ndIn Session In Louis ville PRES HOGES REPORT All Lines Throughout Ken- tuckY ¬ Will be Extended During Summer Louisville Ky April 22Forty < ando managers representing practically all of the independent telephone lines in Kentucky are in Louisville to attend the meeting of the Ken ¬ tucky Independent Telephone Asso ¬ elation which is being held at the office of the Home Telephone Com ¬ pany on Fifth street between Wal ¬ nut and Chestnut streets Frank G Hoge of Pembroke president of the association is presiding at the meeting While this is the annual meeting of the association the purpose is tot change the date for holding the an ¬ nual convention Most of the mem- bers favor an amendment to the constitution and bylaws providing for the annual meeting to be held in December This amendment will be adopted and the present officers of the association will bereelected andt serve until the regular D c = t > er meeting Other important changes will be made in the bylaws Constitution and new members received v President loges Report At the morning session discussion was given to the report of President Hoge He reported in detail the work done during the year of his administration and told of the new companies formed and the lines ex in that time He said that the total number of independent tel- ephones ¬ in use and operation in Ken ¬ tucky on April 1 was 42760 He said that Kentucky offers a fine field for independent telephone companies andsaid that many now companies would be formed during the year It is the purpose of al independ- ent ¬ companies Mr Hoge said to e their lines and much work will be done during the summer months He said that hundreds of miles of wires would be stretched and thou- sands of telephones installed We want to reach the 100000 said Mr Hoge and see no reason why we should not The Optimistic View All of the members of the associa- tion view the situation in Kentucky from the independent standpoint with optimism In the discussions today they declared that the inde ¬ pendent companies were coming in Itheir own Reports of the Legisla ¬ tive Committee were received and the committee continued This com mittee will look after legislation not only in the state but in the cities and counties and will help independ ¬ ent companies seeking franchises The visitors will be entertained with a smoker at The Seelbach this evening A had the Clerk to issue an order di to Judge Prowae and Mr Renshaw for a stay of proceedings The papers were soon served after 1 oclo k by Corona r Allensworth This action is in the nature of an from the original order as is- sued by Judge Prpwse and the pe titian supporting this au enl will e new questions in the case These attorneys also contend that as Judge Barkers decision was not re ceivEd and entered upon the record within the prescribed twenty days the day on which Judge Cook the injunction which was March 2 that the opinion loses force dissolving the injunction is has been granted Mr Renshaws attorneys Trimble Bell claim that the decision is a settlement of all the law pointst The Frankfort Journal says In reversing the Circuit Judge and in some measure reversing the Court of Appeals as shown in the case of Schuft vs Pflanz 99 Ky 97 Barker calls attention to thef made in the revenue law of which required that the new c Iyear on or before the first Monday in January of each year It was ad- mitted j that the bond was not fill d and accepted by the County Judge or before the first day of March 1908 and the judge points out that law gives the County Judge the opinion of removing the Sheriff or suspending him from office for such and as the County Judge the opinion of removing the Judge decides he was clear ¬ within his rights and therefore the office to Renshaw Judge Barker draws the following between the decision in the case of Schuff vs Pflanz above referred to and the present case as followsSection I 4557 of the Kentucky provides that it shall be the duty of the county court to cause the sheriff annually to renew his bonds and upon his failure to do so the is required either to suspend from acting until he does give or may vacate hi4 office So far this phase of the case is concern ¬ I am of opinion that concluded by the reasoning in Schuff vs Pflanz Ky 97 That case is similar in principle in all respects to the case at bar except that after the sheriff failed to give bond at the proper the county judge accepted his and then entered an order va- cating ¬ the office and appointing a I successor The court then goes on H to shpw that the present toss lifts in that the county judge old nolpicl a cept the bond of Smith but on other hand made an order vacating toI pro- vided ¬ by law and appointing his suc ¬ theI case of Schuff vs Pflanz the same decision as in the present case would have been rendered The court overruled the conten tion of Smith that it was the duty of the county judge to first notify him requiree d ¬ ing that the onus that he would oc ¬ an office adjacent to the house and perform the duties of th office until he coud get the regular officeCounty I Judge Prowse and all other county officers excepting County Attorney Duffy the only Delriacratlefcon the squarewit 1 recognize Mr Renshaw ad if Mr Smith refuses to yield there will u two sheriffs each claiming to be th legal officer The affair is so com ¬ plicated that it is hardly possible t explain the exact status of the claim s made by the two sides In brief it may be stated that Mr Smith claims that the appeal taken was not onI the order itself and the court while dissolving the injur ctit > n did not have before it the case on its merits and that the opinion itself did no come within the twenty days limit An appaal has been taken from th order of removal and Mr Smith claims the right to hold on until thi settled in June and another appeal taken Mr Renshaw claims the the court of appeals had settled the whole thing by sustaining the right of the County Judge to make the or- der of removal and that the question of time was waived by a written agreement on the appealed papers The law makes ita misdemeanor to refuse to obey the court order provided it
