Each local conservation district is governed by a seven-member board of supervisors elected by the registered voters within that district. The purpose of a conservation district is to conserve and develop all renewable natural resources within the district.

Marsy’s Law Crime Victim’s Rights Amendment

Ballot Question: Are you in favor of creating a new section of the Constitution of Kentucky relating to crime victims, as proposed in Section 2 below?

Summary: The amendment would add specific rights of crime victims, together known as Marsy’s Law, to the KY Constitution. KY voters approved this measure during the 2018 election, but the KY Supreme Court ruled the approved amendment void since the full text of the amendment was not provided to voters.

Support: Supporters of the amendment believe the crime victims’ rights amendment (Marsy’s Law) would incorporate a victims’ bill of rights into the state constitution, including the right to be notified, to be present and to be heard in court proceedings. KY is currently one of only 15 states that does not provide crime victims with constitutional-level protections, and Marsy’s Law would ensure the inclusion and respect of victims within our criminal justice system. Opposition: Opponents for Marsy’s Law, including the ACLU and the NKY Tea Party, argue this amendment is bad for victims and wrong for KY. They note the bill doesn’t provide any detail, funding, resources or direction for a new section of the Constitution and many of the victim rights are already granted under existing law. Terms of Judicial Offices

Ballot Question: Are you in favor of changing the term of Commonwealth’s Attorneys from six-year terms to eight-year terms beginning in 2030, changing the terms of judges of the district court from four-year terms to eight-year terms beginning in 2022, and requiring district judges to have been licensed attorneys for at least eight years beginning in 2022, by amending the Constitution of Kentucky to read as stated below?

Summary: Extends the office terms of circuit court clerks, Commonwealth’s Attorneys public prosecutors and district judges and changes eligibility requirements.

Support: Supporters of the amendment note it would increase the qualifications and professionalism of the judiciary by requiring district judges to have been a licensed attorney for at least eight years, up from the current two years minimum requirement. Aligning the prosecutor’s terms with the judges’ terms would make it easier to recircuit the courts to better balance judicial resources across the Commonwealth.

Opposition: Opponents of the amendment state that lengthening the terms of judges and prosecutors to eight years promotes the idea of less accountability for these offices and is too long for any elected official to serve. Furthermore, in Kentucky’s rural areas there will be less applicants due to the eligibility requirement.

CONSTITUTIONAL QUESTIONS The KY Constitution enables the General Assembly to place proposed amendments on the general election ballot before voters statewide, requiring approval by a simple majority of the voters.
