1.0 PREAMBLE

BACKGROUND

NHAI under took the development of Access Control Highway from Km 10.00 to Km

29.50 of Bangalore – Nelamangala Section of NH-4, in the State of Karnataka on Build,

Operate and Transfer (BOT) basis through a Concessionaire under NHDP Phase III

Program of development. NHAI awarded the works to the Concessionaire, M/s

Navayuga Bengalooru Tollway Pvt Limited in May 2007 with a concession period of 20

years.

The works consists of construction of a stretch length of 19.5 km. as access Control

Highway. Out of this a length of 4.5 kms from Km.10.00 to Km.14.50 is a 4-lane elevated

highway and 15 kms of length from Km.14.50 to Km.29.50 is 6-lanes Access Control

Stretch at ground level.

Aarvee - Bonifica JV was appointed by NHAI as Independent Consultant (IC) to supervise

the development of Access controlled highway and maintenance of existing highway

during construction stage. The project highway along with the facilities except as per

details given below ITEM – 4 (Completion Certificate of the Project Highway) was

completed by the Concessionaire on 10th

December 2010 and accordingly the IC issued

the Provisional completion certificate on 12th

December 2010 along with the punch list in

compliance with the provision of the Concession Agreement (CA).

The Project Highway from Km.10.00 to Km.29.50 of Bangalore-Nelamangala section of

NH4 has been under Commercial operations since 10th

December 2010 and the IC (M/s

Aarvee –Bonifica JV) has been monitoring the completion of the works and the operation

and maintenance (O&M) activities up till 31 December 2011.

Pursuant to the provision in the Concessionaire Agreement, NHAI appointed M/s Unihorn

India Pvt Ltd, as Independent Consultant w.e.f April 2012 to October 2015 to monitor the

O&M activities after the completion of the services of M/s Aarvee-Bonifica JV on 31

December 2011.

Now, NHAI has appointed M/s Consulting Engineers Group Ltd. as Independent

Engineers to monitoring the O&M activities of the project Highway with its

commencement of services w.e.f from 19 October 2015.

1.1 Monitoring and Supervision during Operation & Maintenance of the Project

Highway.

In accordance to the various requirement of the Clause 19.2, IC during his monthly

inspection report has pointed out defects and deficiencies for immediate rectification by

the Concessionaire on the Project Highway in the O&M period. The Concessionaire has

started to carryout some of the rectification works and is yet to submit para wise

compliance.

1.2 Operation of Toll Plazas

At present the six lanes provided for collection of toll fees from vehicles in Toll Plaza at

Km.14.825 and at Km.26.050. On many occasions, there are long queue more than the

permissible of 5 vehicles (5 vehicles/lane max. to be allowed as per the Agreement). It is found that the present six lanes found not sufficient at present may leads to serious

problems in managing the traffic at Toll plazas.

The concessionaire has been reminded to conduct the traffic survey.

2. Completion Certificate of the Project Highway

2.1 The Concessionaire has completed the works included in the punch list except the

following:

i. Shoulders on Service Roads

All works on service roads and earthen shoulder have been completed except a length

of 1.5Km, where land is not available for shoulder works. Details are provided in

Table 1 (chapter-3).

ii. Outer drain along ROW

The drain along ROW on both side of Project Highway has been completed except the

stretches where additional land required has not been made available by NHAI so far.

The total length remains to be constructed is 4.727 km. out of 30.660Km. The details

are provided in Table 1 (chapter-3).

iii. Head walls of Culverts The head walls of some of the culverts could not be completed due to dispute in the

ownership of the land and resistance of the people. The details of such culverts are in

Table 2 (chapter-3).

iv. Truck Lay Bye

The Truck lay-Bye with all the facilities could not be constructed for want of land

acquisition by NHAI.

PD/PIU-NHAI requested the details regarding land acquisition/possession certificate of

the above land for which concessionaire could not take up the work. The issue was

discussed in PD/PIU- NHAI office in detail with SLAO, concessionaire and IE to get the

above details. It was decide in the meeting to have a site inspection along with SLAO,

concessionaire and IE to have clarity on the issue. The verification of land acquisition /

possession was verified at site. The issue is yet to be resolved.

2.2 Deviation in Proposed Project Facilities:

The than IC M/s Unihorn India has observed during the inspection that some changes

from the Proposed Project Facilities provided in the Schedule ‘C’ of the Concession

Agreement have been made during the execution at site in the provision of Lay-Bye at

Elevated section of the Project Highway. The Concessionaire has intimated through his

letter of 23rd

August 2012 that Lay Bye has been provided at location as per the scope,

whereas IC has observed that the Concessionaire has not provided the length of Lay Bye

as per scope of the Concession Agreement and accordingly the PIU NHAI and the

Concessionaire has been informed by IC’s letter of 10th

September 2012.

3. CHANGE OF SCOPE OF WORKS

Detailed Status of Change of Scope of work orders issued by NHAI is given in tables

attached in Chapter-4.

3.1 Proposed VUP in front of BIEC Bangalore - Nelamangala Section of NH-4

from Km.10+000 to Km.29+500.from Km.10+000 to Km.29+500.

Government of Karnataka proposed the requirement of Vehicle Under pass near BIEC,

and the same was intimated by the NHAI for submission of detailed proposal of 2X12

Mtrs VUP in front of BIEC. Secretary, PWD, Government of Karnataka finalized the

proposal or Rs: 11.95 crores with the cost sharing basis, in that 50% of the share borne by

the Government of Karnataka and the other 50% has to be borne by the NHAI.

Concessionaire has been submitted their final cost estimate amounting to

Rs.15,70,88,405/-. IC (M/s Consulting Engineers Group) checked, scrutinized and review

of the proposal based on design incorporations, drawings and SOR of NH-2014/15, the

total re-revised cost of the 'COS' proposal works out to Rs.15,63,51,198/-. The GOK has

deposited an amount of Rs: 5.975 Cr out of Rs:7,81,75,799/- and persuasion is being done

for the deposition of balance amount of Rs: 1,84,25,520/- for the COS proposal for

construction of VUP.

NHAI RO has issued a COS notice vide their letter no: NHAI/RO-

BNG/11018/13/2016/1436, dt: 15.07.2016 with a final cost of Rs: 15,63,51,198/-.

Concessionaire has commenced the widening of Service Road (BHS) on 31 September

2016 in lieu of Construction of VUP at BIEC.

The CGM(T)-RO and PD-PIU Bangalore asked for re submission of final detailed re-

revised cost estimation vide their letter no: NHAI/RO-BNG/11018/13/2016/4063

Dt:09.03.2017, accordingly the concessionaire submitted the re-revised cost estimate vide

letter no: NBTPL/O&M/CEG/2016-17/288 Dt:22.03.2017.

The re-revised final detailed cost estimation scrutinized and finalized The Total construction cost of Rs: 26,59,52,271/-. The component wise breakup as follows and

submitted the same vide our letter no: CEG/BNG-NEL/NH-4/O&M/2016-17/379 Dt:

22.03.2017.

PD-PIU Bangalore instructed to start the construction of VUP without further delay through their letter no: NHAI160125/01/15-16/PIU-BNG/158 DT: 22.04.2017.

3.2 Construction 4 Nos of additional FOB

Based on directions of NHAI PIU, the Concessionaire transmitted the estimate for

construction of the 4 additional FOBs, along with their justification. IC (M/s Unihorn

India) has examined the estimate and the same has been transmitted to PD NHAI PIU

Bangalore on 25th

September 2012.

3.0 SUMMARY OF CURRENT MONTH MAINTENANCE:

a) Periodic Renewal work is in progress which is going to complete by the end of September

2017 as per Concessionaire’s programme.

b) As a part of Periodic Renewal work Milling of road surface is completed.

c) As per the discussion held with NHAI PD Milling material to be used for Service road

shoulders rectification by blending gravel in 60:40 ratios.

d) Shoulder rectifications works has been started in some locations where they have dumped the

blended milling material and just graded and not rolled which was highlighted to rectify as

per the NHAI norms, concessionaire agrees to do the same.

3.1 STATUS OF CHANGE OF SCOPE OF WORKS:

3.1.1 Proposed Construction of VUP in front of BIEC at Km. 17.200

a) BC laying at LHS from Km.17.080 to Km.17.261 & Km 17.280 to Km 17.540 and RHS

Km.17.500 to Km.17.235 is completed.

b) BC laying on Extension of Box Culvert @ Km.17.400 is completed.

c) Dismantling of New jersey concrete Crash Barrier on RHS side from Km16+939 to

Km16+979 & Km17+470 to Km17+560.

3.1.2 Installation of WIMS at all Toll plaza & SWB at TP-1 (K.14.825) & TP-6 (Km.26.050)

a) At TP-1 installation of WIM’S on all available eight lanes had been completed.

b) At TP-6 installation of WIMS on all available seven lanes had been completed.

c) At TP-1 & TP-6 Static Weigh Bridge platform had been installed ramp work along with

control room is completed.

4.1 Construction of 8 No FOBs:

All the 8 FOBs have been completed by the Concessionaire and the detailed estimate

received from the Concessionaire has been submitted to NHAI.

4.2. Construction 4 No additional FOB:

Based on the directions of NHAI PIU, the Concessionaire submitted the estimate for

construction of the 4 additional FOBs, along with their justification .The than IC M/s Unihorn

India had examined the estimate and the same was submitted to PD NHAI PIU Bangalore on

25th

September 2012.

The CGM(T)-RO and PD-PIU Bangalore asked for re submission of final detailed re-revised

cost estimation vide their RO letter no: NHAI/RO-BNG/11018/12/2015/2655 Dt:09.11.2015,

and PIU letter no: NHAI/160125/01/15-16/PIU-BNG/3443 Dt:15.12.2015 accordingly the

concessionaire has been submitted the re-revised cost estimate for each FOB vide letter nos:

1)1235/RO/COS/CEG/14 Dt:20.07.2017. 2) 1235/RO/COS/CEG/15 Dt:20.07.2017

3) 1235/RO/COS/CEG/16 Dt:20.07.2017. 4) 1235/RO/COS/CEG/17 Dt:20.07.2017

The re-revised final detailed cost estimation for FOBs scrutinized and finalized that the total

construction cost of 4 additional FOBs with a sum of Rs: 3,96,00,000/- (for each FOB

costing of Rs: .99,00,000/-) and submitted the same vide our letter nos as follows:

10) The Total construction cost of Rs: 26,59,52,271/-.

PD-PIU Bangalore instructed to start the construction of VUP without further delay through

their letter no: NHAI160125/01/15-16/PIU-BNG/158 Dt: 22.04.2017.

4.4 Merging of service:

Merging of service road at Km. 29.500 issue has been pending with NHAI.

5.0 SAFETY MANAGEMENT AT SITE

It is of paramount importance to ensure safety issues are tackled by the Concessionaire as

per the requirement of agreement in Schedule ’L’ and ‘S’. IC is supervising/monitoring the

activities regularly.

5.1 TRAFFIC MANAGEMENT

There are 2 VMS on each side of main carriageway and 3 CCTV. ECB are not functioning

as most of them are damaged. CCTV system does not cover the entire area and in absence

of electricity power break down, no back up is available at all locations.

5.3 WORK SITE SAFETY MANAGEMENT-MARKING AND RATING SCALE

(AUGUST-2017)

Road marking has worn out/faded in most of the service road section and also on main

carriage way. Proper road marking is essential for safe travel especially at night times.

The Concessionaire is required to comply with safety requirement while taking up construction and periodical works as per Schedule ‘L’ & ‘S’ of the Agreement.

The Concessionaire has taken up the excavation works for widening of Service Road on Both Sides for proposed VUP at Km.17+220 near BIEC. There are no incidents

found during this period.

7.0 IC-INSPECTION REPORT:

The concessionaire has to ensure that at all times during the operations Period, the

Project Highway is maintained in a manner that it complies with the Specifications and

Standards and the minimum maintenance requirements set forth in Clause 18, Schedule

‘L’ & Schedule ‘S’ of the concession Agreement. Accordingly the inspection report by

IC is based upon the requirements under the provisions of the Agreement. The status of

construction works under Change of scope has been provided in section 4 of this

report.

7.1 MONITORING O&M ACTIVITIES ON THE PROJECT HIGHWAY:

In accordance to the requirement of the Clause 19.2, IC during his monthly inspection

report has pointed out defects and deficiencies for remedy by the Concessionaire on the

Project Highway in the O&M period. The Concessionaire has not started to carryout

rectification works and is yet to submit para wise compliance except routine cleaning

work.

7.1.1 MAINTENANCE:

The details of the deficiencies and defects noticed on the Project Highway during

inspection in the month of August - 2017 are as under:

7.1.1.1 Main Carriageway (Elevated Corridor) Section Km 10.000 - Km 14.500:

Works under routine Maintenance:

i. Expansion Joints: Cleaning of Expansion Joints is now Moderately satisfactory.

Regular monitoring is being done and the concessionaire has been instructed to deploy

more number of labours to clean periodically.

ii. General Cleaning: It is Moderately satisfactory, the concessionaire has been

instructed to deploy more number of labours for regular cleaning.

iii. Painting on kerb: The kerb painting is faded in most of the locations and the same

was instructed to the concessionaire to re-paint.

iv. Median Planatation: The Concessionaire has been instructed to replace the dead trees

with new plant and to maintain the planted tress properly. The work is under progress.

v. Drainage spouts: The Concessionaire has been instructed to clean drainage spouts and

clear the blockages in pipe for the free flow of rain water as early monsoon is expected.

Work under progress.

7.1.1.2 Main Carriageway at Ground Level from Km 10.000-Km 29.500 (LHS & RHS)

excluding elevated corrider:

Shoulder rectification: The concessionaire has been instructed to use Blending of

milling metrial with gravel in 50-50 proportion for shoulder rectification. But the

concessionaire using only gravel material and for which Site instruction issued.

7.1.1.3 Road at Ground level of Main Carriageway Km 10.000–Km 29.500 (LHS):

i. General cleaning: It is Moderately satisfactory, now the concessionaire to be

instructed to deploy more number of labours for regular cleaning.

ii. Drain pipes : It is Moderately satisfactory, now the concessionaire to be instructed to

deploy more number of labours for regular cleaning.

iii. Painting on kerb: The kerb painting work is taken up and completed at all the

Periodical Renewal works completed locations. And also instructed to the

concessionaire to paint simuntaniously after completion of Periodical Renewal works.

iv. Median Planatation: The Concessionaire has been instructed to replace the dead trees

with new plant and to maintain the planted tress properly. And also instructed to fill the

gaps in the median with newly plants, which is under progress.

v. Avenue Plantation: The Concessionaire has been instructed to plant missing plants

along with treeguards at ROW to maintain minimum number of avenue plantation as

per PCOD time from km.14+500 to km.29+500.

vi. Ornamental rails: The Concessionaire has been completed the painting of the

ornamental rails, and also instructed to re-paint when found faded.

7.1.1.4 Road at Ground level of Main Carriageway Km 10.000 –Km 29.500 (RHS):

i. General cleaning: It is Moderately satisfactory, now the concessionaire to be

instructed to deploy more number of labours for regular cleaning.

ii. Service road cleaning on RHS and damaged Guard rail replacement due to Metro work

(BMRCL) has been taken up and completed.

iii. Painting on kerb: The kerb painting work is taken up and completed at all the PR

works completed locations. And also instructed to the concessionaire to paint

simuntaniously after completion of PR work.

iv. Median Planatation: The Concessionaire has been instructed to replace the dead trees

with new plant and to maintain the planted tress properly. And also instructed to fill the

gaps in the median with newly plants.

7.1.1.5 Service Road from Km 10.000 –Km 29.500 (LHS & RHS):

Painting on Speed Breakers: The Speed Breaker painting work is taken up and it is

under progress at all the PR works completed locations. And also instructed to the

concessionaire to paint simuntaniously after completion of PR work

7.1.1.6 Service Road from Km 10.000 –Km 29.500 (LHS):

General cleaning: It is Moderately unsatisfactory, now the concessionaire to be

instructed to deploy more number of labours for regular cleaning of culverts and line

drains in the stretch.

The Concessionaire has been instructed to taken up and completed the Pavement

marking as soon as possible and also instructed to re-paint when found faded.

The Road marking and speed breaker marking work was takn up in the month of

March and it was completed in the month of April.

7.1.1.7 Service Road from Km 10.0 –Km 29.5 (RHS):

General cleaning: It is Moderately unsatisfactory, now the concessionaire to be

instructed to deploy more number of labours for regular cleaning of culverts and line

drains in the stretch.

The Concessionaire has been instructed to taken up the Pavement marking on Service

Road and to complete as soon as possible and also instructed to re-paint when found

faded.

The Road marking and speed breaker marking work was takn up in the month of

March and it was completed in the month of April.

7.1.1.8 Flyover and Vehicular/Pedestrian under Passes:

(a) Flyover:

Expansion Joints: Cleaning of Expansion Joints is now Moderately satisfactory.

Regular monitoring is being done and the concessionaire has been instructed to clean

periodically.

Drainage spouts & pipes: The Concessionaire has been instructed to clean spouts and

clear the blockages in pipe for the free flow of rain water for early monsoon expecting.

Work under progress.

(b) Vehicular Under Passes:

Expansion Joints: Cleaning of Expansion Joints is now Moderately Satisfactory.

Regular monitoring is being done and the concessionaire has been instructed to clean

periodically.

Drainage spouts & pipes: The Concessionaire has been instructed to clean spouts and

clear the blockages in pipe for the free flow of rain water.

(c) Pedestrian Under Passes (PUP):

The PUP provided on the approaches to Fly over and Vehicular passes are cleaning

Moderately Satisfactory.

7.1.1.9 Minor Bridges & Culverts:

No defects noticed during the Inspection.

7.2 Routine maintenance:

Routine Maintenance has been planned in 2016-2017 on the following items: 1.General

Cleaning of Road, 2.Maintaining of Safety signs, 3.Cleaning of vegitaiton, 4.Cleaning

of Drains, 5.Plantation Maintenance, 6.Lighting Maintenance, 7.Road Marking and

8.Improveing Toll Maintenance.

7.3 Pick-up bus stops and shelters:

The Concessionaire has been instructed to clean the Pick-up bus stops and shelters

regularly.

7.4 Base camp facilities:

7.4.1 Following facilities have been provided (outsourced):

(a) Welding Shop

(b) Washing shed and Tyre Repair Shop.

(c) Paint and Sign Shop

(d) Equipment has now been provided in the Laboratory at base Camp in Km 26+000.

7.5 Highway Traffic Management System (HTMS):

There are 2 VMS on each side of main carriageway and 3 CCTVs. CCTV system does

not cover the entire area, and observed during the site inspection and found that All the

3 CCTVs and ATCC, MET were not working. ECB are not functioning as most of

them are damaged, and in absence of electricity power break down, no back up is

available at all locations. The system of ECB needs to be set in order without delay.

The Concessionaire has submitted the alternate proposal of providing help line number

in lieu of the ECB, which was forwarded to NHAI and NHAI has not agreed for the

proposal.

7.6 Operation of Toll plazas:

At present the six lanes provided for collection of toll fees from vehicles are not

sufficient at Toll Plaza at Km 14.825 and at Km 26.050. On many occasions, there are

long queue more than the permissible of 5 vehicles (5 vehicles/lane max. allowed in

the Agreement). The Concessionaire to conduct traffic survey for the purpose of

determination and verification of the actual traffic on the Project Highway.

7.7 Corridor Control for preventing Encroachments, unauthorized parking and

construction of entrance connection on Project highway:

It has been observed that unauthorized posters, bills and other advertisement signs are

being installed/erected on the project Highway. The Concessionaire is required to

ensure that no unauthorized sticking/erecting of posters/bills are allowed with in the

ROW of the Project Highway.

7.8 Highway Lighting:

The luminance provided in stretch from Km 10.000 to Km 29.500 is Moderately

satisfactory. Concessionaire has been instructed to rectify light points to match with

the requirements.

7.9 Arboriculture & Landscaping:

Avenue plantation provided along the ROW on both side of the Project Highway has

been damaged in about 20% area, of course mostly due to the parking by Trucks.

However there are stretches available along the Highway, where parking problem is not

there, especially near the Bye pass at Nelamangala and at underpasses more plantation

should be provided in lieu of the damaged plants in other areas.

7.10 Building Maintenance including other facilities:

Concessionaire has not taken up the annual maintenance of toll plazas and all buildings

of other facilities provided by the Concessionaire under the scope of works (Schedule

‘C’). These are required to be taken up without further delay.

7. 11 Redressal of Public Grievances:

The Concessionaire has instructed to maintain complaint register for the public

grievances redressal at both the main Toll Plazas at Km 14.800 and Km 26.000. The

Complaint register must be contain with their names, address and telephone numbers.

7.12 Over Lay Due:

The Concessionaire have been started the trail patch of BT from Km25+950 to Km

25+840 RHS S/R near to Base camp from Source-1. Periodical renewal laying work

have been started on 15th

April 2016, cumulative periodical renewal of laying is done

up to end of July 2017, as follows:

1) 15.00 Km RHS Service road completed in the month of March 2017.

2) 15.00 Km RHS Main Carriageway completed, in the month of August-2017.

3) 9.00 Kms (4.500 kms LHS and 4.500 kms RHS) Main Carriageway below

Elevated Highway completed, in the month of September 2016.

4) 4.50 kms LHS Service road Below Elevated Highway completed in February-2017.

5) 1.33kms RHS Service road Below Elevated Highway up to end of August-2017.

6) 15.00 kms Service Road on LHS up to end of March-2017.

7) 15.00 kms MCW-LHS up end of July-2017.

8) Elevated Highway:- 4.350 Km RHS & LHS completed in month of August-2017.

DBM: 11.00 Kms MCW on LHS, 11.00 Kms MCW on RHS completed in the month

of August-2017.

Against total quantity of 87 Kms (includes Elevated Highway, Both MCW and Both

SR) concessionaire completed 83.53 Kms up to the end of August-2017.

8.0 DEFICIENCIES & ACTION TAKEN:

In accordance to the requirement of the Clause 19.2, IC during his monthly inspection

9. RECOMMENDATIONS

Following actions by the Concessionaire are recommended for better maintenance of highway:

Round the clock attention to traffic management issues.

Round the clock attention to safety management to create safe environment.

Round the clock attention to carriageway maintenance issues.

Round the clock attention to Corridor control to ensure prevention of encroachments.

Senior management should inspect the highway at regular interval to ensure his team is performing the duties as per scope of the Maintenance Manual and Concession

Agreement.

The Concessionaire has instructed to conduct traffic survey for the purpose of determination and verification of the actual traffic on the Project Highway.

The Concessionaire has instructed to maintain complaint register for the public

grievances redressal at the main Toll Plazas at Km 14+800 and Km 26+000. The

Complaint register must be containing with their names, address and telephone.

The Concessionaire has instructed to mobilize sufficient qualified technical staff to rectify the Operation and maintenance issues.
