Dear ~lr. Kay:

Thank you for your February 10. 1964. letterconcerning the subject patent. If you know of any prior artantedating the patent in question. we would appreciate havingyou call that to our attontion. We have made a very extensiveinvestigation of prior art but know of no anticipations.

On the matt.er of Patent No. 3,086.206 of ChannelMaster Corporation. I must advise you that, in our opinion,it does not in any respect relate to the antenna of the Mayesand Carrel patent. Patent No. 3.086,206 is not owned by theUniversity of Illinois Foundation but rather is owned by thogroup with which you have identified it.

\

JFO Electronics Corporation holds an exclusivelicense under the patent above named as well as others in thos ane broad field owned by the University of Illinois Foundation. Under the circumstances, of cou.rse, the Foundation isnot in any position to grant any license rights to yourcompany. Again, ~IC state that we believe the antennas whichyou are manufacturing and selling comes clearly within thescope of the Mayes. et al. patent above identified.

Re: U. S. Patent No. 3,150,376U. S. Patent No. 3,210,767

Gentlemen:

On behalf of the patent owner, the University ofIllinois Foundation, we call your attention to the subjectu. S. patents, which we believe are infringed by certainantennas made by your Taco subsidiary.

Specifically, we believe that Patent No, 3,150,376is infringed by your Pathfinder series of antennas, asexemplified by Model PAS-70, and possibly others, whilePatent No. 3,210,767 is infringed by your Paralog series,as exemplified by JTP-190, and possibly others.

We ask that you immediately refrain frolll furtherinfringement of these patents. Failure on your part to ceaseand desist manufacture of all antennas infringing the subjectpatents will result in litigation which we desire to avoid,if possible.

Copies of the two patents identified above areattached for your information. Also included is a thirdpatent. No. Re. 25.740, which is closely related and may beof interest.

We would appreciate a prompt acknOWledgment ofthis notice and an assurance that you will cease infringement.

Very truly yours,

Dear Ed:

In accordance with the telephone discussion hadwith you Tuesday, it is agreeable to the University ofIllinois Foundation that all matters relating to preViouslyreleased trade and consumer ads of JPD Electronics Corporationwill be considered as bygones. There obviously was misunderstanding, by all parties, as to what was intended byparagraph 10 of the original licenso agreemeut. If thesuggestions presented in my April IS, 1964 letter concerningfuture advertising are carried out. we think there should beno problem. If the suggosted time-table of IS days forconsideration of advertising matorial proves inadequate. weundoubtedly COUld. under special occasions, accelerate theconsideration, although you realize that this might be difficultbecause of the number of people involved.

On the matter of patont markings and the identification of any apparatus as being rolated to the patonts inquestion. !Day lie ask that you will please submit full detailsof all contemplated structures sufficiently soon so that wecan make a review and advise you whether or not the contemplatedstructure is, in our opinion, actually covered by one or moreof the patents listed in your grouping. For more than 8 years, a group of antenna scientistsat the Antenna Research Laboratory of the Universityof illinois has been experimenting with vhf and uhfantennas that have no theoretical limitations on'bandwidth ~ are frequency-independent.

In fact, the LPV was developed by some of the same, scientists at the Antenna Research Laboratory of theUniversity of Illinois who designed the conical spiralantenna used in the Tr,ansit Satellite.
