The Standing Committee on Rules, Procedures and the Rightsof Parliament has the honour to present its

FIRST REPORT

Pursuant to rule 86(1)(d)(i), your committee has reviewed theRules of the Senate, and recommends as follows:

1. That the existing Rules of the Senate be replaced by therevised Rules of the Senate contained in the First Appendixto this report, including the associated appendices to theRules, effective from September 1, 2012;

2. That the Clerk of the Senate be authorized to prepare a fulland comprehensive index to the revised Rules of the Senatefor tabling in the Senate by the Speaker as soon aspracticable, and to make other minor typographicalcorrections as may be required; and

3. That, for greater certainty, any sessional and other ordersalready adopted remain in effect for the remainder of thecurrent session.

The Second Appendix to this report contains a concordanceindicating the relationship between the existing Rules and therevised Rules.

The revised Rules of the Senate recommended to the Senate bythe committee are the result of many years of work. The projectbegan as many as 12 years ago during the Speakership of the lateSenator Molgat. It continued intermittently in subsequent years,and, last session, the Rules Committee committed itself to thisundertaking. It set up a subcommittee which sat many hours tosystematically review drafts of proposed changes. The members ofboth the subcommittee and the committee worked harmoniously,in the best traditions of the Senate.

The proposed Rules would be organized more logically. Therewould now be 16 chapters, instead of the previous 12, plus anappendix of terminology. The chapters follow a more logical,systematic structure. There are now separate chapters for TimeAllocation, Emergency Debate and Questions of Privilege. Thisnew arrangement will make the rules easier to locate. In addition,each rule is identified with the distinct numeric tag of its chapter.For example, each rule relating to the Order of Business, Chapter4, begins with the number 4. Thus the rule about prayers is 4-1and the rule on the Routine Proceedings is 4-5. This newnumbering system will help senators locate the Rules and subjectmatter more quickly.

The major objective of the revision was to clarify the Rules,while avoiding significant changes in content. In a few caseschanges were required in the interest of clarity or to reflect currentpractice. Additional information on such changes will becirculated to senators separately, accompanied by a documentidentifying the original text and the revised text.

PREMIER RAPPORT

Conformément à l’article 86(1)d)(i) du Règlement, votrecomité a examiné le Règlement du Sénat et recommande ce quisuit :

1. Que l’actuel Règlement du Sénat soit remplacé par saversion révisée figurant à la Première Annexe du présentrapport, y compris les annexes y afférents, à partir du 1er

septembre 2012;

2. Que le greffier du Sénat soit autorisé à préparer un indexcomplet et détaillé de la version révisée du Règlement duSénat pour dépôt au Sénat le plus tôt possible par lePrésident, et qu’il soit également autorisé à corriger leserreurs typographiques au besoin;

3. Qu’il soit entendu que les ordres sessionnels et autres ordresdéjà adoptés continuent de s’appliquer pour le reste de laprésente session.

La Deuxième Annexe du rapport contient une concordance quiétablit le lien entre le Règlement actuel et sa version révisée.

La version révisée du Règlement du Sénat que le comitérecommande au Sénat est le fruit de nombreuses années de travail.Le projet a été amorcé il y a 12 ans, à l’époque de feu lePrésident Molgat. Il s’est poursuivi de manière intermittente dansles années suivantes et, à la session dernière, le Comité duRèglement s’est engagé à le mener à terme. À cette fin, il a créé unsous-comité qui a passé de longues heures à examinersystématiquement toutes les modifications proposées. Comme leveut la tradition au Sénat, les membres du sous-comité et ducomité ont travaillé de concert pour accomplir leur travail.

Le Règlement proposé est organisé de manière plus logique.Il compte maintenant 16 chapitres, au lieu de 12, ainsi qu’uneannexe expliquant la terminologie utilisée. Ces chapitres sontstructurés de manière plus logique et plus systématique. Il y amaintenant des chapitres distincts pour la fixation de délais, lesdébats d’urgence et les questions de privilège. Cette nouvellestructure permettra de trouver les articles du Règlement plusfacilement. En outre, chaque article est identifié par un repèrenumérique qui correspond au chapitre en question. Par exemple,chaque article ayant trait à l’Ordre des travaux (chapitre 4)commence par le numéro 4. Ainsi, l’article sur les prières porte lenuméro 4-1 et celui sur les Affaires courantes, le numéro 4-5.Ce nouveau système de numérotation permettra aux sénateurs detrouver plus rapidement les articles et sujets qu’ils cherchent.

L’objectif premier de la révision était de clarifier le Règlementtout en évitant les modifications de fond plus importantes. Danscertains cas, des modifications ont été apportées par souci declarté ou pour tenir compte de la pratique actuelle. De plusamples renseignements sur ces modifications et un document oùfigurent les versions originale et révisée seront fournis à chaquesénateur séparément.


A new feature of the revised Rules is the use of constitutionaland statutory references as well as lists of exceptions to anyparticular rule. For example, the deliberative vote of the Speakeris sanctioned by section 36 of the Constitution Act, 1867 and this isreferenced immediately after the rule. The general rule withrespect to speaking times, proposed rule 6-3(1), is followed by alist of rules that stipulate any exceptions.

If the revised Rules of the Senate come into force during thecourse of the current session, they will have no effect on theoperations of any orders or motions adopted thus far in thesession. This includes, for example, the sessional order respectingthe sitting schedule of the Senate on Wednesdays and Thursdays,powers granted to committees, and orders of reference tocommittees. Any references to numbers in the existing Rulescan be translated into the revised Rules by use of the concordancecontained in the Second Appendix to this report.

Your committee considers that the proposed revised Rules ofthe Senate represent a significant improvement over the existingRules, being more user-friendly and clearer.

En outre, la version révisée du Règlement renvoie aux lois et àla Constitution et précise les dispositions contraires à un articledonné. Par exemple, la voix délibérative du Président, qui est unevoix non prépondérante, fait l’objet de l’article 36 de laLoi constitutionnelle de 1867, et une mention à ce sujet suitimmédiatement l’article du Règlement où il en est question.L’article qui a trait aux temps de parole, soit l’article 6-3(1), estsuivi d’une liste d’articles indiquant les exceptions quis’appliquent.

Si la version révisée du Règlement du Sénat entre en vigueur aucours de la présente session, ce changement n’aurait pasd’incidence sur les ordres et motions adoptés jusqu’àmaintenant au cours de la session. Cela comprend, par exemple,les ordres sessionnels concernant les séances du Sénat un mercrediou un jeudi, les pouvoirs accordés aux comités ainsi que les ordresde renvoi donnés aux comités. L’utilisation de la DeuxièmeAnnexe du présent rapport permet d’établir le lien entre lesarticles du Règlement actuel et le Règlement révisé.

Votre comité considère que la version révisée du Règlement duSénat constitue une amélioration importante du Règlementactuel, puisqu’elle est plus conviviale et plus claire.
