Due to PA State Law, Kidder Township Trash Vendors WILL NOT pick them up. You MUST take them to a recycling center. Thank you. Signs are posted at the Entrance Gate advising that Tailgating is prohibited. All card holders are reminded that you CAN NOT instruct anyone to follow you in the gate. You MUST exit your car, instruct your guest, relative, vendor, etc., to pull up to the Card Reader as if they were going to swipe the card and once they

are in position you can then swipe your card for the gate to open.

Holiday Pocono offers our deepest condolences to the families and friends of those who have recently left us.

Marie P. CaputoMarie P. Caputo (nee Engrassia)

passed away peacefully at home on Jan. 27, 2018. She was 85. Born in Lyndhurst, N.J., Marie lived in Kearny for 52 years. She had been a switchboard operator at West Hudson Hospital. Marie is survived by her husband, Frank P. Caputo Sr., and her children, Frank P. Jr. (Dorothy), Philip (Margie), Michael (Kathy), and John (Kelly). She was the sister of Joseph Engrassia (Lucille) and is also survived by 10 grandchildren and 11 great-grandchildren.

Hugh R. StottHugh Robert Stott, MELBOURNE

BEACH, FL - Hugh Robert Stott, 73, of Melbourne Beach, Florida died suddenly at home on January 20, 2018 after surviving a long battle with Multiple Myeloma. He was born in Troy, New York, son of the late Marshall R. Stott and Eleanor R. Stott. Hugh is survived by his wife who was his dedicated caregiver, Nancy, son Derek Marshall Stott and his

wife Peggy of Houston, Texas, daughter Megan Rae Stott of Melbourne Beach, Florida, grandsons Maxwell Hugh Stott and Jace Tyler Stott who brought much joy to him during his illness, brother David M. Stott and wife Becky, of Ocala, Florida, sister Leslie A. Roedel and husband Charles, of San Jose, California, stepson John Layton, Robesonia, Pennsylvania, and many nieces and nephews. After graduating from Waterveliet High School, he completed the General Electric Apprentice Training Program in Schenectady, New York. In addition to serving in the US Army, he attended Sienna College while working for GE. At mid-career, he joined Public Service Electric and Gas Company in Newark, New Jersey as the corporate Turbine Engineer. He retired in 2004 from the PSEG as Maintenance Services Manager. He enjoyed time in the Adirondack and Pocono Mountains, golfing, downhill skiing, boating, and fishing with his family throughout his life. He was an active Boy Scout in his youth and also an adult leader for many years. Hugh and his family would like to acknowledge the care and treatment he received at MD Anderson Cancer Center in Houston, Texas. The

care he received there extended his life by many years. Donations in his honor can be made to MD Anderson or the American Cancer Society.

Joseph P. WalshJoseph P. Walsh passed away on

September 3, 2017 at the age of 72. A US Navy Veteran. Loving father of Timothy and Kristen Clarke. Dear Pop-Pop of 3 grandchildren. He is also survived by his brothers Jack and James and his four-legged friend Barney. Interment private. In lieu of flowers, family prefers donations to the Guiding Eyes for the Blind, PO Box 97007, Washington, DC 20090-7007 in his memory.

Beverly J. BrownBeverly Brown, passed away at her

home in Albrightsville, PA peacefully surrounded by her loved ones on Saturday, August 19, 2017, after a lengthy battle with cancer. Born in Philadelphia, she was a former area resident. Prior to retirement she worked as a mechanic for Hurst Automotive. Beverly is predeceased by her parents William and Joan Pezzeca, her brother Bruce and sister Delilia Lee. She is survived by her beloved husband Robert Brown; daughter, Dawn M. Pezzeca; sons, Jeremy Frank, Robert, John Justin

Pezzeca; sisters, Cynthia Murphy and Diane Pezzeca; grandchildren, Jeremy Jr., Ronald, Jordan, Richard, Lucciana and Krista. Relatives and friends were invited to attend her memorial gathering on Thursday, August 24, 2017 at the Molden Funeral Chapel and Cremation Service in Bristol, PA 19007.

Joseph Sellare, Jr.Joseph Sellare, Jr., 61, of Albrightsville,

passed away on Wednesday October 11, 2017 in the Lehigh Valley Hospital, Hospice Care Unit, Allentown.

Born in Brooklyn, New York on May 20, 1956, he was a son of the late Joseph Sr., and Marie (Calandrillo) Sellare. Joseph graduated from Lawrence High School, Cedarhurst, NY, and began his career in home building and remolding. During the 2000’s he relocated his family and his business to Marshalls Creek and then settled in Albrightsville, were he owned and operated Joseph Sellare Inc. General Contracting. Joseph also obtained his real estate license and he enjoyed selling the homes he remolded and built. He was a member of the St. Peter the Fisherman Catholic Church, Lake Harmony, and a 4th degree member of the Knights of Columbus, council #981, Pocono Pines. Joseph enjoyed carpentry work and buying cars.

Surviving are his wife, Diane Cerati Sellare of Albrightsville; daughters, Michelle Sellare of Copaigue, New York, and Jessica Sellare of Albrightsville; son, Christopher Sellare of Albrightsville; brother, Michael Sellare and his wife Dolores Giordano Sellare of Hurley, New York; brother in-law Vincent Cerati and his wife Maureen of Bellmore, New York; grandchildren, Victoria, Eli, Krista, and Jolie.

A catholic prayer service was held on Sunday October 22, 2017, at 4 p.m. at the Yanac Funeral & Cremation Service, Inc. 35 Sterling Road, Mount Pocono.

Robert M. Reczek Sr.Robert M. Reczek Sr., 75, of

Albrightsville, died on Friday, Nov. 24, 2017, at St. Joseph Hospital, Reading, after a long illness. He was the husband of Maria (Fuchs) Reczek. They celebrated their 50th wedding anniversary on Jan. 14.

Born on Dec. 7, 1941 in Coatesville, he was the son of the late Jenny and Barney (Brownie) Reczek. Bob was a retired Pepperidge Farm maintenance mechanic. He was a proud veteran of the U.S. Navy. He was a former Scoutmaster of Thorndale Troop 125.

In addition to his loving wife, Maria, he is survived by his daughter, Melissa, wife of Kyle Dunlavey; a son, Robert M. Reczek Jr.; granddaughter, Gwen Dunlavey; and grandson, Owen Dunlavey. He was predeceased by a sister, Patricia Rittenhouse.

A memorial service with military honors was held Thursday, Nov. 30 at Melber Funeral Home, 524 Center St., Jim Thorpe, with a memorial visitation from noon to 1 p.m. Interment was private.

In lieu of flowers, memorials in his name may be sent to the American Lung Assoc., 2200 Hamilton St., Allentown, PA 18104.

Absentee Versus Proxy---ExplainedThere seems to be some

confusion between what is an Absentee Ballot versus what is a Proxy.

An Absentee Ballot is a ballot completed and typically mailed in advance of an election by a voter who is unable to be present at the polls. We do not have polls and we do not use Absentee Ballots.

A Proxy vote is a ballot cast by one person on behalf of another who is unable to be present at the meeting. This is the process that

is used in accordance with our By-Laws.

If a member of the community is unable to make the Annual General Membership Meeting, they have an option to submit a Proxy vote. That Proxy can be assigned to whomever they chose to assign it to as long as

1) The assignee is a Member of our Community

2) The assignee is a Member in good standing.

If the Proxy is signed and

witnessed in our Office, there is no reason to have it notarized.

If the Proxy is not signed and witnessed in our Office, it MUST

be notarized and mailed to the office and must be received by 4 p.m. on the Friday before the election occurs.

TailgatingEach week there are several

complaints lodged at the Office from property owners regarding people “tailgating” them into the community.

Anyone entering the community can see that there are signs posted prohibiting “tailgating” however, that does NOT stop reckless people from doing it!

There are some who stop at the gate to allow the gate to come down behind them to halt someone from “tailgating” them into the community. Often, they are confronted by the person who tells them “The homeowner told me to tailgate someone in.”

Personally, I find it hard to believe that any of the property owners in our community would be so irresponsible as to tell someone to “just tailgate someone in.” As each new resident moves into Holiday Pocono, they receive the Rules and Regulations and the By-Laws and I personally make them aware that they are responsible for coming to the gate to let in anyone that they have coming to their property.

Please DO NOT call the office to request the office to let people into the community on your behalf.

Enforcement FinesFailure to register your ATV or abide by the rules can be

costly. First offenses range from $50 to $200 plus the cost of prosecution. A second offense carries a fine of $100 to $300 plus the cost of prosecution. Failure to register your vehicle or failure to have liability insurance is an automatic $300 fine plus cost of prosecution.

Law enforcement agency responsibility All law enforcement officers in the state, including

local and state police, are authorized to enforce the Snowmobile/ATV Law. In general:

• State Forest and State Park lands - DCNR Rangers • State Game Lands - Wildlife Conservation Officers

and Deputy WCOs • Municipal and state roadways - municipal and state

police • Private property - municipal and state police You must stop when signaled by a law enforcement

officer. Failure to do so could result in fines and loss of your registration.

SUMMARY OF PENNSYLVANIA’SALL-TERRAIN VEHICLE LAW

INTRODUCTION Pennsylvania has beautiful and challenging opportunities for all-terrain vehicle (ATV) riding. Many trails have been developed on public and private lands to accommodate this recreational pursuit.

This pamphlet summarizes the ATV requirements of state law and regulations. The state law is known as the Snowmobile and All-Terrain Vehicle Law and is contained in Chapter 77 of the PA Vehicle Code. The state regulations are in Title 17 Pa. Code Chapter 51. This pamphlet is not intended to be a substitute for the actual law and regulations.

In addition to state law and regulations, riding on municipal and private property may be further regulated by municipal ordinance.

REGISTRATION Pennsylvania residents owning and intending to use their ATV in Pennsylvania (except those used exclusively as a farm or business vehicle) must be titled and registered with the Department of Conservation and Natural Resources (DCNR), Snowmobile/ATV Registration Section.

General Registration This registration permits the machine to be operated off the owner or operator’s private property. The registration fee is $20 for two years. The owner is provided with a registration plate, an expiration sticker and a Certificate of Registration wallet card.

Limited Registration This registration is for machines used exclusively on the property of the owner. There is no fee and the registration does not expire. The owner is provided with a registration plate and a card, but no expiration sticker.

All-Terrain Vehicles are defined as follows:

1. Class 1 ATV – A motorized off-highway vehicle, which travels on three or more off-highway tires and has a maximum width of 50 inches and a maximum dry weight of 1200 pounds.

2. Class 2 ATV – A motorized off-highway vehicle, which travels on three or more off-highway tires and has a width which exceeds 50 inches or a dry weight which exceeds 1200 pounds.

Applications for registration of ATVs are available from the DCNR’s Snowmobile/ATV Registration Section. The ATV registration application form must be completed and sent to the DCNR, Snowmobile/ATV Registration Section, P.O. Box 8553, Harrisburg, PA 17105-8553, along with the required fee and sales tax statement. Registration applications are also available from: ATV dealers, Forest Districts and State Park Offices or download and print from the web at www.dcnr.state.pa.us/snowmobile.

Exempt from the registration requirements are ATVs owned by non-residents covered by a valid registration in their state, province or country that honors a Pennsylvania registration.

Temporary registrations are available from registered ATV dealers.

NON-RESIDENT REGISTRATION To legally operate an ATV in Pennsylvania that is registered in another state where Pennsylvania's registration is NOT honored, the ATV must also be registered in Pennsylvania. Proof of liability insurance is also required.

TITLES All ATVs in Pennsylvania must have a title issued by DCNR. The cost of a title is $22.50. The only exceptions to this requirement are those ATVs registered with the Department prior to February 12, 1987. These ATVs do not require a title until they are sold by the owner.

SALE – THEFT – DESTRUCTION – CHANGE OF ADDRESS The ATV owner shall notify the DCNR’s Snowmobile/ATV Registration Section in writing of any change of address within 15 days.

Upon the transfer, destruction or theft of an ATV, the reverse side of the Certification of Registration must be properly filled out in the spaces provided, signed by the owner, and returned to the DCNR’s Snowmobile/ATV Registration Section.

OPERATION ATVs may be operated:

1. On state-owned property on clearly marked and previously designated ATV trails;

* 2. On highways and streets when necessary to cross a bridge or culvert;

* 3. On highways and streets during periods of emergency when so declared by a governmental agency having jurisdiction;

* 4. On highways and streets for special ATV events of limited duration that are conducted according to a prearranged schedule under permit from the governmental unit having jurisdiction

* MUST BE 16 YEARS OF AGE OR OLDER.

An ATV may make a direct crossing of a street or two-lane highway provided:

The crossing is made at an angle of approximately 90 degrees to the direction of the highway, and at a place where no obstruction prevents a quick and safe crossing;

The ATV is brought to a complete stop before crossing the shoulder or highway;

The driver yields the right-of-way to all oncoming traffic that constitutes an immediate hazard.

In crossing a divided highway, the crossing is made only at an intersection of such highway with another public street or highway.

Driver must be at least 16 years of age unless he has a safety certificate and is under the direct supervision of a person at least 18 years of age.

It is illegal to operate an ATV: On State Forest Roads open for use by licensed motor vehicles. At the rate of speed that is unreasonable or improper under

existing conditions or in excess of the maximum limits posted for vehicular traffic;

In a careless way so as to endanger the person or property of another;

While under the influence of alcohol, narcotics or drugs.

Designated Roads State and local highways and roads may be designated and posted for ATVs by the government authority with jurisdiction over the road.

Township roads designated for ATVs are posted with a green sign containing the side view silhouette of an ATV and rider in white.

Some roads may be designated and posted as joint-use roads open to both ATVs and licensed motor vehicles. Joint use roads are posted with signs stating that both types of vehicles may use the road. ATV operators on joint-use roads must be at least 16 years of age.

Municipal ordinances may further regulate the use of ATVs on roads within their jurisdiction.

Municipal Roads

Private Property ATVs may not be operated on private property without the consent of the owner. Use of ATVs on private property may be further restricted by municipal ordinance.

ATV TRAILS Certain trails on state forest land and the Allegheny National Forest have been designated for ATV use. ATV trail information is available from the Bureau of Forestry website at www.dcnr.state.pa.us/forestryand the Allegheny National Forest website at www.fs.fed.us/r9/forests/allegheny.

REGISTRATION NUMBERS The five-digit registration number containing a combination of numbers and letters is embossed on an aluminum plate, which measures four inches in height and seven inches in width. This permanent registration plate is to be attached to the back of the machine near the center and as high as possible. The plate must be horizontal and clearly visible from behind the ATV. This plate remains with the ATV if it is sold or transferred to a different owner.

OPERATION OF ATVs BY YOUTH No one under 8 years of age shall operate an ATV on any state-owned property.

No person from age 8 to their 16th birthday shall operate an ATV except on lands of his parent or guardian, unless he or she has completed a prescribed ATV safety training course and received an ATV safety training certificate. Age 8 and 9 year old operators are restricted to an engine size of 70cc or less.

ATV SAFETY TRAINING COURSE Safety training classes are given by trained volunteer instructors. All youth ages 8-15 who complete the course will receive a safety course certificate. For information on a safety instructor near you contact DCNR’s Bureau of Forestry at (717) 783-7941.

ACCIDENT REPORTS The operator of an ATV involved in an accident must stop and give his or her name and address, the name and address of the owner of the ATV and its registration number to the other person(s) involved in the accident or to a police officer.

If the accident results in the injury or death of any person or property damages to the estimated amount of $100 or more, the operator must report the matter in writing within seven days to the DCNR, Bureau of Forestry, P.O. Box 8552, Harrisburg, PA 17105. It is a violation of the Snowmobile/ATV Law to not report the accident to the DCNR.

Accident forms are available upon request from the Bureau of Forestry and State Park offices and state police stations.

LIABILITY INSURANCE Liability insurance coverage is required for all ATVs that are required to have general registration. Proof of this coverage should be carried by the operator. The law does not specify a minimum dollar amount for this coverage. If you have questions about insurance coverage for ATVs contact the PA Dept of Insurance consumer hotline at 1-877-881-6388.

SNOWMOBILE & ATV FUND All registration fees are deposited in a special Snowmobile/ATV Fund. DCNR uses monies from this fund to carry out the Snowmobile/ATV registration, safety education and law enforcement requirements of the Snowmobile/ATV Law, to develop and maintain trails on public land and to encourage trail development on private land through grants.

ENFORCEMENT All law enforcement officers in the state, including local and state police, are authorized to enforce the Snowmobile/ATV Law. Municipal and state police have enforcement authority on private land.

FINES Failure to register your ATV or obtain liability insurance may result in a fine of $300.

A violation of other provisions of the Snowmobile/ATV Law is punishable by a fine of $50 to $200 plus the cost of prosecution for a first offense, and a fine of $100 to $300 plus the cost of prosecution for a second offense.

EQUIPMENT All ATVs operating in Pennsylvania must be equipped with a brake system capable of producing deceleration of 14 feet per second at a speed of 20 miles per hour; and a muffler in good working order. The sound intensity produced by an ATV may not exceed 99dbA, or decibels, when measured at 20 inches from the tailpipe.

All ATVs operated during hours of darkness or when visibility is less than 500 feet must be equipped with an operating headlight and taillight. The headlight must produce a white light sufficient to reveal persons and vehicles at a distance of 100 feet. The taillight must produce a red light plainly visible during darkness from a distance of 500 feet.

HELMETS It is illegal to operate an ATV without a securely fastened helmet on the head of the operator.

Membership Meeting will be held on Saturday October 13, 2018 beginning promptly at 1 p.m. at the clubhouse.

Registration begins at 12 Noon and the doors will close promptly at 1 p.m. Time will be determined by our attorney. Anyone arriving after 1 p.m. will not be permitted to enter until after the voting has been completed.

good standing, meaning all outstanding assessments have been paid in full. The office will be closed on Saturday, October 13 for the General Membership Meeting. No payments will

the policy of the Board of Di-rectors of Holiday Pocono Civic Association to plow snow once there has been a snowfall of at least three (3) inches or more on PAVED ROADS ONLY. Depending on road conditions the Milled Roads will be plowed at the discretion of the Road Com-mittee.

The Road Chairman and the Road Crew closely ex-amine the weather conditions to make the decision as to whether to plow or to cinder the roads.

The Road Crew consistent-ly attempts to address all con-cerns with road conditions. While one truck works the paved roads, another truck is simultaneously reviewing the condition of milled roads. Each milled road leads to a black topped road for better and immediate access during inclement weather.

We acknowledge the dif-ficulty that some folks have regarding their individual driveways however our first priority it to plow the snow off the roads and right of ways. It is not the responsibility of the road crew to plow individual driveways, it is your individu-al responsibility to plow your own driveways and their exit point onto the roads. Holiday Pocono will not be responsi-ble for plowing or shoveling individual driveways. If you are unable to shovel or plow your own driveways, you may want to consider contacting a vendor that will provide this service to you.

If you are a vendor willing to plow driveways for resi-dents, please call the office at 570-722-9464 so that our Secretary can communicate your willingness to residents that may require your ser-vices.

Speed LimitHoliday Pocono Rules and Regulations Section 4, Division A

clearly states “The maximum speed permitted for any vehicle on any road is twenty miles per hour

(20 MPH) as defined by the Association By-Laws. Please obey the posted speed limit at all times.

Plowing Milled RoadsMillings are actually

ground-up and recycled as-phalt from other roads that are being re-surfaced. Mill-ings are “soft” to begin with. They are a loose material as compared to black-top.

Due to the “softness” of this material, certain guidelines are used in the maintenance of these roads. In order to minimize the breakdown of these roads when plowing

during the winter, the recom-mendations of experts are followed.

Specifically, there should be a fully frozen sub-surface in order to hold the road ma-

terial together and in place. Next, there should be 2-3 inches of packed snow on the surface. When the snow level goes above this amount, the roads can be plowed.

If these procedures are not

followed, there is the risk of roads going back to dirt and mud.

As of 2012, new milling ma-terial cannot be purchased as PennDOt is recycling all mill-ings for their own use.

Holiday Pocono Gate Card PolicyGate cards are issued to

home owners and lot owners only and must be picked up in person. You will be asked to provide photo identification at the office when obtaining all

gate cards.It is the responsibility of

home owners who are rent-ing their properties to provide gate cards to their renters. The office will not provide gate cards to renters under any circumstances.

When selling your home, it is the responsibility of the sell-er to turn over all gate cards to the new owner(s). Before do-ing so, please notify the office so we can update our system to reflect the proper owner of

the gate card(s). New owners are urged to notify the office when you receive gate cards so we can ensure our sys-tem is updated accordingly. Failure to do so could result in your gate cards being ter-minated.

Per the board of direc-tors as of April 1989 and as published in the April 1989 newsletter: “home owners will receive two (2) cards. Lot

owners will receive one (1) card regardless of the num-ber of homes/lots owned. There is a limit of seven (7) cards per homeowner and three (3) cards per lot owner. Distribution of the cards is the same as voting under the by-laws. That is homes/lots un-der same ownership.”

There is a $25 Charge for additional/replacement gate cards.
