Demarquis D. Hix adm. . . . who was ordered by an interlocutary decree of this Court at the last
term thereof to sell the negroes slaves mentioned in the petition on a credit of twelve months
after first giving twenty days notice of the time and place of sale, and make report thereof to
the present term of this Court begs leave to submit the following.
Report
Pursuant to said interlocutary order on the 21st day of September 1844 I sold said slaves at public
auction in the town of Shelbyville after giving 21 days notice of the time and place of sale on
a credit of twelve months and William Word being the highest bidder the boy Jessee was
struck off to him at the price of seven hundred and eleven dollars ($711.00) for which sum he
executed his note of that date, payable to me twelve months after date with Thomas S. Word
his security for payment of the same. And Thomas C. Brown being the highest bidder the boy
Sam was struck off to him at his bid of six hundred and fifty three dollars ($653.00) for
which sum he executed his note payable to me twelve months after date with William Tolly
and Thomas H. Shaw his securities for payment of the same. And Robert Cannon being the
highest bidder became the purchasee of Old George at the price of ten dollars for which sum
he executed his note payable to me twelve months after date.

Which report being heard and understood by the Court is in all things confirmed and ordered to
enrolled. And it further ordered, adjudged and decreed by the Court that said heirs shall pro-
ceed to collect said notes when they shall fall due. And that he shall pay the costs which have
accrued in the cause out of the moneys so collected. He shall then divide the residue of said
fund into eight shares and distribute it in the following manner that is to say. He shall
pay to Jacob Kyser [#13], William Kyser [#15], Valentine Kyser, Jr. [#17], Daniel Kyser

"Injunction Bill
The Bill of Complaint of William Hime a citizen of Bedford County Tennessee against James
Christian of the County & State aforesaid filed in the Chancery Court at Shelbyville. To the
Honl. B. L. Ridley Chancellor . . . Your orator humbly complaining would . . . unto your
Honor that he contracted with James Christian for the purchase of a certain tract of land si-
tuate in Bedford County containing about 28 acres, being Lot No. 5 in the division of the
lands of John Hime [#14] deceased, a more particular description of which can be seen by a
reference to said division. Said tract of land descended to the wife of said Christian from her
father the said John Hime, and she at the time of the contract aforesaid was a minor under the
age of 21 years. It was a part of the contract that said Christian and his wife should executed
to your orator for said land and that said Christian should in addition thereto execute to your
orator a bond to refund the purchase money should his said wife when she arrived at the age
of twenty one refuse to ratify the said deed. Your orator would further state that as pursuance
of said agreement said Christian & wife on the 13th day of January 1844 executed and deli-
vered to him a deed for said land and acknowledged the same before the Clerk of the County
Court of Bedford County in pursuance of the Acts of Assembly in such cases made & pro-
vided and your orator executed to said Christian his two bonds on Sept. 1st 1844, one for
$106.00 and the other for $90.00 the latter was to be paid in a waggon which was the consid-
eration agreed to be paid by your orator for said land and it was distinctly understood between
said Christian and your orator that the said Christian was to execute a refunding bond afore-
said and it was upon this condition alone that your orator agreed to purchase. And he never
would have purchased but for such promise of indemnity against loss from the wife of said
Christian refusing when she arrived at age to ratify said sale. Your orator would further state
that said Christian now refuses to execute said bond and has actually sued your orator before
a Justice of the Peace for said County of Bedford (John W. Cobb) upon the largest note and
obtained a judgment for about seventy one dollars and costs the balance due on said note and
threatent to sue him on the trade note, although he has executed no refunding bond and even
refuses to execute one and although his wife lacks more than two years of reaching her ma-
jority, all of which is manifestly against equity and conscience. Said Christian is at this time
utterly insolvent and is about to remove from the County . . . The premises considered your
orator prays your Honor to make said James Christian a defendant to this bill that copies he-
reof and subpoena issue . . . and that he be required full time and perfect answers to make to
the several allegations contained in complainant bill in as full and ample a manner as if the
same were here again repeated and he specially interrogated thereto. And may it please your
Honor at the hearing to decree that said Christian be enjoined from colllecting any of said
purchase money or transferring the notes, bonds, or judgments until he executes to your ora-
tor a bond with good security to refund said purchase money in the event his wife when she
arrives at the age of 21 dissents from her said deed or until she arrives at the age of 21 years
and ratifies her said deed. And in the meantime may it please your Honor to order an injuc-
tion to issue restraining all further proceedings unitl the further order of the Court and such
other and further relief grant in the premises as your Honor may think your orator entitled to
and your orator as in duly bound will every pray. This is the first application for an injunction
