ProjectDescription:TheApplicantiscurrentlydecommissioningthreeseparate,defunctpowergeneratingunits,andhasalreadyconstructedonenewactivegeneratingfacilityat1000KingSalmonAve.,intheCityofEureka.Thethreedefunctgeneratingunitswerecomponentsofthe“HumboldtBayPowerPlant”(HBPP).Thenewpowergeneratingfacilityisreferredtoasthe“HumboldtBayGeneratingStation.”

Decommissioningactivitieshaveresultedinrequirementstorestorepreviouslydisturbedareasandimplementmitigationtocompensatefordevelopmentimpactstojurisdictionalresources.ThepurposeoftheProjectistoimplementsiterestorationactivitiesthatarerequiredasacomponentofformallydecommissioningtheHBPPunits.Requirementsassociatedwithsiterestorationactivitiesincluderestoringthelandsformerlyoccupiedbythedefunctunits,implementingmitigationrequirementsforimpactstojurisdictionalwaters,andinstallingpermanentstormwatertreatmentcontrols.

TheProjectinvolvestheon‐sitereuseoflow‐levelradioactivesoils.Thiscertificationdoesnotauthorizeorprovidecriteriaforanycleanuporreuseofcontaminatedsoils.CleanupandreuseofcontaminatedsoilsaresubjecttotheApplicant’sLicenseTerminationPlanasapprovedbytheNuclearRegulatoryCommission.ImpactsandmitigationassociatedwithconstructionoftheHumboldtBayGeneratingStationareaddressedinaseparate401waterqualitycertificationissuedtotheApplicantonOctober10,2008.Anotherseparate401waterqualitycertificationwasissuedtotheApplicantonApril18,2014,toaddressimpactstojurisdictionalwatersassociatedwiththeIntake/DischargeCanalRemediationProject(CanalRemediationcertification).TheApplicanthasdividedtheProjectsiteintothefollowingtwelvefunctionalareastofacilitatetheProjectdescription:

BuhnePoint; BayviewHeights; IndependentSpentFuelStorageInstallation(ISFSI)andISFSISupportArea; TrailerCity; DuckPond; HBPPCore; HBGS/60kVSubstation; IntakeCanal; AssemblyBuildingArea; BuhnePointWetlandPreserve; ContractorParkingLot#1;and BuhneSloughSaltMarsh.

8. DisturbedSoilArea:Projectimplementationwillresultingreaterthanoneacreof

disturbedsoilarea.TheApplicantshallobtaincoverageundertheNationalPollutantDischargeEliminationSystemGeneralPermitforStormWaterDischargesAssociatedwithConstructionandLandDisturbanceActivities(OrderNo.2009‐0009‐DWQ)andprepareaStormwaterPollutionPreventionPlandetailingbestmanagementpractices(BMPs)tocontrolpollutionfromtheProjectareaduringconstruction.AlltemporarilydisturbedareaswithintheProjectareashallbeappropriatelystabilizedand/orreplantedwithappropriatenativevegetation.

9. OtherAgencyActions:TheApplicanthasappliedtotheUnitedStatesArmyCorpsof

10. CEQACompliance:Asleadagency,theHumboldtBayHarborRecreationand

ConservationDistrictpreparedaMitigatedNegativeDeclarationfortheProject(SCHno.2015062028).TheApplicantsignedaNoticeofDeterminationadoptingtheMitigatedNegativeDeclarationsonAugust27,2015,inordertocomplywiththeCaliforniaEnvironmentalQualityAct.

11. AntidegradationPolicy:Thefederalantidegradationpolicyrequiresthatstate

waterqualitystandardsincludeanantidegradationpolicyconsistentwiththefederalpolicy.TheStateWaterBoardestablishedCalifornia’santidegradationpolicyinStateWaterBoardResolutionNo.68‐16.ResolutionNo.68‐16incorporatesthefederalantidegradationpolicywherethefederalpolicyappliesunderfederallaw.ResolutionNo.68‐16requiresthatexistingqualityofwatersbemaintainedunlessdegradationisjustifiedbasedonspecificfindings.TheRegionalWaterBoard’sBasinPlanimplements,andincorporatesbyreference,boththeStateandfederalantidegradationpolicies.ThiscertificationisconsistentwithapplicablefederalandStateantidegradationpolicies,asitdoesnotauthorizethedischargeofincreasedconcentrationsofpollutantsorincreasedvolumesoftreatedwastewater,anddoesnototherwiseauthorizedegradationofthewatersaffectedbythisProject.

12. ThisdischargeisalsoregulatedunderStateWaterResourcesControlBoardOrderNo.

AllconditionsofthiscertificationapplytotheApplicant(andtheiremployees)and

allcontractors(andtheiremployees),sub‐contractors(andtheiremployees),andanyotherentityoragencythatperformsactivitiesorworkontheProjectasrelatedtothisWaterQualityCertification.Project‐SpecificConditions

1. TheApplicantshallimplementtheBiologicalMitigationandMonitoringPlanfortheHumboldtBayPowerPlantFinalSiteRestorationProject,datedApril2016(MMP),andcreatenolessthan0.638acresofbrackishmarshwetlandsattheShorelineWetlandsMitigationArea,andcreatenolessthan0.234acresofseasonalfreshwaterwetlandadjacentKingSalmonAve.,intheexistingContractorParkingLot#1area.

2. MitigationsuccessshallbesubjecttothereviewandacceptancebyRegionalWater

Boardstaff,andshallnotbeconsideredsuccessfuluntilaminimumoffiveyearsofmonitoringhasoccurred.

3. TheApplicantshallimplementtheEelgrassMitigationandMonitoringPlanforthe

HumboldtBayPowerPlantFinalSiteRestorationProject,datedApril2016.DeviationsfromthisplanaresubjecttothepriorreviewandacceptanceofRegionalWaterBoardstaff.

Project‐SpecificConditionsRequiringReports

4. Annualmitigationandmonitoringreportsshallbesubmittedannuallyfornolessthanfiveyearsfollowingmitigationimplementation(Reports).ReportsshallbesubmittedtotheRegionalWaterBoardbyJanuary31anddetailthemonitoringresultsfromthepriorcalendaryear.Theyear1reportshallbedueJanuary31,2018.Reportsshallinclude: Maintenanceactivitiesperformed Monitoringmethods Monitoringresults Time‐seriesphotographs Statusofachievementtowardssuccesscriteria;and Recommendationsforadaptivemanagement.

5. Thiscertificationactionissubjecttomodificationorrevocationuponadministrativeorjudicialreview,includingreviewandamendmentpursuanttoWaterCodesection13330andtitle23,CaliforniaCodeofRegulations,section3867.

6. ThiscertificationactionisnotintendedandshallnotbeconstruedtoapplytoanydischargefromanyactivityinvolvingahydroelectricfacilityrequiringaFederalEnergyRegulatoryCommission(FERC)licenseoranamendmenttoaFERClicenseunlessthepertinentcertificationapplicationwasfiledpursuanttotitle23,CaliforniaCodeofRegulations,section3855,subdivision(b)andtheapplicationspecificallyidentifiedthataFERClicenseoramendmenttoaFERClicenseforahydroelectricfacilitywasbeingsought.

7. Thevalidityofthiscertificationisconditionedupontotalpaymentofanyfeerequiredundertitle23,CaliforniaCodeofRegulations,section3833,andowedbytheApplicant.Thetotalapplicationfeeis$4,541.TheRegionalWaterBoardreceived$600fromtheApplicantonJuly8,2016,and$3,941onJune13,2016.

8. Thiscertificationwillbesubjecttoannualbillingduringtheconstructionphase

(“AnnualActiveDischargeFee”)andduringthemonitoringphaseoftheProject(“AnnualPostDischargeMonitoringFee”),perthecurrentfeeschedule,whichcanbefoundonourwebsite:http://www.swrcb.ca.gov/northcoast/water_issues/programs/water_quality_certification.shtml.ThesefeeswillbeautomaticallyinvoicedtotheApplicant.

9. TheApplicantshallnotifytheRegionalWaterBoarduponProjectconstructioncompletiontorequestterminationoftheAnnualActiveDischargeFeeandtoreceivea“NoticeofCompletionofDischargesLetter.”IftheProjectissubjecttotheAnnualPostDischargeMonitoringFee,thentheApplicantshallalsonotifytheRegionalWaterBoardattheendofthemonitoringperiodtorequestterminationofthefeeandreceivea“NoticeofProjectCompleteLetter.”TheApplicantmayberequiredtosubmitcompletionreportsattheendofeachofthesephases.RegionalWaterBoardstaffmayrequestsitevisitsattheendofeachProjectphasetoconfirmProjectstatusandcompliancewiththiscertification.

10. Thiscertificationdoesnotauthorizedraftingofsurfacewaters.Anydraftingof

surfacewatersshallbeincompliancewithStatewaterrightslawanddiversionrequirementsoverseenbytheStateWaterResourcesControlBoard’sDivisionofWaterRights.

11. HerbicidesandotherpesticidesshallnotbeusedwithintheProjectlimits.Ifthe

Applicanthasacompellingcaseastowhypesticidesshouldbeused,thenarequestforpesticideuseandaBMPplanmaybesubmittedtotheRegionalWaterBoardstaffforreviewandacceptance.

12. Onlywildlife‐friendly,100percentbiodegradableerosionandsedimentcontrol

productsthatwillnotentraporharmwildlifeshallbeused.Erosionandsedimentcontrolproductsshallnotcontainsynthetic(e.g.,plasticornylon)netting.Photodegradablesyntheticproductsarenotconsideredbiodegradable.TheApplicantshallrequestapprovalfromtheRegionalWaterBoardifanexceptionfromthisrequirementisneededforaspecificlocation.

13. BMPsshallbeimplementedasproposedintheapplicationmaterials.BMPsfor

erosion,sedimentandturbiditycontrolshallbeimplementedandinplaceatcommencementof,duringandafteranygroundclearingactivitiesoranyotherProjectactivitiesthatcouldresultinerosionorsedimentdischargestosurfacewater.Severeandunseasonalraineventsarebecomingmorefrequentduetotheeffectsofclimatechange.Therefore,BMPsshallbeimmediatelyavailablefordeploymentatalltimestopreventdischargestowatersofthestate.

14. TheApplicantisprohibitedfromdischargingwastetowatersoftheState,unless

explicitlyauthorizedbythiscertification.Forexample,nodebris,soil,silt,sand,bark,slash,sawdust,rubbish,cementorconcretewashings,oilorpetroleumproducts,orotherorganicorearthenmaterialfromanyconstructionorassociatedactivityofwhatevernature,otherthanthatauthorizedbythiscertification,shallbeallowedtoenterintoorbeplacedwhereitmaybewashedbyrainfallintowatersofthestate.Whenoperationsarecompleted,anyexcessmaterialordebrisshallberemovedfromtheworkarea.

15. TheApplicantisliableandresponsiblefortheproperdisposal,reuse,and/or

recyclingofallProject‐generatedwasteincompliancewithapplicableStateandFederallawsandregulations.

16. TheApplicantshallprovideRegionalWaterBoardstaffaccesstotheProjectsiteto

documentcompliancewiththiscertification.

17. Workinflowingorstandingsurfacewaters,unlessotherwiseproposedintheprojectdescriptionandapprovedbytheRegionalWaterBoard,isprohibited.

18. If,atanytime,anunauthorizeddischargetosurfacewater(includingwetlands,lakes,

riversorstreams)occurs,oranywaterqualityproblemarises,theassociatedProjectactivitiesshallceaseimmediatelyuntiladequateBMPsareimplementedincludingstoppingwork.TheRegionalWaterBoardshallbenotifiedpromptlyandinnocasemorethan24hoursaftertheunauthorizeddischargeorwaterqualityproblemarises.

19. AllProjectactivitiesshallbeimplementedasdescribedinthesubmittedcertificationapplicationpackageandthefindingsandconditionsofthiscertification.SubsequentProjectchangesthatcouldsignificantlyimpactwaterqualityshallfirstbesubmitted

toRegionalWaterBoardstaffforpriorreview,consideration,andwrittenconcurrence.IftheRegionalWaterBoardisnotnotifiedofasignificantalterationtotheProject,itwillbeconsideredaviolationofthiscertification,andtheApplicantmaybesubjecttoRegionalWaterBoardenforcementactions.

20. PriortoimplementinganychangetotheProjectthatmaybeamaterialchangeas

definedinCaliforniaWaterCodesection13260(c)asaproposedchangeincharacter,location,orvolumeofthedischarge,theApplicantshallobtainpriorwrittenapprovaloftheRegionalWaterBoardExecutiveOfficer.IftheRegionalWaterBoardisnotnotifiedofthematerialchangetothedischarge,itwillbeconsideredaviolationofthiscertification,andtheApplicantmaybesubjecttoRegionalWaterBoardenforcementaction(s).

21. TheApplicantshallprovideacopyofthiscertificationandStateWaterResources

ControlBoard(SWRCB)OrderNo.2003‐0017‐DWQtoanycontractor(s),subcontractor(s),andutilitycompany(ies)conductingworkontheProject,andshallrequirethatcopiesremainintheirpossessionattheworksite.TheApplicantshallberesponsibleforensuringthatallworkconductedbyitscontractor(s),subcontractor(s),andutilitycompaniesisperformedinaccordancewiththeinformationprovidedbytheApplicanttotheRegionalWaterBoard.

22. Disturbanceorremovalofexistingvegetationshallnotexceedtheminimum

necessarytocompletetheProject.23. Fueling,lubrication,maintenance,storage,andstagingofvehiclesandequipment

shallnotresultinadischargeorthreateneddischargetoanywatersofthestateincludingdryportionsoftheshoreline.AtnotimeshalltheApplicantoritscontractorsallowuseofanyvehicleorequipment,whichleaksanysubstancethatmayimpactwaterquality.

24. TheApplicantshallnotuseleakingvehiclesorequipmentwithinStatewatersor

riparianareas.VehiclesandequipmentusedwithinStatewatersshallbecheckedforleaksatthebeginningofeachworkday.

25. Intheeventofanyviolationorthreatenedviolationoftheconditionsofthis

certification,theviolationorthreatenedviolationshallbesubjecttoanyremedies,penalties,processorsanctionsasprovidedforunderapplicablestateorfederallaw.Forthepurposesofsection401(d)oftheCleanWaterAct,theapplicabilityofanystatelawauthorizingremedies,penalties,processorsanctionsfortheviolationorthreatenedviolationconstitutesalimitationnecessarytoassurecompliancewiththewaterqualitystandardsandotherpertinentrequirementsincorporatedintothiscertification.Inresponsetoasuspectedviolationofanyconditionofthiscertification,theStateWaterBoardmayrequiretheholderofanyfederalpermitorlicensesubjecttothiscertificationtofurnish,underpenaltyofperjury,anytechnicalormonitoring

reportstheStateWaterBoarddeemsappropriate,providedthattheburden,includingcosts,ofthereportsshallbearareasonablerelationshiptotheneedforthereportsandthebenefitstobeobtainedfromthereports.Inresponsetoanyviolationoftheconditionsofthiscertification,theRegionalWaterBoardmayaddtoormodifytheconditionsofthiscertificationasappropriatetoensurecompliance.

26. TheRegionalWaterBoardmayaddtoormodifytheconditionsofthiscertification,as

appropriate,toimplementanyneworrevisedwaterqualitystandardsandimplementationplansadoptedorapprovedpursuanttothePorter‐CologneWaterQualityControlActorsection303oftheCleanWaterAct.

27. Intheeventofanychangeincontrolofownershipoflandpresentlyownedor

controlledbytheApplicant,theApplicantshallnotifythesuccessor‐in‐interestoftheexistenceofthiscertificationbyletterandshallemailacopyofthelettertothefollowingemailaddress:[email protected].

Thesuccessor‐in‐interestshallemailtheRegionalWaterBoardExecutiveOfficerat:NorthCoast@waterboards.ca.govtorequestauthorizationtodischargedredgedorfillmaterialunderthiscertification.Therequestmustcontainthefollowing:

i) Effectivedateofownershipchange;ii) Requestingentity’sfulllegalname;iii) Thestateofincorporation,ifacorporation;iv) Theaddressandphonenumberofcontactperson;andv) AdescriptionofanychangestotheProjectorconfirmationthatthe

successor‐in‐interestintendstoimplementtheprojectasdescribedinthiscertification.

28. Exceptasmaybemodifiedbyanyprecedingconditions,allcertificationactionsare

contingenton:i) Thedischargebeinglimitedtoandallproposedmitigationbeing

completedinstrictcompliancewiththeApplicant’sProjectdescriptionandCEQAdocumentation,asapprovedherein;and

ii) CompliancewithallapplicablewaterqualityrequirementsandwaterqualitycontrolplansincludingtherequirementsoftheWaterQualityControlPlanfortheNorthCoastRegion(BasinPlan),andamendmentsthereto.

29. TheauthorizationofthiscertificationforanydredgeandfillactivitiesexpiresonJune

22,2021.Conditionsandmonitoringrequirementsoutlinedinthiscertificationarenotsubjecttotheexpirationdateoutlinedabove,andremaininfulleffectandareenforceable.
