CPRA/Geidankyo is a collective management organization (CMO) with a mission

to protect performers’ rights and benefit andto support the creative activities.

In 1993, the Center for Performers’ Rights Administration (CPRA) was established by

the Japan Council of Performers Rights & Performing Arts Organizations (Geidankyo)

as a specialized body for appropriate administration of performers’ rights with the

cooperation of other concerned organizations.

Since 2012, when Geidankyo became a public interest incorporated association, Rights

Holder Members Committee was formed of such rights-entrusted general incorporated

associations as the Japan Association of Music Enterprises (JAME), the Federation of

Music Producers Japan (FMPJ), Music People’s Nest (MPN) and Performers’ Rights

Entrustment (PRE) along with the CPRA Executive Committee. CPRA is committed to

the administration of performers’ rights independently, transparently and on rightsholders

own initiative.

CPRA is supporting creative activities and contributing to the development of culture

and art by promoting smooth use of performances and protecting performers’ rights.

CPRA/Geidankyo is a collective management organization (CMO) with a mission

to protect performers’ rights and benefit andto support the creative activities.

Performers’ rights are protected in an international framework in the form of a

convention to which most countries in the world are signatories. In this framework,

foreign performers’ rights are protected in Japan and, in the same way, Japanese

performers’ rights are protected overseas. To enable this mechanism to function

practically and satisfactorily, performers’ rights management organizations in each

country have reciprocal agreements, under which they collect and distribute the

royalties for the performers of contracting parties.

CPRA/Geidankyo, as an ordinar y member of Societ ies ' Council for the

Collective Management of Performers' Rights (SCAPR), has actively entered into

such agreements with its counterparts for the effective international protection of

performers’ rights.

Collection and Distribution

The Copyright Law of Japan entitles performers to neighboring rights to their performances

fixed on commercial phonograms.

CPRA/Geidankyo is designated by the Commissioner for Cultural Affairs, the Japanese

Government, as the only organization authorized to exercise on behalf of performers’ and other

right holders’ rights;

(1) to claim secondary use fees of commercial phonograms in broadcasting and wire diffusion, and

(2) to claim remunerations of commercial phonograms for CD rental.

In addition, CPRA is also engaged in management of performers’ rights related to the use of

broadcasting programs, by utilizing its long built-up know-how on collection and distribution of

secondary use fees of commercial phonograms.

CPRA receives the usage report of the secondary use fees of

commercial phonograms from broadcasting organizations and

wire diffusion organizations and royalties and remunerations for

CD rental from CD rental shops, and the col lected monies are

distributed to entitled right holders on that basis. For this procedure,

CPRA/Geidankyo has built up a database consisting of performers

information and repertoire. The entitled right holders are identified

by collating these databases with the used commercial phonograms.

Efficient distribution also contributes to reducing CPRA’s

workload and expenses. As a result, its commissions can be phased

down, resulting in an increased sum of distribution to right holders.

Strengthening performers’ rights and eliminating

the infringement, CPRA discusses with other related bodies

effective ways to address these issues, and is actively committed

to promotional activities including the Arts and

Culture Forum and the Culture First campaign.

For Smooth Distribution and Appropriate Protection of Performances

Advocacy and public information activities

CPRA is also engaged in research on performers’ rights and on effective ways

to exercise these rights in information society.

Research

In collaboration with international bodies of performers,

the International Federation of Actors (FIA) and the International

Federation of Musicians (FIM), CPRA is making contribution

to formulate international norms regarding performers’ rights

and their protection in the World Intellectual Property Organization

(WIPO).

Formulation of international norms on performers’ rights

CPRA is cooperating with international organizations including WIPO regarding

the improvement of legal bases for protection of performers and collective management of

their rights in developing countries, and providing support in diverse ways to the national

governments concerned and relevant non-governmental organizations.
