Secure Storage for IP

• Decentralized Storage - No point of attack. Vaultitude securely stores intellectual property in a decentralized

method by using the InterPlanetary File System (IPFS) combined with the Blockchain.

• Encrypted. Confidential IP data will be fully encoded by Vaultitude before being uploaded.

• Cheaper than storing on-chain. Blockchain not suitable for large amounts of data as this increases network costs.

• Timestamp. The reference to the file, the hash, will be stored on the Ethereum Blockchain to obtain a timestamp and

together forms evidence ideally suited for legal proceedings. To retrieve the data, the address will be fetched from the

Blockchain and IPFS will be queried for the associated file.

Proof of Authorship / of Possession

• Solves existing problem. Holders of unregistered intellectual property rights (copyrights) the owner may have to be

able to later provide definitive proof of authorship as a defence against potential abuse.

Documentation and Protection of Trade Secrets

• New burden of proof. New laws like the EU Trade Secrets Directive require that all trade secrets need to be subject to

reasonable protection measures and that the mere intent of the trade secret owner to keep information secret is no

longer legally sufficient. A company failing to provide such proof of protective measures may lose its trade secret

protection.

• Secure physical storage difficult to proof.

• Encrypted storage on the Blockchain a suitable method. By securely placing encrypted trade secrets in their

Documenting use of Trademarks

• Documentation might be legally required. Some jurisdictions recognize trademarks rights arising through use,

while others strictly require trademark protection to be obtained through registration with the national trademark office.

Documentation is always a good idea.

• Blockchain once again ideal as proof. In the United States, registration requires to prove that a trademark is being used in

commerce and to do the same to maintain or renew that registration. Owners of unregistered trademarks nevertheless

possess legal rights. Following these principles of “use them or lose them” and “common law unregistered trademarks”,

evidence for the documented use of marks is desirable to their owners and can be achieved by storing such information

• Current defensive publication risk, outdated and expensive. Publication in scientific journals requires

preparation, the sharing of confidential information with multiple third parties and a lot of time. Establishing prior art as a

company requires costly service providers that print books and ship them to patent offices or store information on

parties, which comes with a number of legal risks linked to misconduct by the receiving party or IP theft.
