It is the customer’s obligation to deliver all necessary Advertising Materials to Publisher by the due date listed above. Customer’s business card will be used in lieu of artwork if customer’s artwork is not received by “artwork Due Date” listed above. Customer is liable in full for total Advertising Charges in the event that Customer’s advertisement is not run due to Customer’s failure to meet Publisher’s Due Date set forth above. Publisher reserves the right to substitute Ad copy in lieu of delinquent Customer Art.GENERAL POLICIESDisplay adverting is sold on a first-come, first-served basis. All Advertising is subject to Publisher’s approval. Publisher agrees to give faithful reproduction of Customer-supplied artwork that complies to Publisher’s Particulars set forth on the reverse of this Advertising Agreement, and to use reasonable care to preclude omissions and errors displaying Customer’s information. Publisher warrants and limits its liability to the amount paid by the customer. This Agreement is subject to the Laws of Kitsap County in the State of Washington and is the complete and entire Agreement between the Parties. In the event of any unresolved dispute all Parties agree to waive court litigation in favor of arbitration in Kitsap County, with the prevailing party entitled to reasonable attorney’s fees. All Trade-outs, Discounted Ads and Comp Ads subject to available space. Full Customer refund within three days written notice of cancellation.RELEASE, INDEMNIFICATION & COLLECTIONSCustomer is purchasing Advertising in Publisher’s publications and as such agrees to release all reproduction rights of all copyrighted and/or proprietary materials submitted to Publisher for inclusion therein. The Customer agrees to indemnify and hold harmless the Publisher against any/all losses, liability and expense associated with all aspects of publishing Customer’s Advertising. Any overdue balance showing on Customer’s account will be charged a Finance Fee of one and one-half percent (1.5%) per month, and such amount will be added to customer’s statement, and Customer agrees to pay such Finance Fee charges as well as all costs associated with collections thereof including legal and/or arbitration fees and Court costs.
