FAIR’s Congressional Voting Report is designed to help you understand the positions that each U.S. Representative has taken on immigration measures during the 111 th Congress in furtherance of a rational immigration system. What is noteworthy about the 111 th Congress is that the House of Representatives almost entirely avoided the issue of immigration. Nevertheless, we have chosen two immigration-related votes on border security and health care to present a picture of each Representative’s position. Where a Representative voted with FAIR’s position on a motion, amendment, or bill, you will see a green plus sign (+). Where a Representative voted against FAIR’s position, you will see a red minus sign (-). Where a Representative did not vote, you will see (NV). During any period that a Representative was not in office, you will see (NP). H.R. 324 Santa Cruz Valley National Heritage Act H.R. 324 designated the Santa Cruz Valley region of Arizona — a large parcel of land along the U.S.-Mexico border — as a National Heritage Area. This designation allows the National Park Service to support existing and future State and local conservation efforts through Federal recognition, seed money, and technical assistance. House Vote 727, Border Security | September 23, 2009 — Bishop (R-Utah) motion to recommit with instructions to address the legislation’s border security deficiencies. Designating the Santa Cruz Valley region as a National Heritage Area would likely have prevented the Border Patrol from accessing the land with motorized vehicles and establishing certain communications and security structures necessary to carry out its duties to secure the border and control illegal immigration. Accordingly, Rep. Bishop filed a motion to recommit with instructions that, in effect, amended H.R. 324 to include language stating that nothing in the bill “modifies, restricts, impedes, hinders, or supplants any border enforcement or security authority, including drug interdiction and illegal immigration control.” In addition, the motion sought to add a section to the bill entitled “Border Security.” This section stated that nothing in the bill “may impede, prohibit, or restrict activities of the Secretary of Homeland Security to achieve operational control…within the National Heritage Area.” The motion to recommit with instructions was agreed to, 259-167. FAIR supported the motion to recommit with instructions. on the House health care reform bill, H.R. 3962. Prior to Democratic Leadership bringing H.R. 3962 to the House floor, the House Rules Committee met to decide which amendments would be voted on by the full House of Representatives. FAIR urged the Rules Committee to incorporate two amendments that would have: (1) closed loopholes in the eligibility verification for “affordability credits”; (2) reinstated the five-year waiting period for legal aliens to receive health care benefits under the bill; and (3) prohibited illegal aliens from participating in the taxpayer-subsidized health care insurance exchange. The Rules Committee, however, rejected these amendments, and voted to approve a rule for debate – H.RES.903 – that did nothing to address the immigration-related problems in H.R.3962. H.RES.903 was adopted, 242-192. FAIR opposed H.RES.903. H.R.5281 Development, Relief, and Education for Alien Minors Act of 2010 (DREAM Act) House Vote 625, DREAM Act | December 8, 2010 – Berman (D-CA) introduced a bill that would have granted amnesty to illegal aliens up to 30 years old who claim to have lived in the U.S. for five years and “initially entered” before the age of 16. H.R.5281 did this by granting illegal aliens a 5-year period of conditional nonimmigrant status if they completed high school, had a GED, or had been admitted to a college or university (including online schools). The bill also would have allowed these aliens to extend this status for another five years (or longer) if the alien completed two years of college or military service, and an alien could apply for a green card after ten years. Under the bill, aliens would be charged an initial fee of $525 upon being granted conditional nonimmigrant status and a subsequent fee of $2,000 upon renewal. FAIR opposed H.R.5281.
