Hong Kong – Shanghai – Singapore UNCITRAL Model Law Workshop Introduction: As of 1 February 2016, the United Nations Commission on International Trade Law (UNCITRAL) reports that legislation based on the UNCITRAL Model Law on International Commercial Arbitration (1985), with amendments as adopted in 2006 (“Model Law”) has been adopted in 72 States and in a total of 102 jurisdictions. Many of China’s major trading and investment partners, including the United States, Japan, South Korea, Germany, Australia, Russian and Singapore have adopted the Model Law. Although the current Mainland Chinese arbitration law and practices are not yet fully comport with the Model Law, the Hong Kong and Macau SARs have also adopted the Model law. In Mainland China, lawyers and traders are increasingly involved in arbitration seated in Model Law jurisdictions. Mainland Chinese arbitrators have also been called upon to arbitrate in arbitration seated in Model Law jurisdictions. What then do Chinese traders, lawyers and arbitrators need to know about the Model Law? Highlights: The workshop focuses on what lawyers, arbitrators and cross-border trading companies and merchants in China need to know about the UNCITRAL Model Law. Introduction:

Speakers Profile: Dr. Michael Hwang SC is the Chief Justice of the Dubai International Financial Centre (DIFC) Courts. He is a graduate of Oxford University and a former law teacher in the University of Sydney and University of Singapore. In 1997, he was appointed as one of the first 12 Senior Counsel (SC) of the Supreme Court of Singapore (a status equivalent to that of Queen’s Counsel in England). His former appointments include being President of the Law Society of Singapore, a Vice Chairman of the International Court of Arbitration of the International Chamber of Commerce (ICC), a Vice President of the International Council for Commercial Arbitration (ICCA), and a Court Member of the London Court of International Arbitration. He is currently Singapore’s non-resident Ambassador to Argentina. He was appointed as the Chief Justice of the DIFC Courts in June 2010, having served as Deputy Chief Justice since April 2005.

He brings together resourcefulness, energy and years of senior level experience at KPMG and Hutchison Paging Ltd to his legal practice. He specialises in commercial law, company law, construction, arbitration and civil law. Richard is a Chartered Arbitrator and Accredited Mediator and is a member of the Guardianship Board and a Former President of the Hong Kong Institute of Chartered Secretaries and is currently Chairman of the Chartered Institute of Arbitrators East Asia Branch. Paul Barrett (FCIArb, FRICS, FHKIS, FCIOB) is a Chartered Arbitrator and a member of the Hong Kong Bar. He is a HKIAC Panel listed Arbitrator, HKIAC Accredited Adjudicator and HKMAAL Accredited Mediator. Paul’s practice is extensively in arbitration having conducted over 150 cases. He regularly sits as arbitrator and mediator. Paul is also a regular speaker, teacher and examiner on arbitration and mediation. He is a former chairman of the East Asia Branch and currently chairs Professional Development and Training.

Dr. Fan Yang specializes in international commercial contracts and arbitration. She studied law in

Shanghai, Paris, Birmingham and London and was called to the Bar of England and Wales in 2005.

She is a Fellow and an approved faculty member of the Chartered Institute of Arbitrators and an

Elected Committee Member of the CIArb East Asia Branch. Dr. Yang has been appointed as an

arbitrator under the HKIAC Administered Arbitration Rules (2013), and has extensive experience

in UNCITRAL Model Law and arbitrations under leading institutional rules such as the ICC and

HKIAC, and in ad hoc arbitrations. She has also experience in UNCITRAL investment treaty

arbitrations administered by the PCA in The Hague.
