• 15th February 2012 – European Social Partners conclude a Social Partners’ Agreement on certain aspects of working time

• 16th March 2012 – European Social Partners ask for the transposition of the SPA into a Council Directive

• 23th October 2014 – European Parliament supports unanimously the transposition of the SPA into a Council Directive

• 11th December 2014 – the Employment and Social Affairs Council adopts the Working Time Directive for IWT

• 1st January 2017 the Working Time Directive for IWT enters into force

Carrying principles:

• Average 8 hours per working day – maximum 14 hours working day

• Average 48 hours per week – maximum 84 hours per 7 days period

• 12 months reference period

• Maximum working hours per year 2304

• Maximum 31 consecutive working days

• 1:1 principle is guaranteed – if more working days than rest days = additional compensatory leave is granted

• Annual medical check up

Carrying principles:

• Minimum daily rest 10 hours of which at least 6 hours uninterrupted

• Minimum 84 hours per 7 days period

• Maximum 42 hours nightwork per 7 days period

• Minimum 4 weeks paid vacation/holidays

• -18 years old – protection – no nightwork

• All data must be kept on board for at least 12 consecutive months

• 1st January 2006 – NAIADES I action plan for IWT in Europe – Work package 3 focused on jobs & skills

• 1st February 2009 EDINNA – the Educational platform for IWT Training institutions in Europe was founded

• ETF IWT Memorandum 2010-2011 stressed the lack of qualified workforce as one of the ETF Key priorities as a reply to the European Commissions White Paper on Transport that stated that market opening had to go hand in hand with quality jobs and working conditions – human resources are a crucial component of any high quality transport system.

• Platina tables of Competency defined for both Operational and Managerial level

• NAIADES II continued in 2011 where NAIADES I left off – timespan to 2020

• 24th September 2012 first Common Expert Group meets – set up by the EC to accomplish NAIADES package on the recognition of professional qualifications and on the minimum level of training in IWT – supports EC in developing legal framework. All stakeholders are involved (Member States – EU Social Partners – River Commissions – Edinna -Aquapol). It meets 12 times by end 2014.

• CESNI – European Committee for Standards in Inland Navigation – a new instrument to harmonise qualifications is established in June 2015.

• 18th February 2016 draft directive on the recognition and modernisation of professional qualifications in IWT is published. (COM(2016)82final)

• 6th June 2016 ETF IWT Section adopts it position

• 7th June 2016 EU Transport Council adopts the draft directive.

For ETF following issues are of key importance:

• One harmonized, uniform system for the entire EU waterway network

• One central point/body to issue a Quality Assessment and Assurance system and to approve the training programmes

• Transparent – easy to implement – easy to control

• A high standard quality level via regular evaluation done by independent bodies

• Maximum validity of certificate of 10 years in order to remain as close as possible to reality

For ETF following issues are of key importance:

• No exceptions to the rule whatsoever – not even for the Rhine

• The draft directive proposal is the result of many years of intense debate and cooperation between ALL stakeholders (European Social Partners EBU/ESO/ETF – ALL River Commissions Rhine/Danube/Sava/Moselle – Edinna – Member States – Authorities – Aquapol

• So no institutional struggle as this will negatively impact on the content

• The newly introduced notion of “or other person” must be clearly defined as “other person serving on board” when referring to taking measures in emergency situation on board of passenger vessels. Same for LNG – no competencies should be outsourced to quay side staff.

Draft directive has been amended and adopted by the Transport Council of 7th June 2016.

Economic and Social Committee finalised its report – ETF will introduce amendments via EESC members in the TRAN plenary scheduled for 13/14 July.

Debate in European Parliament is awaited for October/November 2016.

Aim = adopted by end 2016.

• Present manning regulation is completely outdated and does not respond to the challenges of a modern IWT sector – a revision is long overdue

• A lot has changed – new technologies have been introduced – vessels became longer and wider – specialisation founds it way into the sector

• ZKR organised a round table on manning in November 2014 – aim was to bring all stakeholders to a same level of understanding and perception of the need to modernise

• At the request of the Dutch delegation EU Social Partners were requested to address some small changes to the Rhine Personnel Regulation as a leap of faith and good will – December 2015

• ETF Position is very clear – the more controlling capacity – the greater the ETF willingness to participate in a revision of the manning requirements

• TASCS – Towards A Sustainable Crewing System – the EU Social Partners introduced a EU funded project on 23rd June 2016

• Workload assessment

• Investigate how & whether influences impact on crewmembers whilst at work/rest

• All critical elements & influences will be identified

• Aim is a documented Social Partners proposal with different options, for an easy to use (transparent, flexible, sustainable) and easy to enforce manning instrument for the EU

• Will start in December 2016 and run till November 2018

• On board ship visits and interviews with crewmembers will be set up

• AQUAPOL acts as a platform for learning and for a permanent exchange of good practice for law-enforcement in the domain of waterborne transport in Europe. Its main activities are about exchange of intelligence, exchange of operational information and experience and cross border cooperation in day-to-day law-enforcement work. (European Agency Water police Organisations)

• ETF closely cooperates with Aquapol in search of an improved and efficient controlling capacity

• Aquapol identified that there is no level-playing-field in European IWT and that more and more social exploitation is to be noted with high safety risks

• Present controls are non-effective and inefficient

• What do we want:

• One unique EU - simple, clear, and transparent - legislation

• Watertight electronic registration of what needs to be controlled

• European database for documents regarding crew and vessel – on board unit

• Digital tachograph to monitor individual crewmembers’ working & resting times
