DAMAGES — LOSS OF CONSORTIUM(In Claims Arising on or After September 27, 1987,

and Subject to ORS 18.560)

If you find the plaintiff is entitled to damages, you will nextconsider the amount of damages, if any, sustained by the [plaintiffspouse's name/defendant spouse's name] as a result of the [fault/negligence] of the [plaintifi/defendant].

In considering the amount of such damage, you must determine thesum that will reasonably compensate [him/her] for any loss of spousalservices, society, and companionship that [he/shel has sustained land thatit is reasonably probable Oie/shel will sustain in the future! as a result ofthe injury.

The law does not furnish you with any fixed standard by which tomeasure the exact amount of noneconomic damages to which a person isentitled for loss of consortium. The law does require the compensationallowed be reasonable. You must apply your own considered judgmentto determine the amount thereof.

[With respect to the matter of economic damages for loss of spousalservices, you shall determine the reasonable value of services that havebeen lost (and of any such future services).l

Comment: It is unclear whether all damages in a consortium claim are"noneconomic" under ORS 18.560(2) (and subject to the cap) or whether some are"economic" damages (not subject to the cap). Noneconomic damages are defined inthat stamte as "subjective, nonmonetaiy losses, including . . . loss of care, comfort,companionship and society, loss of consortium." The statute defines economicdamages as "objectively verifiable monetary losses including . . . reasonable andnecessary expenses incurred for substitute domestic services." Pending appellatedetermination, it is unclear whether the loss of spousal services, if shown to be anobjectively verifiable monetary loss, would be economic damages under the statute.But see Schmitz v. Yant, 242 Or 308, 319, 409 P2d 346 (1965).

If the court determines that the only damages recoverable are noneconomic, thebracketed paragraph should not be given.
