I RECOMMEND THE BOARD OF COUNTY COMMISSIONERS (BOARD) ADOPT THE PROPOSED RESOLUTION SUPPORTING THE DEDICATION OF PARK BOULEVARD (S.R. 694 I C.R. 694) BETWEEN GULF BOULEVARD (S.R. 699) AND U.S. 19 (S.R. 55) AS THE C.W. "BILL" YOUNG MEMORIAL HIGHWAY, AND AUTHORIZE THE CLERK TO RECORD THE RESOLUTION IN THE PUBLIC RECORDS OF PINELLAS COUNTY.

Summary Explanation/Background:

The proposed resolution is for the dedication of Park Boulevard from Gulf Boulevard to U.S. Highway 19 as the C.W. "Bill" Young Memorial Highway.

In honor of the late Congressman Young, the Florida Legislature passed Senate Bill 820, attached, calling for this dedication. The Governor signed the bill effective July 1, 2014. Under Florida Law, a resolution of support from the County where the marker is to be placed is required.

Fiscal Impact/Cost/Revenue Summary:

There is no cost to the County. The Florida Department of Transportation is responsible for placement of markers noting the designation.

WHEREAS, the Florida House of Representatives passed a bill designating Park Boulevard from GulfBoulevard to U.S. Highway 19 as the C.W. "Bill" Young Memorial Highway; and

WHEREAS, Section 334.071, Florida Statutes, requires a resolution of support from the county commission before markers may be placed.

NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pinellas County, Florida, duly assembled this __ day of 2015, that it supports the designation of Park Boulevard (S.R. 694 I C.R. 694) from Gulf Boulevard (S.R. 699) to U.S. Highway 19 (S.R. 55) as the C.W. "Bill" Young Memorial Highway; and

BE IT FURTHER RESOLVED that this resolution be made part of the minutes of the proceedings of this Board, and that a certified copy thereof be filed for record in the Office of the Clerk of the Circuit Court of Pinellas County, Florida.

the vehicle, as established in an official used car guide, DHSMV is required to declare the vehicle unrebuildable and issue a COD.

CS/CS/SB 754 revises the bright-line process for applying for a salvaf~e certificate of title or certificate of destruction after a motor vehicle is declared a total loss. Specifically, the bill:

• defines a "late model vehicle" as an automobile 7 years or newer;

• raises the SO-percent COD threshold to 90 percent, and limits its application to late model vehicles with a value of at least $7,500 just prior to sustainin1g the damage resulting in total loss;

• applies a narrative description requiring a certificate of destruction for all other vehicles when the vehicle is damaged, wrecked, or burned to the extent that the only residual value of the vehicle is as a source of parts or scrap metal, or when the vehicle comes into this state under a title or other ownership that indicates that the vehicle is non-repairable, junked, or for parts or dismantling only;

• requires DHSMV to provide a summary report regarding certificates of title for rebuilt vehicles including legislative recommendations to the Governor, Pres;ident of the Senate, and the Speaker of the House of Representatives;

• revises and strengthens current airbag regulations by defining airbag, counterfeit airbag, and nonfunctional airbags;

• prohibits knowingly importing, manufacturing, offering for s;~le, or reinstalling fake or junk-filled airbag compartments; and

• provides additional fake or junk-filled airbag violations.

The bill will allow a greater number of salvage vehicles to be repaired, inspected, and returned to the road. It is expected to have an insignificant positive fiscal impact to both the General Revenue Fund (GR) and the Highway Safety Operating Trust Fund (HSOTF).

Subject to the Governor's veto powers, the effective date of this bill i1s July 1, 2014.

The bill also authorizes a private entity to erect a memorial near the Sunshine Skyway Bridge for the 35 people who died when a ship named the MV Summit Venture collided with the bridge in 1980.

The bill has an estimated negative fiscal impact of approximately $72,000 on the State Transportation Trust Fund, which is the cost to DOT to erect the markers specified in the bill.

CS/HB 863 revises motor vehicle crash report access requirements. Currently, crash reports are confidential and exempt from public record disclosure requirements for a period of 60 days after the date they are filed. However, they are available to various entities, including but not limited to, the parties involved in the crash and their legal and insurance representatives, prosecutors, law enforcement, the Department ofTransportation, and legitimate news media such as radio and television stations licensed by the Federal Communications Commission, qualified newspapers, and free newspapers of general circulation.

A person attempting to access a crash report within the 60-day period is required to:

• present a valid driver license or other photographic identification, proof of status, or identification that demonstrates his or her qualifications to ·~ccess; and

• file a written sworn statement with the state or local agency in possession of the information stating that information from a crash report made confidential and exempt by this section will not be used for any commercial solicitation of accident victims or knowingly disclosed to any third party during the time that information remains confidE!ntial and exempt.

The bill requires a written sworn statement for each individual crash report requested.

The bill does not appear to have a fiscal impact to state or local governments.

Subject to the Governor's veto powers, the effective date of this bill is July 1, 2014.

623 Section 73. The Department of Transportation may permit the

624 erection by a private entity of a suitable marker in the wayside

625 park on the north end of bridge numbers 150215 and

626 150212/Sunshine Skyway Bridge in memory of those who died on May

627 9, 1980, when the MV Summit Venture collided with the bridge.

628 The type of marker and its location are subject to the approval

629 of the department. The private entity is responsible for all

630 costs of the marker and its installation and maintenance. The

631 pri vatE=: __ entity ~_ha~~ -~lso provide an annual renewable bond, an

632 irrevocable letter of credit, or another form of security as

633 approved by the department's comptroller for the purpose of

634 securing the cost of removal of the marker and any modifications

635 made to the site as part of the placement of the marker should

636 the department determine it necessary to remove or relocate the

637 marker.

638 Section 74. This act shall take effect July 1, 2014.
