any yet dis- covered ¬ wus found by Officer Ztch T Thomasson one of the most cap- able ¬ of the local officials If it is the bullet fired by the assassin i establishes as a Tact the general belief that the mann whc fired it stood within the office of the Secre ¬ tary of State on the first floor of the Executive building and at a point within twentyfive yards of the door of the office in which Mr Taylor sat at the time of the shooting Measurements by a surveyor made under direction of Commonwealths Attorney Franklin from the base of the tree where the bullet entered I to a window in the west end of tha building lower floor front proved the angle toe perfect and a wire line stretched Between the twti points showed that a man standing at the spot s here Goebel fell and going in the direction in which he was moving at the time he was shot would have been struck by a bullet in the same spot whore he was hit and that the bullet would have taken the same course through the body The tree in which the bullet tva found stands on the western side o the legislative building less than thirty feet from the front entrance to the grounds A block of wood several inches square containing the leaden missle was cut from the tree and without the removal of the bullet from it was turned over to CommonwealthsAttorney Frank lin He scaled it up and laid it away to awit the arrest of the con ¬ spirators which from present indi ¬ cations will bu made within two weeksOfficer Thomasson who discov ¬ ered the lodging place of the bullet is one of the boat marksmen in the State He was on duty near the Statehouses on the day of the shoot ¬ ing and helped to carry Gov Goebel to the Capital Hotel from the spot where he fell Going to that spot yesterday afternoon he placed him ¬ self in the position in which Goebel stood and placed a stick across his chest at the same distance from the ground as where the bullet entered Goebels body One end of the stick pointed directly to the window above mentioned in the executive building The other end pointed toward a tree in the western side of the yard From where I stood said heIII could see the torn spot at the base of the tree where the Marshal Sheriff Suter went to the office of Mr Taylor in the Executive building but found the door locked Later in the afternoon he found Mr Taylor at his home and there served the notice of suit Mr Mar- I ¬ shall was not in Frankfort today having got wind of the suit so no service could be had on him The notice will probably be served on him in Louisville tomorrow or in t- rump Frankfort if he attorneys ask ingfor an injunction to restrain Gov J C W Beckham irom a too tempting to perform any of the functions of the office of Governor Kentucky and Gen John B anyf In filing the petition Mr J P attorneysl exact minute of filing noted The only other attempt taken in the case yesterday was the of a summons on Gov Beckham Seelbachs Hotel by Deputy Sheriff Edward Walters Gen Cattleman was not in his office when the Sher ¬ iff was there and the summons toil not be served on him until today The failure of the Republican at ¬ torneys immediately after filing the petition to go before one of the Cir ¬ cuit judges and aslc for temporary f restraining order gave rise to con ¬ siderable comment and the general impression was that in filing the suit the Republicans had no presen idea of fully prosecuting it but di so to forestall the filing of any simi lar suit ia Judge Cantrills court in Franklin county and also to put ofTasfar as possible the final and certain day of reckoning The Democrats having filed like injunction suits against Mr Taylo- an l Mr Marshall in the Franklin Circuit Court after the filing of the Republican suit here the first ques- tion that would arise would be the one of jurisdiction whether it lay in thi Jefferson Circuit Court or the Franklin Circuit Court This would determine which suit could be tried The Republican attorneys not having applied to any
