JUDICIAL AFFIDAVIT OF COMPLAINT

I, JOEL AGAN CENAS, of legal age, married, and residing at Sitio

Tapak, Brgy. Dumlog, Talisay City, after having been sworn to in

accordance with law do hereby depose and state:

That Atty. Juril Broka Patiño of The Law Firm of Piramide, Famor

Jr., Corpuz, Patiño and Piramide located at Suite 222, C.S. Ladia Bldg, P.

Del Rosario St., corner Junquera St., Cebu City is the counsel who

conducted and supervised my examination as a witness at the same office;

That I am answering the questions herein fully conscious that I do so

under oath and that I may be criminally liable for false testimony or perjury;

The following are the Questions propounded by Atty. Juril BrokaPatiño in Cebuano Dialect considering that my educational attainment does

not provide me enough understanding of the English language and my

answers are likewise in Cebuano which are translated in English:

Tecson (Venerando, for brevity). (I want to seek your assistance in

filing a criminal case against the Acting Chief of City of Talisay

Traffic Operations Development Authority (CT-TODA for brevity)

Q2: Unsa man nga kaso ang buot nimung ipasaka batok ni Venerando?

(What case would you like to file against Venerando?)

A2: Buot nako siyang kasuhan ug Grave Coercion ug Grave Misconduct.

(I wanted to file a criminal case for Grave Coercion and

Administrative case for Grave Misconduct.)

Q3: Unsa man diay gihimo niining Venerando kanimo nga buot mu man

siyang pasakaan ug kaso? (What was done to you by this Venerando

that you want to file criminal and administrative cases against him?)

A3: Niadtung Marso 7, 2016 mga pasado alas 8 ang takna sa kabuntagun

didto sa parking area sa Tabunok Public Market sa Talisay City,

nagparking ko sa akong gidala nga Suzuki Multicab nga may

temporary plate no. 124-102 ug nakarehistro sa pangalan ni Ali Haji

Hashem1 ug narehistro sa kasamtangan tuig base sa Official Receipt 2

ug anaa usab Authority to Use nga giisyu sa LTO Sarangani Office3.

Human nakog parking sa maong sakyanan, akong gipatingug ang

radio nga nakainstalar sa sakyanan nga adunay gitaud nga trumpa ug

naminaw ko sa programa ni Danny Cogtas sa istayun nga DYRB,dihang kalit kong giduol sa usa ka tinderang babaye nga nakasul-ob

ug T-shirt nga adunay imprinta sa usa ka kandidato pagka Bise Mayor

sa Talisay nga si Dennis Basillote ug miingun kanako “Nganung

magsabasaba man ka nga dili man na makadaug ang imung agalon

karung election”. Dayun iya kong giingnan nga pahuwatun kay

ipadakop ko niya sa mga sakop sa CT-TODA. Diha-diha miabot pod

dayun ang mga sakop sa CT-TODA ug ila kong gipalibutan. Dayun

nagpaila ang usa kanila nga siya maoy Acting Chief sa CT-TODA nga

nailhan nako nadugay nga si Venerando Tecson ug iya kong

gimanduan nga pakanaugun ko sa multicab sa hinungdan nga wa niya

isulti kanako. Sa dihang nangutana ko kung unsay ako nahimo nga

kasal-anan, nasuko man hiuon siya ug miingun siya kanako kungunsay akong gisaligan kung nganung arrogante kaayo ko. Iya dayung

gipangayo ang akong drivers license. Wala nako gihatag ug ako

siyang gibalik ug pangutana kung unsa ang akong nahimo nga

kalapasan nganung kuhaon niya akong lisensya apan nasuko siya ug

iya kong giinisugan ug gipugos niyag kuha akong lisensya. Wa koy

nahimo kay isug na kaayo siya ug daghan usab kaayo siyag kauban

maong nahadlok ko ug ako nalang gihatag akong lisensya. Human

niyag kuha sa akong lisensya, iyang dayung gipugos pagkuha ang

yawe sa multicab nga wa gani mananghid nako. Wa nakoy nahimo sa

iyang gibuhat tungod sa akong kahadlok nga basin ug unsay ilang

buhatun nako kung mupalag ko. Dayun gisingkahan ko niya kung asa

ang rehistro sa sakyanan ug ako siyang gitug-anan kung asa ang

rehistro dayun iya usab kining gikuha.(Last March 7, 2016 at around

8:00AM at the parking area of Tabunok Public Market, I parked the

driven Suzuki Multicab I was driving bearing temporary plate no 124-

102 registered under the name of Ali Haji Hashem, registered in this

current year basen of the Official receipt together with an Authority

to Use issued by LTO Sarangani Extension Office . After I parked

said vehicle, I turned on my radio set with horn loudspeakers

attached to it and listened to the radio program anchored by Danny

Cogtas over DYRB, when suddenly a lady vendor clad in a T-shirt

with the name of the Vice-Mayoralty Candidate of Talisay Dennis

Basilote imprinted on it, approached me and told me that I should not

create noise for my boss would still lose anyway in this election. She

further told me to wait for she would call CT-TODA members to

apprehend me. Almost immediately after she left, a team of CT-TODA

arrived at my place and surrounded me. Then, somebody introduced

himself as the Acting Chief of CT-TODA whom I later knew as

Venerando Tecson and he asked me to get down from my vehicle and

when I inquired what wrong did I do, he in turn asked me who backed

me up why I am acting so arrogantly. He then arrogantly asked my

driver’s license. I refused to give him my license and asked again

what I violated, if any, but he furiously looked at me and forced me to

give my license. I was left with no recourse except to follow his

demands for I was afraid they might resort to violence. Thereafter, he

forcibly took the key of the vehicle. He snarled at me in asking where

is the Certificate of Registration of the car, and took it along with him

after telling him where I place the same.)

(After Venerando forcibly took your license, key and Certificate of

Registration of the car, what happened next?)

A4: Iya kong gidala sa Police Station sa Talisay kuyog sa lain pa niyangmga kauban sa CT-TODA kay iya kong ipapriso.(He brought me to

the police station of Talisay and was accosted by several members of

CT-TODA to be detained.)

Q5: Sa dihang naabot mo sa police station sa Talisay, gipapriso ba gyud

ka? (When you arrived at the Police Station of Talisay, where you

being detained?)

A5: Wala ko napriso sir. (I was not detained sir.)

Q6: Nganung wala man ka napriso?( Why you were not detained?)

A6: Wala ko napriso sir kay sa dihang iturn-over na unta ko ni Venerando

sa kapulisan, nibalibad man ang mga pulis nga nag duty didto kay

wala daw koy nahimong krimen ug dili ko angayang prisuhon.(I was

not detained sir because when Venerando was about to turn me over

to the police for detention, the police officers on duty refused to take

me in their custody for I committed no crime which would justify my

detention.)

Q7: Unsa may sunod nahitabo sa dihang wala ka gipapriso sa kapulisan?

(What happened after you were not detained by the police?)

A7: Gidala ko ni Venerando ug sa iyang mga sakop sir sa office sa CT-

TODA nahimutang sa Talisay City Hall. (I was brought by

Venerando and his men to their office located at the City Hall of

Talisay.)

Q8: Pag-abot nimu ditto sa CT-TODA Office sa Talisay City Hall, unsa

may sunod nahitabo? ( And when you were at the office of CT-TODA

located at the City Hall, what happened next?)

A8: Pwerteng sukua gyud ni Venerando nako sir labaw na adtung punto

nga nangutana siya nako ug nakaila ba kuno ko niya ug ako siyang

gitubag nga wala. Dayun iyang gitawag ang usa sa iyang mga sakop

sa CT-TODA nga nailhan lang nako nga si Balucos. (Venerando was

so violent especially at that point when he asked me if I knew him and

I honestly answered in the negative. Then he called one of his CT-

TODA men whom I only knew in the name of Balucos.)

Q9: Unsa may sunod nahitabo human gipatawag ni Venerando si Balucos?

(What happened after Venerando called Balucos?)

A9: Giingnan ni Venerando si Balucos sir nga paisyuhan ko ug Citation

Ticket kay nakalapas ko sa public disturbance. (Venerando instructed

Balucos to issue Citation Ticket on me for violating publicdisturbance.)

Q10: Niisyu ba si Balucos ug Citation Ticket nimu tungod sa public

disturbance? (Did Balucos issue Citation Ticket on you for public

disturbance?)

A10: Wala dayun siya muisyu sir. (He did not issue right away sir.)

Q11: Nganu man? (Why?)

A11: Wala muisyu si Balucos dihadiha dayun sir ug iyang giingnan si

Venerando nga walay kalapasan nga public disturbance. (Balucos did

not issue and told Venerando that there was no violation for public

disturbance.)

Q12: Unsa may sunod nahitabo?(What happened next?)

A12: Naisyuhan gyud ko ug citation ticket sir. Gani duha ka citation tickets

ang giisyu sa akoa. (I was still issued sir. In fact, I was issued two (2)

tickets.)

Q13: Nganung naisyuhan man kag duha ka citation tickets? (Why you were

issued two (2) citation tickets?)

A13: Kay giingnan man ni Venerando si Balucos nga papangitaon ug

violation sa akoa para maisyuhan ug citation tickets. Nahibulong gani

ko sir kung nganung si Balucos maoy nag-isyu nako nga si Venerando

man maoy nagkuha sa akong lisensya,yawe ug sa rehistro. (BecauseVenerando instructed Balucos to look for any violation so I can be

issued Citation Tickets. I even wondered sir why it was Balucos who

issued Citation Tickets when it was Venerando who confiscated my

driver’s licens, took the key of the vehicle and the Certificate of

Registration.)

Q14: Unsa man nga Citation Tickets ang naisyu batok sa imuha?(What are

the Citation Tickets issued against you?)

A14: Ang usa sir kay Citation Ticket No. 23944 para sa public

disturbance/nuisanceug Citation Ticket No 23955 para sa Illegal

Installation of Radio Sets. (I was issued Citation Ticket No. 2394 for

public disturbance and the other Citation Ticket No. 2395 is for

Illegal Installation of Radio Sets.)

Q15:Human ka maisyuhi ug Citation Tickets, unsa may sunod nga imung

gibuhat? (After you were issued two (2) Citation Tickets, what did you

do?)

A15: Ako giingnan sila sir nga muuli nako pero dili ko nila pagawasun

kung dili daw ko kabayad sa Citation Tickets.(I told them sir that I

will go home but they prevented me from going home and told me that

I can’t be released unless I would pay the Citation Tickets.)

Q16: Unsa may imung gibuhat sa dihang wala ka nila pagawsa kung dili ka

kabayad sa Citation Tickets? (What did you do when they never

allowed you to go unless you will pay for the Citation Tickets?)

A16: Wala man koy kwarta nga ikabayad sir mao nga wala gyud ko

kagawas didto. Maayo nalang gani kay niabot ang akong abogado ug

gikuha ko didto kay iyang giingnan ang taga CT-TODA nga dili ko

pwede ila pugngan pag-gawas,mao nakagawas ko. (I have no money

sir to pay for the Citation Tickets so they did not release me. Good

thing that my lawyer arrived and he told the CT-TODA members that

they do not have the right to detain me as a result I was released.)

Q17: Human ka makagawas, unsa may sunod nahitabo? (After you were

released, what happened next?)

A17: Gipangayo sa akong abogado ang yawe sa multicab ngadto kang

Venerando. Nagdumili unta si Venerando paghatag sa yawe apan iya

gisultian si Venerando nga wala siyay katungod pagkuha sa yawe ug

mao kadto nga iya kining gihatag, dayun nibalik ko sa nahimutangansa multicab ug giingnan ko sa akong abogado nga muadto mi sa LTO

arun gayud sutaon kung dad-on ba gayud ni Venerando ang akong

driver’s license ngadto sa LTO. (My lawyer demanded the car key

from Venerando which the latter at first hesitated until my lawyer told

Venerando that he had no right to keep my driver’s license and which

time he also gave. Then I went back to the place where my multicab

was parked and I was told by my lawyer to go to LTO to find out if,

indeed, Venerando would bring my driver’s license there.)

Q18: Sa pag-abot ninyo sa LTO Talisay, unsa may nahitabo? (When you

were at LTO Talisay, what happened next?)

A18: Wala gyud nako nalukat ang akong drivers license sir kay gingnan mi

sa taga LTO Talisay nga wala nila gidawat ang akong lisensya sa

dihang gi-turnover na unta ni Venerando kay wala man silay nakitang

kalapasan nako. (I was not able to redeem my driver’s license sir because we were told that they did not accept my drivers license when

it was turned-over by Venerando for I committed no violation.)

Q19: Unsa may sunod nimung gihimo? (What did you do thereafter )?

A19: Ako nalang gipablotter6 ang gihimo ni Venerando kanako sa Police

Station. ( I narrated everything Venerando did to me in police blotter at the

police station.)

Q20:Human nimu ug pablotter, unsa man imung sunod nga gihimo?( After

having the incident in a police blotter,what did you do next, if any?)

A20: Mipadala ko ug suwat7 ngadto sa CT-TODA arun ipapauli ang akong

driver’s license. (I wrote a letter addressed to CT-TODA requesting them to

return my driver’s license.)

Q21:Aduna pa ba kay idugang?( Do you have something to add?)

A21: Oo sir. Nadawat na diay nako ang akong driver’s license adtung

Marso 9, 2016 kay giuli man sa CT-TODA ug gihatud didto sa opisina sa

akong abogado ug gihatag pod sa akong abogado nako. (Yes sir.I already

received my driver’s license last March 9, 2016 because it was returned by

CT-TODA and delivered to the Office of my lawyer which in turn my lawyer

gave it to me.)

Q22: Nganung giuli man ang imung lisensya sa CT-TODA? (Why did CT-

TODA returned your driver’s license?)

A22: Base sa suwat nga gipadala ni Atty. Alfredo Sipalay ngadto sa akong

abogado nga may petsang Marso 7, 2016, gitambagan ni Atty. Sipalay ang

taga CT-TODA nga ipauli ang akong licensya. (Based on the letter of Atty.

Alfredo Sipalay addressed to my lawyer dated March 07, 2016 8 , Atty.

Sipalay advised CT-TODA to return my license9.)
