The people of the state of Wisconsin, represented in senate and assembly, do enact as follows: SECTION 3. 7.33 (1) (a) of the statutes is amended to read: 7.33 (1) (a) “Employe” has the meaning given under s. 101.01 (2) (a) (3) . SECTION 4. 7.33 (1) (b) of the statutes is amended to read: 7.33 (1) (b) “Employer” has the meaning given under s. 101.01 (2) (b) (4) . SECTION 5. 7.33 (1) (c) of the statutes is amended to read: 7.33 (1) (c) “State agency” has the meaning given un- der s. 20.001 (1) and includes an authority created under ch. 231, 232, 233 or 234. SECTION 8. 11.36 (1) of the statutes is amended to read: 11.36 (1) No person may solicit or receive from any state officer or employe or from any officer or employe of the University of Wisconsin Hospitals and Clinics Au- thority any contribution or service for any political pur- pose while the officer or employe is on state time or is en- gaged in his or her official duties, except that an elected state official may solicit and receive services not consti- tuting a contribution from a state officer or employe or an officer or employe of the University of Wisconsin Hospi- tals and Clinics Authority with respect to a referendum only. Agreement to perform services authorized under this subsection may not be a condition of employment for any state such officer or employe. SECTION 9. 11.36 (3) and (4) of the statutes are amended to read: 11.36 (3) Every person who has charge or control in a building, office or room occupied for any purpose by this state or , by any political subdivision thereof or by the University of Wisconsin Hospitals and Clinics Authority shall prohibit the entry of any person into that building, office or room for the purpose of making or receiving a contribution. (4) No person may enter or remain in any building, office or room occupied for any purpose by the state or , by any political subdivision thereof or by the University of Wisconsin Hospitals and Clinics Authority or send or direct a letter or other notice thereto for the purpose of re- questing or collecting a contribution. SECTION 14L. 13.101 (4a) of the statutes is created to read: 13.101 (4a) The committee may transfer appro- priated moneys from the appropriation account of any state agency, as defined in s. 20.001 (1), under which doc- ument production, reproduction or distribution costs are financed, other than a sum sufficient appropriation ac- count, to the appropriation account under s. 20.870 (1) (r), in an amount not exceeding the savings accruing to the state during the fiscal biennium in which the transfer is made resulting from the centralization of document production, reproduction or distribution functions in the department of administration, as documented by the de- partment. * Section 991.11, WISCONSIN STATUTES 1993-94: Effective date of acts. “Every act and every portion of an act enacted by the legislature over the governor’s partial veto which does not expressly prescribe the time when it takes effect shall take effect on the day after its date of publication as designated” by the secretary of state [the date of publication may not be more than 10 working days after the date of enactment].

    An Act relating to: state finances and appropriations, constituting the executive budget act of the 1995 legislature,and making appropriations.

    The people of the state of Wisconsin, represented insenate and assembly, do enact as follows:SECTION 3. 7.33 (1) (a) of the statutes is amended to

    read:7.33 (1) (a) “Employe” has the meaning given under

    SECTION 8. 11.36 (1) of the statutes is amended toread:

    11.36 (1) No person may solicit or receive from anystate officer or employe or from any officer or employeof the University of Wisconsin Hospitals and Clinics Au-thority any contribution or service for any political pur-pose while the officer or employe is on state time or is en-gaged in his or her official duties, except that an electedstate official may solicit and receive services not consti-tuting a contribution from a state officer or employe or anofficer or employe of the University of Wisconsin Hospi-tals and Clinics Authority with respect to a referendumonly.     SECTION 9. 11.36 (3) and (4) of the statutes areamended to read:

    SECTION 14L. 13.101 (4a) of the statutes is createdto read:

    SECTION 14g. 13.101 (4b) of the statutes is created toread:

    13.101 (4b) The committee may transfer appro-priated moneys from the appropriation account of anystate agency, as defined in s. 20.001 (1), other than a sumsufficient appropriation account, in an amount not great-er than the estimated savings to the state resulting fromthe implementation by the agency of an information tech-nology project under s. 16.971 (5), to the appropriationaccount under s. 20.870 (1) (r). The committee shall notact under this subsection unless the estimated savings tothe state are documented by the secretary of administra-tion.

    SECTION 15. 13.101 (4g) of the statutes is amendedto read:

    13.101 (4g) At the request of the department of agri-culture, trade and consumer protection under s. 92.14(4r), the committee may transfer funds from the appropri-ation under s. 20.370 (4) (cq) (6) (aq) to the appropriationunder s. 20.115 (7) (q) if necessary to provide grants un-der s. 92.14 (4) (c).

    SECTION 16. 13.101 (6) (a) of the statutes is amendedto read:

    13.101 (6) (a) As an emergency measure necessitatedby decreased state revenues and to prevent the necessityfor a state tax on general property, the committee may re-duce any appropriation made to any board, commission,department, the university of Wisconsin system or to anyother state agency or activity by such amount as it deemsfeasible, not exceeding 25% of the appropriations, exceptappropriations made by ss. 20.255 (2) (ac), (bc), (bh),(bm), (cg) and (cr), 20.395 (1), (2) (cq), (eq) to (ex) and(gq) to (gx), (3), (4) (aq) to (ax) and (6) (aq) and (ar),20.435 (4) (a), (d) and (e) (1) (c), (6) (a) and (7) (da) and20.445 (3) (a) and (d) or for forestry purposes under s.20.370 (1), or any other moneys distributed to anycounty, city, village, town or school district. Appropri-ations of receipts and of a sum sufficient shall for the pur-poses of this section be regarded as equivalent to theamounts expended under such appropriations in the priorfiscal year which ended June 30. All functions of saidstate agencies shall be continued in an efficient manner,but because of the uncertainties of the existing situationno public funds should be expended or obligations in-curred unless there shall be adequate revenues to meet theexpenditures therefor. For such reason the committeemay make reductions of such appropriations as in itsjudgment will secure sound financial operations of theadministration for said state agencies and at the sametime interfere least with their services and activities.

    SECTION 16g. 13.101 (10) of the statutes is amendedto read:

    13.101 (10) The committee may approve expendi-ture of moneys received by this state as a part of a blockgrant, and may approve a transfer of moneys allocated bythe federal government to this state as a part of a block

    grant for use as a part of another such grant made for dif-ferent purposes. In this subsection, “block grant” has the

    meaning given under s. 16.54 (2) (a).SECTION 16m. 13.101 (13) of the statutes is created

    to read:

    13.101 (13) (a) Upon the crediting of proceeds fromthe sale or lease of a state building or structure or state

    land to the appropriation account under s. 20.865 (4) (a),the amounts in the schedule for that appropriation are in-

    creased by the amount credited for the fiscal biennium inwhich the crediting occurs.

    (b) If the building, structure or land was used by a sin-

    gle agency, as defined in s. 13.48 (14) (a), the committeemay, upon request of that agency, transfer not more than

    50% of the moneys so credited to any appropriationaccount of that agency, other than a sum sufficient ap-propriation account, without finding that an emergency

    exists under sub. (3) (a) 1. Upon such transfer, theamounts in the schedule for any sum certain appropri-

    ation to the agency from the account to which a transferis made are increased by the amount transferred duringthe fiscal year or biennium for which the appropriation is

    made.(c) The committee may, upon request of the building

    commission, transfer not more than 50% of the moneysso credited to the building trust fund without finding that

    an emergency exists under sub. (3) (a) 1.(d) If the building, structure or land was not used by

    a single agency, as defined in s. 13.48 (14) (a), or was un-

    der the management of the department of administrationfor use by more than one agency, the committee may,

    upon request of the building commission, transfer anamount not greater than the amount of the moneys socredited to the building trust fund without finding that an

    emergency exists under sub. (3) (a) 1.SECTION 16q. 13.123 (2) (intro.) of the statutes is

    amended to read:13.123 (2) INTERIM EXPENSES. (intro.) From the ap-

    propriation under s. 20.765 (1) (a) or (b), each member

    of the legislature shall be entitled to an expense allow-ance for postage and clerical assistance for each full cal-

    endar month during which the legislature is in actual ses-sion 3 days or less. No allowance is payable to a

    representative to the assembly unless the speaker of theassembly files with the chief clerk of the assembly a writ-ten authorization for the allowance to be paid. No allow-

    ance is payable to a senator unless the majority leader ofthe senate files with the chief clerk of the senate a written

    authorization for the allowance to be paid. An authoriza-tion filed under this subsection becomes effective for themonth in which it is filed and continues in effect through

    the month in which the speaker of the assembly or the ma-jority leader of the senate files a written revocation of the

    authorization with the chief clerk of the appropriatehouse. The rate of such allowance shall be as follows:

    SECTION 17. 13.172 (1) of the statutes is amended toread:

    13.172 (1) In this section, “agency” means an office,department, agency, institution of higher education, asso-ciation, society or other body in state government created

    or authorized to be created by the constitution or any law,which is entitled to expend moneys appropriated by law,

    including the legislature and the courts, and any authoritycreated in ch. 231, 233 or 234.

    SECTION 17f. 13.45 (3) (a) of the statutes is amendedto read:

    13.45 (3) (a) For any day for which the legislator does

    not file a claim under s. 13.123 (1), any legislator ap-pointed to serve on a legislative committee or a commit-

    tee to which the legislator was appointed by either houseor the officers thereof shall be reimbursed from the ap-propriations under ss. 20.315 and 20.765 (1) (a) or (b) for

    actual and necessary expenses incurred as a member ofthe committee.

    SECTION 17m. 13.48 (1m) (e) of the statutes is cre-ated to read:

    13.48 (1m) (e) Notwithstanding par. (b), the building

    commission may grant waivers under s. 44.39 (5).SECTION 18m. 13.48 (5) of the statutes is renumbered

    13.48 (5) (a).SECTION 18n. 13.48 (5) (b) of the statutes is created

    to read:13.48 (5) (b) Whenever the building commission

    considers any proposal for the construction of a new cor-

    rectional institution or the expansion of an existing cor-rectional institution, the department of administration

    shall provide the commission with information concern-ing annual operating costs, including staffing costs, thatwill result from such construction or expansion in con-

    nection with consideration of that proposal.SECTION 22. 13.48 (10) of the statutes, as affected by

    1993 Wisconsin Act 288, is amended to read:13.48 (10) APPROVAL BY BUILDING COMMISSION. (a)

    No state board, agency, officer, department, commission

    or body corporate may enter into a contract for the con-struction, reconstruction, remodeling of or addition to

    any building, structure, or facility, which involves a costin excess of $100,000, without completion of final plans

    and arrangement for supervision of construction andprior approval by the building commission. The buildingcommission may not approve a contract for the construc-

    tion, reconstruction, renovation or remodeling of or anaddition to a state building as defined in s. 44.51 (2)

    unless it determines that s. 44.57 has been complied withor does not apply. This section applies to the departmentof transportation only in respect to buildings, structures

    and facilities to be used for administrative or operatingfunctions, including buildings, land and equipment to be

    used for the motor vehicle emission inspection and main-tenance program under s. 110.20.

    (b) This subsection does not apply to contracts anyof the following:

    1. Contracts by the department of natural resourcesfor construction work related to hazardous substancespill response under s. 144.76 or environmental repair

    under s. 144.442. This subsection does not apply to proj-ects

    2. Projects approved by the governor in response toemergency situations under s. 16.855 (16) (b) or to al-

    locations from the appropriation made under s. 20.867(2) for special category projects when the building com-mission has released funds under sub. (3) and has also ap-

    proved a plan for the expenditure of those funds. “Spe-cial category projects” for the purpose of this subsection

    subdivision include but are not limited to projects such asspecial maintenance, energy conservation, handicappedaccess and advance property acquisition designated by

    the building commission.SECTION 22m. 13.48 (10) (a) of the statutes, as af-

    fected by 1993 Wisconsin Act 288 and 1995 WisconsinAct .... (this act), is repealed and recreated to read:

    13.48 (10) (a) No state board, agency, officer, depart-

    ment, commission or body corporate may enter into acontract for the construction, reconstruction, remodeling

    of or addition to any building, structure, or facility, whichinvolves a cost in excess of $100,000, without comple-

    tion of final plans and arrangement for supervision ofconstruction and prior approval by the building commis-sion. The building commission may not approve a con-

    tract for the construction, reconstruction, renovation orremodeling of or an addition to a state building as defined

    in s. 44.51 (2) unless it determines that s. 44.57 or 16.846has been complied with or does not apply. This sectionapplies to the department of transportation only in respect

    to buildings, structures and facilities to be used for ad-ministrative or operating functions, including buildings,

    land and equipment to be used for the motor vehicle emis-sion inspection and maintenance program under s.110.20.

    SECTION 23. 13.48 (10) (b) 3. of the statutes is createdto read:

    13.48 (10) (b) 3. Construction or improvement proj-ects of the University of Wisconsin Hospitals and Clinics

    Authority.SECTION 24. 13.48 (13) (a) of the statutes is amended

    to read:

    13.48 (13) (a) Except as provided in par. (c), everybuilding, structure or facility that is constructed for the

    benefit of or use of the state or any state agency, board,commission or department or the University of Wiscon-sin Hospitals and Clinics Authority shall be in com-

    pliance with all applicable state laws, rules, codes andregulations but the construction is not subject to the ordi-

    nances or regulations of the municipality in which theconstruction takes place except zoning, including with-

    out limitation because of enumeration ordinances or reg-ulations relating to materials used, permits, supervision

    of construction or installation, payment of permit fees, orother restrictions.

    SECTION 24c. 13.48 (13) (a) of the statutes, as af-

    fected by 1995 Wisconsin Act .... (this act), is amendedto read:

    13.48 (13) (a) Except as provided in par. (b) or (c),every building, structure or facility that is constructed for

    the benefit of or use of the state or any state agency, board,commission or department or the University of Wiscon-sin Hospitals and Clinics Authority shall be in com-

    pliance with all applicable state laws, rules, codes andregulations and zoning ordinances or regulations of the

    municipality in which the construction takes place but isnot subject to other ordinances or regulations of that mu-nicipality, including without limitation because of enu-

    meration ordinances or regulations relating to materialsused, permits, supervision of construction or installation,

    payment of permit fees, or other restrictions.SECTION 24f. 13.48 (13) (b) of the statutes is created

    to read:

    13.48 (13) (b) Every building, structure or facilitythat is constructed at state fair park shall be in compliance

    with all applicable state laws, rules and codes but is notsubject to zoning or any other ordinances or regulations

    of the municipality in which the park is located.SECTION 24g. 13.48 (14) (a) of the statutes is renum-

    bered 13.48 (14) (am).

    SECTION 24h. 13.48 (14) (a) of the statutes is createdto read:

    13.48 (14) (a) In this subsection, “agency” has themeaning given for “state agency” in s. 20.001 (1).

    SECTION 24j. 13.48 (14) (c) of the statutes is

    amended to read:13.48 (14) (c) Net If there is any outstanding public

    debt used to finance the acquisition of a building, struc-ture or land or the construction of a building or structurethat is sold or leased under par. (b), the building commis-

    sion shall deposit a sufficient amount of the net proceedsfrom the sale or lease of the lands or buildings under par.

    (b) shall be deposited building, structure or land in thebond security and redemption fund under s. 18.09 to pay

    repay the principal and pay the interest on any bonds usedto finance those lands or buildings the debt, and any pre-mium due upon refunding any of those bonds that debt.

    If there are is no such bonds debt outstanding, the net pro-ceeds shall be used to pay the principal and interest on the

    bond which is from any revenue source from which therewere appropriations to support those lands or buildingsand which bears the highest true interest costs in compar-

    ison to any other bond from such revenue sources or, ifthe net proceeds exceed the amount required to repay that

    principal and pay that interest and premium, the buildingcommission shall credit the net proceeds or remaining net

    proceeds to the appropriation account under s. 20.865 (4)(a).

    SECTION 24k. 13.48 (14) (d) 1. of the statutes isamended to read:

    13.48 (14) (d) 1. In this paragraph, “surplus land”

    means land under the jurisdiction of the commission andallocated for use by a state an agency, but unused and not

    needed for the agency’s operations or included in theagency’s plan for construction or development.

    SECTION 24L. 13.48 (14) (d) 2. of the statutes isamended to read:

    13.48 (14) (d) 2. Biennially, beginning on January 1,

    1984, each state agency having surplus land shall submitto the building commission and the joint committee on fi-

    nance an inventory containing the description, location,description and fair market value of each parcel of sur-plus land.

    SECTION 24m. 13.48 (14) (d) 3. a. to c. of the statutesare amended to read:

    13.48 (14) (d) 3. a. The location, description and fairmarket value, description and location.

    b. Whether the commission intends to sell or transfer

    the use of the parcel will be sold or transferred for use byfrom one agency to another state agency.

    c. Whether If the commission intends to transfer useof the parcel from one agency to another agency, whether

    transfer of the parcel for use by another state agency iscritical or desirable, if the commission intends to transferthe parcel.

    SECTION 25. 13.48 (26) of the statutes is amended toread:

    13.48 (26) CLEAN WATER ANNUAL FINANCE PLAN AP-PROVAL. The building commission shall review the ver-sions of the biennial finance plan and any amendments to

    the biennial finance plan submitted to it by the depart-ment of natural resources and the department of adminis-

    tration under s. 144.2415 (3) (bm) and the recommenda-tions of the joint committee on finance and the standingcommittees to which the versions of the biennial finance

    plan and any amendments were submitted under s.144.2415 (3) (bm). The building commission shall con-

    sider the extent to which that version of the biennial fi-nance plan that is updated to reflect the adopted biennial

    budget act will maintain the clean water fund in perpetu-ity, maintain the purchasing power of the clean waterfund, meet the requirements of ss. 144.241 and 144.2415

    to provide financial assistance for water quality pollutionabatement needs and nonpoint source water pollution

    management needs, and provide a stable and sustainableannual level of financial assistance under ss. 144.241 and144.2415 proportional to the state’s long−term water pol-

    lution abatement and management needs and priorities.The building commission shall also consider the extent

    to which the implementation of the clean water fund, asset forth in that version of the biennial finance plan

    updated to reflect the adopted biennial budget act, imple-ments legislative intent on the clean water fund program.The building commission shall, no later than 60 days af-ter the date of enactment of the biennial budget act, eitherapprove or disapprove the biennial finance plan that isupdated to reflect the adopted biennial budget act, exceptthat the building commission may not disapprove thoseamounts that the legislature approves under s. 144.2415(3) (c). If the building commission disapproves the ver-sion of the biennial finance plan that is updated to reflectthe adopted biennial budget act, it must notify the depart-ment of natural resources and the department of adminis-tration of its reasons for disapproving the plan, and thosedepartments must revise that version of the biennial fi-nance plan and submit the revision to the building com-mission.

    SECTION 26. 13.48 (28) of the statutes is created toread:

    13.48 (28) STATE PROPERTY LEASED TO THE UNIVERSI-TY OF WISCONSIN HOSPITALS AND CLINICS AUTHORITY.The building commission may not authorize public debtto construct or improve any on−campus facilities, as de-fined under s. 233.01 (7), if the building commission be-lieves, at the time that the public debt is authorized, thatthe facilities are or will be leased to the University of Wis-consin Hospitals and Clinics Authority.

    SECTION 27. 13.53 (2) (b) of the statutes is amendedto read:

    13.53 (2) (b) Study and review the postaudit or otherreports submitted by the legislative audit bureau, conferwith the state auditor and assistants and with other legis-lative committees in regard to such reports and, whennecessary, confer with representatives of the state agencyentities audited in order to obtain full and complete in-formation in regard to any fiscal transactions and govern-mental operations within the state.

    SECTION 28. 13.53 (2) (c) of the statutes is amendedto read:

    13.53 (2) (c) Refer to the legislature or to an appropri-ate standing committee information that, in its opinion,warrants action by the legislature or by the committee.It may request from a standing committee information onsuch action as is taken. The committee shall seek the ad-vice of the appropriate standing committees with respectto the program portion of an audit relating to a state de-partment or agency an entity which is within the purviewof such committee.

    SECTION 29. 13.53 (3) (a) of the statutes is amendedto read:

    13.53 (3) (a) In any instance in which a postaudit re-port of the legislative audit bureau cites cases of improperpayments; inadequate accounting, operating, or adminis-trative system controls, procedures, or related records;inaccuracies; waste or extravagance; unauthorized orunintended activities or programs; or other deficienciesrequired by statute to be reported, the head of the state de-

    partment or agency entity to which the audit report per-tains shall, within a time period specified by the commit-tee, advise the cochairpersons of the committee, thechairperson of the joint committee on legislative orga-nization and to each appropriate standing committee ofany remedial actions taken or to be taken on matters citedin the report. Where such advice is not forthcoming fromthe head of the state department or agency entity withinthe time period specified by the committee, or where thecommittee determines that suitable action has not beentaken, the committee may report the matter immediatelyto the joint committee on legislative organization and toeach appropriate standing committee.

    SECTION 30. 13.53 (3) (b) of the statutes is amendedto read:

    13.53 (3) (b) The committee may, in any case, pro-pose specific corrective action to remedy undesirablepractices, including changes in applicable laws, rules andprocedures, but with respect to the program portion of au-dit, it shall first seek the advice of the appropriate stand-ing committees which have purview over the state de-partment or agency entity under review. If the committeeintroduces a bill, it shall be referred to the appropriatestanding committee. The appropriate standing commit-tees may propose corrective legislation wherever theyfind that the program portion of the audit indicates that alaw is not being implemented in the manner intended bythe legislature when the law was enacted.

    SECTION 31. 13.53 (4) of the statutes is amended toread:

    13.53 (4) FISCAL AND PERFORMANCE EVALUATIONS.The committee may at any time, without regard to wheth-er the legislature is then in session, request the joint com-mittee on legislative organization to investigate any mat-ter within the scope of a postaudit completed or beingconducted by the legislative audit bureau. It may also re-quest investigation and consideration of any matter rela-tive to the expenditures and revenues as well as the fiscaland performance activities of state departments andagencies entities pursuant to the objectives of the com-mittee and the legislative audit bureau.

    SECTION 35. 13.625 (8m) of the statutes is created toread:

    13.625 (8m) Subsection (3) does not apply to the so-licitation of anything of pecuniary value to pay the costsof remedying environmental contamination, as definedin s. 144.968 (1), by an agency official of the departmentof natural resources.

    SECTION 36. 13.625 (10) of the statutes is created toread:

    13.625 (10) This section does not apply to the soli-citation, acceptance or furnishing of anything of pecuni-ary value by the department of tourism, or to a principalfurnishing anything of pecuniary value to the departmentof tourism, under s. 19.56 (3) (em) or (f) for the activityspecified in s. 19.56 (3) (em).

    SECTION 37. 13.63 (1) of the statutes is amended toread:

    13.63 (1) LICENSES. An application for a license toact as a lobbyist may be obtained from and filed with the

    board. The application shall be signed, under the penaltyfor making false statements under s. 13.69 (6m), by thelobbyist. Upon approval of the application and paymentof the applicable license fee under s. 13.75 (1) or (1m) tothe board, the board shall issue a license which entitlesthe licensee to practice lobbying on behalf of one or moreeach registered principals principal who or which havehas filed an authorization under s. 13.65 for that lobbyistand paid the authorization fee under s. 13.75 (4). The li-cense shall expire on December 31 of each even−num-bered year. No application may be disapproved by theboard except an application for a license by a person whois ineligible for licensure under s. 13.69 (4) or lobbyistwhose license has been revoked under s. 13.69 (7) andonly for the period of such ineligibility or revocation.Denial of a license may be reviewed under ch. 227.

    SECTION 38. 13.75 (1) of the statutes is amended toread:

The plan shall also identify anychanges in the functioning of the legislature and legisla-tive service agencies under the plan.

    SECTION 42. 13.92 (1) (e) 5. of the statutes isamended to read:

    SECTION 44. 13.94 (1) (n) of the statutes is amendedto read:

    SECTION 44m. 13.94 (1) (o) of the statutes is createdto read:

    SECTION 47m. 13.94 (8) of the statutes is created toread:

    13.94 (8) COUNTY AND MUNICIPAL BEST PRACTICES RE-VIEWS. (a) In this subsection, “municipality” means acity, village or town.

    (b) The state auditor shall undertake periodic reviewsto:

    1. Examine the procedures and practices used bycounties and municipalities to deliver governmental ser-vices.

    2. Determine the methods of governmental servicedelivery.

    3. Identify variations in costs and effectiveness ofsuch services between counties and municipalities.

    4. Recommend practices to save money or providemore effective service delivery.

    (c) The state auditor shall determine the frequency,scope and subject of any reviews conducted under par.(b).

    (d) To assist the state auditor with the selection ofcounty and municipal practices to be reviewed by the au-ditor, the auditor shall establish an advisory council con-sisting of the following members appointed by the audi-tor:

    1. Two members chosen from among 6 names sub-mitted by the Wisconsin Counties Association.

    2. One member chosen from among 3 names sub-mitted by the League of Wisconsin Municipalities.

    3. One member chosen from among 3 names sub-mitted by the Wisconsin Alliance of Cities.

    4. One member chosen from among 3 names sub-mitted by the Wisconsin Towns Association.

    (e) The members of the council appointed under par.(d) shall serve without compensation.

    SECTION 47n. 13.94 (8) of the statutes, as created by1995 Wisconsin Act .... (this act), is repealed.

    SECTION 47o. 13.95 (intro.) of the statutes isamended to read:

    13.95 Legislative fiscal bureau. (intro.) There iscreated a bureau to be known as the “Legislative FiscalBureau” headed by a director. The fiscal bureau shall bestrictly nonpartisan and shall at all times observe the con-fidential nature of the research requests received by it;however, with the prior approval of the requester in eachinstance, the bureau may duplicate the results of its re-search for distribution. Subject to s. 230.35 (4) (a) and(f), the director or the director’s designated employesshall at all times, with or without notice, have access toall state departments agencies and the University of Wis-consin Hospitals and Clinics Authority and to any books,records or other documents maintained by such agenciesor the authority and relating to their expenditures, reve-nues, operations and structure.

Iof ch. 14 to study law enforcement issues; 6 members,one of whom is a consumer representing the public atlarge, with demonstrated professional, research or per-sonal interest in alcohol and other drug abuse problems,appointed for 4−year terms; a representative of an orga-nization or agency which is a direct provider of servicesto alcoholics and other drug abusers; a member of theWisconsin county human service association, inc., whois nominated by that association; and 2 members of eachhouse of the legislature, representing the majority partyand the minority party in each house, chosen as are themembers of standing committees in their respectivehouses. Section 15.09 applies to the council.

    SECTION 48g. 14.19 (4) of the statutes is created toread:

    14.19 (4) The governor shall appoint an employe ofthe office of the governor as the family literacy advocateto establish a statewide program to improve family litera-cy.

    nor, and to the legislature under s. 13.172 (2) no later thanJune 1, 1999. Upon acceptance of the report by the gov-ernor, the commission shall cease to exist.

    SECTION 49b. 14.367 of the statutes is renumbered15.187, and 15.187 (1) (a) (intro.) and (b), as renum-bered, are amended to read:

    15.187 (1) (a) (intro.) There is created in the office ofthe secretary of state department of financial institutionsa uniform commercial code statewide lien system coun-cil. The council shall consist of the administrator of thedivision of information technology services in the de-partment of administration or the administrator’s desig-nee and the following members appointed by the secre-tary of state the department of financial institutions for6−year terms:

Telegraphic reports as to results of recordsearches shall be $5 plus the cost of the telegram. Thesecretary of state shall charge and collect for preparingany record or certificate under this subsection in an expe-ditious manner, an expedited service fee of $25 in addi-tion to the fee otherwise required under this subsection,except that only one expedited service fee may becharged for multiple identical corporation or limitedpartnership certificates of status if the certificates of sta-tus are requested at the same time and issued at the sametime.

    SECTION 51c. 14.38 (12) of the statutes is renum-bered 182.01 (6) and amended to read:

    182.01 (6) DISCRIMINATION BY CORPORATIONS OR LIM-ITED LIABILITY COMPANIES. If a complaint is made to thesecretary of state department that any corporation or lim-ited liability company authorized to do business in this

    state is guilty of discrimination under s. 100.22, refer thematter to the department of agriculture, trade and con-sumer protection, which shall, if the facts justify it in itsjudgment, cause appropriate administrative or judicialproceedings to be commenced against the corporation orlimited liability company and its officers or managersand members.

    SECTION 52b. 14.38 (13) (title) of the statutes is re-pealed.

    SECTION 52c. 14.38 (13) of the statutes is renum-bered 220.02 (7) and amended to read:

    220.02 (7) Establish The division shall establish andmaintain, in consultation with the uniform commercialcode statewide lien system council, computer and anyother services necessary to support the uniform commer-cial code statewide lien system under s. 409.410 but maynot maintain a central filing system, as defined in 7 USC1631 (c) (2), for farm products, as defined in 7 USC 1631(c) (5).

    SECTION 53ad. 14.38 (14) of the statutes is renum-bered 182.01 (3), and 182.01 (3) (intro.), as renumbered,is amended to read:

    SECTION 59. 14.59 of the statutes is created to read:14.59 Training conferences. The state treasurer

    may conduct conferences for the purpose of trainingcounty and municipal clerks and treasurers, and em-ployes of their offices, in their official responsibilities.The treasurer may charge participants in any conferencea fee for participation which shall not exceed the propor-tionate cost of conducting the conference. The treasurershall credit all revenues from fees assessed under this sec-tion to the appropriation account under s. 20.585 (1) (h).

    SECTION 65. 14.82 (1) (intro.) of the statutes isamended to read:

    14.82 (1) (intro.) MINNESOTA−WISCONSIN. There iscreated a commission of 5 citizens nominated by the gov-ernor, and with the advice and consent of the senate ap-pointed, for staggered 5−year terms, to represent this

    state on the joint Minnesota−Wisconsin boundary areacommission. Any vacancy shall be filled for the balanceof the unexpired term. To assist the commission, there iscreated a legislative advisory committee comprising 4senators and 6 representatives to the assembly appointedas are the members of standing committees in their re-spective houses, and a technical advisory committee of 2members appointed by the governor and one membereach appointed by the governing board or head of the fol-lowing agencies, to represent such agencies: the depart-ment of justice, the department of administration, the de-partment of agriculture, trade and consumer protection,the department of natural resources, the department ofhealth and social services, the public service commis-sion, the department of tourism and the department of de-velopment. The members of the commission and themembers of its advisory committees shall serve withoutcompensation but shall be reimbursed for actual and nec-essary expenses incurred in the performance of their du-ties, from the appropriation made by s. 20.315 (1), onvouchers approved by the Wisconsin member of the com-mission selected to serve as its chairperson or vice chair-person. All other expenses incurred by the commissionin the course of exercising its powers and duties, unlessmet in some other manner specifically provided by stat-ute, shall be paid by the commission out of its own funds.

    SECTION 66. 14.85 (2) of the statutes is amended toread:

    14.85 (2) The secretaries secretary of development,the secretary of tourism, the secretary of natural re-sources and, the secretary of transportation, and the di-rector of the historical society, or their designees, shallserve as nonvoting members of the commission.

    SECTION 67. 14.85 (8) (d) of the statutes is amendedto read:

    14.85 (8) (d) If permitted by law, any state agency orlocal public body, board, commission or agency may al-locate funds under its control to fund programs recom-mended by the commission. If the department of devel-opment determines that a program recommended by thecommission to undertake activities relating to the promo-tion of tourism and economic development is consistentwith the department’s statewide tourism marketing andeconomic development plans, priorities and resources,the department shall have primary responsibility to sup-port the activities of the program. If the department oftourism determines that a program recommended by thecommission to undertake activities relating to the promo-tion of tourism is consistent with the department’s state-wide tourism marketing plans, priorities and resources,the department shall have primary responsibility to sup-port the activities of the program.

    SECTION 68. 14.85 (9) of the statutes is amended toread:

    14.85 (9) The commission may establish a technicalcommittee to advise the commission. The members of

    the committee shall include at least one employe eachfrom the departments department of transportation, thedepartment of tourism and the department of develop-ment. The commission shall request the departments de-partment of transportation, the department of tourism andthe department of development to designate employes toserve on the committee and may request any other stateagency to designate an employe to serve on the commit-tee.

    SECTION 71. Subchapter VI of chapter 14 [precedes14.91] of the statutes is created to read:

    CHAPTER 14

    SUBCHAPTER VIOFFICE OF THE STATE SUPERINTENDENT

    OF PUBLIC INSTRUCTION14.91 Creation of office of the state superinten-

    dent of public instruction. There is created an office ofthe state superintendent of public instruction attached tothe department of education under s. 15.03. The officeshall be under the direction and supervision of the statesuperintendent of public instruction.

    14.93 Duties of state superintendent of publicinstruction. (1) The state superintendent of publicinstruction shall do all of the following:

    (a) Visit, ascertain the condition of and stimulatepublic interest in the public elementary and secondaryschools of this state.

    (b) Advocate for the needs of the children of this stateand the school districts of this state.

    (c) Provide information to the public on the publicelementary and secondary schools and school districts ofthis state.

    (d) Annually submit to the governor, and to the legis-lature under s. 13.172 (2), a plan for improving the publicelementary and secondary schools of this state and forimproving the academic achievement of public elemen-tary and secondary school pupils.

    (e) Annually by October 1, report to the legislatureunder s. 13.172 (2) his or her activities during the pre-vious fiscal year.

    (2) The state superintendent of public instructionmay do all of the following:

    (a) Designate a staff member as the state superinten-dent’s representative on any body on which the state su-perintendent is required to serve.

    (b) Attend such educational meetings and make suchinvestigations as the state superintendent deems impor-tant and as will acquaint the state superintendent with thedifferent systems of public schools in the United States.

    SECTION 72. 15.01 (2) of the statutes is amended toread:

    15.01 (2) “Commission” means a 3−member govern-ing body in charge of a department or independentagency or of a division or other subunit within a depart-ment, except for the sentencing commission which shallconsist of 17 education commission which shall consist

    of 11 members, the Wisconsin waterways commissionwhich shall consist of 5 members, the parole commissionwhich shall consist of 5 members and, the Fox river man-agement commission which shall consist of 7 membersand the Wisconsin sesquicentennial commission whichshall consist of 29 members. A Wisconsin group createdfor participation in a continuing interstate body shall beknown as a “commission”, but is not a commission forpurposes of s. 15.06. The parole commission created un-der s. 15.145 (1) shall be known as a “commission”, butis not a commission for purposes of s. 15.06.

    SECTION 73. 15.01 (4) of the statutes is amended toread:

    15.01 (4) “Council” means a part−time body ap-pointed to function on a continuing basis for the study,and recommendation of solutions and policy alternatives,of the problems arising in a specified functional area ofstate government, except the Milwaukee river revitaliza-tion council has the powers and duties specified in s.23.18, the council on physical disabilities has the powersand duties specified in s. 46.29 (1) and (2), the privacycouncil has the powers specified in s. 19.625 and the statecouncil on alcohol and other drug abuse has the powersand duties specified in s. 14.24.

    SECTION 74. 15.01 (6) of the statutes is amended toread:

    15.01 (6) “Division,” “bureau,” “section” and “unit”means the subunits of a department or an independentagency, whether specifically created by law or created bythe head of the department or the independent agency forthe more economic and efficient administration and op-eration of the programs assigned to the department or in-dependent agency. The office of justice assistance in thedepartment of administration has and the office of creditunions in the department of financial institutions have themeaning of “division” under this subsection. The officeof health care information in the office of the commis-sioner of insurance, the office of the long−term care om-budsman under the board on aging and long−term careand the office of educational accountability in the depart-ment of public instruction have the meaning of “bureau”under this subsection.

    SECTION 75. 15.02 (1) of the statutes is amended toread:

    15.02 (1) SEPARATE CONSTITUTIONAL OFFICES. Thegovernor, lieutenant governor, secretary of state, state su-perintendent of public instruction and state treasurer eachhead a staff to be termed the “office” of the respectiveconstitutional officer.

    SECTION 76. 15.02 (3) (c) 1. of the statutes isamended to read:

    15.02 (3) (c) 1. The principal subunit of the depart-ment is the “division”. Each division shall be headed byan “administrator”. The office of justice assistance in thedepartment of administration has and the office of creditunions in the department of financial institutions have the

    meaning of “division” and the executive staff director ofthe office of justice assistance in the department of ad-ministration has and the director of credit unions have themeaning of “administrator” under this subdivision.

    SECTION 76c. 15.02 (3) (c) 2m. of the statutes is cre-ated to read:

    15.02 (3) (c) 2m. Notwithstanding subds. 1. and 2.,the principal subunit of the department of tourism is the“bureau”, which shall be headed by a “director”.

    SECTION 77m. 15.04 (1) (c) of the statutes isamended to read:

    15.04 (1) (c) Advisory bodies. In addition to anycouncils specifically created by law, create and appointsuch councils or committees as the operation of the de-partment or independent agency requires. Each councilor committee created under this paragraph is terminatedupon expiration of the term of office of the governor dur-ing whose term the council or committee is created, un-less terminated at an earlier date by the head of the depart-ment or independent agency in which the council orcommittee is created. Members of councils and commit-tees created under this general authority shall serve with-out compensation, but may be reimbursed for their actualand necessary expenses incurred in the performance oftheir duties and, if such reimbursement is made, such re-imbursement in the case of an officer or employe of thisstate who represents an agency as a member of such acouncil or committee shall be paid by the agency whichpays the officer’s or employe’s salary.

    SECTION 77n. 15.04 (1) (cm) of the statutes is createdto read:

    15.04 (1) (cm) Termination of certain nonstatutorycouncils and committees. Notwithstanding par. (c), eachcouncil and committee created under that paragraph thatis in existence on January 3, 1999, terminates on that dateunless the council or committee is terminated at an earlierdate by the head of the department or independent agencyin which the council or committee is created.

    SECTION 77p. 15.04 (1) (cm) of the statutes, as cre-ated by 1995 Wisconsin Act Wisconsin Act .... (this act),is repealed.

    SECTION 78. 15.04 (1) (h) of the statutes is amendedto read:

    15.04 (1) (h) (title) Report of forms and papers usedrecords management. Annually, no later than September1, file with the public records and forms board a reportwhich shall include such information relative to recordsand forms management as may be specified by the board.The report shall cover all previously unsubmitted formsand papers that were required to be filed with the depart-ment or independent agency during the preceding fiscalyear.

    SECTION 79. 15.04 (1) (j) of the statutes is amendedto read:

    SECTION 79h. 15.05 (1) (b) of the statutes is amendedto read:

    15.05 (1) (b) If Except as provided in pars. (c) and (d),if a department is under the direction and supervision ofa board, the board shall appoint a secretary to serve at thepleasure of the board outside the classified service. Insuch departments, the powers and duties of the boardshall be regulatory, advisory and policy−making, and notadministrative. All of the administrative powers and du-ties of the department are vested in the secretary, to be ad-ministered by him or her under the direction of the board.The secretary, with the approval of the board, shall pro-mulgate rules for administering the department and per-forming the duties assigned to the department.

    SECTION 79r. 15.05 (1) (c) of the statutes is createdto read:

    15.05 (1) (c) The secretary of natural resources shallbe nominated by the governor, and with the advice andconsent of the senate appointed, to serve at the pleasureof the governor.

    SECTION 82. 15.06 (1) (a) of the statutes is amendedto read:

    15.06 (1) (a) Except as otherwise provided in thissubsection and s. 15.105 (17) ss. 15.37 and 15.705 (3), themembers of commissions shall be nominated by the gov-ernor, and with the advice and consent of the senate ap-pointed, for staggered 6−year terms expiring on March 1of the odd−numbered years.

    SECTION 84. 15.06 (1) (b) of the statutes is amendedto read:

    15.06 (1) (b) The commissioners commissioner ofbanking, credit unions, savings and loan, insurance andsecurities shall each be nominated by the governor, andwith the advice and consent of the senate appointed, toserve at the pleasure of the governor.     resources, electronic information dissemination or tele-communications technologies.

    SECTION 118p. 15.105 (26) (a) 1. of the statutes, as

    created by 1995 Wisconsin Act .... (this act), is repealedand recreated to read:

    15.105 (26) (a) 1. An employe of the division for li-braries and community learning in the department of edu-

    SECTION 127. 15.155 (5) of the statutes is repealed.SECTION 127m. 15.157 (2) of the statutes is amended

    to read:15.157 (2) COUNCIL ON TOURISM. There is created in

    the department of development a council on tourism con-sisting of 14 members serving 3−year terms, and the sec-retary of development or the secretary’s designee, onemember of the majority party in each house and onemember of the minority party in each house appointed asare members of standing committees in their respectivehouses, the executive secretary of the arts board and thedirector of the historical society and, subject to s. 44.65,the executive secretary of the arts board. Nominationsfor appointments to the council of members, other thanex officio members, shall be sought from but not limitedto multicounty regional associations engaged in promot-ing tourism, statewide associations of businesses relatedto tourism, area visitor and convention bureaus, arts orga-nizations, chambers of commerce, the Great Lakes inter−tribal council and other agencies or organizations withknowledge of American Indian tourism activities, andpersons engaged in the lodging, restaurant, campground,amusement establishment, recreation establishment orretail liquor or fermented malt beverages business. Nom-inations shall be sought from throughout this state, to en-sure that council members live in different geographicalareas of the state and that they reflect the tourism indus-try’s diversity and its distribution throughout both urban

    and rural areas of the state. Each council member, otherthan ex officio members, shall have experience in mar-keting and promotion strategy.

    SECTION 128. 15.157 (2) of the statutes, as affectedby 1995 Wisconsin Act .... (this act), is renumbered15.447 (1) and amended to read:

    15.447 (1) COUNCIL ON TOURISM. There is created inthe department of development tourism a council on tour-ism consisting of 14 members serving 3−year terms, andthe secretary of development tourism or the secretary’sdesignee, one member of the majority party in each houseand one member of the minority party in each house ap-pointed as are members of standing committees in theirrespective houses, the director of the historical societyand, subject to s. 44.65, the executive secretary of the artsboard.
