r i t y of the same, as follows :

l. (1) This Act may bo ci ted as the Lembaga

Kcmajuan Ikan Malaysia Aot, 1971.

(2) This Act shall apply throu&out Malaysia.

(3) This Act shall come into force on such date

as the Miniater may by notification i n the Gazette

appoint, and diffarent dates may bo appointed fo r dif-

ferent States or part8 of Malaysia.

2. In this Act, unleso the context otherwise requirca: Interpretation.

5. (1) The Deputy Chairman of the Lmbaga shall be Officers and rcsponsiblo f o r the day t o day administration and servants o f the

(2) The Lcmbwci rnw appoint such off icers and

(3 ) The of f icers anrl servants of tho Lanbaga shall

hold office f o r such poriod or periods, receive such

sa lar ies and allowancoa a d bc subjcct t o such condi-

t ions of s c ~ c e as mw bo dotcrmincd by tho Lanbaga

with the approval of the Minister,

(4) The Deputy Chairman s h a l l have the powers of LKlH. hendment

( i i ) moncys earned by the L c m b ~ a i n thc clis- chargo of i t s functions undor or pursuant t o thc 2rovisions of .this Act;

( i i i ) moneys earned or a r i s ing from any dovelop- ments, invcstncnt, mortgages, charges or dcbcnturos acquired by or vested i n the Lcmbabn;

( iv) sums borrowed by the Lanbaga f o r the purposo of meeting any of its obligations or discharging any of its functions;

(v) a l l other suns or properties whether movable or immovable which m a y i n any mamer become payablz t o or vested i n the Lenbaga;

(b) out of vhich sha l l bo defrayed - (i ) ?l1 expenditure (including capi ta l

oxponlituro) incurred by the Lembzg?, i n carrying out i t o functions and powcrs; and

( i i ) moneys f o r the repaynont of any loan t o the Lernbw pursuant t o i t s powcrs t o borrow.

(2) Before the beginning of Juno of each year the Lembaga

shall submit t o the Minister zn es t ina te of the expennes (inclu-

ding those fo r devolo2ment projects) f o r the following yc,v i n

such form and with such part iculars as the Ifinister may require;

and the 1.Iinistcr s h d l beforo the beginning of Nwember of tha t

year notify the LembwG of tho amount authorised f o r expcnses

generally or of the amount authorised f o r each description of

expenditure,

(3) The Lembaga nay at any timc subnit t o the %nister a

supplementary eotinate of any ono year and tho Minister may allow

tho whole or any part of tho adclitionzl exponditlure included therc-

in,

7. The Lcmbaga may upon tho te rns and conditions apprwed by Borrovf ng.

the Auditcr Genera or other auditor^ appointed by the

Lcmbaga with tho csproval of the Minister,

(3) After the end of each f inv lc i a l year, and as Boon

srs the accounts of thc Lcmbaga have becn audited, the Lcmbqp

sha l l cause a copy of the statement of accounts i n such manner

as the Minister may requiro t o be t rmsmit tod t o the finister,

together with a cogy of any obssrvations mado by tho Auditor

General o r othor auditors a2pointed under subacc t ion (2) on

any statement or on thc accounts of the Lembaga.

(4) Tho 1.Iinister sha l l causo 2 copy of every such stats-

ment and observations t o be l a id on the tab le of oach Housa of

Parliament.

10. The Lembaga sha l l not l c t c r t h w tho 30th day of June

of each year, cause t o bo mado and transmitted t o the Minister

a report d o d i n e with the a c t i v i t i e s of tho Lembaga during the

preceding year and containing information r e l a t ing t o tho pro-

oceding and policy of thc Lembaga as the Minister may from time

t o time require,

carry out such inspection and examination (including tho

inspection =and examinztion of books) as he may ccnsidor

evidcnce of an offancc under t h i s Act or under any rulo

made thcrounder.

Provided tha t when any person has been

arrested a s aforesaid he s h a l l be thereafter

dealt with as provided by the l a w r e l a t ing

t o cr ininal procedure fo r the time being i n

force; and

(b) seize anything which he considers it necessary

t o seize i n re la t ion t o the evidence necesscrry

t o establ ish the commission of any such offence,

(2) Any authorized of f icer and any police of f icer not below

the rank of Inspector may in relat ion t o any investigation in r e s ~ e c t of any offenoe under t h i s Act o r any rule made there-

under without order of the Public Prosecutor exercise the special

powers in re la t ion t o police investigations given by the l a w

re la t ing t o criminal procedure in any seizable offence.

(3) Any prosecution in respect of an offence under

t h i s Act o r under any rule made thereunder may be conducted

by an authorized officer.

14. (1) Where an authorised of f icer o r police of f icer has Pomr t o stop

reasonable suspicion tha t any conveyance i s carrying any and scarch.

f i s h in contravention of any provision of this Act or any

rule aade thereunder, it sha l l be lam1 f o r such o f f i ce r

t o stop and examine such conveyance fo r the purpose of

ascertaining whether any f i s h i s contained therein or i s

being moved o r transported contrary to the provisions

thereof and the person in control o r i n charge of such

conveyanco shal l i f required t o do so by such off icer ,

stop such conveyance an6 allow such off icer t o examine

the same.

(2) The person in control o r in chazge of any

conveyance examined under the provisions of this section

shall be request by the authorized of f icer r\r police

of f icer open a l l p a t s of the conveyance fo r examination

by such off icer and take a l l measures necessary t o

enable such examination as such of f icer considers necessary

t o be made,

15. (1) If any authorized of f icer or police off icer has Power to tzlce possession.

offence under t h i s Act or under any rule nade thereunder

he nay take possession in such manner as he sha l l deem

f i t of any f i s h in respect of which he has reason t o

believe. such an offence has been comit tad o r of any

vehicle, vessel o r other a r t i c l e by means of which any

offence has been committed o r which he has reason

t o believe i s intended t o be used f o r the commission

of such offence,

(2) There under the provisions of this section

posessess.ion has been taken of any f ish, then the Deputy

ChaFrman -

(a) i f he has reason t o believe that an

offence under this Act or under any

rula made thereunder has been committed

and crFninal proceedings have been

ins t i tu t ed against any person in

respect of such offence, he may apply

t o the hiagistrate f o r zn order tha t the

f i s h &all be sold or disposed of, and

i f the f i s h i s ordered t o be sold, the

proceeds of sale sha l l be kept under

the conclusion of such cr in ina l proceedings;

(b) in any other. case, nay restore possession

t o the owner.

(3) Where under the provisions of this section posp ~ e s s i o n

has been taken of any vehicle, vossel o r other a r t i c l e , then the

Deputy Chairnan - (a) i f he has reason t o belleve tha t an

offence under this Act or under 2ay ,

ru le nade thereunder has been committed,

may at his discretion, temporarily return

such vehicle, vessel or other a r t i c l e t o

the owner of the sane on security being

f'urnished t o his sa t i s fsc t ion tha t the

vehicle, vessel o r other a r t i c l e sha l l

be surrendered t o him on demand; o r

(b) in any nther. case, nay restore possession

t o the owner.

(2) Any body corporate which commits an offence

under, or f a i l s t o conply with, any of the provisions of

this Act o r of any rule made thereunder sha l l be

l i ab le on conviction t o a fine not exceeding twenty-

f ive thousand dol la rs and, fo r a second o r subsequent

offence, t o a f ine not exceeding f i f t y thousand dollazs.

(3) Where a peraon charged with as offence under

any of the provisions of this Act o r of any ru le made

thereunder i s a body corporate every person who, at the

time of the conmission of such offence i s a director o r

of f icer of such body corporate may be charged joint ly

in the sane proceedings with such body corporate, and

where the body corporate i s convicted of the offence

charged, every such director o r of f icer sha l l be deemed

t o be gui l ty of tha t offence unless he proves tha t the

offence was comnitted without h i s knowledge o r that

he tool reasonable precautions t o prevent i t s commission.

(4) Any person nho would have been l i ab le under

any of the provisions of this Act or of any ru le made

thereunder t o any penalty f o r anything done o r omitted

i f such thing had been done or omitted by him personally,

sha l l be Uable t o thc same penalty, i f such thing haa

been done o r omitted by his partner, agent o r servant,

unless he proves tha t he took reasonable precautions t o

prevent the doing or omission of such thing.
