With the recent fires throughout the county, disaster preparedness is at the top of property owners’ minds. Watching flames race across our beautiful region reminds me that one can never be too cautious when working to keep people and property safe. As always, the SDCAA website is a great resource for those looking for a little more piece of mind or just some useful tips on preparing for any situation. If you experience damage as a result of a natural disaster, be extra aware of potential scams out there as you look to rebuild. Our Emergency Resources page has some great information on preparing for and dealing with the aftermath of disasters, visit it at http://www.sdcaa.com/legislationandpublicaffairs/emergency-resources.
On a happier note, this month’s RentalOwner is packed with information for rental housing businesses of any size. Fair Housing is a priority for many rental property managers, but often trends in discriminatory practices can be overlooked. In “It’s No Secret,” on page 37 read about one landlord’s experience with Fair Housing issues related to LGBT residents. The onus is on property managers to present the best practices in our field and not fall to discrimination that gives our industry a bad reputation. If you’re interested in learning more about current Fair Housing trends, consider signing up for SDCAA’s Fair Housing course series beginning on June 18. By far the largest segment of SDCAA members are our independent rental owners. While they may own only a few units, these entrepreneurs provide a massive amount of housing for our region and are leaders in our industry. On page 6 Lucinda Lilley has assembled a great selection of budgeting tips that apply across all sizes of management, but are especially useful to independent owners.
Stay tuned for exciting updates from the SDCAA as we prepare for some big events including our annual PAC Baseball Night at Petco Park on August 26 and the Reverse Trade Show on July 22. Coming on June 17 is another Member Networking and Information Night at the Greek Palace in Kearney Mesa where members can network and learn about upcoming events and offerings from the SDCAA.

This month our Public Affairs department has published the always popular Vacancy and Rental Rate survey, providing market data for rental industry professionals both big and small. Key statistics confirm what we’ve been hearing from industry experts at a number of professional events this year—now is a great time to be in the rental business. With demand for housing units at near record highs in San Diego and local and state level policies contributing to a constricted construction pipeline, existing units are rapidly gaining value. Turn to page 11 to see what the numbers look like in our Spring 2014 survey.
SDCAA members benefit from some of the best lobbying in the industry. We’ve continued fighting SB 1439 (Leno) which would severely impact the Ellis Act. It seeks to prevent landlords in San Francisco who haven’t owned property for at least five years from going out of business. While this bill has a local focus, it could set a dangerous precedent and trap landlords in a business they no longer are able to operate in. It would also prevent owners or their family from moving into their property for a five year period.
Standing together with industry partners at recent legislative meetings, SDCAA has continued battling two bills that aimed to implement split roll property taxes. One of these, SB 1021 (Wolk) would allow more than 1,000 California school districts to impose unlimited tax increases on property owners. These increases could be split based on property square footage and would pose an enormous burden on owners of multifamily properties. Take a look at our lobbying update from Aaron Read and Associates on page 42.
SDCAA is able to be an influential voice in our industry thanks to the unity of our members. We have a great group of professionals from the rental housing industry as well as many industry partners in related fields. We’re always happy to advocate for our members and help to connect businesses for mutual benefit. Budgeting for the Independent Owner

Budgets! No way! I don’t need a budget! I own my rental property and operate it any way I want to. Why do I need to have a budget? Besides, if I have a budget and something happens that I didn’t expect, then it all goes out the window anyway.
Sound familiar? I, too, have had a budget-phobia in my career and said much the same words!Then one day, during a conversation with my mentor, I realized something: A Budget is simply a plan – a roadmap – a guide to help keep track of the important components of running a business. A budget is a
best guess on how your business will perform in the coming month/year/3 years/5 years. If something happens out of the ordinary that you didn’t anticipate in your budget, at least you will have the ability to explain how things went off course from what you “thought” you might attain!
Let’s qualify this a bit.• You own rental property.
• Your rental property is a business – it creates income and has expenses.
• You run your business to create cash in your pocket now.
• You may be running your business to create more value in it so you can sell it for a profit later.
• You may not really have a stated objective and are just “winging” it.
In any of these events, wouldn’t it be nice to be able to anticipate some extra income or plan for out of pocket expenses that may arise?
You might start with a monthly budget and include:• How much rent will I receive?• How much will my routine
expenses be (utilities, insurance, mortgage)?

Apartment Association’s 40th Annual Rental Housing Education Conference & EXPO ~ Connecting You Since 1974!
The industry went “retro” on Tuesday, April 22, 2014 when the San Diego Rental Housing Industry met at the SD Convention Center for a full day of seminars, exhibits and networking. SDCAA commemorated the event’s 40-Year anniversary with a fun “70’s” theme and exhibitors and guests celebrated in style. Over 2,000+ attendees filled their game cards with stamps in an effort to win cash prizes and had EIGHT free seminars to choose from! The tradeshow was busy all day with over 180 exhibitors on the EXPO floor.

After 38 years in the multifamily business, the two most important questions I have for housing applicants are still the same:“Do you pay your rent on time?” and “Do you play well with others?” Sure, we need to verify their answers, verify the number of occupants, and check out some other stuff like employment and rental payment history and maybe credit rating if your company needs that information. Other than that, what else matters? In a word: Nothing.
So do we care about – or need to know about – someone’s sexual orientation or gender identity?No.
An article in a recent HUD Study found that the response to rental inquiries from same-sex couples was significantly lower than the response to inquiries from heterosexual couples. And it was higher in jurisdictions with state-level protections against housing discrimination on the basis of sexual orientation!
An older study conducted in Michigan using fair housing testers posing as same-sex and opposite-sex couples looking for housing showed that in 32 of the 120 test visits (26%), the same-sex couples received unfavorable treatment, including being told the apartment was no longer available, the rent and/or application fee was higher, and receiving lower levels of encouragement to lease. In some cases, the same-sex couples were subjected to offensive comments.
Although LGBT is not a federally
protected class – it is protected in a number of cities and states including California – the real question is, “Why do we care?” Perhaps one of these is the answer:1. Well, I just don’t approve of THOSE people.2. People shouldn’t live that way.3. This is a family community – we have lots of kids here.4. My religion does not approve of that kind of behavior.
If you chose one of the answers above, start over. None of these answers is a legal reason to deny housing. Not only are they illegal but they are just plain wrong! Remember the essence of fair housing: Everyone who qualifies is entitled to an equal opportunity to buy or lease the home of their choice. Once they have bought or leased a home, they are entitled to an equal opportunity to enjoy living in their home. Equal access and equal enjoyment, regardless

of anything other than qualifying and fulfilling the lease. Nothing else matters.And even though LGBT is not a federally protected class, remedies are available. On the federal level, HUD and DOJ can pursue certain complaints based on the protected class of sex, the theory of disparate impact and LGBT Equal Access Rule for HUD assisted housing, mortgages insured by HUD and FHA-insured loans. In California, the Department of Fair Employment and Housing (DFEH) specifically prohibits “any discrimination in housing based on sexual orientation.”
So what to do? Here are some “Ace Your Next Shop” tips from Joanna Ellis, Chief Executive Officer, Ellis Partners in Management Solutions:1. Treat everyone the same over the telephone, the internet and
in person! You never know who or why you are being shopped. Is it a real customer, a professional mystery shopper, or a fair housing tester?
2. Use your guest card and other leasing tools to ensure you’re treating all customers the same. Use these tools to accurately record information (details are important) and keep you on track.
3. Understand and cover the basics of your leasing presentation. Make sure you know what to include in your presentations. If you are still unclear, attend training and educational seminars/webinars to sharpen your skills.
4. Use mystery shops to help you identify opportunities for improvement. The mystery shop is an excellent training
resource as well as a guideline of what should be covered in every presentation. Study the test questions, in other words.5. Treat all customers like shoppers – actually strike “shoppers” – treat all customers like customers! We are in the business of leasing apartments and every customer deserves to be treated equally, respectfully and
professionally.Fair housing testers are out there and it is just a matter of time before you get shopped. But that should not cause any anxiety as long as you are treating everyone equally in a consistent manner and using the qualifying standards designed to protect the interests of the owner and residents.

Water Authority Proposes Rate IncreasesThe San Diego County Water Authority has proposed increased rates and charges for 2015 in an effort to maintain service reliability in the face of increasing service and maintenance costs. The Water Authority’s Board of Directors will consider the new rates for member agencies that would increase price by 2.9%-3.8% for untreated water or 2.6%-3.3% for treated water. Alternative proposals are expected to be presented to the Board, who will ultimately decide on the new rates in the coming weeks.
Morena Height Limit Debate ContinuesAfter a contentious community meeting which sparked outcry from residents opposed to increasing housing density along the new Morena Boulevard trolley line, Councilmember Ed Harris
is seeking clarification from San Diego’s planners. Both Harris and Councilmember Lorie Zapf have voiced opposition to updates to the area’s zoning to allow for increased multifamily and mixed-use development near proposed mass-transit nodes and are concerned that the height limit could still be raised regardless of the community’s wishes. Responding to Harris’ inquiry, Planning Director Bill Fulton confirmed that his department will not pursue the changes to the area’s building height limit but will instead look for other ways of increasing ridership for the new trolley line.

We thought the heat generated by bill and budget deadlines was extreme, but apparently it is nothing compared to what you all in San Diego are going through. These fires prompted the Governor to say that these fires have created unprecedented danger and that California will be on constant alert as California rolls into summer. According to Mike Lopez, President of CDF-Firefighters, in his 25 plus years as a firefighter in California, he has never seen this level of fire danger so early in the year…It is unprecedented. All-in-all, the California Department of Forestry and Fire Protection (CalFire) has responded to more than 1500 wildfires statewide this year, which were fueled by drought conditions and strong winds.
All of us at ARA are relieved that cooler temperatures have allowed firefighters to gain the upper hand on a series of wildfires plaguing your beautiful
County. Hopefully all of you came through the most recent fires unscathed and with no loss of life or property.
ELLIS ACT One Ellis Act bill down, one to go. Assembly Member Amminao’s bill allowed, after being amended, a court to mask Ellis Act evictions, from the tenant's credit report and rental history. It is a similar procedure to the statute enacted several years ago for tenants who were evicted from rental units that were being bank foreclosed. After agreeing to these amendments in Assembly Local
Government Committee, Assembly Member Ammiano elected not to move forward and put them in his bill when it was heard in Assembly Judiciary Committee. As a result, SDCAA continued to oppose and the bill was defeated in committee by a vote of 4-3. He was granted reconsideration and could possibly take the bill up again, however, it is unlikely he will pursue this course of action.
The one Ellis Act bill that has a chance of passage is Senator Leno’s SB 1439. As you recall, SB 1439 (San Francisco only) would allow the city and county

of San Francisco to enact law or regulations to prohibit a rental housing owner from removing a building from the market pursuant to the Ellis Act unless all owners in the property have held their ownership interest for at least five years. While SB 1439 is a San Francisco only bill, SDCAA is strongly opposed to it because it is inherently unfair to property owners.
As of this writing, Senator Leno has had two opportunities to present his bill on the Senate floor, however, on both occasions, he has failed to do so which is an indication of how closely the Senator is managing his vote count. ARA is actively lobbying San Diego legislators and others asking them to vote against this bad public policy. SDCAA also weighed in locally both in San Diego and with Senator Roth in Riverside. Consequently, as a result of lobbying efforts and SDCAA’s calls to district offices, Senator Leno currently does not have the votes for passage.
ARA will continue monitoring for possible amendments and lobbying against the bill so when Senator Leno does present the bill on the Floor, our strong opposition will be voiced. We will keep you informed and let you know if the situation changes in the coming days ahead.
Split RollA deal was struck on AB 2372 (Ammiano) – a bill that clarifies the definition of “change of ownership” in current law for commercial property to prevent cases where 100% change of ownership occurs,
but reassessment is avoided. The new language would trigger reassessment of property when at least 90% of a property’s ownership changes in any three-year period. It would not apply, however, to incremental changes of ownership through stock market trades.
The amendments are a compromise and will remove some of the bill’s opposition. The
compromise falls somewhere between current law and Ammiano’s original measure and will win support from opposing groups such as the California Chamber of Commerce, the California Tax Reform Association (pro-tax group) and the Howard Jarvis Taxpayers Association. CalTax still has concerns with the bill and has not, as of this writing, removed their opposition. It’s less than some wanted and is not a

full “split roll,” which would have completely removed Proposition 13’s limits from business property. As you know, a split roll would require a constitutional amendment. A full split-roll would have multi-billion-dollar impacts while the compromise amendments are likely to have much smaller impacts on both business tax bills and local government revenues.
As far as why the deal was cut - it may be an attempt to thwart Senator Wolk’s SB 1021, another split roll bill authorizing more than 1,000 California school districts to impose unlimited tax increases on property owners by allowing the imposition of non-uniform parcel taxes. Under the bill, school districts could split parcel tax assessments within a district based on one or more of the following rates: a flat amount,
the square footage of a parcel, the square footage of improvements on a parcel or according to the property’s classification — commercial, industrial, single-family residential or multifamily residential — so long as the same tax rate is levied on all properties within the same classification. Unlike AB 2372, SB 1021 is a majority vote bill making it an easier bill to pass in the Assembly. Amending and supporting AB 2372 gives moderate democrats cover to not vote for SB 1021 allowing them to point out that they have already voted for a split-roll bill and there is no need to support another (one that is universally opposed.).

If the GOP were a corporation, the public relations department would be exhausted from the month of April. Three of its
members in the House of Representatives, Mssrs. McAllister, Grimm and Stockman, were caught on film in a compromising position with a staffer, placed under a federal 20-count indictment and reported to be under investigation by the House Ethics Committee for campaign finance infractions, respectively. Now, it’s unlikely the voting public believes that the actions of these three men are in some way indicative of a larger problem within the Republican Party, despite efforts by some Democrats
to paint them that way. While that strategy worked for Democrats in 2006 during the Jack Abramoff debacle, it is much less effective now. Voters know that members of both parties engage in these types of shenanigans and have frankly become desensitized to them.
These events do, however, serve to distract from the larger political narrative the GOP is attempting to emphasize with voters. Instead of getting to talk about the Affordable Care Act or jobs, they have to spend time responding to the drama and showing that they are dealing with the members involved. In this instance party leaders are gently (or not so gently) trying to move “do-badders” out of their seats in Congress. As it happens, Rep. Vance McAllister (La.) has already said he will not run for re-election though Republicans are trying to get to resign now. Rep. Michael Grimm (N.Y.) did step down from his seat on the Financial Services Committee, but has vowed to continue his own re-election campaign as he defends himself in court. Rep. Steve Stockman’s (Texas) situation is the least tenuous of the bunch as the ethics inquiry has just begun and could take many months to complete.
House Speaker John Boehner (R-Ohio) also made news last month for teasing some members of the GOP that they could not handle the difficult legislative issue of immigration reform. The Speaker has said on several occasions that he wants to pass reform, though the Senate-passed measure will not be the starting point. He sees both the policy importance of reform and the political necessity for Republicans to deal with it if they want any chance to be competitive nationally in the future. Unfortunately, his desires bump up against conservatives in the GOP who are squarely opposed to any reform that includes a path to citizenship for undocumented workers currently in the country. These same members are worried that the House leadership will attempt to force passage of reform or pieces of reform in other bills. As Rep. Steve King (R-Iowa), a leading tea party conservative in the House, remarked recently to Politico, “You have to man the watchtowers 24/7.” This does not bode well for reform occurring this year, a priority issue for the apartment industry.

Senate Banking Committee successfully reported out a housing finance reform bill in April. Alas, the scheduled markup was postponed in order for the Chairman and Ranking Member to gather more support from their respective sides of the Committee. The bill is almost assured to be passed by the Committee, but the stronger the vote, the better chance of passage by the full Senate. To gather those additional votes, the Committee leaders will have to make some tweaks to the underlying bill (which the apartment industry supports), all the while maintaining the balance in the bill that can appeal to both sides of the aisle. Those members of the Committee who are being courted for their support represent the more conservative and liberal branches of the Republican and Democratic parties, respectively. What they require to back the legislation could upset that balance and will have to be carefully considered. Stay tuned for news on developments on this issue and progress in the Senate.
Finally, I want to highlight for you a partial victory achieved at the end of April for our nation’s military personnel and for the Military Housing Privatization Initiative (MHPI). The MHPI is a 20-plus year public/private partnership, in which many NAA firms participate, that helps to meet the housing needs of the two-thirds of our military personnel who do not live in on-base housing. The House Armed Services Committee rejected a request by the Department of Defense to cut soldiers’ Basic Allowance for Housing or BAH, the subsidy given to every serviceman and woman to help cover their housing costs. Not only would this have increased out-of-pocket housing expenses for military personnel, it would undermine the funding stability of long-term privatized military housing contracts. That in turn impacts reserves for capital repairs, maintenance and on-site services at these communities. This is not the end of the story as the Senate still has to act; however, the House action is an excellent start. On a related note, members of the NAA Privatized Military Housing Committee were scheduled to come to town in May to lobby Congress on the BAH issue and other concerns. This is a tremendous example of commitment to the industry and to the advocacy process!

My resident advised he is terminating the lease. I sent my resident notice of the initial inspection. The resident said that he didn’t want the initial inspection. I argued with him stating
that we must have the initial inspection? If he does not want to have the initial inspection, what can I do? You have done what the law requires. According to Civil Code 1950.5(f)(1) “within a reasonable time after notification of either party’s intention to terminate the tenancy, …, the landlord shall notify the tenant in writing of his or her option to request an initial inspection and of his or her right to be present at the inspection…. The purpose of the initial inspection shall be to allow the resident an opportunity to remedy identified deficiencies, in a manner consistent with the rights and obligations of the parties under the rental agreement, in order to avoid deductions from the security…. If a resident chooses not to request an initial inspection, the duties of the landlord under this subdivision are discharged….”
Therefore, no need to argue with your resident. You have done your duty. You have notified the resident
in writing of his right to the initial inspection. If the resident does not chose to have the inspection that is his prerogative. Now, remember, you must either return the security deposit or provide its accounting within 21 days after possession has been returned to you. Moreover, if you deduct $125 or more from the security deposit, you must provide copies of invoices demonstrating the amount deducted. There are additional requirements concerning the statements. If you need further advice, consult an attorney.
