The Indo-Naga politicalnegotiation has beensuccessfully concluded onthe 31st of October 2019 atDelhi. The Government,however, could not announcethe outcome of it. But thebiggest surpr ise was theyannounced that the f inalsettlement of the Naga issuewould only be arrived at afterconsulting with ArunachalPradesh, Assam and Manipurand also after consulting withstakeholders.Therefore, when Governor RNRavi delivered his maidenAddress to the 13th NagalandLegislative Assembly onJanuary 17, 2020, we expectedthat some f ine-tunedmodalities would behighlighted in the Address forresolving the protracted Indo-Naga political issue.Surprisingly, the Address hasnot laid out any progress ofthe status of consultation withArunachal Pradesh, Assamand Manipur or stakeholders.I t has been nearly threemonths since the conclusion

Butthey are still kept in suspense.However, if one carefullyexamines Governor Ravi’sremark in his Address, an earlysettlement to the Naga issuewould depend on the unity ofall the various organizations.Then the veiled warning hascome, “If we fail this time, then
we will be missing a goldenopportunity.”Will the Indo-Naga issueremain unresolved or will theAutonomous Councils begranted to the Nagas ofArunachal Pradesh andManipur and then what will bethe arrangement for the Nagasof Assam? What will theGovernment do with thedemand of ENPO with regardto a separate frontier NagalandState or instead grant them an
Autonomous Council? Willthere be an increase of a LokSabha Seat in Nagalandmaking a total of two or will aBi-cameral system be given tothe State? News has beenappearing in mass media eversince the Indo-Naga politicalnegotiation was over that theGovernment would be workingout to grant theaforementioned demands aspart of resolving the Nagaissue.

None of the telecomcompanies paid the adjustedgross revenue (AGR) asdirected by the SupremeCourt, even as deadline tomake payment of pendingdues of Rs.1.47-lakh crore byover 15 companies expired onThursday. “ Bharti Airtel”, “ VodafoneIdea” and “Teleservices” havefiled modification pleas in thecourt seeking negotiationsand fixation of schedules forpayment of statutory dues bythe Depar tment ofTelecommunications (DoT),which has sought immediatepayment of dues includinglicence fees and spectrumusage charges (SUC)
Stand off between DOT and telecom operators over AGR continuescalculated on the basis ofAGR. The state-owned RailTelCorp also has filed a petitionin the SC. In response to the pleas filedby the telecom operators, theSC on Tuesday said that it willtake up the modif icationpetitions filed by VodafoneIdea, Bharti Airtel, and TataTeleservices, on giving themmore time to pay off AGRrelated dues. The matter wasmentioned before a benchheaded by Chief Justice SABobde, who said it will list thefresh pleas “sometime in nextweek” before the same benchwhich had heard the earlierpetition in the case. The telecom operators in theirpleas requested for an opencourt hearing with regard toworking out fresh schedule of
payment of their dues.Responding to the request, theChief Justice of India, saidthat “open court or in-chamberhearing will be decided by thebench concerned”. Earlier on January 16, a benchcomprising Justices ArunMishra, S.Abdul Nazeer andM.R.Shah, had d ismissedreview petitions filed by thesecompanies challenging SC’sorder dated 24 October, 2019.Holding that interest andpenalty have r ightly beenlevied on the telecomcompanies, SC had specifiedthat there should not be anyfurther litigation on the matter. As per the SC order of October24, telecom operators wererequired to pay up their duesby January 23. For Bhar tiAirtel, dues are around Rs
35,586 crore (Rs 21,682 croreas license fee (LF) and Rs13,904 crore as SUC) and forVodafone Idea the duesamount to Rs 53,038 crore(Rs28,309 crore in LF and Rs24,730 crore in SUC). TataTeleservices, which has soldits consumer mobilitybusiness to “Airtel”, facesdues of Rs.13,823 crore. As per the affidavit filed earlierin the SC, by DOT, the amountis also due from: RelianceCommunications-Rs 16,456.47crore, BSNL-Rs 2,098.72 crore,and MTNL-Rs 2,537.48 crore. After the telecom sector wasliberalised under the NationalTelecom Policy 1994, licenseswere issued to companies inreturn for a fixed license fee.In 1999, the governmentgave an option to the licensees
to migrate to the revenuesharing fee model, underwhich thethey were required to share apercentage of their AGR withthe government as LF andSUC. AGR is computed afterallowing for cer taindeductions spelt out in theselicense agreements. The LFand SUC were set at 8 per centand between 3-5 per cent ofAGR respectively, based onthe agreement. However in 2005, the CellularOperators Association ofIndia (COAI) challenged thegovernment’s definition forAGR calculation and in 2015and the Telecom DisputesSettlement and AppellateTribunal (TDSAT) stayed thecase in favour of telecomcompanies and held that AGR
includes all receipts, exceptcapital receipts and revenuefrom non-core sources such asrent, profit on the sale of fixedassets, dividend, interest andmiscellaneous income.However on 24 October, 2019,SC set aside TDSAT’s orderand upheld the definition ofAGR as stipulated by the DoT. In the meanwhile DOT hasserved notices to some of thenon-telecom companies withtelecom licences, includingpublic sector units such asGAIL India, Power Grid Corp.of India Ltd (PGCIL) and OilIndia Ltd (OIL)(Rs. Rs 48,000crore), demanding nearly Rs3 lakh crore. They are alsolikely to file separate reviewpetitions. OIL uses an opticfibre network for in ternalcommunications.

Due to lack oforganized industries andemployment, majority ofpopulation depends onmere labour work and fallprey to drug smugglingactivities.A total of 20 daily wageworkers and troops ofMoreh battalion sharedmeal and camaraderie witheach other assured them24 x 7 vigil and security atInternational border.
Now the question is who hasbeen doing the consultationswith Arunachal Pradesh,Assam and Manipur and thestakeholders after the Indo-Naga political negotiation wasover. It appears that there is notransparency in the process.One is still worried about thefate of the successfullyconcluded talk.It is also interesting to see howGovernor Ravi will remain asInterlocutor for the Naga talkafter the successful conclusionof the talk. Technically, his jobas Interlocutor for the Nagatalk is over ever since the talkhas been successfullyconcluded on the 31st ofOctober 2019 at Delhi.When Prime Minister Modiasked Ravi to conclude the talkwithin three months, he metNSCN (IM) collectiveleaderships. Later, he criticizedthem for adopting theprocrastinating attitude oversymbolic issues of a separateNaga Flag and constitution toprolong the issue. Whateverthe case may be, after the talkhas been successfullyconcluded, will theGovernment still blame NPGs
if the solution to the Nagaissue is not forthcoming?Ravi, representing theGovernment of India,successfu lly signed theFramework Agreement withNSCN (IM) on August 3, 2015,in presence of Prime MinisterModi, Home Minister RajnathSingh and National SecurityAdviser, Ajit Doval amongothers at Delh i. He alsosuccessfully brought the WCof NNPGs to the negotiatingtable af ter signing anagreement with them in 2017.Finally, he successfu llyconcluded the negotiationwith them on the 31st ofOctober 2019 at Delhi meetingthe deadline set by Modi.Therefore, with theunparalleled experience hehad after dealing with theNaga issue and meeting withvarious Naga civil societies,tribal hohos, and other mass-based organizations, it isgenerally believed that hewould be able to resolve theNaga issue. Unfortunately, hismaiden Address to the 13thNagaland LegislativeAssembly has not reflectedthe timeframe for the solution.
