I took possession of document. Original in Durban case – photostat was made. It is this document “EXH BE” “New Problems of a Democratic Movement” – R51 was same found in room 4. I drew attention to Naicker, Naicker said “I dont know where it comes from”.

Steel cabinet, chair and shelves in office M.D. Naicker uses this office – he is a listed communist.

I dont know Gavin Sammy Naicker – I know George Naicker. I dont know his address – I know Taunus car was Naicker’s car.

Senior technician P’maritzburg. Oct ’61 went to 389 Pieter Maritz St, P’Maritzburg. I found that distribution cable had been severed. Item. II was severed apparently by fairly sharp instrument not a blunt instrument. I am not prepared to say not accidentally cut. It served several bldgs. Private amongst speel. We found a dead circuit to BAD Bldg next door. Its in the property of Tea room – two feet inside the boundary wall – almost 40 yds from roadway.

I stay in Durban 104 Umhalatzle Rd Sea View. Representative Central Corp. G.S. Naidoo and George Naicker – the latter is former’s boss. Known him since school days. Used a box – 32 Delbridge Durban. The second half 1961 up to then used Naidoo’s address.

I advised George Naicker. He did not address in a request. I offered use to George Naicker. I gave him a key. If letters for me he would not collect but his only. I saw letters they were postmarked JHB airmail. He said he was expecting letters from JHB.

I dont know G. Nathan – appearing on R174 with my postal address.

I continued use up to end of ’63. Intended to let it go end of ’62. I went to George Naicker said he would effect payment of box. The key I had handed over to S/B.

I knew that George Naicker was member of NIC.

Lt. SAP Queenstown – was in charge of sabotage case at Ngobo.

Item 26: I went to scene of crime. The BAD office and Tax office – I went there – red plastic container on the floor – wet patch. Open window – plastic container ---- smelt of petrol and blackish fluid. Inside 3” plastic cylinder 1” in diam. The outside had silverish powder marks. It is cement with wooden floors – the counters are made of wood. If petrol had caught alight the whole lbdg. would have burned.

29-12-61 Toser Dukodon (?) was arrested by me Transkei No. 1 at his kraal.

He was attached to ANC – in his possession was Potasium permangate and glycerine and similar silver powder as found in container. He made a report – took him to PE on 30-12-61. He pointed out 10 (a) Cape Rd. P.E. motor garages – one of the garages found a classroom – found Pot. permangate – definite traces of silver pwoder. Wooden boxes with Strachan. The premises hired by Strachan.

Pointed out place on the corner – something had exploded. As a result W.B. Mahandla and Alfred Gohololo – known to me as members and organisers in Transkei territory.

Joseph Jack he was a co-accused in P.E. Charged with Strachan and 4. Did not know him before.

Caesar Dukata took me to his home – gave me a deposit slip with two addresses. I see photostatic copy “BF”.

Pogamine of Queenstown. The other Langa Njomela Box number. Both know to me as members of ANC.

The evidence will be that in writing of No. 4.

The plastic container 2 gls used to carry water with screw top on – it had sticky black substance – no signs of black powder.

Caesar member of ANC. Information came during my services – information from other possibly. – I got it from documents in course of investigations – in the same way – I found out during investigation – observation – I heard the garage owner say it.

There were packing cases “handle with care” and Strachan’s address. This was Harold Strachan who was tried under. Caesar was fined R300 or 30 days.

19th Aug. 4.a.m. ‘63 I went Elsies River accompanied white and others – and arrested Looksmart and 2 others. In sitting room under one blanket – in a paper bag roll of toilet vaseline, plastic twigs, paper bags containing Pot. permangate, Pot. nitrate, sulphur, icing sugar eye droppers – a piston, 10 Mochson blades, typewriter and number of pamphlets – some roneoed others in handwriting – admitted they belonged to him.

I made enquiries about – made a report went to certain house Nyanga Location – searched house could not find it but ink and also packets – roneo paper also found, hacksaw without blades

COURT:

They would fit all saws?

A. Yes.

I never found a receipt on No. 10 but handed to me by Bodenstein – I spoke to No. 10 and other documents – made notes Exh “YYY” is the receipt re Taunus.

Q. I asked your document?

A. Yes.

Q. Know the person?

A. Will not be able to point him out.

Q. How did you pay R500?

A. Not a penny.

Q. Why?

A. Just given to bring it to JHB.

George Peake, S. Levy,J. Francis, J. TarshishJackson Tayo – I have knowledge that he was arrested, but I have no personal . . .

I knew J. Tayo – I said yesterday I had not seen him at meetings – I referred to the parade – BUT he did address meetings at Langa and Nyanga – there were meetings of A.Y.L.

Looksmart also addressed meetings of AYL at Langa.

I also kept watch on Tarshish’s house – flow of Bantus and coloureds went to his house also.

I know Jillian Jewell – she was arrested in connection with painting slogans on SAP Bldgs. She was convicted and sentenced. She attended meetings on parade of SA CPC. SACPC according to document is a member of Congress Alliance.

I also saw Jewell visit No. 3 accused also Tarshish’s house. Tarshish is a European. I have no reason to say that I know what Tarshish’s politics are. He was convicted of being in possession of dynamite etc – he got 12 yrs.

WAGNER

NO. 187: Lt. in SAP stationed at CAPE TOWN. On 18-6-63 I attended the scene of alleged sabotage at Langa. I found that an attempt had been made to burn down a beer hall. On roof and in gutter I found remains of 3 bottles. At back were 2 bottles not broken – I open bottle – wine bottle – contained

A mixture of petrol and oil – attached to the bottle was a paper container – this contained a black powder – Bottles were wrapped with cloth. Contents of bottles had caught fire because some of it was on roof and then were . . .

ND: 188: Also Langa – a bottle store was being constructed. Inside bldg I found two bottles – similar to ones I picked up in first instance – none broken – contents similar to previous attack (i.e. 188)

NO: 193: 6 July – I attended place where electric cable had been attempted – at Bridgetown – cable was about 3 ft underground – it was dug open – lead covering over cable was broken. Cable supplies Bridgetown and other parts with power.

NO: 198: 22nd August 1963 – I went to Constantiaberg F.M. Tower – is in Cape – Higher than Brixton Tower. I found attempt had been made to blast 3 cables of anchor.

Photos were tkaen in presence on the same day – (Shows how 3 charges were attached to cables) EXH “BH”

Appears to be steel case which was made to fit on steel cable. Everyone of these cases had a hole with fuse and detonator – 3 of them together were connected to electric wire connected to timing mechanism which lies on ground.

Mechanism is shown on photo “BK” – shows three wires leading from three cables.

Timing Mechanism was buried underground in a fishing reel case – photo “BL”.

“BL” shows where it was buried – shows box concealed under stones alongside concrete block of tower.

We opened the case and found a watch and dry

cell torch battery – photo of contents was taken – this is ‘BM’

A thin wire attached to back of watch broke lose – as a result there was no circuit.

If not for that I assume damage would have been caused.

In connection with first two charges 188 and 191, Jackson Tayo was arrested. I have information that he was a member of ANC – others were suspected – Looksmart Solwandle. Tayo made a statement to me in regard to these two – he had to accompany Solwandle to those two places and Solandle went with him.

Jackson Tayo’s case is still pending – papers are with A/G.

12 th FEBRUARY 1964

J. KENNEDY

W/O SAP Greys JHB. 11-7-63 3.p.m. one of number under Van Wyk to Rivonia. We travelled in Dry Cleaners van – it does not belong to the police – we were ordered to get in driven by Sgt. V. D. Berg. He was wearing a cap. Kleingeld behind a cap on. Van Wyk at the back with us. Right at the back with a police dog.

When we stopped nobody at home. Lt. Van Wyk said we are attacking. Const. with dog. When I came out I saw the outhouses – I saw a white person cleaning the room – I only saw his hand. Could not see who it was. This was room No. 1. I shouted at same to go to the back – I went to the room – I saw Hepple behind the door – I saw somebody in position of disappearing behind window. It was a non white – he had reddish brown hair.

I saw No. 6 standing on the other side of the room other side of Hepple. On the lefthand side was No. 7. Hepple and NO. 6 were nervous. I told them under arrest. They did not sit. I looked at main house – I called Coetzee. He came I went to the window of room No. 1 – the ground outside looked as if persons had jumped out of window. Only one window there.

We took the three outside – others arrived – Dirker also came I believe. Outside No. 2, No. 4 and 5 in custody. Kleing. and police dog there.

2 and 5 had their hair much longer than now. It was obvious that the hair of No. 5 was dyed. I examined Raymond Mhlaba – No. 7 was on lefthand side – he had sat down when asked to earlier.

Q. Did they say anything?

A. Hepple asked what charge. I told him later

he will learn. Others said nothing. (Look at Exh “D” (photographs of accused)

No. 2: looked like that – photo - dont know when it was taken. His hair longer then than now.

No. 3: Goldberg – I saw him later that evening – as bottom photogr. on page 3 of Exh “D”

No. 4: I saw No. 4 that evening – looked like top photo chin beard and moustache on unlike now.

No. 5: Well known to me before. He asked me if he would recognize me if he saw me in Eloff St. He appeared to be proud of his disguise.

No. 6: Looked like that photogr. No. 6.

No. 7: He was dressed like that not as a priest.

No. 8: I know well as attorney Kantor.

No. 9 & 10: Dont know.

No. 16: Hepple as he was when I arrested him.

I searched No. 7 in outside pocket he had on –

I found letters negatives photos – amongst others Exh R 183 – on both.

Also found another document R184 – a letter. I did not ask him for an explanation

As far as I can remember blue envelop and photo negatives and some lottery tickets also found On No. 7 . . .

I began to search room No. 1 – took charge of documents on table – I made a mark – room No. 1 outside room and a number of those found in main house. I gave them to Dirker.

There were ashtrays – one near Hepple. There was a burnt letter airmail could be seen – one or two words ”trainees” could be made out.

3 were taken they were warned in separate rooms. Hepple only said he has no knowledge of those articles, the

the documents in these rooms.

Rooms 4 and 5 were locked and were forced off – possibly by other members of the Force – took the accused to motor cars.

Room 12 of Thomas I searched it. I found 3 children and tried to find out who father was – I went to Govan he was not living there – I searched the room – a number of documents eg. Freedom Charter and also a driver’s licence of Moshoba.

I saw Dirker and others with Goldreich. W/AO Dirker examined booth. Goldreich nervous. Goldreich was taken rooms 1 2 3. Given police warning. He said those dont belong to him only lived in main house --- in No. 3 a roneo machine also photos – he is an artist it is his work.

I took locks of 3 and 4 and Goldreich said the key in house. When we came to his house I asked him to show me. I took them up – I tried the keys – they worked the locks not broken.

He said from a firm Navian (Pty) Ltd – farm had nothing to do with him.

There is coal shed – I found an envelope containing documents under coal.

In No. 6 I found cardboard boxes – papers and lists were made of everything found – numbered and marked all documents.

See “B” Photo No. 6 – I see safe – the built in ----- was closed – Goldreich was present – there was a ----- below – it was made of wood.

Goldreich said he never got the key from owner

He did not know what was in – where it was – he used tool to break it open – there was a safe on the wall – he said he was surprised he did not know – it was exploded by explosives – I saw some money.

6 and 7 and Hepple arrested by me personally.

21st Sept. ’63 S/? and A/G took possession of certain post Saxonwold. I found a statement of account D. Williams Ex. “FF.

Also found advertisement from barber. – also a report in regard to cutlery addressed to Mkize – one book – dont know title addressed not to Williams.

On 9-10-63: -----from Durban – I took his statement – I took him to locations – left of Orlando railway line he pointed out to me double storey bldgs as having received certain training. He called it SK. I dont know why. It was obvious it was a chemist – big bottles of medicine standing around there.

I did not help to point out this house. He showed me house of Levy Seloro in Mofol;o. He said it belonged to Seloro. He took me to Mapetla Location – taken to station – he pointed out road to a house – 1458 – he suddenly said that is the house – he mentioned black dog where he handed over recruits MK. The dog was there. I found a woman whose name was Anna?. There was a photo in a frame – BG behind I found a negative and also a small list of names.

I searched Patricks house. Another slip of paper – salt petre 75 ex. Pot. Nitr. 1/ sulphur/2 – it cant be read well – 1 tablesp of pot. 3 tablespoons -----

The name of person on photo – Festys Borgustu also Tuku.

Also found a coded document in single letters and here and there a word – it appears to be – I cant understand it “BG” – address also in code. “X” pointed out person on photo as person to whom recruits. Mtembu also as Borgustu.

“X” also said he did not know High Command unless we take him there. On the way there he pointed a garage he remembered as landmark – until we got there he pointed room 1 as the room he was in.

Abel Mtembu also pointed out double storey to me as property of Tolo Mashiolione – the owner was in custody.

545 Dube Abel Mtembu pointed out as Mlangeni’s house. He also pointed out house of Winnie Mandela also tried to point out Levy Soloro’s house but could not – said only once he had been there by car. One street away was Levy’s house.

Mtembu took me directly from Southern Locations through Ferndale. He showed me a place where he and Someone had stopped and he and “X” walked back. At the farm he pointed out gate where a footpath was used. This gate is not the ordinary gate – there is grass and trees.

He showed me 23 Empire Rd Parktown JHB as place where Regional Command meetings of MK were held. I ascertained this house was used Isaac Leviton who was listed as a communist. He is overseas I have reason to believe.

He showed me corner Smit(?) Simmonds Sts where Jack Hodgson met him.

The day after “X” showed me SK Bldg. He showed me way to a house. This is the house and this the man. It was Mtembu. I took him into custody.

25th NOV. ’62 I attended meeting Gandi Hall. I saw Dr. Aziz Cajee, Suliman Nathee and Ismail Saloojee and about 300 to 350 persons in hall. Amongst the Indian men I noticed Reggie Nadia and Indrus Naidoo and others – they were later sentenced for sabotage. I assume that all iIndians in Tvl. Are members of TIC. Noticed Vanyar in meetings COD 16-12-61 arrested and found guilty of explosives – chemical explosives and gas pistol. I see exh. So similar found in his possession as also Luthuli badges. He was charged with unlawful possession and found guilty.

ACT NO. 8 8/9th October 1961 cable cut out and left lying there. It served Meerdale – nobody arrested.

ACT 46: 2/3 9th 62 – I was there – a hole in the ground, all the windows smashed – dynamite explosion safety fuse wax paper D ----- not too good – no arrests,

ACT 71: Visited place – 2 cable lines – pylons carry 6” to 8” wires – one tower 4 legs – almost completely cut off by explosion – metal found in tree trunk. The pole next to it 10 paces away stood up on each leg – charges of dynamite brick – piece of dynamite with fuse – cortex. There was a match end of safety fuse did not light. In the vicinity I saw several slogans on walls “Free Mandela” in line with position of poles.

192: J. Mohouro. (9th April 1963) (?) slight fluid matter inside and outside the door – some liquid burned otherwise found nothing. He is from Orlando. He said he was in the house at night.

The names given I saw the lists on a document –

I know Essop Ismail Ouma – last year early in 1962 he was arrested with a suitcase 50 lbs dyn. and a few hundred detonators. Also a book of Che Guvera – in the book

some writing in French Resistance Movement. We had no record of him.

I saw names of Cajee and Aziz and Omar on list found at Rivonia.

In the big house we found documents. The following persons helped: Dirker, Norjie, Posthumus, Kennedy.

We marked and numbered documents in big house. – except Dirker compiled the list – only passage – Dirker got it – Goldreich present.

In room No. 1 I did. The others done by others. Dirker assisted me in No. 1. Little storeroom and room of Moshifane I did.

Every document I found in room No. 1 I marked. Dirker took one document – very interested in it.

Operation Mayebuye was on the table – open on the table – did not take much notice of it – it was open – some pages were turned.

R 185 I see document on table and mentioned it. Notes on Population in S.A. (evidence that it will be No. 2)

17 th FEBRUARY 1964

MR. VAN ZYL:

In 1962 I was a Sgt in SAP – in uniform section. I am now out of the force. I was stationed at Rondebosch.

On 4-12-63 – it happened a few months ago. I have no knowledge of Rivonia case. It happened 3 months ago, about 9.p.m. on 4-12-63. I was on motor patrol in Main Rd. Rondebosch. I turned vehicle on open piece of ground where there is a tree. In the lights of the car I saw something.

A European man pulled away from behind tree on m/cycle. At same time Bantu man walked away in opp. directions.

I stopped White man. Coloured constable sent to fetch Bantu man. Coloured Const. brought Bantu back to me.

I asked for explanation in regard to circumstances in which I found them. European man said:- “I cant afford to say anything”

European was Dennis Goldberg

Bantu was Looksmart (?)

I cannot with certainty point out European person in Court.

Looksmart’s name was very curious – I will try to remember same later.

I took names and addresses and let them go.

When man said Dennis Goldberg, I said it rings a bell. He said what kind of bell. I said I cant remember.

After I said they could go Looksmart crossed Main Rd. Then Goldberg said “can I speak to my friend now” I said “please yourself”. He then crossed Main rd. on m/cycle in direction of Looksmart.

stopped in front of Looksmart – spoke – I was too far away to hear what was said.

This piece of ground is open piece of ground – behind tree is dense bush. Anybody behind tree would be out of sight. Behind that was high wall.

Whit flash I saw was crash helmet worn by Dennis Goldberg. It was about 25 yds from Main Rd.

Previous night a telephone box in Claremont was blown up (Item 116) – in Watering Rd.

(next witness will give date of explosion)

Explosion in Claremont happened on previous evening – 3rd or 12th of month – this was in 1963 (we are now ’64) that is 3 months ago.

I am mixed up – it was 1962 – I was out of police in Oct ’63. This happened in 1962.

I also made a note that I should inform S/B. Nothing more that I can remember. I made written statement to effect of conversation some days later. I did not find it necessary to note conversation in P/book.

S/Orders require material things to be noted in pocket book. I did not at time regard it as important. I now regard it as material.

Attached to S/B – stationed at Cape Town. I am going to give evidence about 8 acts of sabotage.

On 15-12-62 about 0.p.m. I was travelling in Durban St. Mowbray. I saw no. 3’s motor in front – he was driving car and was alone. He drove to a cross st. and stopped at a dark spot. He waited for about 15 mnts – then travelled along another cross street – into Durban St – Mowbray Railway St -

passed – then came back – passed railway St – he stayed for about 5 mnts – spotted me – drove away. Came back – stopped about 30 yds from station – then Looksmart came up to car. I saw him hand over something to L. L. walked away – I stopped and searched him. In outside small pocket of jacket I found small bit of paper – a sketch with certain streets – amongst others Landsdown Rd and Princes Rd (Clarmont) – also a point marked by way of a star – I examined it later on – it agrees with point where railway signal is.

Bantu said he did not know of contents – also had no knowledge of purpose. He kept quiet – did not deny or admit that he got paper from No. 3.

He was detained until about 2.a.m. and then allowed to go home. After we had examined paper.

I don’t know where piece of paper is – I can search for it and send it on if I find it.

I have known Goldberg for 5 yrs – he was at political meetings – meetings held on parade Town Hall and old Drill Hall – held by organisations such as Congress Alliance, SACPC and SACTU.

I never noticed No. 3 address meetings. He lived in-----Claremont.

I also kept observation at house – Friday, Saturday and Sunday – were mixed parties held at his house (meetings attended by all races). I recognized some people who attended – people usually attended were

Storeroom of Adm’s Bldg – I remember incident about 10 to 12 in evening of 14-12-62 – I received a message. As a result I went to store and found it burning. Piece of roof was damaged (?) burned away. Windows broken.

Amongst debris I found broken bottle – in opening of bottles was cottonwool – inside bottle was unlighed matches facing towards bottle opening. Around outside the c/wool smelled of benzine – damage was R 150.

I have knowledge of these incidents. – about 1.30.a.m. on 27-11-62 I received a report – went to school – found two classrooms destroyed by fire – 3rd classroom partly destroyed – also storeroom destroyed. I could not find out what caused fire. Damage was R20,000 – there was a strong smell of petrol.

Prep.school about 50 yds from H/school – at front door I found mat half burned – door scorched. On mat was strong smell of petrol and also paraffin. Damage was slight.

I made a brief note of meeting between No. 3 and Looksmart. I made a note about three days later. I saw it at Rondebosch. Last time I have seen statement was at R. I have not been refreshed from statement before giving evidence. I am now trying to remember without having been refreshed,

I have used exact words of conversation – I can still remember exact words without my memory having been refreshed – this morning I made a mistake about 3 months.

I started when photos started – I opened book myself – I will demonstrate now.

I dont know what is on first page – first page is index of names – 3rd name is Dennis Goldberg. I did not look at index.

I was instructed to go through whole book. I did not look at the index.

Person made remark to me – I spoke to him in English “I cant afford to say anything” – not “I cant afford to tell you anything” – I can remember “say” not “tell” – since December 4th 1962.

Incident took place on 5-12-62. I never made statement about occurrence – also no note in P/book. I am giving evidence relying on my memory.

I took L. to place sketched on plan – on same night that I found him about 2½ miles from where we spoke. I was with D / Sgt Laubscher. From there to S/B office. There L. was questioned – afterwards allowed to go.

Sketch was left in our offices next morning. I left it there. Not certain whose file. In one of two files. No 3’s file or L’s file.

It was not necessary to make a note – I did not consider it necessary. I usually made notes. Maybe a note in file which will show circumstances. No other note – I would not have put document in file without making a record.

I left note in file – made no statement. I got notice last Wednesday about giving evidence.

I could have been asked to give evidence because of evidence given in this case. I reported to advocate this morning. I was just asked to come and give evidence. I have been in police for 16 yrs. I made no statement.

Incident happened at night. I saw something handed over. I was about 15 paces away. Standing on pavement. It was not dark. It looked like white paper your h/kerchief – saw something white.

I think I can say that piece of paper found was thing that was handed over.

He withdrew hand – turned round – put hand to left breast pocket – only thing found there.

I did not mention this in chief – I was not asked about it.

I did not know what evidence was to be before I left C.T. – that is why I did not bring note. I got a telex from Dirker to come.

Q. Do you take names of people who attended parties at No 3’s house?

A. I dont like to advertise methods of investigation. I would like to refuse to give this evidence. I dont want to disclose methods.

We take numbers of vehicles – later on investigate to see whose vehicle it is. We make notes of vehicles outside house.

Gatherings at accused’s house were parties.

I am not aware of any braaivleis – often saw people there.

I cant produce notes – are destroyed as soon as investigated. It is security method. No means of checking on evidence because notes have been destroyed.

Tarshish: banned – not allowed to attend gatherings. I cant remember date of banning – I think it was 1962. He was banned on several occasions.

I don’t say that he attended meetings in defiance of bans.

Q. Parties were social gatherings as far as you were concerned?

A. We cant stop people from going to social gatherings – we had not right to take such steps.

Tarshish was banned on several occasions during last 10/15 yrs – were occasions on which banning orders expired and not immediately renewed.

I have never seen Desai in Durban.

I spoke of what I have been told when I referred to D’s visit to Durban.

I have already given evidence in case. Item No. 19 – Ramutsi charged – Molefe dead.

He lived at 311 Dube. I searched his house on 1st May 1963 in presence of his wife Mana.

I took of ----- meal tin from – it swings open – then quite a lot of room behind it. I found 2 membership cards – names of Petrus and Mana Molefe – m/ship of ANC.

I also found rubbers stamp of Dube branch of ANC. I also found a few books of communist literature. I took possession of them. At that stage I was in Orlando. I made statement and handed to D/sgt Van Niekerk of JHB. I could not trace documents again.

XAC:

Not documents – P/10 comm. books – see book by Com. Dictator of China – Mao Tse Tsung – I did not read book I just noticed book.

I have never been to Vanguard B/Sellers – book was written by M.T.T. – I never heard that M.T.T. has written novel. I don’t say that this is novel. I cant believe that this sort of book is allowed. That book would not be allowed. I just glanced through pages. I don’t know title. It was over guerilla warfare – I cant say what it was just more or less.

As far as I can remember all other books originated from China. Just normal communist literature – all came from Comm.. China.

I don’t know what they were about. Could not have been about 5 yr plans.

A. As far as I know father did not need money. I had certain knowledge of his business affairs. Ruron – Ru – stands for Ruth married to J. Slovo

Ruth Slovo lived with husband – I visited them. I know Jack Hodgson – have met him at my sister’s house, Rico Hodgson also.

I had no dealings with J.H. At one stage I did books of D & A and had dealings with R.H.

I have met H. Wolpe at Slovo’s house.

I know Bernstein – I know wife as Hilda Bernstein. I have met them about six times over the years.

I know Ivan Schembrucker - he was associated with New Age - I dont know anything about working. I was secretary to bail fund with I.S., but had no dealings with him.

Other visitors also went to Slovo’s house.

I had dealings with Wolpe in connection with H.P. collections.

D & A is run by a committee – Mr. Alex Hepple is chairman of Fund – father of Bob Hepple. Purpose to provide relief after Sharpville - provided bail in certain cases – cases were widespread. Only for political work.

Cases such as pass laws etc. I think used for further purposes of orgn.

Money came from Christian Action – Canon Collins was in charge.

Bail Fund – at one stage D & A arranged bail fund – subsequently taken over by I.S. and R.H. – for same type of offence.

Originally D & A donated money – subsequently I had no dealings with fund. Dont know if money came from overseas.

Ruron founded in? Co. created by father for tax purposes. It did no business. Its specific business was, finance company. It had dividend. Certain H.P. accounts put through Ruron. For all practical purposes Ruron stopped doing business.

Money came from Co-op Wholesalers. I never spoke to father about this. I was not aware of all transactions – I had nothing to do with conduct of Ruron.

I never asked about nature of transactions. He told me not funds of business itself. I was aware of this. He said he needed sources for temporary placement of money and Ruron was convenient. He indicated money would not be there long.

I had savings account at A.B.S. in my name opened by father. Father said he needed fund for temporary placement of money. Was done. No money came from me or withdrawn by me.

I did not want to query what father did and took no notice. At time I had no knowledge at all. In light of subsequent events – I presume that it was used for political work.

Langa Riots: - 16-3-62 – I have been doing this work for 3 yrs from May ‘60 to Sept ’62.

March/april 1960, march from Langa – lead by Philip Skosana – I did not see it – I was told 30,000 people in march. Comm.. of Inquiry in regard to march.

Phillipe Skosana – was leader of PAC – Ivan not in S/branch at time.

A’s S/Branch man I was investigating officer – I was not concerned with political matters. I dont have knowledge of events.

Philip S. was PAC (so I was told) much unrest at Langa – plenty since removal from W.Cape. This was mentioned at meetings – particularly by people who spoke at meetings.

Another cause of dissatisfaction was hostel system.

Q. Men had to live in hostels away from families

A. People speaking at meeting referred to this (not mentioned to me personally)

Also common police raids to return people to Transkei. This was mentioned at meeting.

250 people in ambush according to police report – I visited scene – crowd came out of bush – on other side was living quarters – cant say they came from that room.

Wont deny that ambush was because of raids etc.

Q. PAC has most strength in Cape?

A. I don’t want to mix myself in that. I did no investigations in regard to PAC – PAC has strong following in Cape.

Prosecution against number of PAC men who were convicted of leaving Langa to kill Matanzina – so I read in newspaper.

At Paarl Inquiry was said that Matanzima was target of PAC.

Item No. 30: - Burning of City Hall – 2 arrests – Levy was one – the other one gave evidence for State. Evidence at trial was that after some competition – singing – held a meeting.

Q. Spontaneously decided to set fire?

A. I did not take part in all investigation – I dont know.

I know of accomplices statement – I did not see the statements – I was not present at preparatory examination.

PUTS: Evidence was that it was a frolic of own?

A. We have tried to find out background – I was told it was political demonstration. Could have been done by two persons as a frolic of their own.

He made confession that he had grudge against employers that is why he set fire to place. That was his explanation.

ACT NO. 131:

I was there with Sauerman – I cant say who came first – possible that spoke to S. first – had quarrel.

I took written statement from him and wife. If I did question him it would be to clear up things. Could be after statements had been taken.

Did not say that he would not be (XAC). I did ask him questions. He refused to answer them. He did refuse to answer certain questions. I did not put questions to him in light of (XAC). He may have taken is at (XAC). First time I have met him.

I handled Goldberg as a complainant not as a political figure. He may not have thought so.

This was in December 1962. I did not have personal knowledge that he was under observation by police. I kept observation afterwards. I cant say what his relationship with S/B was before that.

I only arrived at Langa riot scene the next day – everything that happened there is gleaned from what I have been told. I found the burned out wagon there.

was painted in Selbourne St on that evening – words were not “Free Mandela” – “Vorster we kill now – African police it is time to decide – then sentence in a Bantu language that I could not make out”.

(XAC):

Slogan was in Selbourne St – against a wall – I first saw it that morning. Morning of 8th Oct. On night of 7th an explosion took place. This is more than ½ mile from scene of explosion.

I cant remember when last I was in Selbourne St before the explosion. I cant say how long it was there for.

I know of organisation known as PAC – I don’t know that PAC have taken credit for destroying pylons – I have never see it in newspapers.

I am aware that PAC criticised certain acts of ANC.

PAC wanted to take over Govt. by violence

National Comm of Liberation – actions so wide I cant describe them – I am one of investigating officers in S/B – as such I am not concerned with investigations in organisations and work except where acts have been reported.

I did not see reports of NCL – first attacks of sabotage there was a pamphlet – N.L.M. – MH

N.C. of L. – that is not banned – I know very little of it. I have read nothing about this organisation in papers.

I went to Rivonia on 11th July – we went from town at about 2.p.m. – we stopped at Rivonia police station. cant say time but it was after 3.p.m. – difficult to say how long we stayed there – could have been 15/20 mnts. I cant remember all names of people who left town.

I went to Rivonia in Dry Cleaners Van with Lt. Van Wyk and about ten others.

We left Grays with Dry cleaning van – with Van Wyk and ten others. We went from Grays to Rivonia police – did not stop on way. At P/St some got out and others remained. Those who got out stood around – about 15 mnts later we got back into van. Instructions were given at Grays by Lt. Van Wyk.

Next place, after getting back to van, was on Rivonia Farm – then we made our raid. We did not stop between police station and farm. On farm itself van was moved a little – after it had stopped – (almost immediately).

I went straight to room No. 1. As I entered room I saw somebody disappearing – very quickly – I thought it was a non-European. I am certain it was N.E.. I saw neck and head. It was my observation.

It was dark and slightly red – if it were one of accused it could only have been No. 2 or No. 5.

Not only colour of hair – also neck etc.

Could be No. 2 – I could see at once that No. 3 is European and No. 5 not.

No. 5 had a leather jacket – as shown on photo – I saw him there later on. I think he had a sweater. He had a shortish leather coat. I am not certain coat had a collar. He was dressed as is is shown on photo. Photo shows a collar on coat.

I did not note if collar was turned up. He could have lifted collar before photo was taken.

It was good weather when we came – I cant remember if it was raining.

I saw marks on ground – it was dry level of ground prints not distinct – distinct cracks on ground. Ground could be disturbed in many ways i.e. by standing at window and looking through.

No. 7 had overalls and long coat – I found R183 – R184 in his possession. Also small negatives – I cant say if they have been developed. I have not them. I did not deal with documents.

Document would be marked on envelope as to where found. I might just have said “found in possession of Mhlaba”.

I have said that I found oath and letter.

I found two envelopes on accused. On one was oath. In other was Exh. R 184 – also small negatives in envelope – lottery ticket – that is all I can remember

A. Not that I can remember. I dont know where envelopes are – the other day I asked myself.

It is possible that I described on envelopes what was found on accused.

I went into room alone – I was quite a long time there alone. I did not leave 3 people there alone. W/O Kotze was first to come of others – about 5 mnts later. I did not look at documents on table or examine them. When Kotze came in we took accd. outside.

Kotze was alone – the two of us.

I closed window after Kotze came – I cant remember whether we took accd. out before others came. I think we took accd. out before search.

Dirker, Klindt came in. I am not sure, but I think D. came after Kotze. I am not sure whether prisoners in room when D. entered.

When D. entered we searched for documents – we were ordered to make search. As far as I know accd were not present when search was made for documents. I searched accd. before search for documents.

D. and I went in together. He started reading document that was open on table.

I was not to mark remaining documents – were documents – I did not mark that were on table.

I started marking documents while D. was reading – accd. not in room at time. None of accud. saw D find the document about which he was so excited.

I cant remember how many documents I marked as being found on table – I marked them – found in first room on table – other documents not marked by me.

I did not handle other docs on table. I dont think there were many documents on table. Could be about 12. There were books on table as far as I can remember. I cant remember what there were. I think there were proper books on table.

D. told me to leave documents alone he would take charge of them. He said I need not go any further with marking of docs. He was to take charge of them.

Reason for him saying so, was that we must go to accd. Warn them and ask if they wanted to give any explanation. There were docs. clothes bed in room.

I went out with D. Brought back No. 2 No. 5 No. 6 and Bob Hepple to room. In room accd. denied that things belonged to them or they gave no explanation. Each was asked in turn by D. He gave usual warning – asked if they could give explanation in regard to things in room. Hepple denied – others kept quiet.

After prisoners put in van D and I came back – to see what was there – cant say if all in van. When D. and I came back documents were still on table. Ones which had been marked as well as others which had not been marked.

Burned letter in ashtray – could see certain words – I dont know where document is. I left document there I dont know who took possession of it.

D. took possession of document in room. I saw word ‘trainee” on document. I did not think it of any particular significance at time. I thought it might be valuable and that is why I left it there. Attention of D. and other officers drawn to this. Did not take it away before we went to main house. He took other documents away. I drew his attention to the burned document.

I saw A.G. that afternoon – had just arrived by car. I saw D. examine boot of car. I did not watch what was inside but a number of articles were taken out. As far as I know

there were a number of suitcases – I don’t remember whether they were of leather. I did not help with that search. Cant remember if he took documents out of the boot.

We searched coalshed after prisoners in van – prisoners were not present – other members were present. One doc. was found – I have not seen it – a number of pages in an envelope. He produces document – writing on top is his – “found between coalbags in roofless coalshed”. – EXHT R. 187

No coal in bags – bags used for coal.

I marked document

I went to room No. 6 – “storeroom” – rubbish old bags etc – things evidently thrown away were there – no documents – in a shoe box I saw name Ruth – one document in it – I have not seen it again (the document)

I made different lists of things we found. I have not the lists – I gave them to investigating officers – Lt Van Wyk and Mr. D.

I made a separate list for each room – viz Mashifane Room 1, room 12.

No note of document in coalshed – I noted clearly on document where I had found it.

I dont know where my lists are – there should be a typed copy of the lists. I made lists in ink.

I handed docs to Mr. D – he took them to main house – also searched there.

For each room a separate carton was used – list was handed over at same time.

In main dwelling house – 4 of us searched. D. kept the lists. I took part in srarch and most of docs I marked. e.g. lounge – gave doc. a number.

I marked all docs. I found. As far as I am

concerned, I meticulously marked them and said in which room they have been found. In room No. 1 a number of docs were found that were not marked.

Accd. were at no stage present in outbuildings as far as I can remember.

I remember that G. was present in main house.

Patrick Gaboutlede: attached to ANC. I met him twice. Arrested and charged with furthering objects. May 1961 was first meeting – charge was withdrawn against him. When I saw his name on list I searched his house – he told me that he had been attached to ANC in past.

He said he had been member of ANC and had taken no further part in organisation since he had been banned.

I have heard that all Indians in Tvl. belong to TIC – they have no choice.

When I brought them out, others were in charge of other policeman – one was brought by Kleingeld – I am not certain who.

D. and I searched thatched room – just two of us – other policemen came into room.

I come from P.E. I own property. I have garages. I advertised garage to let in paper. Strachan saw me about this. He saw me at garage about Nov ’61. He told me where he stayed in P.E.. He asked if garages had electric light. I said no – he said pity because he had to build a trailer. He would use a hurrican lamp.

GArage is at 10a Cape Rd. P.E.. This garage is about 700 yrds from Rink St. P.E.

He paid R4-00 for cash for hire of garage. I cleaned garage – nothing left there.

Next thing I was visited by S/B on 16-12-61. As a result I gave evidence. We went to garage wity S/B. They asked me not to tramp on anything – Wooden box – two handles – name of Strachan on it – nothing else that I can remember. I cant remember any more writing.

Box was not there before. Was white dust, and sand on floor – it was not there before. Nothing else I can tell you.

Wooden case with glass inside – I did not see inside – it is written on outside “with care”.

I gave evidence in P.E. against Strachan – he was charged with others and found guilty

MR. WATSON:

I am engine driver in service of SAR. I am stationed at Greyville. I recall morning of 21-3-63 – I was driving a passenger train from Durban to Port Shepstone. We pick up trucks on way. We left Durban at 1.a.m. First station is at Berea Rd. On way to B.Rd.Station I heard an explosion. I did not see anything. I continued at a cautious speed until I passed under V.Rd.Bridge. Engine gave a jerk to left. Felt as if engine was to be derailed. Engine kept on rails. I kept on line. I took train over damaged portion. I stopped before station and then reported incident to signal man at station. Police arrived soon afterwards. Dynamite was placed on side of rail. Explosion blew 26” of rail away.

At that spot track curves slightly to left. We could see from one side, but from my side we could not see. My view of track was obscured.

If I had not proceeded so cautiously I presume engine might have been derailed etc. Danger to me and firemen. Train carries quite a number of passengers. I think there were passengers that day – ITEM 176.

XAC:

Not first time I have given evidence on incident. I gave evidence at P’mBrg last month. It was established in evidence that train was in 5MPH speed limit section. Just after I passed out of section and before I picked up speed I met detailed section.

One line is sufficient to detail a train.

It is not such a curve to be difficult.

BY COURT:

very, very, slight curve.

Missing portion was on left hand rail.

I have never turned over – I have had a few when wheels went in between lines – I was not travelling very fast – quite a few derailments.

I have been a driver for 16 yrs. I must have been involved in ½ doz derailments.

I have had them in shunting yards – only one on ordinary trip. At Mpopsa Station. I was travelling 10-15 m.p.h. at time. I was derailed but did not turn over.

The flange is on inside of track. With broken rail flange could go out – flanges are between line – if flange is broken.

Each wheel has flanges – all had flanges.

I am B/Detc. Senior Sgt stationed at P.E. I am a Xhosa. I went to school and passed Std 9. EXH. “YY” is a leaflet written in Xhosa. I was asked to translate leaflet. I translated leaflet correctly.

EXH “XX” is typed in Xhosa – I was shown that and asked to translate that – I translated it correctly.

D/Sgt SAP – fingerprint expert JHB. I have been attached to Dept. for 7 yrs.

I went to room No. 4. I found a jam tin in room next to ----- contained small screws. I examined tin and found a fingerprint made by printers ink – I had it photographed.

A photo of that print I hand it in as EXH “BO” I also had prints of Wolpe (QQ) I compared prints. I prepared a C.A. Card (BP) – identical – 10 points of identity.

XAC:

I drew circles round prints – only one with cross was identified. Others could not be identified. I was given other prints – I have them on record.

I examined a lot of articles at Rivonia. I have records of these examinations.

I examined m/car ND 71903 – nothing found there.

Cutlery in room No. 1 – I found prints which I could not identify.

Bottles from room No. 1 – I did not identify any other prints.

ONLY identifiable print was Wolpe. I examined duplicating machine in room No. 4 – I was

D/SGT. FERREIRA

Recently (27-1-63) other bantu were arrested at Pretoria. Of these 4 are detained in connection with attempted sabotage at Synagogue. Four belong to ANC as well as MK. (item 148)

In Oct ’62 there was attack on Minister’s office – 3 are detained in connection with this attack – all are members of ANC and MK.

XAC:

I arrested people in Janury 1964 – attempted sabotage was Jan. ‘63 – Union Bldgs were in ’62.

Old Synagogue people are held under 90 days – no charge yet – other 3 are also held under 90 days. No charge against them at this stage.

4 arrested persons told me that they belonged to MK and ANC.

First two arrested on 27th. Before detention both admitted ANC and MK – one said leader of MK in Pretoria.

They made admission as soon as arrested. As a result of information observation was held – on 27-1 one person was found in possession of home made bomb. He was arrested with goods. He immediately told everything. Nobody has been taken before Magistrate to sign a confession. Leader has made an 81 paged statement.

At this stage there are about 19 who have been held and about 4 or 5 have made statement.

Synagogue: only 4 are being held with that

particular incident – only 1 has made statement – other 3 not yet.

Minister: None of them have made statements yet.

I say that these people are members because they told me so. In regard to those 7 only one has given written statement.

Found Looksmart at house – L. said all articles belonged to him. All 2 were arrested. I dont know where other 2 are. Both of them would be back in Cape. One has been released since. I dont know what has happened to other. As soon as I found articles L. admitted they were his. He made it clear that others had nothting to do with articles.

Depends on circumstances whether police warning is given to 90 day detainee. Object of 90 day detention is to keep until speak. I would warn person if I spoke to him about specific charge against him.

I would give usual warning – I would say no need to make statement even though detained for 90 days. When I spoke to No. 10 I only discussed documents. Did not say he was suspected of anything. Merely said that he could give explanation as to documents. I did not say that I had warned him. I cannot remember saying “in the usual manner”. If I did say that it was a mistake. I don’t remember using word “gewone” There are different types of warning. I told accd. that certain documents in his possession and would like to have an explanation from him. That is what I call a warning.

Chemicals can be prepared according to method described. Picric Acid is authorised explosive. It is yellowish crystals – Require large quantity to be explosive.

SYRINGE BOMB.

Piece of pipe – contains Potas. Permanganate and Al. powder. Mixed and layer of Potas. Perm. End sealed off with syringe containing glycerine – press plunger – release glycerine – causes explosion – get shrapnel effect.NOT safe to test in completed form. DONT know when glycerine would get through. Tested in two sections – worked satisfactorily.

Exhibit BT is example of petrol bomb. Corresponds with Exhibit 2.. Very effective explosive. Not as dangerous to handle as explosives.

PETROL BOTTLE.

Band 3” wide around centre of bottle covered with mixture of Pot. Chlor. and icing sugar – A few pieces of rubber put in bottle – sulphuric acid – throw bottle – breaks – ignites – sets off flame. Pieces of rubber designed to keep device burning.

We found similar bottles sent up to P.E.

THERMITE BOMB : Metal container ± 1 gal. half filed with thermite. Ignited by tube containing mixture of pot. perm. and Al. powder, followed by layer of pot. perm and sand. Glycerine percolates through sand – sets off thermite etc. Vairous types of bombs were all prepared according to specifications in document and verbal instructions from Army. Ones intended to be deadly were deadly.

Others designed for other purposes – burning, melting etc.

Delay Ignition mechanism. Can be used to ignite various substances – cotton wool soaked in petrol could be ignited. (Details given to me by Army) Worked perfectly.

I cant make out words in street. I can see A – I cant suggest what A stands for – I suggest it stands for Point ‘A’. I don’t agree that A appears in both streets - There is A in one street. A in opening between two streets. A near Landsdown Ave. According to sketch streets are parallel. Asterisk is in street itself – Street ends there.

Railway there –

No signal boxes in street. Houses on either side of the street. And on either side of asterisk. No houses on right hand side for 15/20 paces from point. Are houses on left side.

I assume that asterisk shows bottom end of street. Are houses there.
