Motion: Celebrate the 100th Anniversary of Kenilworth Fire District No. 2 and Honor the Service of Former Chief Robert W. Schober.

WHEREAS, Kenilworth Fire District No. 2 is celebrating their 100th anniversary of service to the

residents and businesses of the Town of Tonawanda; and

WHEREAS, Chief Robert W. Schober faithfully served Kenilworth Fire District No. 2 for many

years; and

WHEREAS, this Town Board, on behalf of the residents, business owners and property owners of

the Town of Tonawanda, wishes to recognize Kenilworth Fire District No. 2 and its past and present

members for their public service and dedication to the Town of Tonawanda;

NOW, THEREFORE, BE IT RESOLVED that dedication plaques be placed on Hawthorne

Avenue between Ford Avenue and Kenilworth Avenue in honor and recognition of Chief Robert W.

Schober for his many years of service to Kenilworth Fire District No. 2 and the residents, business owners

Motion: Support Citizens for Regional Transit's Metro Rail Expansion.

Offered the following resolution and moved it adoption: WHEREAS, Citizens for Regional Transit is a grass roots community organization that promotes the

expansion of Metro Rail to service all of Western New York and the improvements of regional transit services; and

WHEREAS, Founded in 1965, their central focus is to see Buffalo’s Light Rail extended to achieve its

original goal of providing a 36 miles network that serves the citizens of the Buffalo-Niagara region; and

WHEREAS, Citizens for Regional Transit has called upon the leadership of the Town of Tonawanda,

New York to support their petition for creating new sustainable funding for public transportation, building of new multi-model rail stations in Buffalo and initiating a light rail extension to the Buffalo Niagara International Airport, State University of New York at Buffalo, and beyond; and

WHEREAS, this petition has received wide support from other municipalities and organizations

throughout the region; and WHEREAS, other endorsers of said petition are the Town of Niagara, Partnership for the Public Good,

the Sierra Club, GOBike Buffalo, the Wellness Institute of Greater Buffalo, the Campaign for Greater Buffalo and many others.

NOW, THEREFORE, BE IT RESOLVED, that the Town of Tonawanda, New York

supports Citizens for Regional Transit’s petition for new sustainable funding for public transportation, building of new multi-model rail stations in Buffalo and specific light rail extensions mentioned in the said petition.

NOW, THEREFORE, BE IT FURTHER RESOLVED, that Supervisor Joseph H.

Emminger is hereby authorized to execute the petition for an Integrated and Sustainable Public Transportation System as presented.

forwarded to Citizens for Regional Transit, Buffalo Mayor Byron Brown, the NFTA, and both State and Federal representatives to our region.







Motion to Support Local Waterfront Revitalization Plans.

WHEREAS, the City of Tonawanda, Town of Tonawanda and City of North Tonawanda share over 24.4 miles of New York's Niagara River and Erie Canal shorelines; and WHEREAS, these shorelines are significant regional assets identified in each communities Local Waterfront Revitalization Plans (LWRP); and WHEREAS, each community contains significant multi-use trails which combine to form essential connections of the Shoreline, Canalway and Empire State Trail networks; and WHEREAS, said communities acknowledge the regional significance of the confluences of these blueways and greenways and wish to collaborate to maximize taxpayer investments to ensure community strengths. NOW, THEREFORE, BE IT RESOLVED that the Town of Tonawanda actively participate in the work group identified in the "Tonawanda Regional Charter" and to work to fulfill its stated vision. Motion: Support the New York State Real Property Tax Law Amendment Providing a Temporary Extension on Property Tax Payment Obligations for Federal Workers Affected by the Federal

Government Shutdown, As Set Forth in the Agenda Before You.

WHEREAS, on February, 1, 2019, the New York State Governor Andrew Cuomo signed into law Senate (S.02523 and Assembly (A.02852) bills which add a new section, Real Property Tax Law 925-e to allow furloughed federal taxpayers or designated non-pay federal employees or by the spouse or the domestic partner of such person in Erie County an extended period of ninety days from the end of the furlough to pay property taxes without interest and penalty. NOW THEREFORE BE IT RESOLVED, that this Town Board of the Town of Tonawanda does hereby support and authorize Marguerite Greco, Receiver of Taxes, under New Yorker State Real Property Tax Law Section 925-e, and this resolution, to extend the interest and penalty free period for ninety days after the end of such lapse in discretionary appropriations by the federal government and; BE IT FURTHER RESOLVED, a furloughed federal taxpayer or designated non-pay federal employee or by the spouse or the domestic partner of such person must provide documentation to the collecting officer and; BE IT FURTHER RESOLVED that certified copies of this resolution be forwarded to the Erie County Director of Real Property Tax Services. Motion: Oppose Governor Cuomo's Proposal to Cut Aid and Incentives to Municipalities.

WHEREAS, Governor’s Cuomo’s proposed 2020 NYS Budget includes unprecedented cuts to

unrestricted State Revenue Sharing program known as Aid and Incentives to Municipalities (AIM) in the

amount of 49 million for all municipalities in the State of New York, effectively eliminating the program,

and

WHEREAS, this proposed cut would result in a loss of $585,000 from the Town of Tonawanda’s

general budget, and

WHEREAS, funding has not been increased in the last several years as unfunded mandates and

cost of Town and Village services have risen, and

WHEREAS, if these cuts go through, a shocking 91% of Towns and Villages will permanently

lose their AIM funding, and

WHEREAS, incentives for shared services, consolidation, and infrastructure remediation directed

by consent orders in no way replace the needed financial assistance to fund and manage the increasing

costs of day to day services and capital projects needed in sustainable Town and Village planning and

management, and

WHEREAS, the proposal to eliminate AIM funding unfairly punishes State residents, making

financial planning aligned with the NYS Tax Cap virtually impossible and

WHEREAS, the Governor is proposing to make the Tax Cap permanent, discontinue the $65

Million in Extreme Winter Recovery Program and proposes no increase for CHIPs funding, for which there

has been widespread vocal support, and

WHEREAS, the proposal to eliminate AIM funding is not proactive, but a method to cut a small

percent from the State Budget, yet a significant amount of revenue to Town and Village budgets.

NOW, THEREFORE, BE IT RESOLVED: The Town of Tonawanda strongly opposes the

elimination of AIM funding, and

FURTHER RESOLVED, the AIM funding benefits all of our residents not only in the Town of

Tonawanda but throughout New York State and eliminating it could result in reduction of services,

program cuts and layoffs. Every dollar that the State shared is a dollar that doesn’t have to be levied on

backs of local taxpayers, and

BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded to

Honorable Governor Andrew M. Cuomo, Honorable Senator Chris Jacobs, Honorable

Assemblyman Robin Schimminger, Honorable Assemblywoman Monica Wallace, Honorable

maintenance activities at 311 Brompton Road.





Motion: Approve and Authorize the Supervisor to Sign an Agreement for the Purchase and Sale of Street Lighting from Niagara Mohawk Power Corp d/b/a National Grid, Nunc Pro Tunc.

WHEREAS, Niagara Mohawk Power Corporation d/b/a National Grid ("National Grid") operates and maintains an electric transmission and distribution system, including certain street lights used to provide lighting service under bill account number 02952-94101 to Buyer within its municipal boundaries under Service Classification ("S.C.") No. 2 of National Grid's Tariff; and

WHEREAS, Town of Tonawanda desires to purchase the Street Lights at a cost of $10,305,014.00 identified in Exhibit E therein (collectively, the "Street Lights,") from National Grid as provided in Section F.8 of S.C. No. 2 of National Grid's Tariff, and National Grid is willing to sell the Street Lights to Tonawanda.



WHEREAS, Due to recent changes to New York State law, the Street light Replacement & Saving Act (PSL 70-a) establishes procedures for the transfer of street light ownership from a utility to a municipality. Subsequently, NYS initiated a statewide program called Smart Street Lighting which calls for the conversion of 500,000 street lights to cost savings LED fixtures by 2025. Several incentives and programs have been set in place to assist municipalities move away from utility owned street lighting which is recognized to be unnecessarily expensive due to self-serving public utility service rules and regulations.

WHEREAS, the Town of Tonawanda has an agreement, Resolution 2018-745, November 19, 2018, with the New York Power Authority to facilitate said purchase, finance and upgrade the street lighting system with LED technology;

NOW, THEREFORE, BE IT RESOLVED, that this Town Board does hereby approve the Purchase and Sale Agreement and authorizes the Supervisor to execute it. Vote Record - Resolution RES-2019-121

Motion: Approve and Authorize the Supervisor to Execute Documents Pertaining to Job 3045 Electric Vehicle Charging Stations from NYSERDA and Authorize to Prepare said Application.

WHEREAS: the New York State Energy Research and Development Authority (NYSERDA) Charge Ready NY program offers rebates up to $4,000 per port to public organizations for the installation of Level 2 Electric Vehicle charging stations, and WHEREAS; NYSERDA requires an Application, Equipment Owner Agreement and Charge Ready NY Site Host Agreement per site, and WHEREAS: the Town of Tonawanda has already submitted a grant application to National Grid for the costs associated with installation of electrical service for seven, two port electric vehicle charging stations in Lincoln Park, 1200 Parker Blvd, Brighton Park, 70 Brompton Road and the Aquatic and Fitness Center, 1 Pool Plaza per resolution 2018-827, and WHEREAS: the NYSERDA rebates will offset costs associated with purchasing the electric vehicle charging ports to be installed at the above locations, NOW, THEREFORE BE IT RESOLVED, that the Supervisor be and hereby is authorized and directed to execute all documents pertaining to the application and acquisition of said funding. Motion: Approve and Authorize the Supervisor to Sign a Municipal Cooperation Agreement for Shared Assessor Services with the Town of Grand Island.

WHEREAS, the Town of Tonawanda and Town of Grand Island are empowered and required to have an Assessor pursuant to §20 of the Town Law of the State of New York; and

WHEREAS, the Town of Tonawanda is empowered to enter into a shared services agreement on a contractual basis with the Town of Grand Island for the provision of Assessor services provided by the Town of Grand Island to the Town of Tonawanda pursuant to §119 -0 of the General Municipal Law of the State of New York, subject to approval by both Town Boards; and

WHEREAS, the Towns are empowered to enter into a municipal cooperative shared services agreement for Assessor services provided by the Assessor appointed by the Town of Grand Island pursuant to §576 of the Real Proper ty Tax Law and Article 5-G of the General Municipal Law;

NOW, THEREFORE, BE IT RESOLVED that this Town Board does hereby approve and

Supervisor Emminger- The Supervisor, Councilman Crangle, Chief Uschold & Captain Waring attended the River Road Volunteer Fire Company Installation where three local firemen received awards; Mike Smith, Chief Thomas Ofenbau and President Kenneth Walker. There was also a celebration for the 100th Anniversary Year for the Kenilworth Fire Department where Josh Strauss received an award. Supervisor Emminger and James Jones attended the American Public Works meeting where the Town of Tonawanda received a merit award for the green infrastructure at Lincoln Park with contractor Louis Del Prince. The State of Town was held last week. In summary, the Town of Tonawanda is strong. Supervisor Emminger commended Thomas Jones and the Highway Department for all of their efforts during the recent snowstorm. Councilman Conrad- Added he recently also attended Elwood Installation where Robert Crane Cross was recognized.

Recently moved to Tonawanda and very happy with the Town’s services. However, resident and children and not happy about possible changes to the pool. Supervisor Emminger informed him there are other pools in the town and there is not definitive plans to change the pool at this time.

Bill Schaab (owner of American Demo-N-Disposal)-

Mr. Schaab has come before the Town Board for clarification as to why he cannot occupy or work on the building he purchased to use as an office for his business. His building permit has gone before the Planning Board and will be going before the Zoning Board this month as well. Mr. Schaab is not looking for confrontation; he is compliant to the town’s rules and regulations, he just wants correct the deficiencies and get back to work. Thomas Duncan responded by saying the stop work order was issued, Mr. Hoffman had direct contact with the owner, explaining until the permit is issued, work must stop. Mr. Schaab ripped the stop order off the door and continued to work. Councilwoman Chimera asked if the work order can be expedited and she was informed there is not a process to expedite this.

Thomas Slocum (34 Tiliton)

Resident is here to follow-up with sewer water issue from October 2018. Mr. Slocum expected to hear some type of response from the Town Board since October. Supervisor Emminger and Councilman Bargnesi asked Michael Kessler to approach and explain the slip lining done on Kenmore Avenue. Mr. Kessler informed the Board there is a surge of water coming from that area and the county is looking into this issue.

WHEREAS ADRIENNE J. SCHULTE passed away on January 11, 2019; and WHEREAS the Town Board and the citizens of this community are deeply saddened by the passing of ADRIENNE J.
