Generally speaking:International Buyers may only buy a house with an Annual Rental Value (ARV) over $177,000 or a condominium with an ARV over $32,400 which is in a Designated Development. Prospective International Buyers must apply for a Licence to Acquire Land and submit an application along with a consideration fee of $1 416.00 (refunded if the license to own property is granted).

From 1st April 2013 the cost of a License to Acquire is reduced from 18 percent to 6 percent of the purchase price of a condominium and from 25 percent to 8 percent of the purchase price of a house.

After 1st October 2014 the licence fees will rise to 8 percent of the purchase price of a condominium and 12.5 percent of the cost of a house

Agreement in principle between an international buyer and seller includes a

deposit of 10 percent of the purchase price. The deposit is held in escrow, sub-ject to contract, and deducted from the overall purchase price.

Properties that form part of a Tourism Designated Development or a Resort property are subject to a 6.5 percent licence fee.

International Buyers may not buy land without a dwelling on it, commercial real estate or property intended mainly to earn rental income.

International owners may be granted permission to rent their property by the Immigration Department. Permission rarely extends to periods of more than a year and includes a tax of 7.25 percent.

Many people do not wish to engage a lawyer to draft their Will in order to save the expense, but preparing a homemade Will can lead to disaster and cost your estate great expense in the long run to construe the meaning of your Will and/or uphold the validity of your Will in court. This also applies to Wills downloaded from the internet, or purchased at a store. There are many requirements to draft a Will. If it is not properly drafted it can be set aside or considered void. Without professional training, provisions of a homemade Will could be drafted in a way that leads to uncertainty of intention. As they say, “penny wise pound foolish”.

There are many key formalities that need to be considered when drafting a Will, which is why a lawyer should always be engaged.

Firstly, a minor (anyone under the age of 18) cannot make a Will. Also an individual of unsound mind does not have capacity to make a Will. If any of the above individuals make a Will an application can be made to the courts to have the Will set aside.

In Bermuda, a Will is required to be in writing. A Will cannot be made by audiotape or video. A Will is required to be signed by the testator in the presence of two or more witnesses. It is important to note that a Will cannot be witnessed by anyone receiving a gift or benefit under the Will. If a beneficiary witnesses a Will, it will not be void, but any gift to the beneficiary (or their spouse) will be void.

Consideration should also be taken when making a Will in contemplation of marriage. Many people may decide to make a homemade Will and then subsequently marry. Unless the Will specifically states that it is being made in contemplation of marriage, upon marriage any former Will executed will be void automatically.

It is common to have multiple Wills in multiple jurisdictions. You may want to have a Will in place for your Bermuda assets and a Will in place for your internationalassets. Most standard Wills contain a revocation clause revoking all previous Wills with an earlier date. By making a homemade Will you may accidentally revoke an international Will that you may want to remain valid. You may wish to only revoke

all previous Bermuda Wills and leave a Will executed in a foreign jurisdiction in place.

When making gifts and legacies, you should consider providing a “gift over” provision in the event that the intended beneficiary fails to survive you. For example if you leave $50,000 to your best friend, and your best friend dies before you, do you want your best friend’s daughter to receive the gift in her place? Under current law if a gift over is not specifically provided for in a Will (except if it is a gift to your direct descendant) the gift will fail should the beneficiary predecease you.

You should also carefully consider defining the object of a gift to be given under a Will. For example if you intend to give your current car to your sister you need to ensure that your Will specifically refers to the car in question i.e. naming the make, color and registration number. If you intend on giving any car owned by you at the time of your death to your sister, such provision will need to be drafted differently i.e. to give any car owned at the time of my death to my sister. Even though the difference seems insignificant the impact on the gift given is

not. In the first case if you do not own the specifically mentioned car at the time of your death then the gift will fail and your sister will not receive anything. In the second case your sister will receive all of the cars that you own at the time of your death.

As you can see there are many key considerations and formalities required to draft a Will. Therefore if you want to make a Will and ensure that your assets are passed in accordance with your wishes, it is best to engage a lawyer. Do not leave your loved ones with the financial burden of having to make an application to the courts to either con-strue the terms of your Will or argue its validity.
