DescriptionThe land at Fountain Head Farm comprises approximately 108.06 acres (43.73ha) of which about 88.68 acres are Grade 3 arable land and about 11.02 acres of good quality, well fenced permanent pasture.

The land is situated to the north and east of the village of Brompton-on-Swale about 2 miles north of Catterick within an area renowned for the quality of its farmland. There is an excellent, quiet access off the new Brompton junction onto the A1 at Scotch Corner. The nearest main town is Richmond which is about 4 miles away with Northallerton about 12 miles to the south.

The land is level with gentle undulations between about 70m and 85m above sea level. It is classified as Grade 3 and is described by Landis as being a slowly permeable, seasonally wet, acid loamy and clayey soil.

The arable land is currently sown to Winter Wheat, Winter Barley and Spring Barley or temporary grass, all of which have shown consistently high yields in recent years. The permanent grass is in ridge and furrow and is well-fenced with access to water via troughs and open ditches.

Method of SaleThe land is offered for sale by private treaty. All potential purchasers are advised to register their interest with the Selling Agents so that they can be advised as to how the sale will be concluded.

TenureThe property is to be sold freehold with vacant possession.

Sporting RightsThese are included in the sale in so far as they are owned.

Mineral RightsThe mineral rights are excepted from the sale with provision for compensation in the event of any damage caused by their workings.

Wayleaves, Easements and Rights of WayThe property is sold subject to and with the benefit of all existing rights, including rights of way, whether public or private, light, drainage, water and electricity supplies and all other rights obligations, easements, quasi-easements and all wayleaves and covenants, whether disclosed or not.

There is a wayleave agreement in favour of BT and Northern Powergrid (Northeast) Limited. There are also easements in favour of Yorkshire Water.

There is a bridleway which crosses the farm as indicated on the sale plan.

There is also a right of access over the farm road in favour of High Gatherley Farm and High Gatherley Barn between points A and B.

A right of access has also been reserved over land belonging to High Gatherley Farm for agricultural access as indicated in brown on the sale plan.

ServicesMains water is available through private branch pipes metered at Fountain Head Farm steading which, if required, will require to be sub-metered by the purchaser who will then be billed for usage accordingly.

BoundariesThe Vendor will only sell such interests as they have in the boundary hedges and fences. Maintenance responsibilities will be as shown by ‘T’ marks on the sale plan. In the event of a lotted sale the Selling Agent will allocate further responsibilities.

Guide PricePrice on Application

VAT Any guide prices quoted or discussed are exclusive of VAT. Should any part of the sale or any rights attached to it become chargeable items for the purpose of VAT then this will be payable by the purchaser.

Basic Payment SchemeThe land is registered with the Rural Payments Agency and is to be sold with the benefit of Basic Payment Scheme (BPS) Entitlements at no additional cost. The Entitlements are currently held by and will be claimed by the Vendor for the 2020 season and the claim payment will be apportioned on a pro-rata basis as at the date of completion. The Purchaser(s) will be obligated to continue to manage the land in compliance with the scheme rules for the remainder of the calendar year and will be required to indemnify the Vendor from any breach or non-compliance.

The Vendor will endeavour to facilitate the transfer to the Purchaser(s) of normal Non-SDA Entitlements. GSC Grays will administer the transfer and charge the Purchaser(s) a fee of £250 plus VAT.

Ingoing Valuation In addition to the purchase price the purchaser will take over and pay for all growing crops, cultivations, stocks and stores at valuation. Payment is to be made on completion at a figure assessed by the vendor’s valuer based on CAAV or contractor rates where applicable and invoiced cost of seeds, fertilizers and sprays applied plus enhancement value.

DirectionsFrom the A1(M) take junction 52 signposted to Colburn and Catterick Garrison turning west on the A6055. After about 400m turn right on Catterick Road, past the racecourse and over the River Swale. At the traffic lights in Brompton-on-Swale go straight over onto Gatherley Road and then on to the roundabout. Fountain Head Farm lies immediately beyond the roundabout on the right.

Viewing & Health and SafetyBy appointment through the Selling Agents. Please take care when viewing the property particularly as this is a working farm. For your own personal safety, you should remain as vigilant as possible particularly around livestock or buildings.

Conditions of Sale Purchase Price Within 7 days of exchange of contracts a non-returnable deposit of 10% of the purchase price shall be paid. The balance will fall due for payment on completion at a date to

be agreed and whether entry is taken or not with interest accruing at the rate of 5% above the Bank of England base rate.

Disputes Should any discrepancy arise within these particulars of sale or the interpretation of them, the question shall be referred to the arbitration of the Selling Agents whose decision acting as experts will be final.
