over the regular season for teams in competing Senior A leagues.

(d) The Goaltenders Award Presented in 1989 by Hockey NL to be awarded annually to the

goaltender in one of the competing Senior A Leagues who has the best goals against record over the regular season.

(e) The Albert "PeeWee" Crane Memorial Trophy Presented in 1970 by Hockey NL Minor Hockey Committee for perpetual

competition. To be presented annually to the Rookie of the Year playing his first full season on one of the teams in a competing Senior A League.



(f) The Howie Clouter Memorial Trophy Presented in 1974 by the Gander Hockey Association. To be awarded

annually to the Most Gentlemanly and Sportsmanlike Player on one of the teams in a competing Senior A League.

(g) The T.A. (Gus) Soper Memorial Award Presented in 1981. To be awarded annually to the player judged the most

valuable on one of the teams in a competing Senior A League.

(h) The Cliff Gorman Memorial Award

Presented in 2005. To be awarded annually to the player judged the

most valuable on one of the teams competing in provincial Senior A

Championship.

200. JUNIOR The following trophies are recognized for Junior Hockey Competition.

(a) The Veitch Memorial Trophy Presented in 1951 by the Buchan’s Social and Athletic Club in memory of

John, Cyril, and Philip Veitch, for perpetual competition. To be awarded annually to the All-Newfoundland Championship Team in the highest Junior category.

(b) The Joe Byrne Trophy Presented in 1989 by Mr. J.R. Byrne. To be presented annually for

perpetual competition in Junior ‘B’ hockey.

(c) The Mel Andrews Trophy Presented in 1986 by Mel Andrews for perpetual competition. To be

awarded annually to the player judged most valuable to his team in Provincial Junior championship competition.

(d) The Ambrose O'Reilly Trophy Presented in 1986 by the Corner Brook Hockey Association for perpetual

competition. To be awarded annually to the player judged to be most gentlemanly and effective in Provincial Junior championship competition.

(e) The Junior Council Meritorious Awards Presented annually to a volunteer who has made a substantial

contribution to the fostering and development of Junior Hockey in the province of Newfoundland & Labrador. Four such awards may be presented – one for each of the four “Junior” regions of our province: Eastern, Central, Western and Northern.

(f) The Don Johnson Trophy



Presented in 1996 by Mr. Don Johnson for perpetual competition. To be awarded annually to the top goaltender in Provincial Junior Championship Competition.

300. MINOR

The following trophies are recognized for Minor Hockey Competition. Each trophy has been allocated to an individual Minor Hockey Association and is to remain with the Association and awarded annually to the winner of each Provincial Tournament that they host. The trophy will be presented at the completion of the Championship game to the winning team, but will remain at the Host Site for annual presentation. It is the responsibility of the Host Association to have a plaque engraved and placed on the Trophy indicating the yearly winners. Associations that do not have a trophy allocated have not hosted a Provincial tournament since this new procedure was adopted. Changes will be required as trophies are allocated to these Associations.
