    The Ministry of Petroleum and Natural Gas in their letter No. P/39012/1/1999-IOC dated 09

    Oct 2000 have reserved 8 % of oil product agencies i.e. LPG and Petrol Pumps for

    the Defence Personnel (DC) category and the Inter-se priority from I to V is as under :-

    Nationality : Indian

    Age as on date of application Widows : Minimum 21 years

    Dependent Son/unmarried daughter:- Min 21 Years & Max 30

    Educational Qualification Matriculation or recognized civil or

    Armed Forces equivalent (for LPG only)

    Income (Applicable for Priority The gross income of the candidate

    APPLICATION FORM8% Defence Quota agencies are advertised under Defence Category, by

    oil companies in two newspapers, in one English Daily and one Regional

    Vernacular Daily having maximum circulation in the Districts in which

    the dealership/distributorship is to be located.

    After publication in the newspaper, application forms can be

    obtained in person or by making a written request through registered

    post, from the Divisional/Regional/Area Office of the concerned oil

    company on payment of an application fee of Rs. 1000/-

    ELIGIBILITY CERTIFICATEAfter advertisement in the newspaper, the applicant is to approach the Director-General

    of Resettlement, RK Puram for issue of eligibility certificate with the following attested

    copies of documents as applicable :-

    (a) Death Certificate of deceased defence person issued by Service Hospital/HQs.

    (b) Proof of death attributable to Military Service.

    (c) Proof of Gallantry Award, if any.

    (d) Proof of disability being attributable to military service and CDA (P) letter mentioningabout disability pension.

    (e) Pension Order.

    (f) Discharge book/Retirement order.

    (g) Matriculation Certificate of the applicant.

    (h) Newspaper clipping of the Advertisement.

    (i) Copy of Identity card issued by Zila Sainik Board/Rajya Sainik Board.(j) Affidavit in original, on Rs 10/- stamp paper duly notarized (Specimen copy placed as (

    Annexure E &F).

    (k) Relinquishment Deed (Specimen copy placed as Annexure G) in case of dependant

    (NOK), from widow and other dependents.

    (l) Passport Size Photograph of applicant (One photograph for each location)

    SELECTION

    Application form and eligibility certificate to be submitted to

    the concerned Regional office of the Oil Company before due

    date.

    Dealer Selection Board appointed by the Ministry of Petroleum

    and Natural Gas will select the individual for

    dealership/distributorship of the oil company

    Applicant issued with the eligibility certificate will only be

    interviewed.

    ISSUE OF LETTER FOR AWARDING GAS

    AGENCY

    Letter of Intent: It will be issued by the concerned Oil Company

    based on the selection made by the Dealer Selection Board.

    Attestation of Documents: In case can applicant applies for the

    eligibility certificate by post, the photocopies of the documents

    submitted need to be attested by Zila or Rajya Sainik Board/ Any

    Gazetted officer

    The objective to obtain a certificate from DGR is to identify

    the suitable candidates for the allotment of gas agency.

    DGR on the basis of information obtained in accordance with the

    guidelines, grants certificate whether or not a particular candidate

    falls in the defence category of ex-servicemen within prescribed

    income limit.

    It is beyond the powers of DGR to restrict the eligibility certificate

    to a particular location and advertisement and also make its own

    recommendations for a particular candidate.

    Appellants stand- The appellant Capt. Sunil Dutt Sharma challenged that the eligibiltycertificate issued by DGR was not valid as it was issued for gas agency at Amritsar Cantt.

    and not for the township of Jagraon. It was submitted by Capt. Sunil Dutt Sharma that an

    up-to-date position of the applicant quo a particular advertisement and a location is the

    basic requirement for the eligibilty certificate.

    Contesting Respondents stand- The Advertisement for the awardof Gas Agency for Jagraon township was issued on 11-1-1994. The

    eligibility criteria issued from DGR is dated 16-8-1993 which

    cannot be said to be very old or stale.

    The candidate who has been certified to be covered in the defencecategory and fulfilling the required income limit cannot lose his

    eligibility merely because certified was not obtained pursuant to a

    particular advertisement and location.

    The mention in the certificate of gas agency at a particular location

    and recommendation in favour of the candidates applying for

    eligibility certificate is a surplusage.

    Merely because the eligibility certificate issued by the DGR is of a

    date earlier than the date of advertisement issued for grant of a

    particular agency is no ground to reject the candidature.

    The allegation made of the eligibility certificate being of a date prior tothe date of advertisement is just a technical objection and not a

    substantial ground to upset the selection made by the Board.

    As a result of the discussion, the appeal failed and was dismissed

    by the court.

    The parties to bear their own costs in the appeal.
