Wayne Yoder Cooler temperatures and a wet Fall will make build-ing a challenge during the winter months, but not impossible. This kind of weather always tests my patience. Hope everyone had a good Thanksgiving with family
and friends! I want to thank all our fellow builders and associates for making 2018 a successful year for the home building industry and I look for 2019 to be a big year as well! OHBA LEGISLATIVE REVIEW OHIO SUPREME COURT RULES IN FAVOR OF INSURANCE COMPANY IN
CONSTRUCTION GENERAL LIABILITY INSURANCE CASE
The Ohio Supreme Court recently issued its opinion in the Ohio N. Univ. v. Charles Constr. Servs., Inc., reversing the Court of Appeals decision, and instead, finding coverage did not exist for faulty work of a subcontractor under the construction gen-eral liability insurance completed operations provisions. The Court held the insurer is not required to defend a commercial general liability policyholder against suit by property owner, because subcontractor faulty workmanship is not fortuitous and not an occurrence. OHBA and NAHB filed a joint amicus urging affirmation of Appeals Court decision finding coverage under the policy. The Court acknowledged policyholders pay premiums for additional endorsements, such as completed operations coverage, but failed to expand its analysis to what then is covered under such provisions. The Court continued to suggest proponents take the issue to the legislature to modify the statutory definition of ‘occurrence’, if it is intended to include faulty workmanship. This brings about more questions: what does general liability insurance cover, as currently written; what other endorsements are being offered and at what additional cost? OHBA is currently reviewing the prac-tical impacts of this recent decision, and continues discussions with both construc-tion and insurance industry stakeholders.

ELECTION RECAP By way of a brief recap, here are our thoughts: Statewide Again, a sweep of the administrative and executive offices by the republi-cans, Mike DeWine, John Husted, Frank Larose, Keith Faber and Robert Sprague won the night. All are former state legislators who OHBA has good working relationships. On the Judicial side, democrats won both open seats on the Ohio Su-preme Court. Republicans still control 7-2. Ohio Senate While one seat still may be subject to a recount, the republicans have in-creased their majority by one. The numbers are a whopping 25-8 Ohio House While a few house seats may be subject to recount, the republican major-ity has shrunk from 66-33 to 62-37. Despite holding on to the majority, we still may see a nasty battle to determine who the next speaker of the house will be. OHBA will continue to hold a strong position with both chambers.
US Congress Republicans continue to hold 12 of the 16 seats assigned to Ohio. How-ever, democrats will now control the US House. Thus, the 4 democrats will likely be in key positions for the next two years. I am sure NAHB would like to know if any members have a good working relationship with Reps Fudge (Cleveland), Kaptur (Toledo), Ryan (Youngstown) and Beatty (Columbus). US Senate Current Senator Brown was reelected. Senator Portman is mid term and returns to the Senate next year. These election results and many other important items will be discussed
at the OHBA fall meeting next week.
