Senator Banner, to move:— That this House recommends to the Government the appointment of a Commission to enquire into and report upon:

(a) Whether the policy of administering' the Trust Farms under agricul­tural officers, instead of Chiefs, is not having the effect of detribalizing

large sections of tribal natives?

(h) Whether the policy of allotting to natives on the Trust Farms a maxi­mum of five morgen of arable land is not calculated to drive natives out of the Trust Farms in order to supply the mining, industrial and agricultural undertakings with further supplies of cheap labour?

(c) Whether it is desirable to dfetribalize and urbanize further sections ofthe native population before the development of more industries has taken place, and before the section of the native population already urbanized has been properly integrated into urban and industrial life?

(d) Whether methods of farming and mining cannot be altered, and whether other sources of labour cannot be obtained, to make these under­

takings less dependent on cheap native labour?

(e) Whether it is desirable to create a permanent native peasantry in South Africa, together with a permanent native urban and industrial popu­lation?

(/) Whether it is not possible to plan the simultaneous and complementary integration of the native section of the population into peasant and urban communities ?

BE IT ENACTED by tie King’s Most Excellent Majesty, the Senate and the House of Assembly of the Union of

South Africa, as follows :—

Definition 1. In this Act the expression “ Consolidation Act ” meansthe Miners’ Phthisis Acts Consolidation Act, 1925 (Act No. 35 of 1925), as amended from time to time.

Replacement of 2. The following section is hereby substituted for sectionsection SSbis of Act thirty-three bis of the Consolidation Act:

inserted by Act 60 “ Special 33bis. (1) The board may, in its discretion, onof 1934 and grants. application, make a grant, as hereinafter provided,ame"r!?,lby from the special fund referred to in section thirty -23 of 1936 and o , xof 1938. mne OIS to—

(a) a beneficiary miner—

(i) who is not entitled to further benefits under the prior law, the principal Act, the previous Act or this Act; and

(ii) whose capacity for work is in the opinion of the bureau or Medical Board of Appeal seriously impaired owing to age or disease or physical or mental disability, or who, though not so incapacitated, is in the opinion of the board, through no fault of his own, unable to earn sufficient for the maintenance of himself and of his dependents; and

(iii) whose total income or means is, in the opinion of the board, insufficient for the maintenance of himself and of his de­pendents ;

(■b) the dependents of a deceased beneficiary miner or the beneficiary dependents of a deceased miner whose total income or means is, in the opinion of the board, insufficient for their maintenance through no fault of their own, if no further benefits are payable to any person in respect of such miner under the prior law or the principal Act or the previous Act or this Act : Provided that such a grant may be made to the widow of a deceased miner, even though a monthly allowance is payable under the principal Act or the previous Act or this Act, to a child of the miner, if the widow is, by reason of sub-paragraph (ii) of the proviso to paragraph (c) of the Third Schedule to this Act, not entitled to such a monthly allowance.

(2) Grants from the said special fund shall be made at rates and on conditions approved by the

Minister.

(3) A grant from the said special fund may be paid in such instalments and for such period or periods as the board may from time to time de­termine, but shall not be paid in respect of any period during which the beneficiary was not in the Union, Bechuanaland, Basutoland, Swaziland or the Mandated Territory of South-West Africa.”

Amendment of 3. Sub-section (3) of section thirty-jive of the Consolidationsection 35 of Act • ^ct is hereby amended by the substitution for the second 35 of 1925 as sentence of the following sentence : “ If as a result of that t^ rH o fbActe60 of examination or of any other m edical examination conducted 1934. within a period of twelve months as from the date on which

1. In hierdie Wet beteken die uitdrukking „Konsolidasie- Woordomslcrywing. wet” die ,,Mijnteringwetten Konsolidatiewet, 1925” (WetNo. 35 van 1925), soos van tyd tot tyd gewysig.

2. Artikel drie-en-dertig bis van die Konsolidasiewet word Vervanging van hiermee vervang deur die volgende artikel : , W e t^ v a n 1925 „Speoiale 336is. (1) De raad kan, naar goeddunken, volgens soas jngOVO0g deur toelagen. onderstaande bepalingen uit het speciale fonds Wet 60 van 1934

vermeld in artikel negen en dertig bis, op aanzoek en gewysig deur een toelage toekennen aan— Wette 23 van 1931.. , n i t •• i en 6 van 1938.(a) een bevoordeelde mijnwerker—

(i) die niet gerechtigd is tot verdere voor- delen krachtens de vroegere wetten, de Hoofdwet, de vorige Wet of deze W e t ; en

(ii) wiens werkvermogen volgens het oordeel van het bureau of van de Mediese Raad van Appfel erg verminderd is wegens ouderdom of ziekte of lichaams- of geestes- gebreken, of die, alhoewel hij niet aldus onbekwaam is, volgens het oordeel van de raad, buiten zijn eigen schuld, niet in staat is orn voldoende te verdienen tot onderhoud van hemzelf en van zijn afhankeliken; eu

(iii) wiens totaalinkomsten of -middelen volgens het oordeel van de raad on vol­doende zijn tot onderhoud van hemzelf en van zijn afhankeliken ;

(b) de afhankeliken van een overleden bevoordeeldemijnwerker of de bevoordeelde afhankeliken van een overleden mijnwerker wier totaal­inkomsten of -middelen volgens het oordeel van de raad buiten eigen schuld onvoldoende tot hun onderhoud zijn, mits geen verdere -voordelen ten opzichte van die mijnwerker aan wie ook al verschuldigd zijn krachtens de vroegere wetten, of de Hoofdwet of de vorige Wet of deze Wet : Met dien verstande dat zulk een toelage toegekend mag worden aan de weduwe van een overleden mijnwerker, zelfs al is een maandelikse toelage aan een kind van de mijnwerker verschuldigd krachtens de Hoofdwet of de vorige Wet of deze Wet, indien de weduwe wegens sub-paragraaf (ii) van de voorbehoudsbepaling tot paragraaf(c) van de Derde Bijlage tot deze Wet niet tot zulk een maandelikse toelage gerechtigd is.

(2) Toelagen uit het voormelde speciale fonds worden toegekend volgens een schaal en op voor- waarden die de Minister goedgekeurd heeft.

(3) Een toelage uit het voormelde speciale fonds mag uitbetaald worden in de paaiementen en over het tijdperk of de tijdperken die de raad van tijd tot tijd mocht vaststellen, doch wordt niet uit­betaald ten aanzien van een tijdperk gedurende hetwelk de bevoordeelde niet in de Unie, Betsjoe- analand, Basoetoland, Swaziland of het mandaat- gebied Zuidwest-Afrika was” .

3. 6. The following new section is hereby inserted in the Consolidation Act after section seventy-five :“ Prescrip- 75bis. No legal proceedings whatsoever shall be tion. brought against the board, the bureau or the

Medical Board of Appeal unless such proceedings are commenced within a period of seven years as from the date on which arose the cause on which those proceedings are based.” .

7. Sub-section (1) of section seventy-six of the Consolidation Act is hereby amended—•

(a) by the insertion after the definition of the word “ beneficiary ” , of the following new definition:“ ‘ benefit ’ or 1 benefits ’ shall not include a gratuity mentioned in sub-section (10) of section three or anyexpenditure incurred or financial assistance rendered under paragraph (e) or (g) of sub-section (1) of section four or a grant under section thirty-three bis ” ;

(b) by the insertion, after the word “ older ” in thedefinition of the expression “ child under sixteen years of age ” , of the words “ to or in respect of whom an allowance is payable in terms of sub- paragraph (v) of the proviso to paragraph (c) of the Third Schedule to this Act or ” ;

(c) by the substitution for the definition of the word“ earnings ” of the following definition : “ ‘ earn­ings ’ , in relation to a miner or a native labourer, means the amount which the employer of the miner or native labourer is obliged to pay to the miner or native labourer as remuneration for his work, and includes the value of food and accommodation which the employer is obliged to supply to or provide for the miner or native labourer ” ;

4. Sub-artikel (3) van artikel negen-en-dertig bis van die VVysigmg van Konsolidasiewet word hiermee gewysig deur die woorde ^et, 35 van*1925, ,,vijf en zeventig duizend” te vervang deur die woorde ,,hon- SOas ingevoeg deur derd en vijftig duizend” . Wet 60 van 1934 en

(c) deur die omskrywing van die woord ,,verdiensten”te vervang deur die volgende omskrywing : ,, ,ver- diensten’ , met betrekking tot een mijnwerker of een naturellearbeider, het bedrag dat de werkgever van de mijnwerker of naturellearbeider verplicht is aan de mijnwerker of naturellearbeider te betalen als loon voor zijn werlc, met inbegrip van de waarde van voedsel en huisvesting die de werkgever verplicht is aan de mijnwerker of naturellearbeider te ver- strekken of te bezorgen” ;

(rf) deur in die tweede voorbehoudsbepaling tot die om­skrywing van die uitdrukking „maandelikse ver- diensten” die woorde „op wie de bepalingen van artikel twee en twintig van W et 19 van 1912 van toe- passing zijn en wiens verdiensten per maand geen dertig pond bedroegen, worden de maandelikse ver­diensten van zulke mijnwerker geacht een door de raad te bepalen som te zijn” te vervang deur die woorde ,,wiens verdiensten per maand minder dan dertig pond bedroegen, worden zijn maandelikse verdiensten geacht een door de raad te bepalen som van niet meer dan dertig pond te belopen” .

“ (v) a monthly allowance granted to a child who has not attained the age of sixteen years and who has no living parent or adoptive parent may, in the discretion of the board, be increased up to an amount not exceeding double the allowance prescribed for such child under any law relating to miners’ phthisis, and when such child has attained the age of sixteen years and his allow­ance has not been increased under sub-paragraph(iv), payment of the allowance may be continued (or if it has been discontinued for any period, may be resumed) during such period as the board may, in its discretion, determine, but not longer than the period mentioned in paragraph (g) and subject to a limitation of the application of this sub-paragraph to not more than two children of any one deceased miner ; ”

(b) by the substitution for paragraph (e) of the following paragraph :

“ (e) Upon the death of a miner who was entitled to a monthly allowance, a legitimate child of the miner, who was dependent upon him, and for whom no monthly allowance was payable in the miner’s life-time by reason of sub-paragraph(ii) of the proviso to paragraph (c), shall be entitled to a monthly allowance as if a monthly allowance had been payable for him in the life­time of the miner in terms of paragraph (c)

9. No monthly allowance shall be paid or increased by virtue of any provision of this Act in respect of any period prior to the commencement of this Act and the provisions of paragraph (d ) of section seven shall not be applied in respect of any award (other than an award of a monthly allowance) made before the commencement of this Act.

10. Section two of the Miners’ Phthisis Acts Further Amend­ment Act, 1930 (Act No. 38 of 1930), is hereby repealed.

11. This Act shall be called the Miners’ Phthisis Amendment Act, 1941, and shall come into operation on the first day of August, 1941.

Act (Transvaal), 1919, and the Asiatics (Transvaal Land and Trading) Act, 1939.

BE IT ENACTED by the King’s Most Excellent Majesty, the Senate and the House of Assembly of the Union of

South Africa, as follows :—

1. Sub-section (5) of section one of the Asiatics (Land and Trading) Amendment Act (Transvaal), 1919, as inserted by section seven of Act No. 30 of 1936 and amended by section one of Act No. 32 of 1937 and section one of Act No. 28 of 1939, is hereby further amended by the substitution for the figures “ 1941 ” of the figures “ 1943 ” .

2. Sections two and three of the Asiatics (Transvaal Land and Trading) Act. 1939, are hereby amended by the substitution for the figures “ 1941 ” wherever they occur in those sections, of the figures “ 1943 ” .

3. This Act shall be called the Asiatics (Transvaal Land and Trading) Amendment Act, 1941.

„(v) een maandelikse toelage toegekend aan een kind dat niet de leeftijd van zestien jaar bereikt heeft en dat geen ouder of adoptant-ouder in leven heeft, naar goeddunken van de raad verhoogd kan worden tot een bedrag van niet meer dan tweemaal zo veel als de toelage die voor dat kind in een of andere wet op mijntering voor- geschreven is en dat, wanneer dat kind de leeftijd van zestien jaar bereikt heeft en zijn toelage niet verhoogd is ingevolge sub-paragraaf (iv), uitbetaling van de toelage voortgezet kan worden (of indien de uitbetaling gedurende een of ander tijdperk gestaakt werd, dezelve hervat kan worden) gedurende een door de raad naar goeddunken te bepalen tijdperk, doch niet langer dan de in paragraaf (g) bedoelde levensduur en met beperking van de toepassing van deze sub- paragraaf tot niet meer dan twee kinderen van een enkele overleden mijnwerker” ;

(b) deur paragraaf (e) te vervang deur die volgende para­graaf :

,,(e) Met de dood van een mijnwerker die tot een maandelikse toelage gerechtigd was, komt aan een wettig kind van de mijnwerker dat van hem afhankelik was en voor wie wegens sub-paragraaf (ii) van de voorbehoudsbepaling tot paragraaf (c), geen toelage verse huldigd was terwijl de mijnwerker nog in leven was, een maandelikse toelage toe alsof een maandelikse toelage voor hetzelve ingevolge paragraaf (c) verschuldigd was terwijl de mijnwerker in leven was” .

9. Geen maandelikse toelae word kragtens een of ander Toekennings is me bepaling van hierdie Wet uitbetaal of verhoog nie met betrek- erugwercen e king tot ’n tydperk voor die inwerkingtreding van hierdieWet en die bepalings van paragraaf (d ) van artikcl seive word nie toegepas nie met betrekking tot ’n toekenning (belialwe ’n toekenning van ’n maandelikse toelae) wat voor die inwerking- treding van hierdie Wet gedaan is.

10. Artikel twee van die Mynteringwette Verdere-Wysigings- Herroeping. wet, 1930 (Wet No. 38 van 1930), word hiermee herroep.
