PART C (PERMJT CONDITIONS)

1 General Conditions

11 The Permit Holder and any person Ori--ing on the Project shall comply with a ll condit ions set out in thi s Permit Any non-compliance b) any person may constitute a contravention of the Environmenta l Impact Assessment Ordinance (E IAO) (Cap499) and may become the subject of appropriate action being taken under the Ordinance

12 The Permit Holder shall ensure fu ll compliance with al l legis lation from time to time in force including ithout limi tation to the Ai r Pollution Control Ord inance (Cap 3 11 ) Water Pollution Contro l Ordi nance (Cap 358) Noise Control Ordinance (Cap 400) and Waste Disposa l Ord inance (Cap 3 54) This Perm it does not of itself constitute any ground of defense aga inst any proceed ings instituted under any legislation or imp ly any approva l under an) legislation

13 The Permit Holder shall make copies of this Permit together with a ll documents referred to in this Permit and the documents referred to in Part A of this Permit read ily available at all times for inspect ion by the Di rector or his authori zed officers at all sitesoffice covered by th is Perm it Any reference to the Permit shall incl ude a ll documents referred to in the Permit and also the relevant documents in the Register

I4 The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) ful ly understa nds all cond it ions and all req uirements incorporated by the Permit The site(s) refers to site(s) of construction of the Project and shall mean the same hereafter

15 The Permit Holder shall d isplay conspicuously a copy of this Permit on the construct ion site(s) at a I I eh icular site entrancesex its or at a convenient location for pub I ic middot s information at a 11 times The Permit Holder shall ensure that the most updated in formation about the Permi t including any amended Permit is di sp layed at such locat ions If the Permit Holder surrenders a part or the whole of this Permit the notice he sends to the Director shall also be displayed at the same locations as the original Permit The suspended varied or cance ll ed Permit shall be removed from disp lay at the construction site(s)

16 The Permit Holder shal l construct the Project in accordance with the project description in Part B of this Perm it (hereafter referred to as the Project)

17 The Permit Holder shal l ensu re that the Project is designed and constructed in accordance ith the middot relevant information and recommenda tions described in the approved CWBampIECL EIA Report (Register No AEIAR-04 1 200 I) the approved WDIIampCWB El A Report (Register No AEIA R- 1252008) the approved CRIII El A Report (Register No AEIAR-040200 I) the app lication documents for environmenta l perm it other relevant documents in the Regi ster and the information or mitigation measures described in this Permit and mitigation measu res to be recommended in submissions that shal l be deposited vi th or approved by the Director as a result of perm it condit ions contained in this Permit and mitigation measures to be recommend ed under on-going surveillance and monitorin g activit ies during a ll stages of the Project Where recommendations referred to in the documents of the Register are not expressly referred to in thi s Permit such recommendations are nevertheless to be implemented unless express) exc luded or impliedly amended in thi s Permit The Project is part of the CWB project

19 All submiss ions approved by the Director all submissions deposited withou t comments by the Director or al l su bmissions rectified in accordance ith comments by the Director under this Permit shall be construed as part of the permit cond itions described in Pan C of th is Permit Any variation of the submissions shall be approved by the Director in writ ing or as prescribed in the relevant permit cond itions Any non-compliance ith the submissions may constitute a contra ention of the Em ironmental Impact Assessment Ordinance (Cap499) All submissions or any variation of the submiss ions shall be certified by the Environmenta l Team (ET) Leader and verified by the Independen t Environmental Checker (IEC) employed for the CWB project before submitting to the Director under this permit (see note 7)

110 The Perm it Holder shall release all final ized submissions as required under this Permit to the publ ic by depositing copies in the Environmenta l Impact Assessment Ordinance Register Offi ce or in any other places or any internet websites as specified by the Director or by any oth er means as specified by the Director for publi c inspection For this purpose the Permit Holder sha ll provide sufficient copies of the submiss ions

111 All submissions to the Director required under this Permit shall be delivered either in person or by registered ma il to the Environmenta l Im pact Assessment Ord inance Register Office (cu rrently at 27 F Southern Cen tre 130 Hennessy Road Wanchai Hong Kong) Electronic copie of al l fina lized submiss ions required under this Permit shall be prepared in H) per Text Markup Language (HTML) (version 40 or later) and in Portable Document Formflt (PDF version 40 or later) unless othem ise agreed by the Director and slull l be submitted at the same time as the hard copies

The ENPC shall make recommendation to enhance the monitoring and aud it of the em iron mental performance of the whole project and other relevflnt nea rby projects on top of requi rements as set out in Conditions 31 to 42 of this Permit or corresponding set out under subsequent Environmental Permits issued for the hole project and other relevant nearby projects (see notes 7 and 8)

214 To reduce the landsca pe and visua l impact during construction stage of the Project the Permit Holder shall implement a series of landscape and isualm itigati on measures The Permit Holder shall at least one month before the commencement of corresponding parts of landscape works of th e Project deposit with the Director four hard cop ies and one electronic copy of landscape plan(s) The landscape plan(s) sha ll show th e design detail s locations implementation programme maintenance and management schedules and drm ings in the sca le of 1 I 000 or other appropriate sca le of the landscape and visual mit igation measures of th e Project Before submission to the Director the landscape plan(s) shall be cer1ified by the ET Leader and verified by the I EC as conforming to the relevant in formation and recommendat ions contained in the apprOed CWBampIECL EIA Report (Regi ter No AEIAR-0412001) and the WDII ampCWB ElA Report (Register No A El A R-1252008) A 11 measures recommended in the fin a I ised su b m ission(s) under th is Condition shall be fu lly and properly implemented (see note 8)

3 Environmental Monitoring and Audit Requirements

31 The EMampA programme shall be implemented in accordance ith the procedures and requirements as set out in the updated EMampA Manual approved for the CWB project (See note 8) An) major changes to the programme shall be justified by the ET Leader and verifi ed by the IEC employed for the CWB project (see note 7) as conforming to the information and requirements contained in the updated EMampA Manua l

32 Samples measurements and necessary remed ial actions shall be taken in accordance with the requirements of the updated EMampA Manual for the CWB project (note 8) by (a) conducting baseline env ironmental monitoring (b) conducting impact monitoring (c) carrying out remedia l actions described in EventAction Plans of the updated EMampA

Manual in accordance with the time frames set out in EventAction Plans or as agreed by the Director in case here specified criteria in the updated EMampA Man ual approved are exceeded and

(d) logging and keeping records of deta ils of (a) to (c) above for a ll parameters within 3 working days of co llection of data or completi on of remedial action(s) for the purpose of preparing and submitting the monthly EMampA Reports and to make avai lab le for inspection

f I To facil itate public inspection of th e Baseline Monitoring Report and regu lar EMampA Reports ia the EIAO Internet Webs ite and at the EJAO Register OITice electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 40 or later) and in Portable Document Format (PDF version -LO or later) unless otherwise agreed by the Director and shall be submitted at the same time as the hardcop ies a described in Condition 34 of th is Permit For the I-ITML version a content page capable of providing h) per ink to each section and sub-section of these Reports shall be included in the beginning of the document H) per inks to all figures drawings and tab les in these Reports shall be provided in the main text from here the respective references are made All graphics in these Reports shall be in interl aced GIF format unless otherwise agreed by the Director The content of the electronic copies of these Reports must be the same as the hardcopies

PART C (PERMJT CONDITIONS)

1 General Conditions

11 The Permit Holder and any person Ori--ing on the Project shall comply with a ll condit ions set out in thi s Permit Any non-compliance b) any person may constitute a contravention of the Environmenta l Impact Assessment Ordinance (E IAO) (Cap499) and may become the subject of appropriate action being taken under the Ordinance

12 The Permit Holder shall ensure fu ll compliance with al l legis lation from time to time in force including ithout limi tation to the Ai r Pollution Control Ord inance (Cap 3 11 ) Water Pollution Contro l Ordi nance (Cap 358) Noise Control Ordinance (Cap 400) and Waste Disposa l Ord inance (Cap 3 54) This Perm it does not of itself constitute any ground of defense aga inst any proceed ings instituted under any legislation or imp ly any approva l under an) legislation

13 The Permit Holder shall make copies of this Permit together with a ll documents referred to in this Permit and the documents referred to in Part A of this Permit read ily available at all times for inspect ion by the Di rector or his authori zed officers at all sitesoffice covered by th is Perm it Any reference to the Permit shall incl ude a ll documents referred to in the Permit and also the relevant documents in the Register

I4 The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) ful ly understa nds all cond it ions and all req uirements incorporated by the Permit The site(s) refers to site(s) of construction of the Project and shall mean the same hereafter

15 The Permit Holder shall d isplay conspicuously a copy of this Permit on the construct ion site(s) at a I I eh icular site entrancesex its or at a convenient location for pub I ic middot s information at a 11 times The Permit Holder shall ensure that the most updated in formation about the Permi t including any amended Permit is di sp layed at such locat ions If the Permit Holder surrenders a part or the whole of this Permit the notice he sends to the Director shall also be displayed at the same locations as the original Permit The suspended varied or cance ll ed Permit shall be removed from disp lay at the construction site(s)

16 The Permit Holder shal l construct the Project in accordance with the project description in Part B of this Perm it (hereafter referred to as the Project)

17 The Permit Holder shal l ensu re that the Project is designed and constructed in accordance ith the middot relevant information and recommenda tions described in the approved CWBampIECL EIA Report (Register No AEIAR-04 1 200 I) the approved WDIIampCWB El A Report (Register No AEIA R- 1252008) the approved CRIII El A Report (Register No AEIAR-040200 I) the app lication documents for environmenta l perm it other relevant documents in the Regi ster and the information or mitigation measures described in this Permit and mitigation measu res to be recommended in submissions that shal l be deposited vi th or approved by the Director as a result of perm it condit ions contained in this Permit and mitigation measures to be recommend ed under on-going surveillance and monitorin g activit ies during a ll stages of the Project Where recommendations referred to in the documents of the Register are not expressly referred to in thi s Permit such recommendations are nevertheless to be implemented unless express) exc luded or impliedly amended in thi s Permit The Project is part of the CWB project

19 All submiss ions approved by the Director all submissions deposited withou t comments by the Director or al l su bmissions rectified in accordance ith comments by the Director under this Permit shall be construed as part of the permit cond itions described in Pan C of th is Permit Any variation of the submissions shall be approved by the Director in writ ing or as prescribed in the relevant permit cond itions Any non-compliance ith the submissions may constitute a contra ention of the Em ironmental Impact Assessment Ordinance (Cap499) All submissions or any variation of the submiss ions shall be certified by the Environmenta l Team (ET) Leader and verified by the Independen t Environmental Checker (IEC) employed for the CWB project before submitting to the Director under this permit (see note 7)

110 The Perm it Holder shall release all final ized submissions as required under this Permit to the publ ic by depositing copies in the Environmenta l Impact Assessment Ordinance Register Offi ce or in any other places or any internet websites as specified by the Director or by any oth er means as specified by the Director for publi c inspection For this purpose the Permit Holder sha ll provide sufficient copies of the submiss ions

111 All submissions to the Director required under this Permit shall be delivered either in person or by registered ma il to the Environmenta l Im pact Assessment Ord inance Register Office (cu rrently at 27 F Southern Cen tre 130 Hennessy Road Wanchai Hong Kong) Electronic copie of al l fina lized submiss ions required under this Permit shall be prepared in H) per Text Markup Language (HTML) (version 40 or later) and in Portable Document Formflt (PDF version 40 or later) unless othem ise agreed by the Director and slull l be submitted at the same time as the hard copies

The ENPC shall make recommendation to enhance the monitoring and aud it of the em iron mental performance of the whole project and other relevflnt nea rby projects on top of requi rements as set out in Conditions 31 to 42 of this Permit or corresponding set out under subsequent Environmental Permits issued for the hole project and other relevant nearby projects (see notes 7 and 8)

214 To reduce the landsca pe and visua l impact during construction stage of the Project the Permit Holder shall implement a series of landscape and isualm itigati on measures The Permit Holder shall at least one month before the commencement of corresponding parts of landscape works of th e Project deposit with the Director four hard cop ies and one electronic copy of landscape plan(s) The landscape plan(s) sha ll show th e design detail s locations implementation programme maintenance and management schedules and drm ings in the sca le of 1 I 000 or other appropriate sca le of the landscape and visual mit igation measures of th e Project Before submission to the Director the landscape plan(s) shall be cer1ified by the ET Leader and verified by the I EC as conforming to the relevant in formation and recommendat ions contained in the apprOed CWBampIECL EIA Report (Regi ter No AEIAR-0412001) and the WDII ampCWB ElA Report (Register No A El A R-1252008) A 11 measures recommended in the fin a I ised su b m ission(s) under th is Condition shall be fu lly and properly implemented (see note 8)

3 Environmental Monitoring and Audit Requirements

31 The EMampA programme shall be implemented in accordance ith the procedures and requirements as set out in the updated EMampA Manual approved for the CWB project (See note 8) An) major changes to the programme shall be justified by the ET Leader and verifi ed by the IEC employed for the CWB project (see note 7) as conforming to the information and requirements contained in the updated EMampA Manua l

32 Samples measurements and necessary remed ial actions shall be taken in accordance with the requirements of the updated EMampA Manual for the CWB project (note 8) by (a) conducting baseline env ironmental monitoring (b) conducting impact monitoring (c) carrying out remedia l actions described in EventAction Plans of the updated EMampA

Manual in accordance with the time frames set out in EventAction Plans or as agreed by the Director in case here specified criteria in the updated EMampA Man ual approved are exceeded and

(d) logging and keeping records of deta ils of (a) to (c) above for a ll parameters within 3 working days of co llection of data or completi on of remedial action(s) for the purpose of preparing and submitting the monthly EMampA Reports and to make avai lab le for inspection

f I To facil itate public inspection of th e Baseline Monitoring Report and regu lar EMampA Reports ia the EIAO Internet Webs ite and at the EJAO Register OITice electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 40 or later) and in Portable Document Format (PDF version -LO or later) unless otherwise agreed by the Director and shall be submitted at the same time as the hardcop ies a described in Condition 34 of th is Permit For the I-ITML version a content page capable of providing h) per ink to each section and sub-section of these Reports shall be included in the beginning of the document H) per inks to all figures drawings and tab les in these Reports shall be provided in the main text from here the respective references are made All graphics in these Reports shall be in interl aced GIF format unless otherwise agreed by the Director The content of the electronic copies of these Reports must be the same as the hardcopies

PART C (PERMJT CONDITIONS)

1 General Conditions

11 The Permit Holder and any person Ori--ing on the Project shall comply with a ll condit ions set out in thi s Permit Any non-compliance b) any person may constitute a contravention of the Environmenta l Impact Assessment Ordinance (E IAO) (Cap499) and may become the subject of appropriate action being taken under the Ordinance

12 The Permit Holder shall ensure fu ll compliance with al l legis lation from time to time in force including ithout limi tation to the Ai r Pollution Control Ord inance (Cap 3 11 ) Water Pollution Contro l Ordi nance (Cap 358) Noise Control Ordinance (Cap 400) and Waste Disposa l Ord inance (Cap 3 54) This Perm it does not of itself constitute any ground of defense aga inst any proceed ings instituted under any legislation or imp ly any approva l under an) legislation

13 The Permit Holder shall make copies of this Permit together with a ll documents referred to in this Permit and the documents referred to in Part A of this Permit read ily available at all times for inspect ion by the Di rector or his authori zed officers at all sitesoffice covered by th is Perm it Any reference to the Permit shall incl ude a ll documents referred to in the Permit and also the relevant documents in the Register

I4 The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) ful ly understa nds all cond it ions and all req uirements incorporated by the Permit The site(s) refers to site(s) of construction of the Project and shall mean the same hereafter

15 The Permit Holder shall d isplay conspicuously a copy of this Permit on the construct ion site(s) at a I I eh icular site entrancesex its or at a convenient location for pub I ic middot s information at a 11 times The Permit Holder shall ensure that the most updated in formation about the Permi t including any amended Permit is di sp layed at such locat ions If the Permit Holder surrenders a part or the whole of this Permit the notice he sends to the Director shall also be displayed at the same locations as the original Permit The suspended varied or cance ll ed Permit shall be removed from disp lay at the construction site(s)

16 The Permit Holder shal l construct the Project in accordance with the project description in Part B of this Perm it (hereafter referred to as the Project)

17 The Permit Holder shal l ensu re that the Project is designed and constructed in accordance ith the middot relevant information and recommenda tions described in the approved CWBampIECL EIA Report (Register No AEIAR-04 1 200 I) the approved WDIIampCWB El A Report (Register No AEIA R- 1252008) the approved CRIII El A Report (Register No AEIAR-040200 I) the app lication documents for environmenta l perm it other relevant documents in the Regi ster and the information or mitigation measures described in this Permit and mitigation measu res to be recommended in submissions that shal l be deposited vi th or approved by the Director as a result of perm it condit ions contained in this Permit and mitigation measures to be recommend ed under on-going surveillance and monitorin g activit ies during a ll stages of the Project Where recommendations referred to in the documents of the Register are not expressly referred to in thi s Permit such recommendations are nevertheless to be implemented unless express) exc luded or impliedly amended in thi s Permit The Project is part of the CWB project

18 Al l deposited subm issions as required under thi s Permit shall be rect ified and

accordance ith the comments if any made by the Director within one month of the receipt of the Director s comments or otherwise specified by the Director

19 All submiss ions approved by the Director all submissions deposited withou t comments by the Director or al l su bmissions rectified in accordance ith comments by the Director under this Permit shall be construed as part of the permit cond itions described in Pan C of th is Permit Any variation of the submissions shall be approved by the Director in writ ing or as prescribed in the relevant permit cond itions Any non-compliance ith the submissions may constitute a contra ention of the Em ironmental Impact Assessment Ordinance (Cap499) All submissions or any variation of the submiss ions shall be certified by the Environmenta l Team (ET) Leader and verified by the Independen t Environmental Checker (IEC) employed for the CWB project before submitting to the Director under this permit (see note 7)

110 The Perm it Holder shall release all final ized submissions as required under this Permit to the publ ic by depositing copies in the Environmenta l Impact Assessment Ordinance Register Offi ce or in any other places or any internet websites as specified by the Director or by any oth er means as specified by the Director for publi c inspection For this purpose the Permit Holder sha ll provide sufficient copies of the submiss ions

111 All submissions to the Director required under this Permit shall be delivered either in person or by registered ma il to the Environmenta l Im pact Assessment Ord inance Register Office (cu rrently at 27 F Southern Cen tre 130 Hennessy Road Wanchai Hong Kong) Electronic copie of al l fina lized submiss ions required under this Permit shall be prepared in H) per Text Markup Language (HTML) (version 40 or later) and in Portable Document Formflt (PDF version 40 or later) unless othem ise agreed by the Director and slull l be submitted at the same time as the hard copies

23 To Oe rsee and fac ilitate effecti ve contro l of the cumul ative environmental im pacts arising from potential multiple contracts for the construction of the en ti re Wan Chai Development Phase 11 (WDII ) and Central-Wan Chai Bypass (CWB) (hereafter referred to as the who le Project) the Permit Holder shall take part as a member of Envi ronmental Project Committee (EN PC) set up for the hole proj ect (see note 8)

The ENPC shall make recommendation to enhance the monitoring and aud it of the em iron mental performance of the whole project and other relevflnt nea rby projects on top of requi rements as set out in Conditions 31 to 42 of this Permit or corresponding set out under subsequent Environmental Permits issued for the hole project and other relevant nearby projects (see notes 7 and 8)

214 To reduce the landsca pe and visua l impact during construction stage of the Project the Permit Holder shall implement a series of landscape and isualm itigati on measures The Permit Holder shall at least one month before the commencement of corresponding parts of landscape works of th e Project deposit with the Director four hard cop ies and one electronic copy of landscape plan(s) The landscape plan(s) sha ll show th e design detail s locations implementation programme maintenance and management schedules and drm ings in the sca le of 1 I 000 or other appropriate sca le of the landscape and visual mit igation measures of th e Project Before submission to the Director the landscape plan(s) shall be cer1ified by the ET Leader and verified by the I EC as conforming to the relevant in formation and recommendat ions contained in the apprOed CWBampIECL EIA Report (Regi ter No AEIAR-0412001) and the WDII ampCWB ElA Report (Register No A El A R-1252008) A 11 measures recommended in the fin a I ised su b m ission(s) under th is Condition shall be fu lly and properly implemented (see note 8)

3 Environmental Monitoring and Audit Requirements

31 The EMampA programme shall be implemented in accordance ith the procedures and requirements as set out in the updated EMampA Manual approved for the CWB project (See note 8) An) major changes to the programme shall be justified by the ET Leader and verifi ed by the IEC employed for the CWB project (see note 7) as conforming to the information and requirements contained in the updated EMampA Manua l

32 Samples measurements and necessary remed ial actions shall be taken in accordance with the requirements of the updated EMampA Manual for the CWB project (note 8) by (a) conducting baseline env ironmental monitoring (b) conducting impact monitoring (c) carrying out remedia l actions described in EventAction Plans of the updated EMampA

Manual in accordance with the time frames set out in EventAction Plans or as agreed by the Director in case here specified criteria in the updated EMampA Man ual approved are exceeded and

(d) logging and keeping records of deta ils of (a) to (c) above for a ll parameters within 3 working days of co llection of data or completi on of remedial action(s) for the purpose of preparing and submitting the monthly EMampA Reports and to make avai lab le for inspection

f I To facil itate public inspection of th e Baseline Monitoring Report and regu lar EMampA Reports ia the EIAO Internet Webs ite and at the EJAO Register OITice electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 40 or later) and in Portable Document Format (PDF version -LO or later) unless otherwise agreed by the Director and shall be submitted at the same time as the hardcop ies a described in Condition 34 of th is Permit For the I-ITML version a content page capable of providing h) per ink to each section and sub-section of these Reports shall be included in the beginning of the document H) per inks to all figures drawings and tab les in these Reports shall be provided in the main text from here the respective references are made All graphics in these Reports shall be in interl aced GIF format unless otherwise agreed by the Director The content of the electronic copies of these Reports must be the same as the hardcopies

42 All ellmiddotironmentalmonitori ng data desc ribed in Condition 41 above shall be made a ailablc to the public ia a dedicated eb site to be set up for the CWB project (see note 9) in the shortest practicable time and in no event later than two vveeks after the relevant ell ironmentalmonitoring data are co llected or become ava il able unless othen ise agreed with th e Director

f I To facil itate public inspection of th e Baseline Monitoring Report and regu lar EMampA Reports ia the EIAO Internet Webs ite and at the EJAO Register OITice electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 40 or later) and in Portable Document Format (PDF version -LO or later) unless otherwise agreed by the Director and shall be submitted at the same time as the hardcop ies a described in Condition 34 of th is Permit For the I-ITML version a content page capable of providing h) per ink to each section and sub-section of these Reports shall be included in the beginning of the document H) per inks to all figures drawings and tab les in these Reports shall be provided in the main text from here the respective references are made All graphics in these Reports shall be in interl aced GIF format unless otherwise agreed by the Director The content of the electronic copies of these Reports must be the same as the hardcopies
