Papers of C. Nils (Cyrus Nils) Tavares (b. 1902, d. 1976)

Introduction

The papers of C. Nils Tavares, attorney, public servant, and District Court Judge of the United States District Court for the District of Hawaii, were presented to the Hawaii State Archives as a gift by his daughter Shirley Ann Tavares Wetzel in 1993. Physical custody of the papers is assumed to have been uninterrupted after Judge Tavares' death in 1976, the majority of the documents being found in his residence where his wife, Mrs. Unita Thelma Gillet Tavares, continued to live until her death in March, 1993.

Another set of papers was accessioned by the Hawaii State Archives in 1999. Composed primarily of correspondence of the 1950s pertaining to statehood issues, these records were given by the U.S. District Court Library and taken by the University of Hawaii, School of Law. In 1979, the Law School transferred the records to the University of Hawaii, Hamilton Library. In 1999, the Hamilton Library transferred the records to the Hawaii State Archives. Although these records have been added to the collection, they have not been interfiled with the other records received from Ms. Wetzel.

Access to this manuscript collection is unrestricted with the exception of material containing personal/financial information, and attorney;client and attorney work product files. They are restricted by Hawaii Revised Starutes (HRS) §§92F,13, and 92F�l4 and Office of Information Practices ("OIP") opinion letter 03-19. The restrictions are removed by HRS §94-7, effective on different dates as marked on the Records Container List. See reference archivist for assistance.

Biographical sketch

The Honorable Judge C. Nils Tavares1 was born in Pukalani, Maui, on April 12, 1902. His father, Antone F. Tavares, was also a prominent figure in Hawaii: a business man, a Representative to the Territorial Legislature from 1910�1920, and a Territorial Senator from 1920,1928.

Judge Tavares' personal life and professional career touched upon and shaped the State of Hawaii in its transition before and after 1959. When Judge Tavares resigned as Attorney General in 1947, Territorial Governor Ingram M. Stainback stated:

I venture to say that more history has been made during the last five years than at any time since the annexation of the Territory, and Judge Tavares has played no small part in the making of this history.

Governor Stainback could not have conceived of the continuing role Judge Tavares would play in the years after 1947. Indeed, _at the memorial service in 1976, Chief Justice William H. Richardson called Judge Tavares one of Hawaii's "founding fathers".

Cyrus Nils Tavares attended and graduated from Maui High School, class of 1920, matriculating to the University of Michigan.

In 1925, he graduated from the University of Michigan with a degree in law and earning entry into the Order of the Coif by graduating in the top 10% of his class. He was also an editor of the Michigan Bar Review. After graduation, he returned to Maui, where he was appointed Deputy District Magistrate, a position in which he served from 1925 to 1927.

In 1927, he relocated himself and wife to Honolulu. He was appointed as a deputy attorney general under the Attorney General William Lyman, and while in that office he met future Attorney General Harry R. Hewitt. Judge Tavares continued to work as a deputy attorney general until 1934, when he formed a partnership with his boss Mr. Hewitt, and began private practice as Hewitt &: Tavares. Their parmership would last until 1940.

His professional relatio11ship to the Archives is tangential but happily coincidental. In 1935, the librarian of the Archives of Hawaii, Ms. Maude Jones, a republican, was abruptly and, as had been alleged, due to a political change in the administration, removed from her position. From 1935 to 1937, Judge Tavares represented Ms. Jones in a lawsuit seeking her reinstatement. In 1937, Ms. Jones regained her position.

From 1940 to 1942,Judge Tavares worked in private practice, later accepting an appointment to serve as a Special Deputy Territorial Attorney General for War Emergency Matters from 1941 to 1942. He continued working as an Assistant Attorney General from 1942 to 1943. In 1944, Governor Ingram Stainback appointed him Attorney General, a position he held until resignation in 1947.

When Judge Tavares left government work, his future law partners C. Dudley Pratt and Charles E. Cassidy, welcomed him. They renamed their law firm Pratt, Tavares & Cassidy, where he wouldwork until 1960. The firm is now known as Case Bigdow& Lombardi.

In 1950,Judge Tavares was elected as a delegate to the Constitutional Convention, serving as a subcommittee chair for the Judiciary committee, and as an integral part on several other committees including the Style committee which was responsible for the document's overall format and integrity. Throughout,Judge Tavares zealously advocated for Statehood. In his own words, he was a "'laboring oar" that helped draft the final form of Constitution later ratified by plebiscite in 1959.

In 1949,Judge Tavares served as sub,committee chair of the Taxation and Finance Committee of the Hawaii Statehood Commission. From 1953 to 1956, he served as chairperson of the Commission, giving testimony before the United States Congress in 1954. In 1956, perhaps due to his efforts to reapportion the districts for future elections, and due to the Democratic political groundswell then building against Republicans generally and him specifically, the Senate failed to confirm the nomination for his position with the Commission ( see letter dated October 16, 1956 from Governor Samuel W. King).

On January 14, 1960, President Dwight D. Eisenhower nominated Judge Tavares to serve as the first federal judge for the United States District Court for the District of Hawaii. The Senate failed to confirm the nomination before it recessed, and on October 13, 1960, President Eisenhower issued a recess appoinnnent for Judge Tavares to fill the vacancy. He was sworn in on October 25, 1960. As the sole interim federal judge from 1960 to 1961, Judge Tavares technically served as "Chief Judge" of the United States District Court for the District of Hawaii for that period.

On January 10, 1961, when the Senate reconvened.Judge Tavares was nominated to one of two full-time, life.time judgeship positions. After several months, on September 21, 1961, he, a republican, and Judge Martin Pence, a democrat, were confirmed. On September 22, 1961,Judge Tavares received his commission from President John F. Kennedy. Despite Judge Tavares' "seniority" for his service since October, 1960, the title "Chief Judge" was bestowed upon Judge Pence.

In 1969, Judge Tavares requested, but later withdrew his name from consideration for appoinnnent to a vacancy on the Circuit Court of Appeals for the Ninth Circuit. The appointment would eventually go to his colleague John F. Kilkenny, a contemporary District Judge from Oregon. In 1971, President Richard M. Nixon appointed Herbert Y.C. Choy to the Ninth Circuit Court, the first judge to serve from the State of Hawaii; at Judge Choy's request, Judge Tavares administered the oath of office.

Judge Tavares served Hawaii and, by intra�district assignment, other state federal district courts, assuming senior/retired status on April 12, 1972. His health was failing due to years of radiation and surgical treatment at the Mayo Clinic in Minneapolis for stomach cancer and kidney disease. Despite his weakened condition, in 1975 he signed his commission to the Ninth Circuit Court Administrators, indicating his willingness to serve as District Judge for another year through 1976. On August 3, 1976,Judge Tavares died in Honolulu.

Apart from his judicial career, Judge Tavares served Honolulu and Hawaii in several other important ways. ln 1935, he was a member of the Compilation Committee for the Revised Laws of Hawaii, the statutory precursor to the Hawaii Revised Statutes. From 1943 to 1953, he served in an uncompensated position as member of the Advisory Board for Registrants for the Selective Service System.

In 1950, he helped establish and served as the first president for the Legal Aid Society of Hawaii. In that year, he was also elected as President of the Bar Association of Hawaii.

From 1952 to 1954, he served on the Hawaii Supreme Court Procedural Rules Committee.

Receiving an appointment in 1957 from Mayor Neal S. Blaisdell, Judge Tavares served as a commissioner for the Honolulu Charter Commission from 1957 to 1959. Other information can be found in Series C&Cl - Honolulu Charter Commission?

In the early 1970s, Judge Tavares was asked to be a consultant to the Hawaii Bicentennial Commission's "Encyclopedia of Hawaii" project. As one of the state's "founding fathers," Judge Tavares was asked to author or co�author certain articles pertaining to statehood Although the project foundered and a final product was never produced, some information has been retained by the Hawaii Bicentennial Commission, and has been accessioned by the Archives. Other information can be found in Series 192 - Encydopedia of Hawaii, Records relating to, 1973,1976.

Essentially, Judge Tavares played an architect's role in creating all of Hawaii's laws; legislatively, o administratively and judicially. During the Constitutional Convention of 1950, he helped draft a

constitution which frames the executive, legislative and judiciary branches of government. As a member of the Compilation Committee, he helped rewrite and compile the statutes of the Territory. On the Hawaii Supreme Court Procedural Rules Committee, he helped create rules which govern the judiciary. Ultimately, as one of the first federal judges for the State of Hawaii, he created a substantial body of decisional case law.

Scope and Content Note

The items within the C. Nils Tavares Manuscript Collection span the years 1922 through 1976, with the bulk of the collection falling into the years he served as a delegate to the Constitutional Convention (1950), as a member of the Statehood Commission (1950 through 1956), and as United States District Court Judge (1961 through 1976). The following types of materials are included in these papers: drafts, both holographic and typed; correspondence; lists; tabulations; memoranda; legal documents; research notes; printed materials; Xerox, Photostat and Thermofax copies; photographs and phonodiscs.

The papers include committee documents for the Constitutional Convention of 1950, records of the Statehood Commission, and Judge Tavares' working papers for the cases for which he wrote opinions. There is also an extensive collection of correspondence dating from the mid 1920s through the 1950s, retained by the addressee, his wife Mrs. Tavares. Another extensive collection of correspondence, written to his college friend Mr. Herbert .. Hans" Wagner, was apparently given to Mrs. Tavares in March, 1990.

When accessioned by the Archives, the majority of the records were filed and pronged in folders or binders which were labeled understandably as related to the contents therein. In some situations, records unrelated to the file labels appeared to have been placed loosely therein; in other situations, folders or binders were unlabelled or apparently mislabeled according to the contents therein. During processing of the records by the Archivist, certain series were assigned, and the records reorganized chronologically and/or alphabetically for ease of reference to the researcher.

Series Descriptions

Appointment Books: 1927, 1934, 1936, 1945, 1947; 1976, 1.5 cubic feet in 39 volumes.

This series contains daily planning and reminder books concerning his life as an attorney in private law practice, his duties as a deputy attorney general. as well as daily notes to himself about cases and work in progress, likely a function of his billing practices. These books contain details about his law practice such as client names, types of cases (wills, probates, land, leases, stocks, etc.), and actions taken.

The books continue through the years of his judgeship, but contain very little personal information as compared with a personal diary or journal.

The appointment books are arranged chronologically.

II. Correspondence: 1923; 1976, 2.5 cubic feet.

Judge Tavares met Unita Gillet, a Michiganite, at the University of Michigan. The lettersfrom Judge Tavares to Mrs. Tavares span approximately the years from 1925 when hereturned to Maui after graduating, to 1928, and contain many career and professionaldetails including his plans and intentions, travel between Maui and Oahu, and somedetails about the early years of his law practice. The correspondence evidences the .. longdistance" relationship the couple shared since she remained in Michigan for much of thisera.

Judge Tavares' professional correspondence covers many different areas of topics, someof them personal, including scheduling speaking engagements and participation inorganization activities. Judge Tavares was a very public figure both before and after hisappoinnnent to the bench in 1960.

Judge Tavares established a lifelong friendship with Mr. Herbert .. Hans" Wagner. Whileat the University of Michigan, the two often sang and performed publicly, with JudgeTavares playing guitar. Newspaper accounts of them exist for and after their collegeyears. The two remained correspondents in the years after Judge Tavares returned toHawaii.

Condolence letters sent to Mrs. Tavares in 1976 document the life lived, and the livestouched, by Judge Tavares. Although lacking in biographical information, the collectionprovides some sentimental background.

This series contains several subseries, generally arranged chronologically. The majorsubseries are: (A) letters to and from the Judge, Mrs. Tavares, her sisters, brother, sister­in-law, and other family members; (B) professional correspondence from Judge Tavaresas an attorney or as Judge; (C) correspondence to and from college classmate Mr.Herbert .. Hans" Wagner; (D) congratulatory letters upon the Judge's retirement in 1972;and (E) condolence letters to Mrs. Tavares upon the Judge's death in 1976.

This series provides the biographical and autobiographical account of Judge Tavares' professional career in Hawaii. He prepared resumes periodically for various purposes, submitting them to various publishers including Who's Who, Men and Women of Hawaii, and West Publishing. Campaign literature and biographies were also prepared for his candidacy for delegate to the Constitutional Convention of 1950, and for his nomination for United States District Court Judge.

The records are arranged alphabetically.

Arranged alphabetically by subject matter or client name, this collection includes somefiles of clients or matters handled while judge Tavares was a practicing attorney on theisland of Maui in the mid 1920s, and later in Honolulu in 1939, and in 1959.

V. Attorney General Files: 1944.-194 7, 0.25 cubic feet

As Territorial Attorney General, Judge Tavares oversaw several important cases in post­war Honolulu, including Duncan v. Kahanamoku, a historic case that successfullychallenged the United States Army's unconstitutional imposition of martial law uponHawaii (December 7, 1941 through October 19, 1944), and the unlawful suspension of theright of habeas corpus. The Duncan case was eventually heard by the United StatesSupreme Court on December 7, 1944. Judge Tavares was also the Territorial AttorneyGeneral who oversaw the police graft cases of 1947. VI. Hawaii Statehood Commission: 1947-1956, 1968, 1.5 cubic feet

Although the Territorial Senate did not reconfirm Judge Tavares as chairman of theCommission after 1956, records pertaining to the Reapportionment efforts in 1956 wereplaced within this subseries arrangement. Similarly, records pertaining to the 1968Constitutional Convention ("Con Con"), were kept with this subseries, and placed at theend of this subseries arrangement.

Although the records span a period of several years, this sub,series refers primarily toofficial statehood efforts prior to and including 1953. Each of the subseries files containsinformation pertaining to discrete issues including congressional hearings inWashington, D.C., publications of the Commission, statements and other testimony,research of the statehood campaigns from other states (Alaska, Texas, etc.), and meetingminutes. VIII. U.S. District Court judge: 1961,1976

Judge Tavares authored opinions in the many cases presented before him, and many wereretained as part of this collection. His service, however, was not confined to the

Qchambers in Honolulu. Rather, inter·district assignments took him to District Courts inCalifornia, Washington, Arizona, Nevada, and elsewhere. Further, he served briefly as aninterim judge on the Circuit Court of Appeals for the Ninth Circuit.

In some cases, in addition to the final decision or order, the file contains research,pleadings, correspondence, or other case related material. In some cases, publicity oreditorial comment is found among the newspaper clippings in section XU, below.

The records are arranged by court jurisdiction or venue, and alphabetically therein byplaintiff's name.

IX. Speeches: 1932,1974, 0.5 cubic feet

A contributor to civic and other causes, Judge Tavares gave several speeches during hiscareer, and he retained his prepared scripts for many of them. Most of the speeches were,naturally, related to the legal profession, the Constitution, or the Statehood Commission.He was also asked to give commencement addresses for Flint College of the University ofMichigan in 1963 (unfortunately missing), and for the University of Hawaii in 1948(fortunately retained). There are also scripts documenting events in his professional life:his resignation as Attorney General in 1947; and his acceptance upon appointment asinterim Judge in 1960.

Not only an attorney and public servant, Judge Tavares was a man of the community,participating in many clubs and organizations. On August 4, 1976, Judge Tavares' death was front page, headline news in both theHonolulu Advertiser and Honolulu Star Bulletin. Condolences, honors and tributes andpoured in from around the state and from around the country. On August 12, 1976, aspecial session of court at the Judge's courtroom was held, allowing attorneys and hisfellow judges to celebrate his life; an official court transcript is among the collection.

When accessioned by the Archives, the records pertaining to the services and ceremoniesafter Judge Tavares' death, likely maintained by Mrs. Tavares or Ms. Wetzel, werecollected in large manila envelopes.

Personal Effects and Artifacts: 1920-1976, 5.0 cubic feet

High School annuals, college year books, musical programs, gavels, name plates, andother personal effects are part of the collection. Photographs, newspaper clippings andscrapbooks are also here. Documents showing the Judge's educational and legal careersuccesses are joined with evidence of his musical prowess on the guitar and ukulele.

Newspaper articles and clippings were replaced by photocopies made on archival qualityacid free paper. Where-ever possible, the newspaper articles were then arrangedchronologically.

The Memorial Book, other original newspaper clippings which had been affixed toscrapbooks, and portions of entire newspaper daily editions, are also part of thecollection, and are retained without being preserved by photocopying processes. TheMemorial Book has been placed separately in a smaller sized "flat" box, Box M�491-32.The scrap books and newspaper portions are placed in larger "flat" boxes, M-491-33, M·491�34, and M-491-35.

Certificates have been placed in several boxes depending on their size. Box M-491-27contains certificates which are generally 8.5 x 11 inches and are able to be filed in archivalfolders and a six inch Hollinger box. Box M·491-30 is a larger "flat" box, and containscertificates which are generally larger than 8.5 x 11 inches.

TENNEY FAMILY COLLECTION

This collection contains predominantly photographs of the Tenney family, donated by the Honolulu Academy of Arts in February 1981. The collection contains 2.25 linear inches.

BIOGRAPHY

The Tenney family of Honolulu, Hawaii, was engaged in business and some important positions once held by Edward Davies Tenney (1859-1934) include: President and Chairman of the Board of Castle & Cooke, Ltd.; Chairman of the Board and President of the Matson Navigation Co.; Chairman of the Board of Bank of Hawaii, Ltd.; and President of Hawaiian Sugar Planters Association. His wife Rose Williams Makee Tenney (d. 1927), daughter of Captain James Makee, was active in the social life of Honolulu, a patron of the arts, and involved with the Episcopal church of Hawaii. They had two children, Vernon Edward (1895-1937) and Wilhelmina (1891-1951).

Wilhelmina, served in France with the American Red Cross during World War I, and on her return to Honolulu was active in local civic affairs, associated with many local charities, and a patron of the arts. At the time of her death on June 5, 1951, Miss Tenney was a board member of Castle and Cooke, Ltd., Honolulu Academy of Arts, Strong Foundation, Honolulu Symphony Society and Catholic Charities. She remained unmarried and had no children.

SCOPE AND CONTENT NOTE

The collection contains primarily photographs of the Tenney family. The only papers in the collection are a certificate issued by the American National Red Cross to Wilhelmina Tenney, and genealogy charts of the Tenney and Castle families.

The photographs are located with the Photograph collection.

THOMPSON SETTLEMENT ASSOCIATION

An organization formed under provision of Land Act, 1895, that homestead areas might be acquired by cash freehold agreement, allowing installment purchase extending over three years with provision whereby six or more persons might form a "settlement association" and obtain homesteads in one block ofland.

Organization took its name from organizer, Dr. Lyman S. Thompson and included (1907) Floyd C. Eaton, Bertha Ben Taylor, Charles G. Macomber, George C. Hewitt, S. E. Rogers, George J. Green, Lou H. Rogers, LilyK. Auld, John Kekuna, Walter H. Hayselden and Jane B. Jones.
