Pursuant to his Answer to Question 61 in January Tynwald, what the Government’s potential maximum exposure is under the air route underwrite arrangements up to their expiry dates?

4. The Chairman of the Education Bill (Mr Moorhouse) to move -

That the Education Bill Report Volume 1 [PP No 2020/0224(1)] and Volume 2

[PP No 2020/0224(2)] be received and that the following recommendation be

approved –

The Department should not bring the Bill back for further examination:

without a clear statement of which clauses it will not wish to take forward

and which clauses it will wish to amend substantially; and

until it has prepared a clear statement of the direction of its planning; in

particular, the House will wish to know what its plans are for the structure

of delivering education.

The House should examine in Committee of the Whole House the changes which the Department will wish to bring to the Bill in the light of experience over the summer.

The next stage of the Bill should be in Committee of the Whole House on all the Clauses of the Education Bill, focusing on the impact of the Beamans’ Report on the Department’s plans and any consequent policy changes; in particular, the House should examine closely all the provisions in the Bill relating to governance.

The House should discuss the broad policy issues which the Bill will seek to deliver and the reasons for the extensive powers which it is seeking; it would be appropriate for the House to examine in detail in Committee of the Whole House the specific areas raised with us by witnesses and for those witnesses to be called to give evidence before the whole House.

(b) apply to the Island as part of the law of the Island, subject

to such modifications as may be specified in the order, any

subordinate legislation made under UK legislation

concerning any matter which relates, directly or indirectly,

to enabling climate change action or mitigating potentially

negative consequences arising from climate change action;

(c) incorporate into the law of the Island any obligation in an

EU instrument, or other international treaty, convention or

other such instrument in respect of any matter which

relates, directly or indirectly, to enabling climate change

action or mitigating potentially negative consequences

arising from climate change action;

(d) directly apply an EU instrument, or other international

treaty, convention or other such instrument in respect of

any matter which relates, directly or indirectly, to enabling

climate change action or mitigating potentially negative

consequences arising from climate change action; and

(e) make ambulatory reference to technical standards referred

to in UK legislation, an EU instrument, or other

international treaty, convention or other such instrument

as they may —

(i) be stipulated or amended from time to time; or

(ii) appear in a particular edition of a publication in

which they are set out,

and providing that those technical standards have the force

of law in the Island without the need for further legislation

whenever they are amended or a new edition of the

publication is produced.

(2) The legislation referred to in subsection (1)(a) is any of the

following UK legislation —

(a) the Environmental Protection Act 1990;

(b) the Environment Act 1995;

(c) the Clean Air Act 1993;

(d) any provision of UK legislation an Act of Parliament, or of

any instrument of a legislative character made UK

legislation, amending or varying, directly or indirectly, any

of the Acts of Parliament mentioned in paragraphs (a) to

(c);

(e) any instrument of a legislative character made or having

effect as if made under any of the Acts of Parliament

mentioned in paragraphs (a) to (c).

(3) An order under subsection (1) may include provision repealing or

amending any provision of a Manx enactment which is

inconsistent with, or is unnecessary or requires modification in

consequence of, the order, subordinate legislation made under UK

legislation or any EU instrument or other international treaty,

convention of other such instrument incorporated into the law of

the Island by the order.

(4) An order under subsection (1)(b) must—

(a) specify the modifications (if any) subject to which the UK

legislation applies to the Island;

(b) set out the subordinate legislation applied by the order,

incorporating the modifications subject to which it applies

to the Island;

(c) in the case of an order applying subordinate legislation

which amends previous subordinate legislation applied to

the Island, set out the previous legislation so applied as

amended, incorporating the modifications subject to which

that subordinate legislation applies to the Island.».
