    Attached for underwriters use and information is a copy of the revised Joint Rig CommitteeMarine Warranty Surveyors Code of Practice (CoP) and Generic Scope of Work (GSoW)(JR2009/002), drawn up by JRC after consultation with surveyors, and others..

    This Code of Practice and Generic Scope of Work replaces the 2004 Code of Practice and2005 Generic Scope of Work previously issued by JRC. It is now presented as a singledocument which underwriters may use as an Endorsement to marine energy coverages theyare issuing. In common with all JRC produced Clauses, this Clause is published by JRC, butit is expressly non-binding and JRC makes no recommendation as to its use in particularpolicies. Underwriters are of course free to offer different policy wordings and clauses to theirpolicy holders.

    The Code of Practice and Scope of Work has the following objectives:

    To:

    Clarify the respective roles of the Marine Warranty Surveyor, the Assured, and

    Underwriters Define the function of the Marine Warranty Surveyors Scope of Work.

    Outline criteria for Marine Warranty Surveying activities.

    Establish guidelines for communication with underwriters.

    This Endorsement also gives Underwriters the option of specifying the application of anProject Specific Scope of Work (PSoW) where they think this is required,

    MARINE WARRANTY SURVEY

    1) Coverage under this Policy for proj ect act ivi t i es is condit i onal upon:

    a) A Marine Warranty Surveyor being appointed by the Assured from the fol lowing

    panel

    3) The Marine Warranty Survey shall be conducted in accordance wit h the Marine WarrantySurveyor Code of Practice (CoP) and the GSOW contained herein (or the Project specificScope of Work (PSOW) as agreed by t he Contr act leader(s)).

    A mater i al change to t he project wil l require a review of t he Scope of Work.

    4) The cost of t he Marine Warrant y Survey wil l be borne by the Assured.

    5) Any expenses incurred to comply wit h the Marine Warranty Surveyor srecomm endations wil l be solely at t he expense of t he Assured.

    6) The Marine Warranty Surveyor shall not be rest r ict ed from f urnishing informat ion to orconsult ing in an unrestr icted manner with Underwriters.

    7) Underwrit ers shall be entit led to receive a copy of any recommendat ions and/ orreport s direct ly f rom t he Marine Warrant y Surveyor.

    This CoP has been produced in order to establish agreed standards for Marine WarrantySurveyors performance while conducting Marine Warranty Surveys.

    It has the fol lowing object ives:

    To :

    Clar if y t he role of t he Marine Warranty Surveyor. Define t he funct ion of the Marine Warranty Survey Scope of Work.

    Out l ine approval cr i t er ia f or Marine Warranty Surveying act i vit ies.

    Est ablish minim um st andards for Marine Warranty Surveyor perfor mance.

    Define l ines of communication between Underwriters and the MarineWarranty Surveyor.

    Not hing in t his CoP shall rel ieve any part y of any legal obligat ions exist ing in t he absence oft his document. The Code of Pract ice out l ines t he obligat ions for t he Marine WarrantySurveyor, t he Assured & t he Underwrit er.

    The Code of Pract ice incl udes a Generic Scope of Work (GSOW) in t abular f orm at. At ai lored Project Specif ic Scope of Work (PSOW) may be subst it uted for t he GSOW wi t h t heexpl ic i t agreement of Underwr i t ers.

    1 Role of the Marine Warranty Surveyor

    1.1 The fundament al obj ect ive of t he Marine Warranty Surveyor is t o make reasonableendeavours to ensure that the r isks associated with the warranted operat ions to which aMarine Warranty Surveyor is appointed are reduced to an acceptable level in accordancewit h best indust ry pract ice.

    1.2 The Marine Warranty Surveyor Company wil l only appoint personnel who aredemonstrably competent , in terms of qual i f icat ions and exper ience, to per form thereview / approval act i vit y being undertaken in accordance wit h t he Marine Warrant y Scopeof Work.

    1. 3 The Marine Warranty Surveyor wil l be satisf ied, so far as possible, that theoperations are conducted i n accordance wit h:

    recognised codes of practice for design and operations;

    best indust ry pract i ce appropr iate f or t he vessels, equipment and locat ion;

    vessels and equipment being used wit hin defi ned safe operat ing l im it s.

    1. 4 The Marine Warranty Surveyor wil l make available t o Underwrit ers:

    an opinion on t he adequacy of t he Marine Warranty Scope of Work;

    part iculars of t he experience of t he key personnel t o be engaged;

    a schedule of actual and proposed site at t endances;

    a schedule of Cert i f icat es of Approval t o be issued.

    1. 5 The Marine Warranty Surveyor shall perform a review of the relevantdocumentat ion in accordance wi th the requirements of I tem 1.3 above re lat ing to theproposed operat ions within the Marine Warranty Scope of Work including, but not l imitedt o:

    calculat ions;

    drawings;

    procedures;

    cer t i f icates;

    manuals;

    relevant reports.

    1. 6 The Marine Warranty Surveyor shall carry out suitability surveys of vessels,st ruct ures and equipment pr ior to each operat ion, including any required fol low up closeout inspections unless otherw ise defined in t he Marine Warranty Scope of Work, and shall :

    est ablish t hat t he relevant i t ems are suit able for t he proposed operat ions;

    make known, in clear terms, in wr it ing to the Assured the recommendationst o be implement ed pr ior t o commencement of t he proposed operat ions;

    make known, in clear terms, in wr it ing to the Assured the recommendationsto be implemented dur ing the per iod of the proposed operat ions;

    review metocean condit ions and, where appropr iate, incorporaterequirements as to metocean condit ions in the recommendations in theCert i f icate(s) of Approval;

    observe and record t he preparat ions for t he proposed operat ions;

    att end and wit ness cr it ical funct ion t est s or relevant assurance tests.

    1. 7 Subject to the Marine Warranty Surveyor being satisf ied that the object ivesoutl ined under I tems 1.1 above wil l be met, the Marine Warranty Surveyor wil l issue aCer t i f icate of Approval . The Cer t i f icate of Approval wi l l c lear ly ident i f y:

    t he operat ion to be car r ied out ;

    t he vessel(s) to be used; recommendations to be satisf ied dur ing the per iod of the proposed

    operat ions wit hin the Marine Warranty Scope of Work. Recommendat ionsissued for the Assureds implementat ion should be targeted to reduce r iskt o Underwr i t ers and worded in a c lear and expl ic i t manner and whether t herecommendation has been implemented or not should be capable of beingobject ive ly ver i f ied.

    1. 8 The Marine Warranty Surveyor wi l l :

    advise Contract leader(s) when a confidential i ty agreement with theAssured is in place which would preclude the exchange of information orcommunication with Contract leader(s);

    not provide any other services t o the Assured and/ or Operat or and/ or MainCont ractor(s) and/ or Sub Contr actor(s)that could present a confl ict ofin t erest wi t h t he Mar ine Warrant y Work, for example:i ) Marine or Design Consultant involved ina/ Design of proj ect com ponents t o be used in a marine operat ion, t hefa i lure of which could compromise the integr i ty of a pro ject asset ( forexample a l i f t beam or padeye).b/ Pr im ary analysis of st ruct ures, hull s or component part s ther eof. Note:the Marine Warranty Surveyor is however expected to review a design byothers where this has a direct bear ing on the marine r isk e.g. check of thestrength of launch frames on a launch jacket, or assessment of a l i f tanalysis of a deck.c/ The product ion of procedures, pr oj ect st andards, r isk assessment s and

    other management documentat ion which inf luences how a marineoperation is conducted and which has a direct bear ing on the r isk of apar t icu lar mar ine operat ion e.g. loadout , l aunch, l i f t o f a j acket . i i ) Loss adjusterii i) Classif icat ion Authori t yiv) Verification

    1. 9 The Marine Warranty Surveyor wil l immediately advise Contract leader(s), with acopy to the Assured:

    i f any Cert i f icate of Approval is withheld; or a Non Conformance Cert i f icateissued;

    i f the Assured fai ls to comply with any recommendations made by the

    Marine Warranty Surveyor; of any proposed changes to rel evant k ey personnel employed by t he Marine

    Warranty Surveyor.

    1.10 The Marine Warranty Surveyor wi l l issue t he fol lowing st atus report s t o t he Contr actleader(s) direct at key r isk mil estones:

    t he mar ine warranty survey act iv i t y car r ied out in t he per iod;

    the mar ine warranty survey act iv i ty p lanned pr ior to the next r iskmi lestone;

    copies of Cert i f i cate(s) of Approval issued since t he last report .

    I f the Assured has provided insuff icient information to perform a comprehensive review ort he Marine Warrant y Surveyor s quest ions/ request s for i nform ation rem ain pending, t henthe Marine Warranty Surveyor shall make this clear in his reports to Underwriters andoutl ine the potential implicat ions of the omissions.

    1.11 All equipment and vessels associat ed wit h load-out, transport at ion and instal lat ionactivit ies shall be ful ly operat ional and used within their safe working l imits, which shall beagreed by t he Marine Warrant y Surveyor . All vessels (incl uding off shore cranes, pipel ayvessels, r igs and flotels) to be in IACS Class. Marine Warranty surveyor to agree alloutstanding Class it ems as not m ater ial t o int ended operat ions. Marine Warranty surveyorto approve l imit ing metocean cr iter ia, and weather windows for al l marine operat ions.

    2 Role of the Assured

    2.1 Once appointed on t he proj ect the Marine Warranty Survey Company shall not bechanged wit hout t he express and pr ior agreement of t he Cont ract leader(s).

    2.2 The Assured shall provide t he Marine Warranty Surveyor wit h a point of contact forthe Contract leader(s) and an appropr iate point of contact in the Assureds organisation toassist wit h the resolut ion of quer i es.

    2.3 The Assured wil l provide Contr act leader(s) wit h t he contact detai l s of t he MarineWarranty Surveyor(s) wi t hin 14 working days fol l owing appointm ent of t he same.

    2.4 The Assured wil l provide t he Marine Warranty Surveyor(s) wit h t he contact detai lsof Cont ract l eader(s) wit hin 14 working days fol lowing appointm ent of t he same.

    2.5 The Assured shall procure Marine Warranty Surveyor part icipat ion at al l relevantproj ect management meet ings, including marine operat ion HAZOPs/ HAZID, cont ingencyplanni ng and assurance/ t est ing plans.

    2.6 The Assured shall contr act the Marine Warranty Surveyor direct ly (wit hout t heinvolvement of any contractor or intermediary) unless required to enable compliance withthe law in the jur isdict ion or government regulat ions.

    2.7 The Assured shall appoint a single Marine Warrant y Survey Company f or t he ent irescope of w ork herein.

    3 Role of t he Underwri ters

    3.1 The Panel of Marine Warrant y Surveyor s is t o be agreed by t he Cont ract leader(s).

    Ot her addi t ions t o the panel wi l l need t o demonstrat e t heir capabi l i ty / exper ience ofsimi lar proj ects and wat er dept hs, and t o be agreed by the Cont ract l eader(s).

    3.2 On each proj ect Underwri ter s wil l specif y whet her a Kick Off meet ing is requiredbet ween Underwrit ers, t he Assured and the Marine Warranty Surveyor. The Assured,

    Contract leaders and Marine Warranty Surveyor shall agree key risk milestones and date(s)for a j o int review of the pro j ect scope and development .

    3.3 At t he request of the Marine Warrant y Surveyor, Underwr it ers wil l make available:

    The PSOW, otherwise the GSOW to be used;

    relevant applicable policy terms and condit ions including, in part icular, anywarrant y provisions or condit ions precedent;

    identity and contact detai ls ( including telephone, e mail, fax and out ofhours numbers) of the nominated Contract leader(s) to receivecomm unications from the Marine Warranty Surveyor.
