2. In this Act, unless, the context otherwise requires:~ • . "Principal Act" means the Chhattisgarh Nirashrit<?n · Avam Nirdhan Vyaktiyon Ki Sahayata Adhiiliyam, 1970 (No. 12 ofl970). ·

3. (t} For sub-clause (ii) ofclause(~) ofSection 2 .of the Prindpal Act. the following sub-clause shall be ~ubstituted, namely : ­"Person with disability" suffering from not less than forty percent ~f any dis­. ability as certified by a medical authority .

. (2) After sub-~lause (ii) of clause: (a) of Section2.of thePrinc-.ipal Act, the follow­ing sub-clause shall be inserted, namely.:- .. "(iii) a widow or a divorcee or a woman subjected to cruelty fulfilling such

requirements including that of residence in a local area as may be prescri~;

(iv) Ch~ldren affected by naxal violence."

' (3) . For sub-clause (a-i) (ii) of Section 2, the following sub-clause shall be substi~ tutoo., namely :- · ••members belonging to family. ofbelo~ poverty line as notified by the State' Government from time to time."

' . (6) In clause (d) of Section 2 of the Principal Act. for the words •notified area

com,nittee..or gram 'panchayat or adivasi panchay~t" the· words "notified ~ committee or gram panchayat" .shall be subs.tituted.

(I) After clause (g) of Section 2 of t;he Principal Aci the following (h) and (i) . clauses.shall be added, namely:...:.. ' ."(h) . "State Destitute Fund" m~s the Fund·constituted ·under section 4. . . . . ·. . .

(i) "Cruelty" means­(a) any ~ilful cond\Jct which is of such a nature as is likely to

drive the woman to commit suicide or to cau.se grave injury . or danger to life, limb or .heal~ (whee.her mental or' phys.i-. cal) of the woman, or

(b) harassment of woman-where sµch ~arassmem is with a view to coercing her or any per:son related her to meet any unlaw­ful demand for any property or v~hiahle securily or is on account of failure by her or any person· related to her to meet such demand .." . · ·

4. (I ) . In section 3 of the Principal Act, for the words '"make adequate provision" the words "im,plemen.t scheme and lo provide adequate relief' shall b'e substituted.

..(24 AA) AIi moneys of the State Destitute Fund shall be; deposited in a co-operative bank or any Bank .specified in the first Schedule to the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (No: 5 of 1970), as a cotre.~ponding new bank or in post office sa:vit1g bank.

· (2-A~) The amount remaining after apportionm~nt uncier sub-section (2) ar:td (2-A) shall be utilised for the,purpose of setting up and maintaining homes·for d.estitutes and'indigent persons in the area falling within the jurisdiction of the mar.ket COIJ)mittee concerned: t
