About Japan Ocean AFR
u On March 30, 2012, a Customs Law amendment passed through the
Diet in Japan.
u This amendment enacts the Advance Filing Rules (AFR), which
require a vessel operator or a non vessel operating common carrier
(NVOCC) to electronically submit information on maritime container
cargoes to be loaded on a vessel intended to entry into a port in
Japan, to Japan Customs in principle no later than 24 hours before
departure of the vessel from a port of loading.
u The Rules will be implemented in March 2014.
u The implementation of AFR shall be executed using electronic data
processing system managed and operated by Nippon Automated
Cargo and Port Consolidated System, Inc. (the NACCS Center).

Question: Why is the new timing for submission for
Japan Ocean AFR based on the date/time of departure,
not the date/time of loading as is the case in
other countries?
Answer: It is difficult for both filers and Japan Customs to accurately gauge when a vessel will be loaded. Therefore, the date and time of departure from a port of loading is adopted for the basis of the time of the filing since both filers and Japan Customs can definitively confirm this.*
* In order to speed the movement of trade, preliminary registration of cargo information can also be performed before cargo loading, however a filing must be made no later than vessel departure.

Japan Customs has stated that the inclusion of a 6-digit Harmonized System Code is essential to perform risk-analysis

Advanced Notice (AN) Code Description
DNL Do Not Load – Per the risk assessment, Japan Customs has identified the cargo as high-risk
HLD Hold - The filing transmitted to Japan Customs via the NACCS center is incomplete or requires correction
DNU Do Not Unload – In the case that the vessel has already departed from the port of loading, per the risk assessment, Japan Customs has identified the cargo as high-risk and requests that the cargo should not be unloaded at a Japanese port
Alternately, the Do Not Unload code may be received when a vessel has departed from a foreign port of loading and the HLD (Hold) code was not cancelled or corrected
SPD Suspend – This code is unique in that it regard to the timing of the filing such as when: • The cargo information is not filed. In this case, a filing must be made or the cargo cannot be
unloaded in Japan
• The filing was made after the deadline. In this case, permission must be obtained by Japan Customs to unload the cargo
For both of the above, Japan Customs has stated that penalties could be assessed including “…imprisonment with labor for up to a maximum period of one year or a fine not exceeding 500,000 yen”
Japan Customs has stated that the following advanced notice codes will be transmitted in the case of exceptions within 24 fours from filing received.
Unless risks are recognized, no Advanced Notice code will be sent

Advance Filing Rules are applied at the last foreign port where cargo is loaded on a vessel heading for a port in Japan.
In the case of transshipment, cargo information is required to be filed with AMR and AHR procedures by no later than 24 hours before departure from the port where transshipment is made, regardless of the filing at the original port.
(Example) Cargo from Europe is unloaded and transshipped at the port of Pusan, South Korea, and heads for a port of Kobe.

Q : If an unscheduled transshipment of a cargo is conducted due to vessel schedule changes, is it required to be filed not only the cargo information based on Master B/L level from a shipping company, but also the cargo information based on House B/L level from a NVOCC linked to relevant Master B/L at least 24 hours before departure from a port of transshipment?
A : Even if an unscheduled transshipment of a cargo is suddenly conducted, as a general rule, both the cargo information based on Master B/L level and the cargo information based on House B/L level are required to be filed again at least 24 hours before departure from a port of transshipment.
