1—Board Minutes Kansas State High School Activities Association Minutes Note: Minutes are subject to approval by the Board at its next meeting. ADMINISTRATIVE REPORTS AND UPDATES The Board received financial and administrative reports from Executive Director Bill Faflick, Assistant Executive Directors Cheryl Gleason, Francine Martin, Mark Lentz, Jeremy Holaday, Rod Garman and Office/Operations Manager Brent Unruh. Craig Manteuffel’s report was presented by Bill Faflick as Craig was on NFHS business in Chicago. 2018-19 AUDIT REPORT APPROVED Mr. Faflick presented the Executive Board with the annual certified audit report prepared by Wendling, Noe, Nelson, & Johnson L.L.C. of Topeka. Eric Otting, CPA, represented the accounting firm by providing a review of the audit and the Board voted unanimously to approve the audit report. The report will be printed in the October 2019 issue of the KSHSAA Activities Journal. FOOTBALL CLASSIFICATION DISCUSSION Superintendent John Whetzal, USD 223 Barnes-Hanover-Linn, presented information regarding local efforts and current challenges to form a cooperative agreement for Linn High School. Discussion focused on classification and count process for smaller schools and explored possible solutions for future evaluation and consideration. TOPEKA CAIR PARAVEL LATIN SCHOOL REQUEST FOR MEMBERSHIP CONSIDERATION Representatives of Topeka Cair Paravel Latin School (Head of School Melody Congdon, School Board President Mark Bucholtz, and Activity Director Gary Cleverdon) made a presentation regarding their request for membership in the KSHSAA starting next school year. Following discussion, the board voted to table the decision until November when final action is expected. ELIGIBILITY REVIEW The Executive Board conducted an eligibility review for a transfer student at Blue Valley North High School. Following a review of documentation provided in the exchange between the former school and BVN, and testimony provided by Dr. Tyler Ostroski (BVN Principal), Mickey Masterson (BVN Athletic Director), and Lane Green (Blue Valley School District Director of Administration), the board determined that the hardship application did not meet the standard of the transfer rule as defined in Handbook Rule 18, Purpose Statement and Hardship 18-1-13. The Executive Board encouraged pursuit of limited eligibility. HALL OF FAME NOMINATIONS Following an update on the KSHSAA Hall of Fame and the NFHS Hall of Fame, the board was encouraged to nominate worthy candidates for consideration to the KSHSAA Hall of Fame. CLASSIFICATION Following discussion regarding the procedures used for clas- sification, the board discussed issues relative to developing district assignment protocol for Class 1A football. The board approved the use of 7-team districts, pending the number of schools participating at the 1A level. SHOULDER TO SHOULDER WEIGH-INS APPROVED Following discussion, the Executive Board approved immedi- ate implementation of shoulder to shoulder weigh-ins for all high school wrestling competition. Such weigh-ins are to be scheduled to begin one hour prior to the first scheduled match of a dual competition and two hours prior to the start of any high school tournament. ADMINISTRATIVE REPORTS AND UPDATES

The Board received financial and administrative reports from Executive Director Bill Faflick, Assistant Executive Directors Cheryl Gleason, Francine Martin, Mark Lentz, Jeremy Holaday, Rod Garman and Office/Operations Manager Brent Unruh. 2018-19 AUDIT REPORT APPROVEDMr. Faflick presented the Executive Board with the annual certified audit report prepared by Wendling, Noe, Nelson, & Johnson L.L.C. of Topeka. The Executive Board met in the office of the Kansas State High School Activities Association on Tuesday and Wednesday, September 17-18, 2019, with the following in attendance: President Alan Stein, Shannon Haydock, Deena Horst, Mike Kastle, Penny Lane, Monty Marlin, Pam McComas, Mark Meyer, Roger Perkins, Matt Renk, Greg Rosenhagen, Ken Stonebraker, and Bill Faflick, Executive Director. Assistant Executive Directors Cheryl Gleason, Francine Martin, Mark Lentz, Jeremy Holaday, Rod Garman and Office/Operations Manager Brent Unruh were also present. 6-PLAYER FOOTBALLFollowing discussion, the Executive Board approved the interim plan for 6-player football with all 6-player games concluding by the end of SCW 17 (playing week 9) starting with the next assigning cycle. The Executive Board also asked the staff to develop playoff protocol for a possible sanctioned 6-player championship tournament.

LAWRENCE FREE STATE PERFORMING ARTS HONORED

The Executive Board recognized Lawrence Free State High School, staff and students involved in their performing arts programs as they have been selected as the KSHSAA Perform-ing Arts School of Excellence for 2019.

UNDUE INFLUENCE DETERMINATION The Executive Board reviewed materials submitted by a pri-vate school regarding the payment of tuition by a non-parent. The Board voted to deny eligibility based upon connection to activity participation.

KAMS RECEIVES APPROVED STATUS The Kansas Academy of Math and Science applied for approved status with the KSHSAA. Following discussion, approved status was granted for KAMS and they will be able to compete in regular season Scholars Bowl events.

ANTI-VAPING POLICIES AND EDUCA-TIONAL MATERIALS

The Executive Board discussed vaping and the associated student health risk being realized in our schools and commu-nity. The board will consider appropriate next steps following input from SMAC relative to current handbook and manual language which may be refined to include a prohibition of any device designed to deliver nicotine.

FALL REGIONAL MEETING DATES & LOCATIONS

The Executive Board reviewed the schedule and procedures for the October Regional Meetings. The agenda topics were discussed, approved, and will be distributed to all member school principals and posted on the KSHSAA website under New Topics, during the first week of October. Registration for each meeting listed begins at 12:30 p.m. and the meetings begin at 1:15 p.m.

The following agenda items will be discussed and voted upon by participating school leaders:

1. Should the KSHSAA change the baseball and softball playoff formats from currently putting the state into 4 – 16-team seeded quadrants and instead seed into 2 – 8-team sub-states (Classes 3A, 2-1A)?

2. Should the KSHSAA continue to “pair” state baseball and softball to geographically proximate locations?

3. Should the KSHSAA establish a football playoff format that would seed the remaining 32 teams after district play into 2 – 16-team brackets (East-West) (Classes 3A, 2A, 8-Player)?

4. Should the KSHSAA use the annual classifications released in late September for the two tennis seasons in the next calendar year? For example, the 2019 classifications released in late September would be used for both 2020 tennis seasons (boys and girls).

5. Should the KSHSAA increase four of the current six 3 p.m. start times to 1 p.m. during the school week for regular season tennis tournaments? (Golf is allowed two all day meets and four meets with a 1 p.m. start during the school week in the regular season. Tennis is asking for the same. At this time tennis is allowed six 3 p.m. starts and two all day meets. Many larger, 16+ team tennis events are already scheduled for Saturdays so no class time is missed for these tournaments. The Saturday event will continue to be scheduled for tennis. Golf does not often use Saturdays/Sundays for high school events due to club members wanting the courses.)

6. Should the KSHSAA change the volleyball playoff format from currently putting the state into 4 – 16-team seeded quadrants and instead seed into 2 – 8-team sub-states (Classes 3A, 2A)?

7. Should the KSHSAA change the classification count day to the Wednesday immediately following Labor Day?

8. Should the KSHSAA require assistant coaches to attend an annual rules meeting for their respective activities?

9. Should the KSHSAA require assistant coaches to complete the annual rules test for their respective activities?

10. Should the KSHSAA require head coaches to attend a face-to-face rules meeting at least every other year?

11. Should the KSHSAA develop a mandatory one game exclu-sion for any player or coach following their ejection from a contest?

The vote tabulations will be provided to the Executive Board at their November meeting at which time they will formulate next steps for each respective item.

2019-20 BUDGET APPROVEDFollowing a hearing held on Wednesday, September 18, 2019 at 11:30 a.m. in the office of the KSHSAA, the Executive Board unanimously approved the KSHSAA budget for the 2019-20 school year and authorized its publication and distribution to member schools.

Details concerning each of the charts of accounts listed are available upon request. A summary of the approved budget will be included in the October Journal.

The Board of Directors assembled at 4:00 p.m. Wednesday evening for an orientation session, discussion and voting on the Agenda items.

President Alan Stein advised members an item could be added to the agenda provided three-fourths of those present (67) agreed. (50 votes would be required.) No additions were requested.

EXECUTIVE DIRECTOR’S REPORTBill Faflick, Executive Director, called roll, presented remarks on the Association’s financial position, and updated the mem-bers of the Board of Directors on business and policy matters of the Association.

APRIL 2019 MINUTES APPROVEDFollowing the Call to Order by President Alan Stein and the roll call, B. Lewis moved, second by S. Reed, to approve the Minutes of the April 26, 2019, Board of Directors meeting. The motion passed (67-0).

All agenda items passed become effective imme-diately upon publication of these minutes unless otherwise specified.

NOTE: Words or phrases which appear underlined in the following sections indicate the changes which were made to existing handbook rules

CLASS 1A CLASSIFICATION CHANGES TO BE VOTED ON BY

MEMBER SCHOOLSA proposal was made to modify Rule 5, Classification of Senior High Schools, Section 2, Article 1 as follows:

Rule 5 Classification of Senior High Schools

Section 2: Senior High Regulations

Art. 1: All member senior high schools shall be divided into six classes-6A, 5A, 4A, 3A, 2A and 1A. Class 6A shall include the thirty-six (36) high schools with the largest enrollments; Class 5A the next thirty six (36); 4A the next thirty-six (36); 3A the next sixty-four (64); 2A the next sixty-four (64); and Class 1A, the remainder.

FOOTBALL EXCEPTION: Classifications, for the pur-pose of determining district football assignments, shall be based on the total enrollment in the school's ninth, tenth and eleventh grades as submitted to the KSHSAA on the date established by state statute for official enrollment. (Exception: See Note in Article 3 below for football clas-sification procedure for USD #207 and USD #453.)

For the purpose of district football, utilizing this exception, member schools will be classified as follows:

Class 6A: 32 largest member schools playing 11-Player football

Class 5A: 32 next largest member schools playing 11-Player football

Class 4A: 32 next largest member schools playing 11-Player football

Class 3A: 48 next largest member schools playing 11-Player football

Class 2A: 48 next largest member schools playing 11-Player football

Class 1A: All other member schools playing 11-Player football

8-Player: Participating schools will be assigned to two separate Divisions, as established by the Executive Board

NOTE: For 8-Player district football participation, assign-ments shall be limited to those schools with a maximum enrollment of 100 students in grades 9, 10 and 11. (See Rule 35-2-3, Football.) Schools not requesting a football district assignment will have their position filled in each category by the next school moving up in enrollment.

Class 1A Exception: Class 1A schools shall compete in two separate divisions in volleyball, basketball and schol-ars bowl for postseason and KSHSAA state championship competition.

Following annual classification and determination of schools assigned to Class 1A, the half of the schools with the larger enrollments will be assigned to Division I and the half with smaller enrollments will be assigned to Divi-sion II. If Class 1A has an odd number of schools, Division I will be assigned one more school than Division II.

A motion was made by B. Shaffer, second by D. Adams to adopt the proposal for the 2020-21 school year. The vote was 41 in favor, 26 opposed. Per Bylaw Article XII, Section 4, the proposal will now be sent to all Class 1A member schools, based on the 2019-20 classification counts, to be voted upon by ballot.

CLASSIFICATION CHANGES FOR PRIVATE SCHOOLS DENIED

A proposal was made to modify Rule 5, Classification of Senior High Schools as follows:

Rule 5 Classification of Senior High Schools

Section 1: General Regulations

Art. 1: Private schools are defined as a school that can decline admission/enrollment to a student that resides within that school's Public School district or designated geographic area.

Art. 2: Private schools involved in a Cooperative Agreement, under the provisions of Rule 29, with a member Public School shall be allowed to participate in the Public School postseason tournament provided the member Public School is listed as the designee to administer the program. This ex-ception shall not include Quasi-team/Individual athletics.

Section 2: Senior Public High Regulations

Art. 1: All member senior high schools shall be divided into six classes-6A, 5A, 4A, 3A, 2A and 1A. Class 6A shall include the thirty-six (36) high schools with the largest enrollments; Class 5A the next thirty six (36); 4A the next thirty-six (36); 3A the next sixty-four (64); 2A the next sixty-four (64); and Class 1A, the remainder.

FOOTBALL EXCEPTION: Classifications, for the pur-pose of determining district football assignments, shall be based on the total enrollment in the school's ninth, tenth and eleventh grades as submitted to the KSHSAA on the date established by state statute for official enrollment. (Exception: See Note in Article 3 below for football clas-sification procedure for USD #207 and USD #453.)

For the purpose of district football, utilizing this exception, member schools will be classified as follows:

Class 6A: 32 largest member schools playing 11-Player football

Class 5A: 32 next largest member schools playing 11-Player football

Class 4A: 32 next largest member schools playing 11-Player football

Class 3A: 48 next largest member schools playing 11-Player football

Class 2A: 48 next largest member schools playing 11-Player football

Class 1A: All other member schools playing 11-Player football

8-Player: Participating schools will be assigned to two separate Divisions, as established by the Executive Board

NOTE: For 8-Player district football participation, assign-ments shall be limited to those schools with a maximum enrollment of 100 students in grades 9, 10 and 11. (See Rule 35-2-3, Football.) Schools not requesting a football district assignment will have their position filled in each category by the next school moving up in enrollment.

Art. 2: If two or more schools have identical enrollments and

are on the lower end of a Class division, the school(s) having the larger enrollment the previous year(s) shall be assigned to the higher classification.

Art. 3: Annual classifications (except football), shall be deter-mined by the total enrollment in the ninth, tenth, eleventh and twelfth grades as of the date established by state statute for official enrollment. Students who are on the school rolls as of that date must be counted.

NOTE: K.S.A. 72-5333b does not permit USD #207, Fort Leavenworth school district to offer or operate grades 10 through 12. To accommodate high school participation of 9th grade students attending Patton Junior High in Fort Leavenworth - the annual and football classification count of USD #453 Leavenworth High School shall include the count of 9th grade students attending Fort Leavenworth-Patton Junior High School according to the following formula:

Determine the percentage of Patton Junior High students entering Leavenworth High School as 10th graders during the previous four year period. This number shall determine the percentage of USD #207 9th graders to be included in USD #453's classification count for annual and football classification.

Art. 4: Any student, including special education, enrolled in five or more subjects of unit weight, shall be counted as a full-time student for classification purposes. A subject of unit weight shall be defined as per that established by the Kansas State Board of Education. (See Rule 13, Scholarship Requirements.)

Section 3: Senior Private High Regulations

Art. 1: All member private high schools shall compete in sepa-rate postseason tournament(s) from public school members.

RULES 15 AND 18 MODIFIED TO EXPAND HIGH SCHOOL ELIGIBILITY

WAITING PERIOD TO ONE CALENDAR YEAR BEGINNING IN 2020-21

A proposal was made to modify Rule 15, Enrollment, Sec-tion 1, Articles 2 & 4 and Rule 18, Transfer, Sections 1-2, as follows:

Rule 15 Enrollment/Attendance

Section 1: General Regulations (apply to grades 7-12)

Art. 2: A student who attends one class after enrolling is con-sidered in attendance. Attending a class the opening day of school which is called for the purpose of organization or assignment, counts as attendance. If a student transfers to a new school, enrolls and attends one class, as indicated above, and then goes back to the former school, the student may not become eligible until after eighteen weeks one calendar year, in accordance with the provisions of the Transfer Rule. (Exception: See Rule 18-1-9, Transfer.)

Art. 3: If a student repeats subjects previously passed and is not enrolled in at least five new subjects (those not previ-ously passed) of unit weight, or its equivalency, then that semester does not count as a semester of attendance under provisions of the Semester Requirements Rule and would not be considered a last semester of attendance, as noted in the Scholarship Requirements Rule. (Such a student is not eligible to represent a school in interschool activities during a repeat semester.) (See Rule 13-1-3, Scholarship Requirements.)

Art. 4: Students who must attend eighteen weeks one calendar year to become eligible shall not participate until after they have attended classes on Monday (or the first day of school) in the nineteenth week the first day following one calendar year from the date of transfer.

Rule 18 Transfer

PURPOSE—The purpose of the Transfer Rule is to protect students from being displaced by those who change schools for interscholastic activity reasons. It is devised to eliminate “school shopping” after a student has initially chosen the school of his/her choice. This avoids transfers when the motivation is for activity purposes and prohibits recruitment. Students transferring who do not meet the criteria or one of the excep-tions listed in Sections 1, 2 or 3, would otherwise be taking the place of a student in interscholastic competition who has met those requirements.

NOTE: In addition to the transfer rule, the student must meet all other rules and regulations, such as Age, Scholarship, Bona Fide Student in Good Standing, etc.

A student is eligible transfer-wise if:

• BEGINNING SEVENTH GRADER—A seventh grader, at the beginning of his or her seventh grade year, is eligible under the Transfer Rule at any school he or she may choose to attend.

• BEGINNING NINTH GRADERS IN A THREE-YEAR JUNIOR HIGH SCHOOL—So that ninth graders of a three-year junior high are treated equally to ninth grad-ers of a four-year senior high school, a student who has successfully completed the eighth grade of a two-year middle/junior high school, may transfer to the ninth grade of a three-year junior high school at the beginning of the school year and be eligible immediately under the Transfer Rule. Such a ninth grader must then, as a tenth grader, attend the feeder senior high school of their school system. Should they attend a different school as a tenth grader, they would be ineligible for eighteen weeks one calendar year.

• ENTERING HIGH SCHOOL FOR THE FIRST TIME—A senior high student is eligible under the Transfer Rule at any senior high school he or she may choose to attend when senior high school is entered for the first time at the beginning of the school year.

• BONA FIDE MOVE—If a student’s parents, or legal guard-ian in case neither parent is living, make a bona fide move to a new permanent residence in the vicinity of the new school to which the student transfers, the student is then immediately eligible. If the parents’ move occurs during the school year, see Sec. 1, Art. 9, for other timing factors.

- Guardianship Definition—The term “guardian-ship,” while either parent is living, is not recognized for eligibility purposes. Only those appointed by the courts to a full personal and estate guardianship are recognized if both parents are deceased.

- Vicinity Definition—The term “vicinity” is when a student continues to reside with his or her parents and commutes daily to and from school.

A student is ineligible if:

• CHANGE IN SCHOOL IS MADE WITHOUT AN AC-COMPANYING MOVE ON THE PART OF THE STU-DENT’S PARENTS—If students change schools without an accompanying move on the part of their parents, they will be ineligible for interschool extracurricular activities for eighteen weeks one calendar year, beginning with the first day of their attendance.

• INDEPENDENT STUDENTS—A student who is “on his or her own” and not dependent upon parents or a guardian for a home and who transfers from one school to another, is required to attend eighteen weeks one calendar year before becoming eligible.

FOR EXCEPTIONS AND ADDITIONAL INFORMATION REFER TO SECTIONS 1, 2 and 3.

Section 1: General Regulations (apply to grades 7-12)

Art . 1: USE OF FORMS—In transferring from one middle/junior or senior high school to another, each receiving school shall process and have on record a Certificate of Transfer (Form T-E, T-E/P, FES, or T-E/H found online at www.kshsaa.org) on behalf of each student, showing eligibility status, and a record of participation in interschool activities.

Art . 2: EIGHTEEN WEEKS ONE CALENDAR YEAR DE-FINED—Students who must attend eighteen weeks one calendar year to become eligible shall not participate until they have attended classes on Monday (or the first day of school) in the nineteenth week the first day following one calendar year from the date of transfer.

Bylaw Article XIII states, in part:

A partial week of school (which includes at least three days’ attendance) caused by holidays, teachers’ meetings, or any emergency, may count as one full week of school toward the eighteen weeks attendance requirement. Two or three partial weeks of school with a total accumulation of three days may be counted as one week’s attendance.

Art. 3: STUDENTS DEPENDENT UPON OTHER FAMI-LIES—The Executive Board may sanction the eligibility of students who move with families upon whom they have been continuously dependent for at least one year and with whom they have made their homes.

Art. 4: TRANSFER FROM NON-MEMBER SCHOOL—Stu-dents who transfer from a school which is not a member of the KSHSAA or an Association of any state as recognized by the National Federation of State Associations, may be declared eligible by the Executive Board. (Process Form T-E—Send a copy of it and a letter of request for eligibility to KSHSAA, identifying the non-member school.)

Art. 5: SPECIAL TRANSFERS—Students who transfer from one attendance center to another within the same unified district (USD) when initiated by the school, may be declared eligible without a move on the part of the parents, provided policies on such transfers are clearly defined in board of education policy and provided both principals approve the “special” transfer. (Process Form T-E—KSHSAA need not be involved unless a disagreement occurs.)

Art. 6: POSSIBLE LIMITED ELIGIBILITY—When a student transfers schools under circumstances which do not meet other terms of the Transfer Rule, he/she may be granted eligibility to participate in interscholastic activities as hereinafter restricted if the student qualifies under the following terms and conditions:

a. A student whose name was included on a school eligibility roster at any level (varsity, junior varsity, freshman, middle/junior high, etc.) for a given activity during the twelve calendar months preceding the date of such transfer can be eligible only for non-varsity competition in that activity.

b. A student may have unrestricted eligibility in all other activities in which his/her name has not appeared on a school eligibility roster (at any level). Eligibility can be granted provided the activity eligibility is approved by the principals of both the sending and receiving schools and the KSHSAA Executive Board, and fur-ther, provided there is no activity purpose involved in the transfer. Approval must be granted on a special KSHSAA form (Form T-E/P).

c. The student shall be ineligible for all activities for eighteen weeks one calendar year from the date of transfer in the event either or both principals or the Executive Board declines to approve activity eligibility.

Art. 7: DISCONTINUED SCHOOLS—Any student transfer-ring from a closed or discontinued school shall be eligible

for interschool activities immediately upon enrollment in another school, provided he or she attends a school in the vicinity of his or her home which is close enough so the student may continue to reside at home. (Process Form T-E.)

Art. 8: OFFICIAL CHANGE IN DISTRICT BOUNDARIES—Any student who transfers to another school because of a definite official change in school district boundaries shall be eligible upon enrollment, provided transfer is made to the school into which district his or her home has been annexed, and provided enrollment in such school is not later than the opening of the school year following the official change of school boundaries. (Process Form T-E.)

Art. 9: MOVE OF PARENTS TO NEW SCHOOL AREA—If a student’s parents move to the vicinity of a new school and the student elects to remain at the school in which he or she has been enrolled and attending, the student may do so without affecting his or her eligibility at that school.

If the parents move during the school year and the student wishes to transfer to the school in the vicinity of the new permanent residence, he or she may become eligible im-mediately under the following conditions: (Process Form T-E.)

a. If the student transfers within ten days of the time of his or her parents’ move, the student becomes eligible at once as far as the Transfer Rule is concerned.

b. If the student remains until the close of the current semester or until the close of the school year, he or she may become eligible immediately upon enrolling in the new school and attending classes.

c. If the student transfers within ten days after the end of an activity season in which he or she competed and which was in progress at the time of the parents’ move, the student becomes eligible immediately. An activity season is interpreted as being “in progress” after a school has been represented in at least one interschool event in that activity.

NOTE: If a student does not transfer to the new school within the time span as explained above in a, b, or c, the student will remain eligible at the original school but would be ineligible at the new school, unless otherwise approved by the school from which he or she transferred and the Executive Board.

Art. 10: TRANSFERRING BACK TO HOME SCHOOL—If a student has lived and attended school away from home, he or she shall be eligible for interschool activities upon returning home and attending the home school (the school the student previously attended, if there has been no change in family residence), provided the student meets all other general eligibility requirements. (Process Form T-E.)

NOTE: Questionable cases must be submitted to the Executive Board.

Art. 11: PARENTS MOVE TO CREATE ELIGIBILITY—A student who transfers from one school to another before or without regard to a move by his or her parents, does not become eligible if the parents move later for the purpose of making the student eligible. If the move was contemplated and the change in schools made for some justifiable reason (home under construction, but not finished; impending job transfer; etc.), such as starting a new semester, a student

may be declared eligible as soon as the new family home has been established. (Process Form T-E.)

Art. 12: FOREIGN STUDENTS—

a. A student from a foreign country who attends a member school as the result of participation in a foreign exchange academic program which has been approved by the Executive Board and which student meets all other eligibility requirements shall not be considered a transfer student during his or her first academic year of attendance. Such a student is eligible for participation during the first year of academic at-tendance if Form FES (found online at www.kshsaa.org) is completed, filed with the Executive Director and approved before participation.

b. Should a student from a foreign country attend a member school, but not as the result of participation in a foreign exchange academic program approved by the Executive Board, or attend a second academic year, regardless of the length of attendance in the first academic year, that student shall, for purposes of this rule, be treated as all other students who change schools. If there is not an accompanying move on the part of the students’ parents, the student will be ineligible for interschool extracurricular activities for eighteen weeks one calendar year , beginning with the first day of his or her attendance.

Art. 13: HARDSHIP—This rule applies only to transfer stu-dents who, because of unforeseen, unavoidable, or unusual circumstances, including but not limited to, broken home conditions, death of parents or guardian and abandonment, find it necessary to change schools.

In accordance with K.S.A. 72-60c01, the KSHSAA recog-nizes hardship transfer status for children of active duty military personnel who qualify per the requirements of the “Interstate Compact on Educational Opportunity for Military Children.”

The situation may be referred to the Executive Board for evaluation by completing Form T-E/H from the Entry Forms (online).

The Executive Board may declare the student eligible, provided the change was necessary and there was no undue influence.

If the Executive Board declares the student eligible under the foregoing circumstances, he or she shall be eligible upon notification.

Art. 14: BOARDING SCHOOLS—A boarding school which has a significant number of foreign students enrolled may play soccer in the fall and/or spring seasons without the eighteen weeks one calendar year waiting period being enforced for these foreign students. Such a team may not compete in a KSHSAA postseason tournament.

Section 2: Senior High Regulations

Art. 1: ENTERING HIGH SCHOOL FOR THE FIRST TIME —A senior high student is eligible at any senior high school he or she may choose to attend when senior high is entered for the first time at the beginning of the school year.

Art. 2: CHANGING SCHOOLS AFTER INITIAL YEAR—After a student is eligible in his or her initial year of senior high school, he or she may not change schools without forfeiting

eighteen weeks one calendar year of eligibility, unless there is a bona fide move on the part of the student’s parents to a permanent residence in the vicinity of the new school to which the student transfers.

Art. 3: NON-FOUR-YEAR HIGH SCHOOL—Students who complete the course of a high school that does not offer a full four-year course may transfer to a secondary school in the vicinity of their home, where they may continue their education and become eligible immediately.

Section 3: Middle/Junior High School Regulations

Art. 2: CHANGING SCHOOLS AFTER INITIAL YEAR—After a student is eligible as a seventh grader, or in his or her initial year of middle/junior high school, he or she may not change middle/junior high schools without forfeiting eighteen weeks one calendar year (NOTE: SEE AMEND-MENT BELOW) of eligibility, unless there is a bona fide move on the part of the student’s parents to a permanent residence in the vicinity of the new school to which the student transfers.

Motion for adoption of the proposal as written was made by P. Lane, second by D. Thon. An amendment was made by J. Hines, second by S. Boden, to leave the Middle/Junior High regulation in Rule 18, Section 3, Article 2 as currently written at 18 weeks. The amendment was approved by a vote of 53 in favor, 13 opposed. An amendment was made by T. Bumgarner, second by M. Graber, to adopt the changes for high schools beginning with the 2020-21 school year. The implementation date amendment was approved by a vote of 62 in favor, 4 op-posed. The original proposal (with amendments included) was adopted as amended, 42 in favor, 24 opposed.

OUTSIDE COMPETITION RULE UPDATED TO REFLECT CALENDAR

A proposal was made to modify Rule 22, Outside Competi-tion, Section 1, Article 1 as follows:

Art. 1: A student who is a member of a school athletic, scholars bowl or debate squad effective Tuesday following Labor Day Monday SCW #7 through Friday preceding Memorial Day may not participate as a member of an outside team or as an independent competitor in the same sport, scholars bowl or debate activity. (Exception: See Rule 4, United States Olympic Committee-Sponsored National Tri-als and Competitions.)

a. When fielding a common participating group, no more than two (2) member schools may be combined to compete, and the classification appropriate for the combined enrollment of the schools involved will apply.

(1) The KSHSAA Executive Board may waive the number of schools that may be combined when the schools are within the same school district.

(2) For interscholastic music activities, the KSHSAA Executive Board may waive the number of non-district schools that may be combined. Before a cooperative interscholastic music agreement may be established, a hearing with the Executive Board and the participating schools is required.

(3) For Quasi-team/Individual athletics, the KSHSAA Executive Board may grant a request for no more than three (3) multiple schools to be combined. Before a Quasi-team/Individual cooperative agreement may be established, a hearing with the Executive Board and participating schools is required.

TENNIS RULE LANGUAGE MODIFIEDA proposal was made to modify the language for Rule 41, Tennis (Girls & Boys), Section 2, Articles 3-6 as follows:

b. Boys – The Executive Board shall establish the state tournament during Standardized Calendar Week #45. Regional tournaments, when needed, will be held during SCW #44. In classification groups of 33 or more schools, a two day regional tournament will be conducted during SCW #44.

Art. 4: The Executive Board may schedule summer tournaments if a sufficient number of schools enter summer competition.

a. A school shall not participate during the school year and in summer competition.

b. A school shall declare its choice in advance.

Art. 5 4: No student representing a member school shall par-ticipate in more than eight days of interschool competition during a season, exclusive of regional, sub-state and state tournaments.

a. Two dual meets may be substituted for one day of tournament competition provided no loss of instruc-tional time would take place for competition and/or travel.

b. Schools are encouraged to schedule as many quadran-gular or smaller events as possible. It is recommended these events start after school hours.

c. On those days when school time is used, only two matches or tournaments may start prior to 3 p.m. C.T.

Art. 6: The regional winners of first, second, third, fourth, fifth and sixth places in both singles and doubles shall qualify for the state tournament series.

a. No school may be represented by more than two con-testants in the singles matches and not more than two teams in the doubles matches.

b. A student may not represent a school in both singles and doubles matches.

The language has been inserted in the Tennis Manual and was obsolete in the Handbook, consistent with other KSHSAA rules. R. Morrisey moved adoption of the modification, second by J. Vanek. The vote was 66 in favor, none opposed.

a. If a team qualifies for the state tournament, all six members shall qualify.

b. If a school enters fewer than four players, they shall compete for individual medalist honors.

Art. 5: After three games of medal competition in state tourna-ments, championships will be awarded for low medalist and for the low medalist six-member team.

NOTE: Ties for team awards and medalist honors will be decided by tie-breaking procedures adopted by the Execu-tive Board.

Art. 6 4: The Executive Board has the authority to revise the participation regulations and to establish regulations for outside tournament competition.

The language has been inserted in the Bowling Manual and was obsolete in the Handbook, consistent with other KSHSAA rules. P. McComas moved adoption of the modification, second by G. Rosenhagen. The vote was 66 in favor, none opposed.

COMPETITION LIMIT CHANGE APPROVED FOR SCHOLARS BOWL

A proposal was made to change the language for Rule 51, Scholars Bowl, Section 2, Article 3 as follows:

Rule 51 Scholars Bowl

Section 2: Senior High Regulations

Art. 3: No student may participate in more than eight nine scholars bowl competitions per year, exclusive of regional and state. On those days when school time is used, only two competitions may start prior to 3 p.m. C.T.

NOTE: Each student is limited to eight scholars bowl competitions, except that should his or her school host a league or invitational tournament, then he or she may participate in nine scholars bowl competitions. If a school attempts to host a tournament and is unable to do so, it may appeal to the Executive Board for a waiver of this regulation to permit its students to enter nine scholars bowl competitions.

B. Lewis moved adoption of the proposal beginning with the 2020-21 school year, second by M. Straub. The vote was 66 in favor, none opposed.

Appeal Board Meeting KSHSAA Board Room

Friday, September 27, 2019

The meeting of the Appeal Board was held in the office of the Kansas State High School Activities Association on Friday, Sep-tember 27, 2019.

Call to Order: Travis Githens, chairperson, called the meeting to order at 1:05 p.m. Sonya Martin served as recording secretary.

Motion by Loren Feldkamp, seconded by Jason Walker, to allow the plaintiff the opportunity to enter additional information to the Appeal Board. Motion approved 6-0.

A recess was called at 1:09 p.m. in order to receive documentation from the appellant. The meeting was called back into session at 1:15 p.m.

Roll Call: Members present were Loren Feldkamp, Brian Fitch, Travis Githens, Jeff Koelzer, Sonya Martin and Jason Walker.

Member David Morford was absent.

In accordance with Bylaw Article VIII, Section 6, Tom Mitchell was excused due to conflict of interest.

All Appeal Board members signed an Oath of Office.

Travis Githens served as chairperson, Jason Walker served as vice-chairperson, Sonya Martin as recording secretary and Loren Feldkamp as alternate recording secretary. These officer positions will remain in place until such election is necessary.

Purpose of Appeal: Greg Miller, parent of a student attending Overland Park-Blue Valley North High School, requested the hearing with the Appeal Board to determine the eligibility status of his son. The appeal is from the September 18, 2019 eligibility determination by the Executive Board. In accordance with Transfer Rule 18-1-13, Hardship, the Executive Board found the student not eligible for varsity football participation but instead guided the parent and school to apply for limited eligibility participation for which the student would be eligible.

Appeal Board Decision: A recess was called at 2:40 p.m. to provide a break for attendees. The meeting was called back into session at 2:50 p.m.

Motion by Jason Walker, second by Brian Fitch, to enter into Executive Session for the purpose of deliberating beginning at 3:27 p.m. Motion approved 6-0. The Board resumed open session at 3:52 p.m.

Motion by Loren Feldkamp, second by Sonya Martin, to deny the ruling of the Executive Board in accordance with Transfer Rule 18, Section 1, Article 13.

The vote resulted in a 3-3 deadlock and therefore no majority vote was achieved. As a result, the ruling by the Executive Board stands and the student is denied immediate eligibility per the Transfer Rule.

The meeting was adjourned at 3:54 p.m.
