The organising committee consisting of Chief Justice Blow, Justice Judith Kelly as Chair, Justice Hilary Penfold and Magistrates Michael Daly and Marc Sargent have worked hard to prepare a stimulating program for the colloquium which will also enable attendees to enjoy the beauty of Hobart.

The Governor of Tasmania, Her Excellency, Professor the Honourable Kate Warner will officially open the conference and present the keynote address. Her Excellency is a distinguished legal academic and an internationally recognised expert in the fields of criminal law, criminology and sentencing. After the keynote address Carly Anne Shrever, an advisor to the Judicial College of Victoria, will outline the latest research on the psychological impact of judicial work. This will continue the ongoing dialogue on this topic from previous JCA colloquiums. Facilitating discussion on this topic is an important part of the JCA’s functions. On the Friday evening the Governor will host a reception at Tasmania’s magnificent government house.

In the first session on Saturday morning we will hear from two speakers from the renowned United States Studies Centre on the politics surrounding the judiciary in the USA and the passing of legislation in the Congress. This will provide insight into the developments there and perhaps some cautionary lessons for this country.

Other sessions include:

- an address from Chief Justice Grant of the Northern Territory on the topic of the interaction of superior courts with royal commissions;

- a session on the future of Courts and the legal profession from Professor Dan Hunter, the Dean of Swinburne Law School;

- Professors Gabrielle Appleby and Brian Opeskin will discuss the research they have undertaken on behalf of the JCA into temporary judicial appointments.

Last and by no means least on the Saturday night we will all be treated to an after dinner speech from Tasmania’s very own Chief Justice Blow in the magnificent waterfront confines of the Peppermint Bay restaurant.

The JCA prides itself on providing a colloquium that is thought provoking, useful, collegial and value for money. I hope you and your partner can join us.

Judges have distinctive political identities that are increasingly partisan. Judicial politics has become so important in American government that the appointment of a new Supreme Court justice became the pivotal issue of the 2016 election, guaranteeing Donald Trump the support of millions of conservative Christians who were otherwise wary of him.

America: the Confusion of PowerApril Palmerlee – Former Senior Coordinator for International Women’s Issues, US State DepartmentSome people say that passing legislation in the United States has become “war minus the shooting” and it is no wonder Washington is gridlocked. The phrase “get stuff done” doesn’t immediately come to mind for most people when they think about the US government in general and Congress specifically. Congress is more polarized now than it has been in 150 years. The President can’t make laws himself or force Congress to make any, but he can issue Executive Orders instructing the government how it is to work within the parameters set by Congress and the Constitution.

The Future of Courts and the Legal ProfessionProfessor Dan Hunter, Foundation Dean, Swinburne Law School, MelbourneThe combination of technology, the internet, and globalisation is profoundly changing all professions and most markets. For some—such medical radiography and ophthalmology—the professionals are, in the words of Professor Geoffrey Hinton, like Wile E. Coyote: “You’re already over the edge of the cliff, but you haven’t yet looked down. There’s no ground underneath.” 

For the courts and the legal profession the diagnosis isn’t so dire, but changes are accelerating. This presentation foretells what the practice of law and the administration of the legal system will look like over the next twenty-five years; and posits what new legal skills and dispositions will be necessary to survive (and even thrive) in this brave new legal world.

Temporary Judicial Officers in Australia: An Empirical and Critical AnalysisProfessor Gabrielle Appleby, Faculty of Law, University of New South Wales and Professor Brian Opeskin, Faculty of Law, University of Technology, SydneyPresentation of research undertaken Gabrielle Appleby (UNSW), Suzanne Le Mire (University of Adelaide), Andrew Lynch (UNSW) and Brian Opeskin (UTS) 

This presentation will draw on research that was commissioned by the Judicial Conference of Australia into the use of temporary judicial officers across the Australian state and territory jurisdictions. The findings as to current levels of use of temporary judicial officers across Australia will be presented, followed by an interactive discussion around the benefits and challenges of such appointments, and possible best-practice principles to inform their future use.

Watching the Watchers: the Interaction between Superior Courts and Royal CommissionsChief Justice Michael Grant, Supreme Court of Northern Territory The Royal Commissions into child sex abuse and youth detention currently in train potentially involve a revisitation of decided cases, access to court records for that and other purposes, and, in some cases, a review of matters subject to parallel proceedings before superior courts. The materials considered by the Royal Commissions include material subject to secrecy and non- ‐ publication provisions under State and Territory legislation. Those matters raise broader questions of jurisdiction, comity and contempt.
