LABOUR NEWS published by the Chamber once in two months has entered the Forty fourth year of service to Members and Member Bodies of the Chamber in particular and industry and trade in general. LABOUR NEWS rededicates itself to the service of the Members and Member Bodies in an ever-increasing measure in the NEW YEAR 2011.

Shri T.S. Gopalan, B.A.B.L., Advocate & Notary, T.S. Gopalan & Co., and Member, Executive Committee and Hon. Adviser of the Chamber on Labour is the Chairman of the Labour & Management Sub-Committee of the Chamber, while Shri R.S. Sharma of Nagraj Associate, is the Co-Chairman.

The Sub-Committee assists the Chamber in formulating its views and policies on matters relating to Labour & Management. The Sub-Committees meets from time to time to discuss problems referred to the Chamber by Members and Member Bodies.

Free Consultancy Service on Labour is being offered by the Chamber for over 39 years at Chennai office of the Chamber. This service is being made available at Secun-derabad office of the Chamber for the past 29 years.

EMPLOYEES‟ STATE INSURANCE (CENTRAL) AMENDMENT RULES, 2012:

Vide Notification G.S.R. 73(E) & F.No.S-38012/03/SS-I dated February 8, 2012 issued by the Employees’ State Insurance Corporation, New Delhi.

Whereas the draft of certain rules further to amend the Employees’ State Insurance (Central) Rules, 1950, were published as required by sub-section (1) of Section 95 of the Employees’ State Insurance Act, 1948 (34 of 1948), vide notification of the Government of India in the Ministry of Labour and Employment, number G.S.R. 849(E), dated 30th November, 2011, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-Section (i), dated the 30th November, 2011, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published, were made available to the public;

And whereas, the copies of the said Gazette were made available to the public on the 30th November, 2011.

And whereas no objection or suggestion has been received from any person in this regard;

Now, therefore, in exercise of the powers conferred by Section 95 of the Employees’ State Insurance Act, 1948 (34 of 1948), the Central Government, after consultation with the Employees’ State Insurance Corporation, hereby makes the following rules further to amend the Employees’ State Insurance (Central) Rules, 1950, namely:-

1. (1) These rules may be called the Employees’ State Insurance (Central) Amendment Rules, 2012; (2) They shall come into force with effect from the 1st day of March 2012.

2. In the Employees’ State Insurance (Central) Rules, 1950, in rule 58, after clause (ii) of sub-rule (2), the following proviso shall be inserted, namely:-

―Provided that the total amount of the periodical monthly payment of dependents’ benefit payable to all eligible dependants of a deceased employee, shall be not less than one thousand two hundred rupees.

DECLARATION OF RATE OF INTEREST FOR THE EMPLOYEES PROVIDENT FUND MEMBERS ACCOUNT FOR THE YEAR 2011-12:

Vide Circular No.Invest.1/3(2)/133/11-12/ROI/51350 dated March 14, 2012 issued by the Employees’ State Insurance Corporation.

It is to inform that Ministry of Labour and Employment, Government of India, vide its letter no. R-11018/1/2010.SS-II dated 14.3.2012 has conveyed the approval of the Central Government under para 60(1) of Employees’ Provident Fund Scheme, 1952 to credit interest @ 8.25% for the year 2011-12 to the account of each member of the

Scheme.

You are, accordingly, requested to issue necessary instructions to all concerned for crediting the interest to the members’ accounts.

THE EMPLOYEES‟ PENSION (AMENDMENT) SCHEME, 2011:

Vide Notification No. S.O. 1809(E) dated August 5, 2011 issued by the Ministry of Labour, Government of India and published n the Gazette of India, Extraordinary Part-II, Sec.3(ii) issued no. 1515 dated August 5, 2011.

In exercise of the powers conferred by section 5 read with sub-section (1) of section 7 of the Employees, Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952), the Central Government hereby makes the following Scheme, further to amend the Employees’ Pension Scheme, 1995, namely;-

1. This Scheme may be called the Employees’ Pension Scheme, 2011.

2. It shall come into force on the date of its publication in the Official Gazette.

3. In the Employees’ Pension Scheme, 1995,- (i) in paragraph 20, after sub-paragraph (4), the following sub-paragraph shall be inserted, namely:-

―5) Every employer shall send the Commissioner, as electronic format of the returns referred to in sub-paragraphs (1) and (2), in such form and manner as may be specified by the Commissioner.‖;

(ii) in paragraph 39-A, after the words and figure ―Commissioner in Form-1‖, the following words shall be inserted, namely:-

―and such return shall also be submitted in electronic format in such form and manner as may be specified by the Commissioner.‖

THE EMPLOYEES‟ DEPOSIT LINKED INSURANCE (AMENDMENT) SCHEME, 2011:

Vide Notification No. S.O. 1810(E) dated August 5, 2011 issued by the Ministry of Labour, Government of India and published n the Gazette of India, Extraordinary Part-II, Sec.3(ii) issued no. 1515 dated August 5, 2011. In exercise of the powers conferred by section 5 read with sub-section (1) of section 7 of the Employees’ Provident Fund and Miscellaneous Provisions Act, 1952 (19 of 1952), the Central Government hereby makes the following Scheme, further to amend the Em-ployees’ Deposit Linked Insurance Scheme, 1976 namely;-

1. This Scheme may be called the Employees’ Linked Insurance Scheme, 1976, namely;-

2. It shall come into force on the date of its publication in the Official Gazette.

3. In the Employees’ Deposit Linked Insurance Scheme, 1976,-

―(3) Every employer shall send to the Commissioner, an electronic format of the returns referred to in sub-paragraphs (1), (1A) and (1B), in such form and manner as may be specified by the Commissioner.‖;

(ii) in paragraph 28, after sub-paragraph (7), the following sub-paragraph shall be inserted, namely:-

―(8) Every employer shall send to the Commissioner, an electronic format of the returns referred to in clause (ii) of sub-paragraph (1) and clause (ii) of sub-paragraph (4), in such form and manner as may be specified by the Commissioner. DEARNESS ALLOWANCE PAYABLE TO EMPLOYEES IN SHOPS AND COMMERCIAL ESTABLISHMENTS IN TAMIL NADU WITH EFFECT FROM APRIL 1, 2012:

The average Consumer Price Index Number for Industrial Workers for Chennai (Madras) City (Base: 1982-100) for the period from January to December 2011 was 848 points. After deducting 475 points on the basis of which Minimum Wage and Dearness Allowance were fixed, the number of points on which Dearness Allowance should be paid works out to 373 points. Calculated at Rs.4.30p per point effective from April 1, 2012, the D.A. works out to Rs.1,604.00 per month.

Member-Shops and Commercial Establishments in Tamil Nadu are advised to note that the Dearness Allowance payable to their employees with effect from April 1, 2012 is Rs.1,604.00 (Rupees One Thousand Six Hundred and Four only.

COST OF LIVING INDEX NUMBERS APPLICABLE TO THE EMPLOYEES EM-PLOYED IN VARIOUS SCHEDULED EMPLOYMENTS UNDER THE MINIMUM WAGES ACT, 1948 (A.P) AS ON 01-10-2011— COST OF LIVING ALLOWANCE PAYABLE:

Vide Proceedings No. N1/2459/2011 dated October 20, 2011 issued by the Commissioner of Labour, Government of Andhra Pradesh and published in the Andhra Pradesh Part-I, Extraordinary Gazette.

In exercise of the powers conferred under clause (d) of Section 2 and sub-section 2 of the Section 4 of the Minimum Wages Act, 1948 (Central Act 11 of 1948)-I, the Commissioner of Labour, A.P., Hyderabad and the Competent Authority under Minimum Wages Act, 1948, hereby declare the average rise in the State Industrial Workers Consumer Price Index numbers for half year ending June 2011, as on 01-04-2011 is as follows in respect of the employments specified in the Schedule:

The Consumer Price Index Numbers so notified in the Extraordinary Gazette came into force with effect from 01-10-2011.
