sale and before the sheep are removed from the premises unless arrangements and approvalhave been made with the Sale Manager prior to the sale. The auctioneer’s decision is finalon any disputed bids. All animals are at purchaser’s risk as soon as sold. Sheep purchasedon order must be paid within five (5) days of the sale. A 10% handling fee will be added to allmail bids not paid within five days of the sale. A 20% surcharge will be assessed to any insuf-ficient funds check issues. Buyer shall be responsible for any and all costs of collection,including attorney’s fees. Institutions may pay by requisition. Foreign buyers must pay inU.S. funds. Registration papers will not be transferred to the new owner until paid in full.
REGISTRATION & HEALTH: All animals are registered. Health papers will be handedout sale day to the new owner upon complete payment of the sheep. Transfer of registrationpapers will be handled by Banner Sale Management Service after the sale.
ENTRY SUBSTITUTIONS: A bar beneath the number painted on the animal’s back des-ignates that it is a substitute entry, meaning the information about the animal is different thandesignated in the catalog. Check with the consignor for complete pedigree information.

1 – Every ewe sold will be guaranteed as a breeder if properly handled. It shall be theresponsibility of the buyer to return a non-breeder to the seller in acceptable breeding con-dition. The seller, after a fair trial and the animal is found to be a non-breeder, shall have theprivilege of replacing the ewe with one of equal value to the satisfaction of the seller, orrefunding the purchase price. This guarantee shall not apply to any sheep that are shownsubsequent to the date of the sale.
2 – Ewes sold as bred ewes that are not in fact bred, shall be adjusted by one of the threefollowing seller’s options:
a. replace the original ewe with another bred ewe or with a ewe with lamb(s) at side tothe satisfaction of the buyer, or
b. the buyer to keep the original ewe with the seller to provide a compensatory lamb orlambs to the satisfaction of the buyer, or
c. the seller to refund a compensatory 20 percent of the original purchase price for thelack of lamb crop.
3 – This guarantee shall constitute a contract between the buyer and the seller only, andno other parties assume any liability, legal or otherwise, expressed of implied.
4 – Neither the Sale managers nor sponsoring organizations can or will assume anyresponsibility as to the authenticity of the pedigrees, bloodlines, or information provided inthe sale catalog, pen cards or otherwise, and the subsequent genetic performance of anysheep purchased. All such information must be accepted at face value. Any statements orinformation given sale day supersedes cataloged information. Any special guarantees orclaims offered by individual consignors is strictly between the consignor and the buyer, andwill not be enforced by the Sale managers or the sponsoring organization.
