Hello and Welcome to another year! It is September, the beginning of another HMPGA year, our 20th!! Please join us on September 17th at the Century House to celebrate HMPGA’s birthday! We have commemorative swag available, prizes and games planned, dinner and cake. And if the 20th anniversary of HMPGA wasn’t enough excitement for this year, please plan to join us for the the “Joint Geologists Meeting” on October 15th at the State Museum again. The meeting will provide an opportunity to celebrate and learn more about the passage of the New York geology practice bill. The New York geology practice bill that provides for licensing geologists passed both houses of the New York State Legislature and is waiting to be sent to the governor’s office for his
signature. What this ground-breaking piece of legislation means for New York and for those who practice geology in the Empire State will be discussed during a meeting at the
New York State Museum in Albany on October 15.

The Eastern New York Chapter of the Air and Waste Management Association (AWMA-ENY) is proud to announce the third annual Peter B. Desrochers Golf Tournament at Van Patten Golf Course in Clifton Park on Friday, September 19, 2014. Your participation in this event will help fund the education committee’s Earth Day Grant program for the 2014-2015 academic year. The bill to establish the Profession of Geology in New York State passed both houses of the Legislature in June of this year. This is the first time we have been successful in getting the bill to this point. The questions that have been circulating since the bill passed the Legislature include inquiries into when the bill will arrive at the governor’s desk. There is no set timeframe and the bills are sent over in groups. We should know in advance whether there are any concerns that may need to be addressed. NYSCPG has worked diligently with all of the stakeholders over the years to ensure the language in the bill is solid. News about the bill reaching the governor and his decision will be forwarded to the HMPGA membership as soon as it is received. Many people over the last couple of months have asked what happens after the bill passes and is signed by the governor. I want to address a few of these questions and also provide a general roadmap for the process going forward. Once the bill becomes law, we enter the regulation creation period. The State Education Department has asked for two years to craft the regulations. We want to be part of the regulation writing process through our lobbyist, Peter O’Connell. We are hoping to shorten the time it takes to prepare the regulations and we would like to propose a pre-qualification period to State Ed. The reason for this period is to help business owners transition their companies into professional corporations. Every business within New York State owned by geologists and/or offering geologic services will be required to become professional corporations. Details regarding the various professional corporation types can be found at http://www.op.nysed.gov/corp/. Section V of the Corporate Entities for Professional Practice highlights the Design Professional Corporation (D.P.C.) designation that was effective January 1, 2012. We will cover this in more depth in future NYSCPG newsletters. One question has been asked about the degree requirement and will people currently working in the field with geology-related degrees have issues obtaining a license. I have been telling people to refer to the Certified Professional Geologists requirements from AIPG (www.aipg.org) for a rough idea on the potential course requirements for licensure. The ASBOG site (www.asbog.org) also provides suggested course requirements. If you have the requisite educational background provided by either of these entities, then it is probable that you will meet the future New York State requirements. Continued on Page 9…

There is also a stipulation in the bill for persons without a geology based degree. The requirement is twelve years of geologic work under a qualified profession. I have been involved in discussions with members of state agencies regarding who will be considered ‘qualified’ during the grandfathering period since the current lack of professional stature. It appears that there will be some leniency during this time period, but it will be up to State Ed to determine once the bill becomes law. A second question has related to the grandfathering period. The bill language is written that there will be a one year grandfather period after the regulation writing phase. This essentially provides a three year window from the date the bill is signed into law for people to garner the necessary experience required to obtain a license. The planning has begun for our next Annual Membership Meeting, to be held on October 15th. The format of the meeting will be similar to last year. This will again be a joint meeting with NEAIPG and the regional professional associations and will take place during the New York State Museum’s open house. Activities will include business meetings as planned by the individual professional organizations, an evening reception and networking event followed by a presentation on the licensure bill (with Q&A session).
I will be speaking regarding the passage of the bill and what this means for the profession in New York. This will be an open forum to discuss questions, concerns and thoughts regarding the regulation phase and how passage can affect you. There also will be a discussion on the future of NYSCPG and the formation of our Transition Committee. I highly recommend that you attend this meeting to participate in the process. I would also ask all of you to reach out to friends and colleagues, and encourage them to come and join NYSCPG as we move forward. Our membership rolls represent less than one-third of the total geologists in New York. Now is a critical time for everyone to become a member and keep up-to-date with the latest information. The earthquake lies within a 70-km-wide (44 miles) set of major faults of the San Andreas Fault system that forms the boundary between the Pacific and North American tectonic plates. The persistent northwestward movement of the Pacific plate relative to North America primarily causes right-lateral slip across the major faults, but also causes deformation between the major faults. The ongoing complex deformation field is revealed by modern geodetic surveys and earthquake patterns as well as the regional geologic structure. The earthquake is located at the eastern shore of San Pablo Bay between two major active fault systems: the Hayward-Rodgers Creek Fault system on the west and the Concord-Green Valley Fault system on the east. The earthquake occurred near the well-known West Napa Fault, and the less well known Carneros-Franklin Faults, which juxtapose different suites of rocks. Although there are several faults in the region of the earthquake, only the West Napa Fault is known to have displaced Holocene-age sediment — which is positive evidence of surface fault rupture in the last 11,000 years. Historically, in this region shaking sufficient to seriously damage structures at Mare Island occurred during the M6.8 1868 Hayward Fault earthquake, the M7.8 1906 San Andreas Fault earthquake, and particularly during the M6.3 1898 Mare Island earthquake. The 1898 earthquake may have occurred about 20 km (12 miles) to the northwest on the southern Rodgers Creek Fault. Even larger nearby events than the 1898 earthquake can be expected in the future. In addition, the epicentral region of this earthquake is depicted on the USGS National Seismic Hazard Maps to have a high probability of strong shaking in the future. Continued on Page 13…

The earthquake is located between two major, largely strike-slip fault systems. The Hayward-Rodgers Creek Fault system, which is approximately 7 km (4 miles) west of the site, generated damaging earthquakes in 1868 and probably in 1898. The Concord-Green Valley Fault system, which is 12 km (7 miles) east of the site, produced a M5.5 earthquake in 1954; while it has not generated a large historical event, there is strong evidence for recent pre-historic activity. The 1999 Working Group on California Earthquake Probabilities (WG99, 1999) concluded that the Hayward-Rodgers Creek Fault system has a 32 percent probability of generating a large earthquake (M6.7 to 7.4) by the year 2030, and the Concord-Green Valley Fault system has a 6 percent chance of generating a large earthquake (M≥6.7) in the same time period. The earthquake occurred near the north shore of San Pablo Bay. The bayshore areas in the San Francisco Bay region are underlain by landfill and bay mud and have experienced disproportionately greater damage during historic earthquakes. Such damage is caused by soil failure in the fills and amplification of ground shaking by the soft bay mud.

Capital District Breakfast Club Presentations
The Capital District Environmental Breakfast Club is an informal group of environmental professionals that meets monthly to discuss current environmental issues. Each meeting features a speaker on a topic of interest, a regulatory update, and an open forum. Meetings are held on the first Friday of each month except July and August. The Environmental Breakfast Club meets at the Holiday Inn Turf on Wolf Road in Colonie, New York. Meetings start at 7:30 am. The cost is $15 per person, which includes a full breakfast buffet.
