Greetings from the Director

Welcome to Waseda University Institute of Comparative Law

KIKUCHI, Yoshimi

September 2014-September 2016

Waseda University Institute of Comparative Law was established in 1958 for the purposes

of conducting comparative research into Japan's legal system and those of other countries,

and to contribute to research and education in the field of Japanese jurisprudence.

Throughout its history the Institute has been systematically collating materials concerning

the legal systems of countries worldwide, accumulating collections of statutes, case law, and

law journals, and building one of Japan's preeminent law libraries.

The Institute's activities initially focused on research into legal systems, primarily of

Western countries, but with the development of Japan's social and economic systems and the

evolution of Japan's own legal system, steadily increasing importance has been given to

promulgating information about Japan's legal system to Western and other Asian countries.

The Institute's staff include 127 research members, all of whom are full-time Waseda

University faculty members, and 82 research affiliates selected from researchers outside the

university. In addition, agreements have been concluded with the Institute of Law, Chinese

Academy of Social Sciences; School of Law, Tsinghua University; Institute for Comparative

and International Law, University of Melbourne; School of Law, Duke University; , the Max

Planck Institute for Foreign and International Criminal Law; the Korea Legislation Research

Institute; and University College London (UCL), and exchange researchers are welcomed

from those institutions. Visiting scholars and researchers from abroad are also accepted

through such channels as the Waseda University International Affairs Division's

International Office.

The Institute is currently engaged in 18 joint research projects in which comparative-law

research is being actively conducted by its research members and research affiliates. In

addition, it holds public lectures on a semi-monthly basis for which it invites legal academics

from around the world who are at the forefront of research in various fields of law. The results

of these research activities are published regularly in our journal Hikaku Hogaku

(Comparative Law) and in our series of books grouped as Hikakuho Kenyujo Sosho

(Comparative Law Studies Series), and to provide information about the Japanese legal

system and jurisprudence internationally, we also publish the Waseda Bulletin of

Comparative Law annually in English. We have also recently been placing greater emphasis

on the use of websites for the dissemination of information in English, providing up-to-date

details of legislation and important case law and other topics such as recent developments in

the academic world. The articles are written by researchers conducting research activity at

the cutting edge of academia and posted in a timely manner.

In addition to these research activities, since 2013 we have been conducting an

Institute-wide research project entitled "The Role of Law and Legal Studies in the Transition

to a Sustainable Society: From the Perspective of Regional Law in Asia" This research is

based upon the reflection that modern nations pursuing development premised on ceaseless

economic growth have accelerated the depletion of natural resources and given rise to

production and labor surpluses, and it aims to give consideration to the role of law and

jurisprudence in balancing three elements: the economy, society, and the environment, in

order to accomplish a transition to a sustainable society that also takes future generations

into account. As exemplified by the problems that are afflicting the natural environment,

there is a pressing need for research of this kind, not only with regard to the situation within

Japan, but also at supranational level.

Learning in part from the experiment embodied by the European Union as a model case,

this project is conceptualizing the development of regional law for the Asian region. The

project arose from a conception by my predecessor as Director of the Institute, Professor

Yoshiki Kurumisawa (currently Senior Dean, Waseda University Jurisprudence Academy),

and as his successor I shall carry on the task of developing it.

Through diverse research activities such as those referred to above, Waseda University

Institute of Comparative Law desires to serve as an "open door" that contributes actively to

strengthening ties between law researchers in countries throughout the world and Japanese

jurisprudence and law researchers. Please feel free to contact the Institute. All approaches

will be welcomed.

The Institute of Comparative Law (ICL) at Waseda University was established in 1958. The

purpose of the Institute is to conduct comparative research on the legal systems of Japan and

other countries, and to contribute to research and education in the field of Japanese legal

studies. Working towards these goals, the Institute has been systematically collecting

material on the legal systems of other countries, including their statutes, case reports, and

law journals, to build one of Japan’s most impressive law libraries. With the development of

Japan’s social and economic systems and the evolution of its legal system, our mission has

expanded. We aim to disseminate information on the development of contemporary Japanese

law and its legal system, and to raise critical legal questions of universal importance for

discussion from a Japanese perspective.

At present, the Institute has 123 research members who are full-time faculty members at

Waseda University, and 111 research affiliates from elsewhere. In addition, agreements have

been concluded with the Institute of Law, Chinese Academy of Social Sciences; School of Law,

Tsinghua University; Institute for Comparative and International Law, University of

Melbourne; School of Law, Duke University; Max Planck Institute for Foreign and

International Criminal Law; Korea Legislation Research Institute; and University College

London (UCL). Exchange researchers from these institutions are welcome to work with us at

the Institute. Scholars and researchers from other countries can visit the Institute through

such channels as the International Affairs Division of Waseda University.

The Institute conducts three different programs: specific or individual events, group research

projects, and multi-annual research that is carried out by the Institute as a whole.

1) In terms of specific events, the Institute holds public lectures on a semi-monthly basis for

which it invites legal academics from around the world who are at the forefront of research

in various fields of law. In addition, our research members contribute articles to our annual

journal, the Waseda Bulletin of Comparative Law, or to our online publication, Topics of

Japanese Law. Both publish articles in English for readers worldwide, and the topics are

related to the contemporary Japanese legal system, such as recent Japanese legislation and

important Japanese court judgments.

2) Concerning group research, 20 joint research projects are being conducted by our research

members and research affiliates, who are working together on comparative legal studies.

3) Since 2013, we have been conducting an Institute-wide research project entitled ‘The Role

of Law and Legal Studies in the Transition to a Sustainable Society: From the Perspective of

Regional Law in Asia’. The research project is based on a critical view of modern states and

their societies, the rapid economic development of which is considered the premise of social

development. However, economic development has accelerated the depletion of natural

resources and environmental deterioration. Thus, the project aims to determine a new role

for law and legal studies that will be instrumental in bringing about a balance between the

economy, society, and the environment to achieve a transition to a sustainable society that

protects the interest of future generations. Economic activities go beyond nation-states, and

the social problems that result from these activities inevitably extend beyond national

borders. Thus, an effective legal response to the problem would require legal measures

and/or regimes at national, macro-regional, and global levels to work in a mutually

reinforcing and complementary manner. In this research project, we have tried to

conceptualize an Asian regional law/regime that will respond to some of the major

cross-border problems. Since there is a lack of research on macro-regional legal responses in

Asia, we have studied the experiences of the European Union for lessons and inspirations.

The results of our various research projects are published regularly, in print and online. The

print versions include our journal, Hikaku Hogaku (Comparative Law), our comparative law

book series, Hikakuho Kenkyujo Sosho, and our annual journal in English, the Waseda

Bulletin of Comparative Law. We also publish online articles in English in Topics of Japanese

Law. In addition, in 2016, we have started two new online publications, Waseda ICL Online

Journal and Waseda ICL Online Forum.

The Institute of Comparative Law aspires to be a unique forum that will strengthen ties

between legal scholars in Japan and other countries through its diverse research activities.

We welcome research proposals and initiatives, as well as academic professionals, from all

over the world.

Symposia and Lectures

ICL has conveyed its research results to the relevant researchers, and more broadly to

students and the general public through symposia and public lectures. ICL continues to

deepen it exchanges with interested parties both within and outside Waseda University.

In 2016 more than 270 people (including more than 30 students) participated in ICL’s

thirteen symposia; more than 457 people (including more than 123 students) participated

in its 22 public lectures. *

*The count of participants started in 2016. The total numbers attending ICL

events will therefore presumably have exceeded the recorded numbers.

ICL’s topics of study include those aiming at a profound understanding of

jurisprudence in various fields, in combination with interdisciplinary seminars in which

non-legal experts participate. Through these joint activities, ICL is able to approach

diverse issues from multiple perspectives.

Symposium ‘‘Brexit and Politics: The Constitution in England focusing on the gaps between

constitutional rule and political practice’’

In this symposium, reports and discussions were made from the perspectives of law and politics, mainly on

litigation in the UK that began to advance the way toward Brexit (withdrawal of the UK from the EU) following the

2016 referendum.

▼Professor Tamio Nakamura

Professor Tamio Nakamura introduced the background of the Brexit litigation. (The UK

government assumed that the notification of withdrawal from the EU could be made

solely by the UK government itself. Some UK citizens raised a lawsuit claiming this as

illegal. Decisions of the High Court (3 November 2016) and the Supreme Court (24

January 2017) both ruled that the UK government could not withdraw from the EU

solely by the action of the UK government, and the government thus needed national

legislation in advance of Brexit. Mass media, citizens and politicians supporting Brexit

fiercely refuted the courts’ decisions. Among them, the backlash against the Supreme

Court’s decision was so fierce that some media criticized the judges as ‘Enemies of the

People.’) Nakamura explained that the Supreme Court’s reasoning and conclusion were

in fact appropriate; but, at the same time the judgment highlighted the gaps between law and politics. The logic of

parliamentary sovereignty does not correspond to the form of direct democracy’ such as referendum, the latter

being the form of popular sovereignty; the supreme court decision did not touch on this constitutional point.

Nakamura commented that adopting the ‘principle of popular sovereignty’ could lead to such a fundamental change

of the constitutional theory in Britain, which would be unlikely to emerge under the UK’s current political culture.

▼Professor Takashi Kuramochi

In response to Nakamura’s report, Professor Kuramochi asked some questions from a

directly opposite standpoint, and thereby pursued clarification of Nakamura’s report. For

example, Kuramochi asked Nakamura whether it was appropriate or not for the court to

have decided solely on legal criteria without taking into consideration the political aspects

relevant to Brexit. Kuramochi thought that the opinion that the UK government itself was

entitled to give notification of the UK’s withdrawal from the EU was more appropriate. The

reason for his argument was that the withdrawal notice was, in legal terms, merely the

notification of the commencement of the withdrawal procedure and its retraction might be

possible. The results could thus not be predicted.

▼Professor Kunihiro Wakamatsu

Professor Wakamatsu presented the following arguments from the perspective of political

science. The Brexit litigations were essentially oppositions against the political

“procedure” towards withdrawal. Before the referendum, two-thirds of the UK

Parliament’s members supported remaining in the EU. There had thus been a possibility

that the decision to withdraw from the EU might be overturned if a procedure requiring

Parliament’s legislation before notification of withdrawal were to be made. The

supporters of the withdrawal from the EU won by a hair, and they felt that their position

was vulnerable. For these reasons, some UK citizens and many MPs supporting Brexit objected fiercely to lawsuits

that questioned the legitimacy of the withdrawal process.

▼Professor Ariyoshi Ogawa

Professor Ogawa shifted focus towards Europe, and he summarized how

referenda were politically utilized in European countries. Ogawa introduced the

example of the Swedish Parliament overturning the result of a referendum.

Ogawa pointed out that there were general trends to conduct referenda when the

ruling political party had the expectation of winning. Regardless of expectations,

there were increasing numbers of examples rejecting the ruling l party’s policies.

Ogawa introduced some perspectives to analyze such phenomena. He concluded

that, in the European countries beyond the UK, there was a lack of arguments how to position referenda in law and

politics.

The moderator invited questions from the audience and there were active exchanges of questions and answers.

The following suggests the variety of the questions that were posed:

- Does Brexit have any connection with the advent of the Trump

administration in the US?

- A referendum would be necessary for Japan to amend its Constitution. Is

there any lesson that Japan could learn from Brexit and other referenda in Europe?

- What position will Scotland take after the Brexit rulings?

- Is there any possibility that the Supreme Court is trying to strengthen

judicial power as opposed to the power of Parliament and the government by its

Brexit rulings?

- Is the appointment process for the Supreme Court’s judges democratically controlled?

The discussion was active and it ended after 30 minutes extension of the discussion time.
