CHAPTER ONEObt ai ni ng a NewCr edent i alIndiana drivers licenses, permits and identifcation cards are produced using security features to help prevent identity theft, fraud, card tampering and to improve the detection of underage drinking.Te security features include embedded digital enhancements to ensure security and authenticity. Some information is detectable only with a black light, while other secured data is embedded in a barcode on the back of the card. A vertical format is provided for Hoosiers under twenty-one (21) years of age, with the dates the recipient turns age eighteen (18) and twenty-one (21) designated in yellow and red.A gold star marker appears in the upper right-hand corner to indicate a SecureID credential and refect compliance with the U.S. Department of Homeland Securitys requirements as recommended by the 9/11 Commission and federal and state laws. Drivers licenses are identifed with a rose header and a gold State of Indiana in the upper left-hand corner. Learners permits are identifed with a purple State of Indiana in the upper left-hand corner, while commercial drivers licenses will have a red State of Indiana.Identifcation cards include all of the same security features as drivers licenses with a green header and a green State of Indiana in the upper left-hand corner.SecureID drivers license: Over 21 years of ageSecureID drivers license:Under 21 years of age1 2Sec ur eI DSecureID is the Indiana BMVs efort to fully comply with the recommendations of the 9/11 Commission, and state and federal regulations in two ways:SecureID is a requirement for anyone applying for a new Indiana drivers license, permit or identifcation card. To qualify for a SecureID, applicants must prove their identity, lawful status, Social Security number and Indiana residencyAll permanent drivers licenses, permits or identifcation cards are mailed from a secure, government-run location to a customers mailing address following an extensive verifcation of documentsIf you are renewing, amending or replacing your current Indiana drivers license, permit or identifcation card and wish to upgrade to a SecureID, you are asked to bring original versions or certifed copies of certain documents to a license branch.If you have questions about collecting your documents, you can call the Indiana BMV toll-free at 888-692-6841 and speak with a customer service representative, or visit any Indiana license branch for help. For a complete list of required documents, visit myBMV.comRecei vi ng Your Cr edent i alby Mai lYour permanent credential will be mailed to you from a government-run, secure location after you apply for a new, renewed, amended or replacement drivers license, permit, or identifcation card. Your credential will arrive at your mailing address within ten (10) business days. Te process used to mail credentials is similar to that used by the fnancial services industry to mail credit and debit cards.I ndi ana Resi dency Requi r ement sYou must be a legal resident of Indiana to obtain an Indiana drivers license, learners permit or identifcation card. Evidence of residency in Indiana includes:Maintaining a legal address in the State of Indiana and not claiming residency in another stateBeing a registered voter in the State of IndianaLawful stewardship of a juvenile that is enrolled in an elementary or secondary school located in IndianaHaving more than one-half of your gross income derived from sources in IndianaFor the purposes of obtaining a drivers license, learners permit or identifcation card, the following persons living in Indiana solely for any of the following reasons and without the intent to make Indiana their permanent home, are not considered to be an Indiana resident:Students enrolled at a post-secondary educational institutionActive duty military personnel in the Armed ForcesTemporary employmentNewI ndi ana Resi dent sWhen you become a resident of Indiana, you have 60 days to obtain a new Indi-ana drivers license if you hold a valid drivers license from another state.If you have never held a valid drivers license from another state, you must hold an Indiana learners permit before you can apply for an Indiana drivers license.If your out-of-state license has been expired for not more than three (3) years, and you have held an unrevoked out-of-state license for at least one (1) year, you must pass a standard vision screening test and a knowledge test to obtain an Indiana license.If your out-of-state license has been expired for more than three (3) years, or you have held an unrevoked out-of-state license less than one (1) year, you must pass a standard vision screening test, a knowledge test and a driving skills test to obtain an Indiana license.I dent i c at i on Car dsIdentifcation cards may be issued to an Indiana resident of any age who does not have a drivers license. You cannot hold both an identifcation card and a drivers license at the same time, even if one of the credentials was issued by another state.Identifcation cards may also provide privileges to operate a Motor Driven Cycle Class B (MDC-B) as long as the holder is at least ffteen (15) years of age and passes an MDC-B knowledge test. If successful, an MDC-B endorsement will be placed on the identifcation card to signify your operational authority.3To apply for an identifcation card you must visit a license branch and present documents described in Appendix A proving your identity, Social Security number, lawful status and Indiana residency.I dent i c at i on Car d Val i di t yAn identifcation card is valid for six (6) yearsIdentifcation cards issued to lawful temporary residents may not refect standard periods of validityDr i ver s Li c ensesDrivers licenses provide driving privileges to Indiana residents who are eighteen (18) years of age or older. Probationary drivers licenses provide restricted driving privileges to Indiana residents who are younger than eighteen (18) years of age.An Indiana operators license does not allow the holder to drive for hire, transport passengers for hire or transport property for hire in any vehicle with a gross vehicle weight rating of 16,000 pounds or more. For more details, see the section on Commercial Drivers Licenses.You may apply for a drivers license at any Indiana license branch. To obtain a drivers license, you must meet the following requirements:Meet drivers license age requirements described later in this section Hold a valid Indiana learners permit for a period of time described later in this section, unless you are currently licensed by another jurisdiction Present documents described in Appendix A proving your identity, lawful status, Social Security number and Indiana residency Pass a standard vision screening test Pass a knowledge testPass a driving skills test with an Indiana BMV driver examiner, unless you qualify for a waiverDr i ver s Li c ense Age Requi r ement sIn order to apply for an Indiana drivers license:You must hold a valid (not suspended or invalidated) Indiana learners permit for 180 days to obtain a drivers license4You must be at least sixteen (16) years and 270 days old to obtain a drivers license without completion of an approved driver education program If you passed an approved driver education program, you must be at least sixteen (16) years and 180 days old to obtain a drivers license In addition, if you are applying for a drivers license, you must complete at least 50 hours of supervised driving practice with a licensed instructor or a licensed driver, with valid driving privileges, who is at least twenty-fve (25) years of age, or a spouse with valid driving privileges who is at least twenty-one (21) years of age. At least ten (10) hours of supervised driving practice must be nighttime driving.At the time of application for a drivers license, you must submit a completed BMV-approved Log of Supervised Driving Practice showing proof of the hours driven. Multiple logs must be used, if necessary, to log the required practice driving. Te log must be signed by a parent or legal guardian if the applicant is under eighteen (18) years of age.Dr i verEduc at i on Wai verIf you have a learners permit and attend an approved driver education school that participates in the Indiana BMV waiver program, you may take the driving skills test with the school after successful completion of the course. If you obtained a probationary drivers license on or after July 1, 2009, your license is valid until you are twenty-one (21) years and thirty (30) days of age.7SeatBel t sIf you have a probationary drivers license, every passenger in the vehicle that you are driving must wear a seat belt, or if the passenger is a child under eight (8) years of age, be restrained in a properly fastened child restraint system.Dr i vi ng w i t h Passenger sYou may not drive with any passengers for 180 days after you obtain your probationary drivers license unless one of the following individuals is seated in your vehicles front passenger seat:A licensed individual with valid driving privileges who is twenty-fve (25) years of age or olderYour spouse with valid driving privileges who is twenty-one (21) years of age or olderA certifed driver education instructor However, during the 180 days after you get your probationary drivers license, you may drive with your child, stepchild, sibling, step or halfsibling or spouse during the hours allowed by law without another accompanying individual.Tel ec ommuni c at i on Devi c esIf you have a probationary drivers license you may not operate a motor vehicle while using a telecommunication device, such as a cell phone, unless the device is being used to make a 911 emergency call.When You May Dr i ve w i t h a Pr obat i onar y Dr i ver s Li c enseFor 180 days after obtaining your probationary drivers license, you may not drive between 10 p.m. and 5 a.m.After you have held the probationary license for 180 days, you may not drive during the following hours:Sunday through Tursday after 11 p.m.Monday through Friday before 5 a.m.Saturday and Sunday between 1 a.m. and 5 a.m.8However, you may drive during the periods described above if you are participating in, going to, or returning from:Lawful employmentA school sanctioned activityA religious eventYou are accompanied by an individual with valid driving privileges who is at least twenty-fve (25) years of age, or your spouse with valid driving privileges who is at least twenty-one (21) years of ageDr oppi ng Out , Bei ng Suspended, orBei ng Ex pel l ed f r om SchoolIndiana law requires the BMV to suspend the driving privileges of any person younger than eighteen (18) years of age upon notifcation by the persons principal that the person is in any of the following situations:He or she is under an expulsion, exclusion, or second or subsequent suspension from school during one school year; or He or she has been determined to be a habitual truantHe or she has withdrawn from schoolLi abi l i t y f orI nj ur y orDamageTe application of an individual less than eighteen (18) years of age for a permit or license under this chapter must be signed and sworn to or af rmed by one (1) of the following in order of preference:1 Te parent having custody of the minor applicant or a designee of the custodial parent specifed by the custodial parent.2 Te noncustodial parent (as defned in IC 31-9-2-83) of the minor applicant or a designee of the noncustodial parent specifed by the noncustodial parent.3 Te guardian having custody of the minor applicant.4 In the absence of a person described in one (1) through three(3), any other adult who is willing to assume the obligations imposed by the provisions of this chapter.An adult who signs an application for a permit or license under this chapter agrees to be responsible jointly and severally with the minor applicant. Te individual who signed the application can fle a written request to cancel the license/permit (IC 9-24-9-4(b)).9Know l edge TestTe knowledge test is based on information contained in this drivers manual. To pass the knowledge test, you must demonstrate a basic understanding of Indiana traf c laws and safe driving techniques, and you must be able to read and understand highway signs regulating, warning and directing traf c. Te knowledge tests include multiple choice questions concerning traf c maneuvers and identifcation of types of traf c signs.Te knowledge test is required for the following individuals:Learners permit applicantsFirst-time chaufeurs license applicantsFirst-time public passenger chaufeurs license applicantsDrivers younger than twenty-one (21) years of age renewing a valid drivers license who have active points on their driving recordNew Indiana residents who hold an out-of-state license of any type and are applying for an Indiana drivers licenseNew Indiana resident who holds an out-of-country licenseDrivers whose Indiana drivers license has been expired for more than 180 daysDrivers who have six (6) or more active points on their Indiana driving record and are renewingActive duty military personnel and the spouse and/or dependent, if applicable, whose Indiana drivers license has been expired for more than 180 days and who have been returned from deployment for more than 90 daysOut-of-state active military personnel applying for a new Indiana drivers license If you fail to pass a knowledge test, you must wait until the next business day to take the test again.Dr i vi ng Sk i l l s TestYou must schedule an appointment for the driving skills test online at myBMV.com or by visiting an Indiana license branch. Tere is no charge for the driving skills test administered by the Indiana BMV driver examiner, but you must provide your own vehicle.10A driving skills test given by an Indiana BMV driver examiner is required for the following:Driver with an Indiana learners permit, unless that driver qualifes for, and passes, the driver education skills test waiverNew Indiana resident who has held an unrevoked out-of-state drivers license for less than one (1) year or whose out-of-state drivers license has been expired more than three (3) yearsNew Indiana resident who holds an out-of-country licenseIndiana resident whose Indiana drivers license has been expired more than three (3) yearsDriver who has an Indiana BMV restriction that requires testing.Driver about whom the Indiana BMV has received a medical complaint and the Indiana BMV determines after reasonable investigation that a skills evaluation is neededWhen the Indiana BMVs medical board has recommended a skills evaluation, the BMV may require the driver to undertake a driving skills testActive duty military personnel and the spouse and/or dependent, if applicable, whose Indiana drivers license has been expired for more than three (3) years and who have been returned from deployment for more than 90 daysDischarged military personnel who hold an out-of-state license, and the expiration of the license is beyond the allowed extension, and the out-of- state license has been expired for more than three (3) years.No one besides the driving skills test examiner and a supervisor is allowed in your vehicle when you take the driving skills test.Your vehicle must be legally equipped and be in safe and clean condition. You must provide the vehicles current registration before taking the driving skills test.It shall be within the discretion of the Indiana BMV driver examiner to reject a vehicle for the skills test.Te driving skills test examiner will ask a few required questions before you begin driving. His or her job is to administer a fair and objective test based on what he or she observes, not to provide instruction. He or she will use a standardized form to evaluate your ability to operate a motor vehicle safely.11When taking the driving skills test, you must pay particular attention to the following situations:Driving in the proper lane by obeying the lane markings, looking carefully and signaling properly before changing lanesAllowing enough distance between your vehicle and the vehicle aheadReacting appropriately to being overtaken and passed by another vehicle by maintaining your speed and providing enough room to passControlling your speed according to posted speed limits and varying traf c conditionsObserving good defensive driving habitsListening to instructions and observing general traf c fowApproaching an intersection at the proper speed, looking for other vehicles and coming to a complete stop when requiredReversing skills and backing correctly out of a parking spaceParallel parking abilityWhen taking the driving skills test, the following actions could detract from your fnal score or cause you to fail the driving skills test:Failing to use defroster or wipers when neededFailing to use both hands on the wheelSelecting the wrong gearFailing to signalDriving too slowly or stopping unnecessarilyOverrunning a crosswalk, stop line or stop signFailing to turn into or from the correct laneFailing to check your blind spotSlowing speed when changing lanesReversing too fastLeaving your turn signal on after completed lane changeDriving too closely to the vehicle ahead or to a parked vehicle12Any of the following actions shall result in the automatic failure of the driving skills test:Disobeys a yield, stop, school zone or no turn on red signDisobeys traf c signalBacks over curb while parallel parkingDrives into parked vehicle while parallel parkingFails to follow instructionsFails to use a seat beltFails to react to hazardous driving conditionsBreaks posted speed limitBreaks posted speed limit in school zoneExcessive speed for conditionsTurns into or uses the wrong lanePassing in a no passing zone or crossing a solid yellow lineDriving left of center of street/crosses yellow lineStraddles marked lanes Drives too close to pedestrians or bicyclesPasses school bus with stop arm outFails to pull over and stop for emergency vehiclesCausing an accident during driving skills testFails to yield right of wayFails to come to a complete stop at stop signsFails to obey required laws concerning RR crossingsIt shall be within the discretion of the state driver examiner or driver instructor to continue a driving skills test after a student has failed the driving skills test.If you fail three (3) driving skills tests while holding a learners permit, you must wait for two (2) months from the date of the last failed driving skills test before taking the driving skills test again.13Vi si on Sc r eeni ng TestAll Indiana drivers license or learners permit applicants are required to pass an eyesight exam, even if the applicant is renewing an existing license or permit.If you normally wear glasses or contacts while driving, you should inform the branch personnel and wear them during the vision screening test. If your visual ability does not meet state standards, you will be referred to an eye doctor for examination. If you return to the license branch with a statement from an eye doctor af rming that your vision has been corrected to meet the state standard, you may continue the licensing or renewal process which will include a vision screening test at the license branch.Restrictions may be placed on a drivers license for a variety of reasons. Tese restrictions allow a driver to operate a vehicle under conditions that ensure safety to the driver and to the public.Te most common restrictions are based on vision screening tests. In addition, the holder of a chaufeurs license is permitted to operate a motor vehicle having a gross weightof at least 16,000 pounds up to 26,000 pounds (whether single vehicle or combined gross vehicle weight) when used to transport property for hire. To obtain a commercial drivers license you must meet the following requirements: Be a citizen of the United States or a Permanent ResidentHold a valid Indiana drivers license Hold a valid commercial drivers license learners permit Have at least one (1) year of driving experience as a licensed driver Present documents described in Appendix A proving your identity, lawful status, Social Security number and Indiana residency Pass a knowledge test(s) representative of the type of commercial drivers license that you will receive Pass a driving skills test in a vehicle representative of the class of commercial drivers license that you will receiveHave a valid Medical Examination Report for Commercial Driver Fitness Determination form and Medical Examiners Certifcate completed by a medical examiner listed on the FMCSA National Registry of Certifed Medical Examiners on fle with the Indiana BMV17Te skills test consisting of a pre-trip inspection test, a basic control skills test, and the road trip skills test must be taken at an approved skills test site.To keep your commercial learners permit or commercial drivers license valid, you must submit a Medical Examination Report for Commercial Driver Fitness Determination form and Medical Examiners Certifcate completed by a medical examiner listed on the FMCSA National Registry of Certifed Medical Examiners prior to the expiration of the current medical examiners report and certifcate after receiving your commercial learners permit or commercial drivers license.To obtain the hazardous materials endorsement for a commercial drivers license, you must have a Transportation Security Administration security threat assessment approval for the term of the commercial drivers license. Also, any company empowered by the state or a political subdivision to operate programs, including the provision of transportation or facilities, for persons with physical disabilities may apply for a placard.To apply for a parking placard, you must have a physician, chiropractor, advanced practice nurse or podiatrist complete the Application for Disability Parking Placard or Disability Plate State Form 42070 af rming that you qualify for a parking placard. If you have a visual disability, an optometrist or ophthalmologist licensed to practice in Indiana may complete the form. After you have completed State Form 42070 and have it certifed, you may get a parking placard at any Indiana license branch or by mailing it to the address on the form.If you have a permanent disability, your parking placard does not expire unless a physician certifes that the disability is no longer considered permanent or needed. Tere is no fee for a permanent parking placard. If you lose your credential or it is stolen, you may replace it at an Indiana license branch. If you are outside of Indiana and meet certain requirements, you may obtain an interim credential until you return to Indiana. Customers meeting certain requirements may renew or replace their licenses or identifcation cards online at myBMV.com. For a listing of those requirements, visit myBMV.com. If your name or legal address changes, you must visit an Indiana license branch to amend the information on your credential.Renew i ng a Cr edent i alYour drivers license or identifcation card expires at midnight on your birthday. A probationary license expires when the holder is twenty-one (21) years and thirty (30) days of age. If your birthday falls on a day when license branches are closed, your license or identifcation card will expire at midnight on the next business day. A late fee will be charged if your license or identifcation card is renewed after that date.If you are renewing a drivers license that has been expired for 180 days to three (3) years, you must pay a late fee, pass a knowledge test and pass a standard vision screening test. If you are renewing a drivers license or identifcation card that has been expired for more than three (3) years, you must pay a late fee. Additionally, for a drivers license renewal, you must also pass a knowledge test, pass a driving skills test and pass a standard vision screening test.A drivers license or identifcation card may be renewed by U.S. citizens up to one (1) year prior to expiration. An Indiana BMV-approved DSP provides a summary of defensive driving techniques and is a refresher course for drivers. Any Indiana driver may complete a DSP course from an Indiana BMV-approved provider and receive a four- (4) point credit.However, Indiana drivers required by the BMV to participate in a DSP will receive a notifcation indicating that they must successfully complete a BMV-approved DSP within 90 days of the mail date. Each driver is allowed one (1) four- (4) point credit during a three (3) year period. Te Indiana BMV may require drivers eighteen (18) years of age and older who are convicted of two (2) or more traf c ofenses within a twelve (12) month period to complete a BMV-approved DSP course. Drivers who are less than eighteen (18) years of age and are convicted of two (2) or more moving traf c ofenses, involved in two (2) or more accidents, or a combination of the two (2) may be required to complete a DSP course. Failure to complete the Indiana BMV-approved DSP within 90 days from the date of the BMVs notice will result in the suspension of the individuals driving privileges.A judge may order a driver who commits a traf c violation to attend a DSP. If a court orders you to complete a DSP, the court may require classroom instruction only.Te four- (4) point credit will only be applied to your driver record if you complete an Indiana BMV-approved DSP provider.Te maximum fee for any DSP is $55. Allow seven (7) to ten (10) business days for results to be processed by the Indiana BMV. To deter uninsured drivers, Indiana law provides a number of sanctions for operating a vehicle without proper insurance.29Pr oofofFi nanc i alResponsi bi l i t y (I nsur anc e)Your insurance provider must electronically submit proof of fnancial responsibility to the Indiana BMV on your behalf for any of the following situations:An auto accident for which the BMV receives an accident reportA pointable moving traf c violation within one (1) year of receiving two (2) other pointable moving traf c violationsA serious traf c violation such as a misdemeanor or felonyAny pointable moving traf c violation by a driver who was previously suspended for failing to provide proof of fnancial responsibilityIf any of the preceding situations occur, a request for fnancial responsibility verifcation will be sent to your mailing address on fle with the Indiana BMV.You must then arrange for your insurance provider to fle a Certifcate of Compliance (COC) electronically with the Indiana BMV. Te COC will demonstrate that the vehicle you were operating at the time of the incident or accident was insured to the states minimum motor vehicle liability protection. Te COC must be received and processed by the BMV within forty (40) days of the Indiana BMVs mailing of a request for fnancial responsibility verifcation or your driving privileges will be suspended. Once your driving privileges are suspended, you may have the suspension removed from your driver record only by having your insurance provider electronically provide the COC covering the date of the incident or accident and the vehicle involved.If your driving privileges are suspended upon conviction of certain court-related ofenses, or for insurance violations, your insurance provider must electronically fle proof of future fnancial responsibility with an SR22 form for you to be reinstated. Te SR22 requirement, along with any reinstatement fees, must be satisfed before your driving privileges will be reinstated.Te SR22 form demonstrates that you have a motor vehicle insurance policy that meets the states minimum standards and cannot be cancelled without prior notice given to the Indiana BMV. When you have an SR22 requirement, you must maintain an efective SR22 policy on fle with the Indiana BMV for three (3) years as a result of your frst and/or second no-insurance suspension; or fve (5) years as a result of your third and subsequent no-insurance suspensions. If the Indiana BMV receives a SR26 (cancellation of SR22 insurance) notice from your insurance provider, or the BMV does not have an efective SR22 on fle at any time during the three- (3) or fve- (5) year period, your driving privileges will be suspended until the Indiana BMV receives an efective SR22 policy that shows coverage is in efect, or the SR22 requirement period expires.30Dr i vi ng Wi t houtI nsur anc eA driver who operates a motor vehicle without a liability insurance policy that meets the states minimum standard is subject to a suspension of driving privileges for 90 days. Additionally, a driver who is suspended more than one (1) time within a three- (3) year period for failing to provide proof of fnancial responsibility will incur a one- (1) year suspension. A driver that has been suspended for no-insurance will then be required to submit proof of future fnancial responsibility. To reinstate driving privileges following the suspension, the drivers insurance provider must electronically fle proof of future fnancial responsibility (SR22). Also, the driver must pay a reinstatement fee of $250 for their frst no-insurance suspension, $500 for their second no-insurance suspension, or $1,000 for their third and subsequent no-insurance suspension after January 1, 2015. For suspensions prior to January 1, 2015 reinstatement fees of $150 for a frst no-insurance suspension, $225 for a second no-insurance suspension, and/or $300 for a third and subsequent no-insurance suspension may alsobe required. If an Indiana court convicts a driver of operating a motor vehicle without insurance, that driver will be required to maintain a SR22 insurance policy on fle with the Indiana BMV for a three- (3) or fve- (5) year period, depending on the number of prior no-insurance convictions on their drivers record. Additionally, if a driver has more than one (1) conviction for operating without insurance in a fve- (5) year period, that driver is subject to a one- (1) year driving privilege and vehicle registration suspension, as well as an SR22 requirement and any other reinstatement fees. All drivers who have been suspended following a conviction for operating a vehicle without insurance, or who have received an administrative (BMV) suspension for failing to provide proof of fnancial responsibility, will be required to maintain proof of future fnancial responsibility (SR-22) with the Indiana BMV for three (3) or fve (5) years following the end of each suspension.Suspensi onIndiana law gives courts the authority to order the Indiana BMV to suspend an individuals driving privileges when he or she is found to have committed certain traf c violations. Suspensions begin eighteen (18) days after notice from the Indiana BMV is mailed to the driver, unless otherwise directed by Indiana law or a court.31Dr i verRec or d Ac c ess and Rei nst at ementYour driver record may be viewed online at no charge at myBMV.com. If your driving privileges are suspended by a court, the courts phone number will be listed with the associated court-ordered suspension. You may contact the court to fnd out how to fulfll the requirements of that particular suspension.Once the courts requirements are fulflled, the court will send reinstatement information directly to the Indiana BMV for processing. Processing by the Indiana BMV may take up to ten (10) business days once the information is received from the court.If your driving privileges are suspended, you will have to serve the required suspension time and, in some cases, fulfll Indiana BMV reinstatement requirements. You can fnd these requirements at the top of your Viewable Driver Record. Typically, reinstatement requirements include providing proof of current (SR50) or future (SR22) fnancial responsibility and/or paying a reinstatement fee to the BMV. Te proof of fnancial responsibility must be sent electronically from your insurance provider directly to the Indiana BMV. Driving while suspended with a prior ofense can result in a misdemeanor or felony conviction on your driving record. Oper at i ng a Vehi cl e Whi l e I nt ox i c at edOperating a vehicle while intoxicated or with a blood alcohol content in excess of the legal limit is a criminal ofense and has an immediate and signifcant efect on your privilege to operate a vehicle. If a law enforcement of cer has probable cause to believe that a motorist committed an ofense under IC 9-30-5, IC 9-30-6, IC 9-30-9, or IC 9-30-15, the of cer may ask the motorist to submit to a chemical test to determine the amount of alcohol in the persons system. A motorist for whom a judge has found probable cause exists that he or she was operating a vehicle while intoxicated may face a suspension of driving privileges. A judge may, however, order that the motorist be required to operate only with an ignition interlock device in lieu of a suspension. A motorist who fails a chemical test may have his or her driving privileges suspended for up to 180 daysA motorist who refuses to submit to a chemical test will face a suspension of driving privileges for up to two (2) yearsA court may suspend a persons driving privileges following a conviction for operating while intoxicated. Te suspension periods may be longer for repeat ofenders. Penalties for this ofense may include conditions placed on your driving privileges, and the installation of an ignition interlock device. If the motorist is eligible, the court may issue an order for probationary, conditional, hardship or specialized driving privileges.
