If the Commission finds that the report was filed timely or that there were unusual circumstances that excused the failure, it may waive the fine, in whole or in part. This letter pertains to Case No: FEC 14-185 in which I, as treasurer for NAAPAC-FL, am alleged to have violated Florida's Elections Laws by failing to file a timely amendment to the 2014 M3 Report. I respectfully request that this letter, sent to you in a timely manner for receipt before the deadline of January 28, be placed promptly in my case file so that it is available to the Commission in its probable cause hearing scheduled for February 24-25, 2015

Summary:

In short, this matter originated with a notice dated March 21, 2014, and a second notice

dated April 1, 2014 Both notices were sent to my old address, 9452 Lita Rd W, Jacksonville, FL 32257 We moved in late summer 2013 The letter from Florida Elections Commission was also sent to the NAAPAC FL president, Victor Swaroop, who was suffering from serious health issues The errors made were not intentional, were caused by a new user lack of familiority with the interface, and should have had no impact on any political campaign in 2014

I received a package on September 23, 2014 regarding Case No: FEC 14-185 I promptly corrected the 2014 M2 Report and called to verify with Division of Elections that the amended 2014 M3 report was clear There are no reports or amended reports are pending.

We just moved to 224 Bowles Street, Neptune Beach from 9452 Lita Road W, Jacksonville when the error was made on the r·eport. The original package subsequently was sent to my old address. I corrected and called for help for numerous times regarding the mistakes on the reports .. The error or mistake was not

intentional. I believe this came about due to selecting a wrong options in the drop down menu I was a first time user to the filing system, and filing the 2014 Ml and M2 report

National Asian American PAC, FL (NAAPAC FL) is a new organization NAAPAC FL accepts membership fee from general membership at large .. We have limited financial resources. All board members and officers are volunteers We live in the different places throughout the state. We all have limited time to work on the campaign finance reports. I am trying my best not to make mistakes. I never did this kind of job

before I have been learning about the web filing system and self-taught how to report the transactions

on EFS I have not made errors since 2014 M4,, Strangely, I did not notice any message or alerts about the errors in M2 report when I logged in to file 2014 M4, MS, M6, and so on

I am a mother and a full-time CPA I am a volunteer for NAAPAC FL I hope that I am doing work for a good cause to promote increased engagement by Asian Americans in our democratic process

As is evident from the preceding events, this circumstance arose from an unfortunate convergence of

factors, the organizations fledging status, inexperienced and health issues of its leaders, official notice

sent to an old address, and earlier indication from FEC that all issues have been resolved such that there was no further follow·up action

No less importantly, the above innocent errors have not resulted in any effect whatsoever upon any political candidate, organization or process, In 2014, NAAPACFL made no political contribution to anyone. We have learned from our innocent mistake and pledge greater effort towards total compliance

STAFF RECOMMENDATION FOLLOWING INVESTIGATION

Pursuant to Section 106 25(4)(c), Florida Statutes, undersigned staff counsel files this written recommendation for disposition of the refenal in this case recommending that there is probable cause to charge Respondent with violating Section 106.07(2)(b)l., Florida Statutes Based upon a thorough review of the Report of Investigation submitted on December 18, 2014, the following facts and law support this staff recommendation:

1 On July 15, 2014, the Florida Elections Commission ("Commission") received a 1efe1ral fiom the Department of State, Division of Elections, alleging that Wenxia Raiti ("Respondent") violated Chapter 106, Florida Statutes ..

2 Respondent is the treasurer for National Asian American PAC-Florida, Inc (PAC), a political committee currently registered with the Division of Elections (ROI Exhibit 3)1

3 Complainant alleged that Respondent, acting as treasurer of a political committee, failed to file an addendum to an incomplete report after receiving notice from the filing officer that the report required an amendment

4. The PAC filed its State of Florida Appointment of Campaign I reasurer and Designation of Campaign Depository for Political Committees form ("DS-DE 6") on January 25, 2013, and appointed Respondent as its treasurer (ROI Exhibit 2)

5. By letter dated October 17, 2014, the Executive Director notified Respondent that Commission staff would investigate the following statutory p10vision:

Section 106.07(2)(b)l., Florida Statutes: Respondent, treasmer for National Asian American PAC Florida, a political committee, failed to make necessary amendments to the committee's 2014 M2 and M3 reports, as alleged in the complaint 2

6. Respondent timely filed the PAC's 2014 M3 Repo1t on Ap1il 10, 2014; however, the repmt was incomplete (ROI Exhibit 11)

7 By lette1s dated May 20, 2014, June 2, 2014, and June 30, 2014, the Division info1med Respondent that the PAC's 2014 M3 Repmt was incomplete and required an amendment The lette1s advised Respondent to file an amended repo1t within 7 days of receipt of the notice.. As a comtesy, the Division also attached an enor repo1t to each of the notices which explained the items that required an amendment The June 30, 2014 "Final Notice" lette1 was sent via ce1tified mail and was confirmed delive1ed to Respondent on July 9, 2014 (ROI Exhibits 12, 13, 14, and 15)3

8 According to the Division's History Notes, Donna Brown sent an email to Respondent on June I 0, 2014 informing her that the June 2, 2014 letter was returned to the Division. Ms .. Brown's email advised Respondent to update her mailing address with the Division through the EFS, by mail, email, or fax. (ROI Exhibit 8, page 2)

9.. On October 27, 2014, Commission staff received a written response from Respondent Respondent stated, "I was learning how to file the financial report on the website of the Division of Election.. I simply chose the wrong answers fiom the dropdown menu" Respondent also indicated that she had just moved to a new house and forgot to update her contact information with the Division (ROI Exhibit 17)

10 The committee's Queued Transaction Repo1t indicates that Respondent last amended the committee's 2014 M3 Report on July 31, 2014 .. (ROI Exhibit 16, page 7) Commission staff reviewed the committee's amended 2014 M3 Repo1t, and it appears the repo1t is complete and is now in compliance .. Id

12 "Probable Cause" is defined as reasonable grounds of suspicion suppo1ted by circumstances sufficiently strong to warrant a cautious person in the belief that the person has committed the offense charged. Schmitt v State, 590 So 2d 404, 409 (Fla .. 1991). P1obable cause exists where the facts and citcumstances, of which an [investigator] has reasonably trustwmthy information, ate sufficient in themselves for a reasonable man to reach the conclusion that an offense has been committed Department of Highway Safety and Motor Vehicles v. Favino, 667 So 2d 305, 309 (Fla .. 1'1 DCA 1995).

13 The facts set forth above show that Respondent was the treasurer for National Asian American PAC-Flmida, Inc , a political committee cu11ently registe1ed with the Division of Elections On April 10, 2014, Respondent timely filed the committee's 2014 M3 Repmt;

Conclusion:

25. In a final interview, Respondent states that she was not purposefully failing to amend the rep01ts She states that she was a volunteer and this was the first time that she has served as a treasurer She also advised me that she did not receive the failure-to-amend letters timely due to her moving from one place to another She advised me that the reports were all timely filed, and they have all been amended properly.

In the May 16, 2013 acknowledgement letter, Respondent was informed that all of the Division's publications were available online at DOE's website In the letter, Respondent was admonished as follows: It is your responsibility to read, under·stand, and follow the requirements of Florida's election laws. Received a phone call from Mr Swaroop He had just received a copy of the final ntice letters for the M2, M3 and MS. He sci id he was no longer chair and Ms Raiti was no longer treasurer and that the board would be appointing new ones I explained that we would need written notification for the chair change and a new DS"·De 6 for the new treasuer along with a resignation or removal letter from the treasurer

I also shared with him that we had received mulitple returned mails and had called numerous times with no call backs from the PAC

He said he would have someone from the PAC give us a call for assistance on changing the officers

Received a call from ".Jen"?? She had an asian accent, so I couldn t understand her very well. She said she had just received my email. She wanted to know if I had received her amendment. I realized she was talking about the M5 report. Checked EFS and saw that the M5 had been amended but still had the same errors Two new records had been added with the correct information, but the incorrect records had not been deleted I explained how to amend and delete the unnecessary records She said she understood and Would amend the report She said she was the new treasurer

On July 15, 2014, the Floiida Elections Commission received a complaint alleging that you violated Florida's election laws.. I have reviewed the complaint and find that it contains one or more legally sufficient allegations.. The Commission staff will investigate the following alleged violations:

Section 106.07(2)(b)l., Florida Statutes: Respondent, treasmer for National Asian American PAC Florida, a political committee, failed to make necessary amendments to the committee's 2014 M2 and M3 reports, as alleged in the complaint.

You may respond to the allegations above by filing a notarized statement providing any information regarding the facts and circumstances smrounding the allegations Your response will be included as an attachment to the investigator's report

When we conclude the investigation, a copy of the Report of Investigation will be mailed to you at the above address You may file a response to the report within 14 days from the date the report is mailed to you.. Based on the results of the investigation, legal staff will make a written recommendation to the Commission on whether there is probable cause to believe you have violated Chapter 104 or I 06, Florida Statutes A copy of the Staff Recommendation will be mailed to you and you may file a response within 14 days from the date the recommendation is mailed to you Your timely filed response(s) will be considered by the Commission when determining probable cause.

The Commission will then hold a hearing to determine whether there is probable cause to believe you have violated Chapters 104 or 106, Florida Statutes You and the complainant will receive a notice of hearing at least 14 days before the hearing. The notice of hearing will indicate the location, date, and time of your hearing. You will have the opportunity to make a brief oral

statement to the Commission, but you will not be permitted to testify 01 call others to testify, or introduce any documentary or other evidence

At any time before a prnbable cause finding, you may notify us in writing that you want to enter into negotiations directed towards reaching a settlement via consent agreement

The Report of Investigation, Staff Recommendation, and Notice of Hearing will be mailed to the above address as this letter. Therefore, if your address changes, you must notify this office of your new address. Otherwise, you may not receive these important documents. Failure to receive the documents will not delay the probable cause hearing.

I received a package on July 26, 2014 regarding Case No : FEC 14-185. I corrected 2014 M2 Report and 2014 M3 Report right away I called and confirmed with the Election Divisions that the both reports were clear I also just logged in to the web account and no reports or amended reports are pending. I spoke to Donna Brown from Elections Commission about the case She suggested that I do nothing and wait for the case to be close.

I just moved to 224 Bowles Street, Neptune Beach from 9452 Lita Road W, Jacksonville The package went to my old address I corrected and called for help for numerous times regarding the mistakes on the reports Errors and mistakes are not intentional Sometimes, it was related to selecting a wrong options in the drop down menu

National Asian American PAC, FL (NAAPAC FL) is a new organization NAAPAC FL accepts membership fee from general members at large. We have limited financial resources All board members and officers are volunteers .. We live in the different parts of the state We all have limited time to work on the campaign finance reports I am trying my best not to make mistakes I never did this kind of job before I have been learning about the web filing system and how to report the transactions on EFS I have not made errors since 2014 M4 Strangely, I did not notice any message or alert when I logged in to file 2014 M4, MS, M6, and so on

I would like to request that we settle this case as soon as possible I also would like to plead forgiveness on delaying responding to the case due to the above reasons

Pin numbers are conlidcntial secure credentials that allow you to submit reports and update information The enclosed sealed envelope provides a confidential pin number for the chairperson B1 copy of this letter, a confidential pin number to access tbe EFS was sent to the treasurer

Each political committee chairperson is required to provide the Division of Elections with confidential personal information that may be used to allow access in the event that the password is forgotten or Jost When you enter the campaign account screen, there will be a drop down box where you pick a question (such as What ii your mother '1 maiden name?) and supply an answer All passwords and answers to questions are stored as encrypted data and cannot be viewed by Division staff and given out over the phone. Please notify the Division if' your credentials have been compromised

All reports must be completed and filed through the EFS no later than midnight, Eastern Standard Time, of the due date Reports not filed by midnight of the due date are late filed and subject lo the penalties in Section 106 07(8), Florida Statutes In the event that the EFS is inoperable on the due date, the report will be accepted as timely filed if filed no later than midnight, Fastcrn Standard Time, of the first business day the EFS becomes operable No fine will be kvied during the period the EFS was inoperable

Any political committee failing to file a report on the designated due date is subject to a fine of $50 per day for the first 3 days and, thereafter, $500 per day for each day, not to exceed 25% of the total receipts or expenditures, whichever is greate1, for the period covered by the late report However., for the reports immediately preceding each primary and general election, the fine shall he $500 per day. not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report

Electronic Receipts

The person submitting the report on the EFS will he issued an electronic receipt indicating and \erit;ing the report was filed Fach campaign treasurers report filed by means of the E.FS is considered to be under oath by the chairperson and campaign treasurer and such persons are subject to the provisions of Section 106.07(5), Florida Statutes.

RE: Phone call received regarding M12 report

Ms Raiti called She was driving but had received an email and wanted to check on what it meant She said it told her the M12 report had not been filed and that she needed to call us She thought she had already done it as a waiver I checked her account in EFS and saw it in Pending It was done as a waiver and had been review but had not been filed I told her this and she said that she was grateful for the automatic email because she would not have realized there was a problem since she thought she had completed the process already She said she is not enjoying the monthly report and asked if it would continue to be monthly after the elections this year I told her the new reporting dates for 2014 were all online for download I told her they would remain monthly until closer to election and then the dates would get tighter but they are all listed on the calendar available online She said she would look at the calendar and finish filing the report when she got to a computer

On October 30, 2013 (Second Notice)_ you were advised that one or more of your campaign treasurer's reports were incomplete and that you had 7 days to provide the requested information

Our records show that changes to the report were made, however the reports are still incomplete. Please provide the requested information below by the end of today Nov 15 2013 or a Third (Final) Notice Letter will need to be mailed

Q3 Report Expenditure: Seq 3: The Transaction Date Is Either Before or After The Report Coverage Period

I also notice that this expenditure is made to an individual for a banner. If he did not actually make the banner, and this was actually a reimbursement to him, it will need to be shown as such If it is a reimbursement and if needed please see page 32 of the EFS User Guide for instructions

The next report is the M10 and it is due on Nov 12 2013 which will cover October 1-31 2013 activity

I left a message for Ms Raiti at both of her phone numbers regarding no response to 2 notices sent by us regarding an incomplete 03 report

She called back 11 8/13@ 9:40 am She said she knew about both notices, but she is a volunteer and it has been hard to find time to do them She asked if the monthly reports were only because the election was coming up and I told her no, it was a new law passed by the legistature and it would be monthly from now on, on the 10th of every month or next business day if it fell on a weekend or holiday She said ok but that it makes it very hard for her to keep up with all the reports when it switches to monthly instead of being quarterly She thanked me for calling 1 told her she was welcome to call with any questions

Spoke wNictor - having trbl w/password - had called in yesterday and was given original PW because he had not been in the system 84 - Lenard/Terri both spoke w/him - has not looked at EFS manual yet - relying totally on trying to remember what he was told over the phone - apparently he had tried to reset the PW and failed - had to have Terri reassign new PW for him -was able to get signed on - explained to him where to find report to be filed - how to review it before submitting - once again advised hime to run off EFS User Guide for both himself and treasurer - appeared to have a grasp of everything when we completed the call
