Welcome to our autumn Interiors sale! This month we bring you another range of privatecollections, spanning eclectic Scottish homes to an elegant French chateau.

Opening on page 8 we begin with a collection of fine Australian art amassed by the well-knownscholar and academic Professor Doeker-Mach, and his late wife, Alice Tay. Previously housed intheir chateau in the South of France, the collection of contemporary pieces features several of themost significant names in Australian art of the last fifty years, including William Rose, StanislausRapotec and Andrew Sibley.

Our collections then move slightly closer to home, as we feature pieces from the Edinburgh-baseddealer, the late Anna Fersch (page 51), as well as a range of furniture, pictures and works of artfrom Blacket Place in Edinburgh, belonging to one of Britain’s leading jazz singers, Todd Gordon(page 18).

We also delved into the world of upholstery and up-cycling this month, when we asked owner of TheOriginal Chair Company, Kate MacKenzie all about her job and what it takes to rework originalantique pieces. Turn to page 40 to find out more!

Anna Fersch was a well-known antiquesdealer from Edinburgh, who during hertime in the trade built up an impressivecollection of ceramics, furniture and worksof art. In particular she purchased andsold wrought iron, which was arguablysomething in her blood, being the daughterand grand-daughter of blacksmiths. ThisOctober we are fortunate enough to benefitfrom her good eye and passion for theantique, as we sell a range of pieces fromher home in Edinburgh.

A Private Collection of European &Australian Fine Art

Our fourth Interiors sale features an impressive collection ofpaintings and sculpture from the scholar Professor Doeker-Machand his late wife, Alice Tay. As academics in the fields of law andjurisprudence, both travelled extensively across the world, and inparticular acquired fine art during their time in Australia. Thismonth we are fortunate enough to be auctioning a range of theircontemporary Australian pieces, as well as paintings and sculpturesby the artists Gunther Christmann and Lothar Fischer.

Highlights from the Sale

This month we’re privileged to be selling items from of one of Britain’sleading jazz singers, Todd Gordon. Todd’s eclectic collection, from hishome in Blacket Place, Edinburgh, includes a range of antiquefurniture, paintings and works of art. Notable pieces include a 17thcentury oak trestle table, a Scottish longcase clock and a pair ofChristopher Fratin candlesticks.

Oak trestle table

Pieces of antique oak have always interested me, they have a lovely honest wear and patina that only 300 yearsof use can bring to furniture of this colour, and this table is no exception. It has an interesting yet simple

design and construction, enhanced by the detail of the carved frieze and theturned block legs. The age of the trestle table is also something whichfascinates me, when you consider the history and connection furniture likethis has with its previous owners, and all the hundreds of years ofconversation and celebration it has borne witness to!

St George and Queen Margaret of Denmark

Although the sale has a varied collection of modern and traditional paintings,the obvious connection between history and art is perhaps best shown in this19th century copy of a 15th century original. Queen Margaret was held to be abeautiful, gentle and intelligent royal, being the consort to King James III ofScotland. The image of 'St George and Queen Margaret of Denmark' also haswider Scottish significance too: the image had an important place within theTrinity chapel, and the original is on display in the Scottish National Gallery.The original features as one of several panels, which were commissioned byEdward Bonkil, Provost of the Collegiate Chapel of the Holy Trinity inEdinburgh. This is therefore a scarce opportunity to own a very interestingand attractive item, with a good story to tell!

Specialist’s Choice

Clocks

It has often been said that the beating of a clock is the heart of the home. My firstchoice, therefore, is not one particular item in the sale, but a nod to the various clockswhich we have for auction this month, ranging from impressive longcases to morediminutive mantel clocks. Although longcase clocks have become less popular andfashionable over recent years, they actually represent very good value for money.Examples range from around £300 to £3,000 in this sale, they offer the chance to own atrue and classic antique item, which is both functional and decorative. If you haven'tquite got the space for one though, then this can equally be said of a mantel or bracketclock too – so there really is something for every home here!

A Private Collection of European& Australian Fine Art

Professor Doeker-Mach is a well-known scholar andacademic who has worked in several countries includingAustralia, India, the United States, Canada and throughoutEurope. He is the author and editor and co-editor (withAlice Tay) of twenty books and the author of more than onehundred articles on comparative constitutional andinternational law (especially treaty law), legal systems andhuman rights. In addition he was a scholar on the subjectsof regionalism and federalism, as well as legal systems inAsia Pacific and the rule of law in Asia.

Alice Tay was the University of Sydney’s Challis Professor ofJurisprudence for twenty-six years and was committed tolaw as an instrument of justice and protector of democracy.Tay taught the first Australian university course on thesubject and published widely on it. Justice andjurisprudence – the philosophy of law - was her intellectualpassion.The following lots were collected by both Professor Doeker-Mach and Alice Tay over the last thirty years during theirmany posts and extensive travel throughout the world.

WILLIAM ROSE

William Rose, a native Australian, was a member of theVictoria Street Group of Sydney abstract expressionists.Rose was more comfortable with the title ‘constructivist’,however, which better suited the geometric, detailed andtightly controlled formal approach which typified his work.Throughout the early 1960s, Rose’s work was representedin significant national exhibitions, including AntipodeanVision, Tate Gallery, London. William Rose’s work is widelyrepresented across major Australian art galleries includingNational Gallery Australia, Art Gallery of New South Wales,Art Gallery of South Australia, Art Gallery of WesternAustralia, National Gallery of Victoria, Queensland ArtGallery, Museums and Art Galleries of the NorthernTerritory, Queen Victoria Art Gallery and Museum andTasmanian Museum and Art Gallery.

STANISLAV RAPOTEC

Stanislav Rapotec is highly regarded among collectors andinstitutions alike in his adopted home of Australia. Broughtup in the newly formed Yugoslavia, Rapotec led a politicallyactive life; establishing links between the Resistance andthe Royal Yugoslav government-in-exile in Jerusalem andCairo upon the collapse of the Yugoslavian army. Hediscovered a love of Australia after a visit in 1955 and wouldlater settle there and begin to paint. When asked about hiswork as an artist he once commented: "In order to createyou must have had experience. You must have quite a fewdramas; you must have suffered; when you have balancedon the razor's edge between life and death, only then areyou capable of true creation. To become an artist you musthave a life rich in experience, a strong desire to expressyourself, a will strong enough to carry out this desire andon top of all that - talent." His work is featured in manyimportant Australian collections, including the NationalGallery of Australia, Art Gallery of New South Wales, ArtGallery of South Australia, Art Gallery of Western Australiaand Queensland Art Gallery.

SIR SIDNEY NOLAN

Sidney Nolan is one of the best known and most significantartists Australia has produced. The Ned Kelly series ofpaintings and prints are among his most famous anddistinctive works. As well as telling the story of Australia’snotorious outlaw, Nolan explores the universal themes ofinjustice, love and betrayal. His unique depiction of theAustralian landscape is iconic. The Kelly saga of prints isheld in several national and international collectionsincluding the Tate Gallery, London..

What can you tell us about your businessand how it works?

My business started as a natural progressionfollowing my own love for antique chairs. I buyantique chairs and sofas and then have themfully restored and refurbished to bring themback to their former primed state. Thankfullythere are many people out there who have thesame love of antique chairs as I do and theyknow that if they come to The Original ChairCompany they are assured of buying a genuinepiece of history.

Part of your business is aboutrefurbishing and reupholstering antiquepieces of furniture, what would you saywere the benefits of doing this?

We sell many Victorian, Edwardian and olderperiod pieces and the wonderful expectation isthat these pieces are traditionally made usingskills honed by exceptionally well trainedcraftsmen. Once restored our customers arebuying a chair/sofa that is equal or better than ahigh-end new build piece but with the addedbonus that they have a unique item, and theyhave saved an antique from heading to landfill.

Is buying at auction a way in which yousource stock, and can clients bring theirown pieces to you for a face-lift?

We do source much of our stock from auction.This is often particularly helpful if we have aclient who is looking for a specific periodchair/sofa. We have developed a relationshipwith many auction houses over the years and

can usually track down an item which helps ourclients find the perfect chair. We also sourcefrom other avenues and often our clients donatechairs that they are finished with. They no longerhave need of the chair but nor do they want tothrow it in the tip. We are always happy to re-home unwanted antiques...

Clients do also bring in their own pieces for us torestore for them. We have a vast and variedfabric range to choose from and one of the mostenjoyable parts of our job is helping clients pulltheir colours, patterns and textured fabricstogether with trimmings etc. to transform theirfurniture.

For those that haven’t explored thisprocess before, is this a timely and costlymethod of furnishing your home?

There are certainly many pieces of furniture tobe bought for less money, but for anyone whowants a special piece of upholstered furniturewith history, who recognises the benefits of up-cycling and appreciates the value in periodpieces, then this is a great way to obtain aunique item to add to their home.

Time-wise, the process of buying an antiquechair, choosing fabric and having the upholsterywork done can take as little as 2-4 weeks or itmay take a lot longer. Bear in mind whenordering new furniture these days lead times canbe as much as 16 weeks! The most commonreason for time delays when we reupholster isthe wide fabric choice but we, at The OriginalChair Company, love fabrics, we know the fabric

The world of recycling and upcycling is ever increasing in a time whenfashions look to the more organic and people have less money for expensiveand brand new pieces for the home, so this month we spent some timetalking with furniture maker and upholsterer, Kate MacKenzie, founder of‘The Original Chair Company’ for a litte inspiration.

books well and are always happy to spend timehelping our clients with their choices. Oftencustomers know exactly what they want; it maybe to match in with an existing colour scheme intheir home. Other times the customers have noidea what they want and are delighted to takeadvice (and lots of fabric inspiring samples)home with them to mull over.

The end result is always the same: exceededexpectations and a delighted client.

You also design and make your ownpieces, what inspires your work?

I have seen so many wonderful, charming,beautiful and elegant pieces of antique furnitureover the years. They are the reason that I love myjob and they are also the inspiration behind mydesigns. It can often be the scale of a deepseated Victorian Armchair, the placement ofbuttons on the arm of Georgian bedroom chairor the curve along the back of a small Edwardiansofa that sets a piece apart and above the rest,and it is the detail combined with comfort thatmakes a successful design.

Tell us about a favourite project that youhave worked on in the past.

We recently worked with a well-known Londonbased international interiors company to puttogether a ‘Victoriania’ inspired brand offurniture. We collected many curvaceous, ornate,and heavily buttoned chairs, sofas and chaise-longues and then set to rebuild them; when theywere then upholstered in floral fabrics with

numerous trimmings the results were trulystunning / sumptuous!

What are your top tips for the home?

There is a saying about only having things thatare practical or things that you love in your home(this may work if we can add ‘on show’ in yourhome).

A home is an incredibly personal space andwhilst I, and everyone else, loves to look atglossy magazines, make-over shows and filmsets for ideas and inspiration, ultimately thechoice of decor should be a very individual one.

Saying that, I think the largest most expensiveitems in the home are generally not disposableand from an anti-landfill side point of view, theseitems could be in the family for generations. Ialso like at least one item in the room to havesome ‘real presence’ about it e.g. a chair! Aneutral colour scheme lends itself to being themost flexible over time. With a variety of texturesused in soft furnishings, wall coverings andflooring, this alone can become an interestingplace to be. If, like me, an entirely neutral roomis just too calm and lacking expression then it isso simple to add pattern and colour and yourown personality into a room with smaller items.For example, rugs, cushions, throws, lamps,pictures and smaller items of furniture such asfootstools and occasional chairs. All these itemsare relatively inexpensive and simple to change.

9. THIRD PARTY LIABILITY

All members of the public on ourpremises are there at their own riskand must note the lay-out of theaccommodation and securityarrangements. Accordingly neitherthe auctioneer nor our employees oragents shall incur liability for death orpersonal injury (except as required bylaw by reason of our negligence) orsimilarly for the safety of the propertyof persons visiting prior to or at a sale.

10. COMMISSION BIDS

While prospective buyers are stronglyadvised to attend the auction and arealways responsible for any decision tobid for a particular lot and shall beassumed to have carefully inspectedand satisfied themselves as to itscondition we shall if so instructedclearly and in writing execute bids ontheir behalf. Neither the auctioneer orour employees or agents shall beresponsible for any failure to do so.Where two or more commission bids atthe same level are recorded we reservethe right in our absolute discretion toprefer the first bid so made.

11. WARRANTY OF TITLE ANDAVAILABILITY

The seller warrants to the auctioneerand to you that the seller is the trueowner of the property consigned or isproperly authorised by the true ownerto consign it for sale and is able totransfer good and marketable title tothe property free from any third partyclaims.

12. AGENCY

The auctioneer normally acts as agentonly and disclaims any responsibilityfor default by sellers or buyers.

13. TERMS OF SALE

The seller acknowledges that lots aresold subject to the stipulations of theseConditions in their entirety and on theTerms of Consignment as notified tothe consignor at the time of the entryof the lot.

14. STANDARD VENDOR FEESAND CHARGES(Subject to VAT)

(1) Commission: 15% of the first £3000and 10% thereafter is charged on theselling price of each lot (subject to aminimum charge of £30). Loss anddamage warranty: 1.5% on value of lotssold. Photography: max £40 mono perlot, max £250 colour. InternetMarketing Service: £10 per lot.

(2) If a vendor wishes to withdraw a lotorganized for sale, a withdrawal fee willapply;

(a) If withdrawn over 28 working daysprior to the sale, this will be charged at10% of the mid estimate along with anyancilliary incurred (such asphotography), all subject to VAT at thecurrent rate.

(b) If withdrawn within 28 working daysof the sale, this will be charged at 20%of the mid estimate along with anyancilliary incurred (such asphotography), all subject to VAT at thecurrent rate.

15. DESCRIPTIONS ANDCONDITION

(1) While we seek to describe lotsaccurately, it may be impractical for usto carry out exhaustive due diligence oneach lot. Prospective buyers are givenample opportunities to view andinspect before any sale and they (andany independent experts on theirbehalf) must satisfy themselves as tothe accuracy of any description appliedto a lot. Prospective buyers also bid onthe understanding that, inevitably,representations or statements by us asto authorship, genuineness, origin,date, age, provenance, condition or

estimated selling price involve mattersof opinion. We undertake that any suchopinion shall be honestly andreasonably held and accept liability foropinions given negligently orfraudulently. Subject to the foregoingneither we the auctioneer or ouremployees or agents or the selleraccept liability for the correctness ofsuch opinions and all conditions andwarranties, whether relating todescription, condition or quality of lots,express, implied or statutory, arehereby excluded. This Condition issubject to the next following Conditionconcerning deliberate forgeries andapplies save as provided for inparagraph 6 “information to buyers”.

(2) Private treaty sales made underthese Conditions are deemed to besales by auction for purposes ofconsumer legislation.

16. FORGERIES

Notwithstanding the precedingCondition, any Lot which proves to be adeliberate forgery (as defined) may bereturned to us by you within 21 days ofthe auction provided it is in the samecondition as when bought, and isaccompanied by particulars identifyingit from the relevant cataloguedescription and a written statement ofdefects. If we are satisfied from theevidence presented that the lot is adeliberate forgery we shall refund themoney paid by you for the lot includingany buyer’s premium provided that (1) ifthe catalogue description reflected theaccepted view of scholars and expertsas at the date of sale or (2) youpersonally are not able to transfer agood and marketable title to us, youshall have no rights under thiscondition.

The right of return provided by thisCondition is additional to any right orremedy provided by law or by theseConditions of Sale.

GENERAL

17. We shall have the right at ourdiscretion, to refuse admission to ourpremises or attendance at our auctionsby any person.

18 (1) Any right to compensation forlosses liabilities and expenses incurredin respect of and as a result of anybreach of these Conditions and anyexclusions provided by them shall beavailable to the seller and/or theauctioneer as appropriate.

(2). Such rights and exclusions shallextend to and be deemed to be for thebenefit of employees and agents of theseller and/or the auctioneer who maythemselves enforce them.

19. Any notice to any buyer, seller,bidder or viewer may be given by firstclass mail in which case it shall bedeemed to have been received by theaddressee 48 hours after posting.

20. Special terms may be used incatalogue descriptions of particularclasses of items (Books, Jewellery,paintings, guns, firearms etc) in whichcase the descriptions must beinterpreted in accordance with anyglossary or guidance notes appearingin the catalogue. These notices andterms will also form part of our termsand conditions of sales.

21. Any indulgence extended to biddersbuyers or sellers by us notwithstandingthe strict terms of these Conditions orof the Terms of Consignment shallaffect the position at the relevant timeonly and in respect of that particularconcession only; in all other respectsthese Conditions shall be construed ashaving full force and effect.

22. Scottish law applies to theinterpretation of these Conditions.

Lyon & Turnbull carries on businesswith bidders, buyers and all thosepresent in the auction room prior to, orin connection, with a sale on thefollowing General Conditions and onsuch other terms, conditions andnotices as may be referred to herein.

1. DEFINITIONS

In these Conditions:

(a) “Auctioneer” means the firm ofLyon & Turnbull or its authorisedauctioneer, as appropriate;

(b) “deliberate forgery” means animitation made with the intention ofdeceiving as to authorship, origin, date,age, period, culture or source butwhich is unequivocally described in thecatalogue as being the work of aparticular creator and which, at thedate of the sale, had a value materiallyless than it would have had if it hadbeen in accordance with thedescription;

(c) “hammer price” means the level ofbidding reached (at or above anyreserve) when the auctioneer bringsdown the hammer;

(d) “terms of consignment” means thestipulated terms and rates ofcommission on which Lyon & Turnbullaccepts instructions from sellers ortheir agents;

(e) “total amount due” means thehammer price in respect of the lot soldtogether with any premium, ValueAdded Tax chargeable and anyadditional charges payable by adefaulting buyer under theseConditions;

(f) “sale proceeds” means the netamount due to the seller, being thehammer price of the lot sold lesscommission at the stated rate, ValueAdded Tax chargeable and any otheramounts due to us by the seller inwhatever capacity and however arising;

(g) “You”, “Your”, etc. refer to the buyeras identified in Condition 2.

(h) The singular includes the pluraland vice versa as appropriate.

2. BIDDING PROCEDURES ANDTHE BUYER

(a) Bidders are required to registertheir particulars before bidding and tosatisfy any security arrangementsbefore entering the auction room toview or bid;

(b) the maker of the highest bidaccepted by the auctioneer conductingthe sale shall be the buyer at thehammer price and any dispute about abid, which must be raised before thenext lot is offered, shall be settled atthe auctioneer’s absolute discretion.

(c) Bidders shall be deemed to act asprincipals.

(d) Once made, no bid may bewithdrawn.

(e) Our right to bid on behalf of theseller is expressly reserved up to theamount of any reserve and the right torefuse any bid is also reserved.

3. INCREMENTS

Bidding increments shall be at theauctioneer’s sole discretion.

4. THE PURCHASE PRICE

The buyer shall pay the hammer pricetogether with a premium thereon.

25% up to £25,000 / 20% thereafter.

VAT will be charged on the premium atthe rate imposed by law.

5. VALUE ADDED TAX

Value Added Tax on the hammer priceis imposed by law on all items affixedwith an asterisk (*) or dagger (†).Value Added Tax is charged at theappropriate rate prevailing by law atthe date of sale and is payable bybuyers of relevant lots.

6. PAYMENT

(1) Immediately a lot is sold you will:

(a) pay to us the total amount due incash or in such other way as is agreedby us. We accept cash, bank transfer(details on request), Switch or DebitCards and Visa or MasterCard (pleasenote there is a surcharge of 2% (VATincluded) when using credit cards). Wedo not accept American Express.

(2) any payments by you to us may beapplied by us towards any sums owingfrom you to us on any accountwhatever without regard to anydirections of you or your agent,whether express or implied.

7. TITLE AND COLLECTION OFPURCHASES

(1) The ownership of any lotspurchased shall not pass to you untilyou have made payment in full to us ofthe total amount due.

(2) You shall at your own risk andexpense take away any lots that youhave purchased and paid for not laterthan four working days following theday of the auction or upon theclearance of any cheque used forpayment after which you shall beresponsible for any removal, storageand other associated charges.

(3) No purchase can be claimed orremoved until it has been paid for.

(4) It is the buyer’s responsibility toascertain collection procedures,particularly if the sale is not being heldat our main saleroom and the potentialstorage charges for lots not collectedby the appropriate time.

8. REMEDIES FOR NON-PAYMENT OR FAILURE TOCOLLECT PURCHASES

(1) If any lot is not paid for in full andtaken away in accordance with theseConditions or if there is any otherbreach of these Conditions, we, asagent for the seller and on their behalf,shall at our absolute discretion andwithout prejudice to any other rights wemay have, be entitled to exercise one ormore of the following rights andremedies:

(a) to proceed against you for damagesfor breach of contract;

(b) to rescind the sale of that lotand/or any other lots sold by us to you;

(c) to resell the lot (by auction orprivate treaty) in which case you shallbe responsible for any resultingdeficiency in the total amount due(after crediting any part payment andadding any resale costs). Any surplusso arising shall belong to the seller;

(d) to remove, store and insure the lotat your expense and, in the case ofstorage, either at our premises orelsewhere;

(e) to charge interest at a rate of 1.5%per month above the current base rateon the total amount due, to the extent itremains unpaid for more than fourworking days after the sale;

(f) to retain that or any other lot sold toyou until you pay the total amount due;

(g) to reject or ignore bids from you oryour agent at future auctions or toimpose conditions before any such bidsshall be accepted;

(h) to apply any proceeds of sale ofother lots due or in future becomingdue to you towards the settlement ofthe total amount due and to exercise alien (that is a right to retain possessionof) any of your property in ourpossession for any purpose until thedebt due is satisfied.

(2) We shall, as agent for the sellerand on their behalf pursue these rightsand remedies only as far as isreasonable to make appropriaterecovery in respect of breach of theseConditions
