Motion: Oppose Governor Cuomo's Proposal to Cut Aid and Incentives to Municipalities.

WHEREAS, Governor’s Cuomo’s proposed 2020 NYS Budget includes unprecedented cuts to

unrestricted State Revenue Sharing program known as Aid and Incentives to Municipalities (AIM) in the

amount of 49 million for all municipalities in the State of New York, effectively eliminating the program,

and

WHEREAS, this proposed cut would result in a loss of $585,000 from the Town of Tonawanda’s

general budget, and

WHEREAS, funding has not been increased in the last several years as unfunded mandates and

cost of Town and Village services have risen, and

WHEREAS, if these cuts go through, a shocking 91% of Towns and Villages will permanently

lose their AIM funding, and

WHEREAS, incentives for shared services, consolidation, and infrastructure remediation directed

by consent orders in no way replace the needed financial assistance to fund and manage the increasing

costs of day to day services and capital projects needed in sustainable Town and Village planning and

management, and

WHEREAS, the proposal to eliminate AIM funding unfairly punishes State residents, making

financial planning aligned with the NYS Tax Cap virtually impossible and

WHEREAS, the Governor is proposing to make the Tax Cap permanent, discontinue the $65

Million in Extreme Winter Recovery Program and proposes no increase for CHIPs funding, for which there

has been widespread vocal support, and

WHEREAS, the proposal to eliminate AIM funding is not proactive, but a method to cut a small

percent from the State Budget, yet a significant amount of revenue to Town and Village budgets.

NOW, THEREFORE, BE IT RESOLVED: The Town of Tonawanda strongly opposes the

elimination of AIM funding, and

FURTHER RESOLVED, the AIM funding benefits all of our residents not only in the Town of

Tonawanda but throughout New York State and eliminating it could result in reduction of services,

program cuts and layoffs. Every dollar that the State shared is a dollar that doesn’t have to be levied on

backs of local taxpayers, and

BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded to

WHEREAS, Due to recent changes to New York State law, the Street light Replacement & Saving Act (PSL 70-a) establishes procedures for the transfer of street light ownership from a utility to a municipality. Subsequently, NYS initiated a statewide program called Smart Street Lighting which calls for the conversion of 500,000 street lights to cost savings LED fixtures by 2025. Several incentives and programs have been set in place to assist municipalities move away from utility owned street lighting which is recognized to be unnecessarily expensive due to self-serving public utility service rules and regulations.

WHEREAS, the Town of Tonawanda has an agreement, Resolution 2018-745, November 19, 2018, with the New York Power Authority to facilitate said purchase, finance and upgrade the street lighting system with LED technology;

Tonawanda Vehicle and Traffic Local Law 2-83, Relative to Parkhurst Boulevard in the Area of Ben Franklin School, as Set Forth in the Agenda Before You.

WHEREAS, this Town Board, at its regular meeting held on the 11th day of February 2019 did call a public hearing to consider amending Schedule XI: Parking, Standing and Stopping Restrictions of the Town of Tonawanda Vehicle and Traffic Local Law 2-83, Relative to Parkhurst Boulevard in the area of Ben Franklin School, as follows:

SCHEDULE XI: PARKING, STANDING AND STOPPING RESTRICTIONS

1. INSTALL: "NO STOPPING ANYTIME" signs along the west side of Parkhurst Boulevard

adjacent to the north/south bus loop exit and entrance at Ben Franklin School; and WHEREAS, Service Bureau Lieutenant Mark Shoemaker has received a complaint from the Ken-Ton Transportation Department indicating there is not enough room for buses to enter or exit the bus loop safely when vehicles are parked along Parkhurst, adjacent to said bus loop. This has resulted in bus/vehicle collisions; and WHEREAS, it is recommended that by installing these signs, it creates a buffer zone allowing enough room for the buses to enter and exit the bus loop safely; and NOW, THEREFORE, BE IT RESOLVED, that said public hearing will be held on the 25th day of February, 2019 at 7:00 PM, local time, in Council Chambers of the Municipal Building in the Village of Kenmore, NY, at which time and place the Town Board will meet and hear all persons interested in said amendment as above described; and BE IT FURTHER RESOLVED AND ORDERED, the Town Clerk give notice of said hearing by a publication of a notice in the KEN-TON BEE, a newspaper regularly published and having general circulation in the Town of

Tonawanda Vehicle and Traffic Local Law 2-83, Relative to Fairmount Street, as Set Forth in the Agenda Before You.

WHEREAS, this Town Board, at its regular meeting held on the 11th day of February 2019 did call a public hearing to consider amending Schedule XI: Parking, Standing and Stopping Restrictions of the Town of Tonawanda Vehicle and Traffic Local Law 2-83, Relative to Fairmount Street, as follows:

SCHEDULE XI: PARKING, STANDING AND STOPPING RESTRICTIONS

1. REMOVE: "NO STANDING HERE TO CORNER" signs on the west side corner of Kenmore

Avenue at Fairmount Street and the sign located 130' north of the north curb line of Kenmore Avenue on Fairmount Street; and 2. INSTALL: "NO PARKING ANYTIME" signs on the west side of Fairmount Street between

Kenmore Avenue and Wilton Parkway; and WHEREAS, Service Bureau Lieutenant Mark Shoemaker has received a resident's complaint indicating the safety hazard that has been created for pedestrians, children at play, and residents backing safely out of driveways due to patrons of Sinatra's Restaurant parking vehicles on both sides of Fairmount Street; and WHEREAS, a resident survey was conducted in which 25 out of 28 Fairmount Street residents were in favor of one-sided parking, surpassing the Town requirement of 70% in favor; and NOW, THEREFORE, BE IT RESOLVED, that said public hearing will be held on the 25th day of February, 2019 at 7:00 PM, local time, in Council Chambers of the Municipal Building in the Village of Kenmore, NY, at which time and place the Town Board will meet and hear all persons interested in said amendment as above described; and BE IT FURTHER RESOLVED AND ORDERED, the Town Clerk give notice of said hearing by a publication of a notice in the KEN-TON BEE, a newspaper regularly published and having general circulation in the Town of

Tonawanda, which is designated as the newspaper for this publication, and by posting the same in the manner required by law.

WHEREAS, Daniele Family Companies, has submitted an application for a Minor Subdivision into two lots and approval of Final Plat Plan for property located at 2375 Sheridan Drive; and WHEREAS, based on the criteria contained in §617.7(c) of Part 617 of Title 6 of the NYCRR and a Town Board resolution dated March 28, 2000, this minor subdivision is a Type II activity and therefore

no further SEQR action is required; and

Supervisor Emminger- The Supervisor, Councilman Crangle, Chief Uschold & Captain Waring attended the River Road Volunteer Fire Company Installation where three local firemen received awards; Mike Smith, Chief Thomas Ofenbau and President Kenneth Walker. There was also a celebration for the 100th Anniversary Year for the Kenilworth Fire Department where Josh Strauss received an award. Supervisor Emminger and James Jones attended the American Public Works meeting where the Town of Tonawanda received a merit award for the green infrastructure at Lincoln Park with contractor Louis Del Prince. The State of Town was held last week. In summary, the Town of Tonawanda is strong. Supervisor Emminger commended Thomas Jones and the Highway Department for all of their efforts during the recent snowstorm. Councilman Conrad- Added he recently also attended Elwood Installation where Robert Crane Cross was recognized.

X. Delegations/Public Portion

John Fucile (2742 Colvin Blvd)

Recently moved to Tonawanda and very happy with the Town’s services. However, resident and children and not happy about possible changes to the pool. Supervisor Emminger informed him there are other pools in the town and there is not definitive plans to change the pool at this time.

Bill Schaab (owner of American Demo-N-Disposal)-

Mr. Schaab has come before the Town Board for clarification as to why he cannot occupy or work on the building he purchased to use as an office for his business. His building permit has gone before the Planning Board and will be going before the Zoning Board this month as well. Mr. Schaab is not looking for confrontation; he is compliant to the town’s rules and regulations, he just wants correct the deficiencies and get back to work. Thomas Duncan responded by saying the stop work order was issued, Mr. Hoffman had direct contact with the owner, explaining until the permit is issued, work must stop. Mr. Schaab ripped the stop order off the door and continued to work. Councilwoman Chimera asked if the work order can be expedited and she was informed there is not a process to expedite this.

Thomas Slocum (34 Tiliton)

Resident is here to follow-up with sewer water issue from October 2018. Mr. Slocum expected to hear some type of response from the Town Board since October. Supervisor Emminger and Councilman Bargnesi asked Michael Kessler to approach and explain the slip lining done on Kenmore Avenue. Mr. Kessler informed the Board there is a surge of water coming from that area and the county is looking into this issue.
