Terms and ConditionsIntroduction

The Lead India Foundation Students' Association (IDEAL INDIAN CLUB) membership programme is governed by the following terms and conditions.If there is any conflict between what is set out in this information and anything a student and/or member has been told by IDEAL INDIAN CLUB staff orits personnel, the terms of this information shall prevail.Every student member is responsible for remaining aware of these Terms and Conditions. Everyeffort has been made to ensure the information provided to student members in relation to the IDEAL INDIAN CLUB membership programme is correct.These Terms and Conditions are effective as at 1 January 2014 and IDEAL INDIAN CLUB reserves the right to amend the Terms and Conditions of themembership programme from time to time. The IDEAL INDIAN CLUB shall use all reasonable endeavours to advise student members of any suchchanges, but shall not be liable in any way for any failure to do so.

DefinitionsIDEAL INDIAN CLUB: means the Lead India Foundation initiated Ideal Indian ClubMember: means a student who has opted to join and is a current memberMember Only: means any of the specific facilities, services, arrangements or discounts offered oravailable to the student member during the period of membership

Goods: means all goods provided by the IDEAL INDIAN CLUB

Services: means all services provided by the IDEAL INDIAN CLUB

Terms and Conditions: means these Terms and Conditions as amended from time to time

Membership Card: means the IDEAL INDIAN CLUB Membership Card

1. Use of your IDEAL INDIAN CLUB Membership Card1.1 The IDEAL INDIAN CLUB Membership Card is required to be presented by the student member to access all or any “member only” services ordepartments of the IDEAL INDIAN CLUB as part of the membership benefit package.1.2 It is the sole responsibility of the student member to ensure they have their IDEAL INDIAN CLUB Membership Card at all times in order to access“member only” services and/or benefits. IDEAL INDIAN CLUB membership is valid only for the member and is not transferable under any circumstances.1.3 IDEAL INDIAN CLUB membership is valid for one year or as otherwise indicated by IDEAL INDIAN CLUB.1.4 The IDEAL INDIAN CLUB reserves the right to require the student member to produce their IDEAL INDIAN CLUB Membership Card at any timewhile utilising “member only” services or benefits.1.5 In the event of loss or theft of a IDEAL INDIAN CLUB Membership Card it is the responsibility of the member to inform the IDEAL INDIAN CLUB in writing.1.6 The IDEAL INDIAN CLUB will not be liable for misuse of a lost or stolen IDEAL INDIAN CLUB Membership Card.1.7 In the case of misused, lost or stolen IDEAL INDIAN CLUB Membership Card a replacement card fee of INR 150 will be charged by the IDEAL INDIAN CLUB.1.8 The replacement card fee will be waived upon request under the following circumstances:· Stolen card: police report or reference number required· Faulty card: Card has an inoperable barcode1.9 The member shall be responsible for advising the IDEAL INDIAN CLUB of any change of name or email address.1.10 By accepting the IDEAL INDIAN CLUB Membership Card the member agrees to be bound by these terms and conditions. 2. General2.1 This agreement is personal to the member which shall not assign its rights or delegate its performance hereunder. 3. Cancellation3.1 Please note that members can choose to cancel their membership. If the student member requests a cancellation of their membership they must notifyIDEAL INDIAN CLUB in writing.4. Alteration of Membership Offer4.1 The IDEAL INDIAN CLUB reserves the right in its absolute discretion to withdraw, cancel, deny access to or in any way change any of the memberbenefits advertised or offered at any time and the IDEAL INDIAN CLUB will not be liable for any loss or damage suffered by the member resulting from suchwithdrawal, cancellation or change.4.2 The IDEAL INDIAN CLUB reserves the right to suspend or terminate a student member's membership for violation of its rules and regulations or forconduct deemed detrimental to the welfare of students and/or the IDEAL INDIAN CLUB.4.3 The IDEAL INDIAN CLUB will only use the information provided to it from the student member in accordance with the Privacy Act 1993.4.4 In the discharge of its duties the IDEAL INDIAN CLUB shall comply with all reasonable resolutions, regulations and directions that may lawfully be madefrom time to time as to the nature and scope of the service to be provided. Nothing in the above clause shall effect the IDEAL INDIAN CLUB's right toexercise its own judgment and to utilise its skills as it considers appropriate in order to achieve compliance with the said resolutions, regulations anddirections or otherwise with its obligations under this agreement.4.5 All disputes relating to or arising out of this agreement:· Shall be governed by the law and policies of Lead India Foundation Students' Association and/or Lead India Foundation· Shall be resolved in the New Zealand court with the appropriate jurisdiction5. Privacy Policy 5.1 IDEAL INDIAN CLUB is bound by the principles as set out in the Privacy Act 1993.6. Collection of Personal Information6.1 IDEAL INDIAN CLUB collects personal information about students wishing to become members of the Students' Association.6.2 This information consists of name, contact details including, but not limited to: full name, address, email address, telephone number, student ID number,enrolment status and faculty.6.3 IDEAL INDIAN CLUB collects this information directly from the individuals concerned. IDEAL INDIAN CLUB endeavours to ensure that the personalinformation it holds is accurate, complete and up-to-date. It relies therefore on the individuals concerned to assist the Students' Association in maintainingthe accuracy of these records.6.4 However, should the Student Union, in an attempt to contact a member within the normal course of business, find that the member has changed contactdetails including email address, address and phone number without informing the IDEAL INDIAN CLUB, other sources for locating the member's new contactdetails may be investigated: eg. Lead India Foundation.6.5 IDEAL INDIAN CLUB staff may request that a member intending on using the “member only” services provided by IDEAL INDIAN CLUB produce theirstudent ID card. Should a member be unable to do so IDEAL INDIAN CLUB staff may request to see other documentation (such as driver's licence or passport)for the purposes of membership identification. 7. Purpose of the Information Collected7.1 IDEAL INDIAN CLUB uses the personal information it collects from student members for the primary purpose of enabling those members to participate inany or all of the services IDEAL INDIAN CLUB offers. IDEAL INDIAN CLUB generally uses personal information to manage and enhance its services and tocommunicate with its members.7.2 In the event you are required to provide member proof, this request for information is to ascertain whether a person has a right to use the “member only”IDEAL INDIAN CLUB services and facilities and/or, in the case of suspected or demonstrated breach of IDEAL INDIAN CLUB rules, the Foundation Statutes,or the Law, in order to refer the situation to the relevant authority.8. Consequences of Not Providing Information8.1 A student member has the right of not providing IDEAL INDIAN CLUB with any personal information. The consequence of not providing this information,as specified above, is that IDEAL INDIAN CLUB will not be able to provide all “member only” services in all circumstances to that member.8.2 A student member has the right to have their personal information deleted from IDEAL INDIAN CLUB's records. With this deletion the member forfeits heror his rights to utilise IDEAL INDIAN CLUB “member only” services.9. Protection of Data9.1 IDEAL INDIAN CLUB undertakes to protect the personal information it holds from misuse, loss, unauthorised access, modification or disclosure by variousmeans including password access and secure servers. IDEAL INDIAN CLUB will grant access only to those staff that requires personal membership informationas part of their job requirement. 10. Sharing of Data10.1 IDEAL INDIAN CLUB does not disclose the personal information it holds to third parties.10.2 As specified above, IDEAL INDIAN CLUB may seek to maintain the accuracy of its records by requesting a student member's personal information fromLead India Foundation.11. Disposal of Data11.1 At the beginning of each academic year, IDEAL INDIAN CLUB purges its current student membership database.12. Access12.1 A student member has the right to access, examine and correct any information IDEAL INDIAN CLUB holds on him/her.13. Complaints13.1 If a member is unhappy with this Policy or IDEAL INDIAN CLUB's practice/s in regard to his/her personal information, all enquiries or comments shouldbe directed to the Communications Coordinator.
