Welcome to the Indiana Trial Lawyers Association’s 32nd Lifetime Achievement Seminar. The Lifetime Achievement Seminar is a great tradition that recognizes our outstanding members! This year’s program features more than forty speakers on topics ranging from medical malpractice to depositions and ethics.

James O. McDonald was born and raised on a farm in Vigo County, Indiana, situated west of the Wabash River.

He began his formal education in a two room brick school house in New Goshen, Indiana which was heated with a coal stove situated in the northeast corner of the north room of the school. The male students took turns carrying in buckets of coal and buckets of water from an outside hand pump. The restrooms consisted of two outside privy’s, male and female. The north room of the school house accommodated the first grade and the south room of the school accommodated both the second and third grade classes.

By the time he entered the fourth grade a new school house with running water, central heat and inside toilets had been constructed in the town of New Goshen.

James found the new school gave him so much more time to study from not having to carry coal and water that by the fifth grade he

found the time, prior to school taking up in the morning, to learn that when Elmer’s Glue was squirted into the locks of the class room doors, all of the students would be sent to the cafeteria while the school custodian had to remove the hinge pins from each classroom door in order for the children to be able to access the classrooms. At that point, James understood that learning could be fun.

After more fun and learning James graduated from Indiana State University while he and his brother farmed about 800 acres and performed custom hay baling.

Upon graduation from ISU he enrolled in the Indianapolis Indiana University at Indianapolis Law School when it was only a night school.

Before graduating from law school he worked days for 6 months as a law clerk for Judge Allen Sharp and a year for Judge Joe Lowdermilk, both of the Indiana Court of Appeals. While attending law school at night, graduated in August 1972 and was admitted to the bar September 1972.

Upon graduating from law school he returned to Terre Haute and began practicing with brothers Ed and Warren Everett. He purchased the practice in 1982.

James tried a lawsuit with Hansford Mann and Max Goodwin in Gibson County in 1982 against I & M Electric Company from May until December 7th.

He and Max Goodwin tried a jury trial for a case for a dairy farmer against Tipmont Electric Company for 8 weeks in Parke County which resulted in a hung jury and a mistrial. They tried that case the following year for 9 weeks, resulting in a Plaintiffs verdict for their client which was upheld by the Supreme Court; 716 N.E.2d 357 (Ind. 1999).

In all James has had 27 published Appellate opinions. Cain v. Griffin, 849 N.E.2d 507 (Ind. 2006) established that an injured party is a third party beneficiary of a landowners insurance company with respect to medical payments of the policy. Auto Owners v. Harvey, 813 N.E.2d 1190, 842 N.E.2d 1276 (Ind. 2006) established that if it is a question of fact for a jury to determine if death resulting from a criminal attack was intentional or negligence, covered by the criminal’s home owners insurance.

James has been a member of the ITLA Board of Directors and College of Fellows since 1993 and was ITLA President from 2015-2016.

He is the proud father of James 0. McDonald II and his daughter Heidi Lynne McDonald and grandfather of Victor James McDonald. James II is married is Karen Haas McDonald who is a wonderful daughter in law and mother to Victor.

He practices law with his associate Joleen Klotz.

Kent Winingham was born and raised in Carmel, Indiana alongside his three sisters, Kate, Mary Beth, and Lindsay. After graduating from Park Tudor, he attended Bowdoin College in Maine where he played college tennis all four years. After college, Kent joined his two older sisters in Chicago. He attended Loyola University Chicago School of Law, and graduated in 2015. Kent then practiced in Chicago in the area of nursing home negligence until he moved back to Indianapolis in the spring of 2017 to take the Indiana bar exam and join Wilson Kehoe Winingham.

Since returning to Indianapolis to practice with his dad, Bill Winingham, and Bruce Kehoe, Kent has had the opportunity to try a variety of cases. He has tried motor vehicle collision, medical malpractice, and premises liability

cases. Kent is a graduate of the ISBA’s Leadership Development Academy (Class VII), has been honored as a Super Lawyers Rising Star, and was named one of 15 Up and Coming Lawyers in Indiana Lawyer’s 2019 “Leadership in Law” class.

Outside of practicing law, Kent is active in a variety of organizations. He is a member of the Goodwill Young Leaders Board, Indianapolis Bar Foundation’s Executive Board, Indianapolis Bar Association’s Young Lawyer Division Executive Board, serves as Chair of the ISBA’s Lawyer Advertising Ethics Committee, and serves as Treasurer of the Park Tudor Alumni Association. However, he is most proud of the fact that he convinced his wife, Ashley Hadler (lawyer at Garau Germano), to marry him this past August. Kent is equally proud of his three sisters, who he gets to see often in Indianapolis and Chicago. Kent’s mom, Maureen, is a longtime therapist who makes sure to keep all the lawyers she is surrounded by in check. Kent and Ashley enjoy spending time with friends and family, playing golf, traveling to South Carolina, and hanging out with their French bulldog, Layla.

Kent is honored to be the 2020 Max Goodwin Award recipient, and wants to thank his mom, dad, wife, and Bruce Kehoe, for all of their support and guidance along the way--but mostly, he wants to thank them for putting up with him.
