1. Welcome and Introduction to FdSc LAw

Welcome to FdSc Law delivered at and by Petroc.

We are pleased to welcome you on this innovative programme. Run in conjunction with Plymouth Univeristy it offers students an excellent introduction to Law together with 2 exciting progression routes for completion of the degree.

Distinctive feature include

Assessment using mock court hearing for the presentation of a speech to the court

Assessment of interviewing skills. Focus on practical and transferable skills Exceptional resources e.g. access to a range of online legal databases and

law journals through the Plymouth University portal ‘Double-badging’ through the Institute of Legal Executives, allowing

successful students the opportunity to gain a professional legal qualification as well as the more academic Foundation Degree

Close links with the Law Team at Plymouth University and the inclusion of ‘taster days’ at the Plymouth University campus to aid students’ progression to either the BSc Law with Business or the second year of the LLB (Hons) Programmes

Encouragement to participate in mock trial Access to a variety of visiting speakers from a range of business and legal

fields

This is relatively new course with the first cohort just now starting their third year in Plymouth on the BSc Law with Business degree. Other students have found employment in the legal sector.

This programme has been designed to equip you with the skills and knowledge base required to work in your chosen specialism or other graduate opportunities. It is also a platform from which you can undertake additional vocational and academic qualifications.

PS2. Brief Description of the Programme The following is a description of the programme that clarifies both its position within the delivering institution and Plymouth University’s portfolio. This material/ may be used for promotion of the programme and the text should be approximately 200-250 words. This Petroc proposal is to offer an FdSc Law programme to both full and part-time student cohorts. The programme will be delivered in Barnstaple, at our Brannams HE Campus. This award is informed by the QAA Benchmark Statements for Law 1 Full time/part time/distance learning etc.2 All award types should refer to QAA Subject Benchmark(s), but for Fd level or below this should be preceded by “informed by …”. Fd level qualifications should also cite Foundation Degree Qualification Benchmark (FDQB)

2000 and 2007 as well as being informed by the QAA Benchmark Statement for General Business and Management 2007 and Foundation Degree qualification benchmark May 2010 The FdSc Law will contain 8 Law modules; introducing students to a broad range of legal concepts, relevant in both legal practices, but also to business. The remaining 4 modules are business modules, ensuring the student has knowledge of business concepts, management and financial strategies. Employability, practical and transferable skills feature highly, allowing the successful student to offer real and appropriate skills whether in a legal or business environment. Students who achieve an overall aggregate grade of 40% or above in the Foundation Degree will be allowed to progress to Stage 3 of the University of Plymouth BSc (Hons) Law with Business. (This is not a qualifying law degree)There is also a progression route available for students who achieve an overall grade of 2:2 in the FDSC law. This is to Plymouth to join their year 2 of the LLB (Hons) which is a qualifying law degree.Petroc is a Further Education College which has developed and delivered a broad higher education curriculum, in partnership with Plymouth University over the past 15 years. In 2013 / 2014 we will deliver in excess of 20 Higher Education courses, including our BA Professional Development (Hons) programme to in total, approximately 500 learners.The college’s strategic plan 2011 – 2016 states the need to; increase the number of HE learners studying at the college, ensure that our HE offer matches the current and future needs of the local economy and to ensure that our HE students achieve high success rates.

PS8. Student Numbers

The following provides information that should act as a guide to assure the quality of the student experience, progression opportunities, and staff and resource planning:Approximate minimum student numbers per stage = 10 full time students and 5 part time studentsTarget student numbers per stage = 15 full time students and 10 part time students each yearApproximate maximum student numbers per stage = 25 full time students and 12 part time students

PS9. Progression Route(s)

Approved ‘progression route(s)’ are those where successful achievement on a programme enables a student to progress onto a stage of another Plymouth University programme.

There may however, be factors that limit the availability of a place on a progression route in any one year. If a progression route place is not available in the first year in which a student wishes to progress to Plymouth University, a place is guaranteed within three years. Should a Plymouth University progression route be withdrawn, the timing of the programme closure will either be timed so as to allow progression for existing students who wish to progress immediately onto a Plymouth University programme (excluding periods of interruption or repeat years of study) or appropriate alternative solutions will be found.Progression opportunities with institutions other than Plymouth University carry an increased element of risk. It is necessary for the delivering partner institution to obtain formal agreement from that institution to guarantee progression for existing students on the programme.Students who achieve an overall aggregate grade of 40% or above in the Foundation Degree will be allowed to progress to Stage 3 of the University of Plymouth BSc (Hons) Law with Business. (This is a non-qualifying law degree)Students who achieve a 2:2 in the FDSC law will also be eligible to progress to Stage 2 of the University of Plymouth LLB(Hons). The methods and strategies detailed below are built around the need to incorporate a variety of methods to ensure all students are engaged and focussed. They are taken from established pedagogy and allow different learning styles to be used to try to ensure all students learn. Visual, oral, aural and kinaesthetic methods are all to be found in the methods and strategies employed within the modules. The focus will be on learning and helping the student develop into an independent autonomous learner.

Knowledge and Understanding.

Knowledge and understanding of substantive law and theory is fundamental to the progression of student’s education and abilities. The framework for building knowledge and Understanding will be lectures where information is delivered by lecturers. It will be further developed by lecturers setting activities for students to prepare for seminars. These activities will allow students to embed knowledge and deepen understanding. This may be through activities such as application questions; group work, presentations or preparation of discussions. Students will be expected to research primary and secondary legal sources, but also wider reading of newspapers and periodicals (not legally focussed) will be encouraged. To begin with the activities undertaken by the student will be heavily directed by the lecturer, but as the course progresses, students will be expected to undertake more responsibility to self direct (with appropriate guidance from lecturers). Seminars and other small group work will allow students to develop confidence in their learning with structured feedback from the lecturers on the task and their performance. At level 4 such knowledge will be built slowly, embedding as the year progresses legal skills for students to be able to discover knowledge themselves. Activities will also increase in difficulty as students develop their own study skills.At level 5, Students will continue to be developed in their knowledge, still through lectures primarily, but with more emphasis on guidance rather than detailed dissemination. Part of the role of seminars will be to ensure that students are able to research and develop their own knowledge and understanding in the depth that is required for the study of law and business. Assessment is carried out through a variety of methods including formal examinations, in class tests, case studies, coursework and presentation. Formative work will be undertaken at both levels to ensure that students are fully prepared for the summative assessments. For example, in class tests and mock examinations. All lecturers will ensure that students have the opportunity to practice on more than one occasion the type of assessment required in each module.

Cognitive and Intellectual skills.

These skills are of vital importance to students in developing lifelong skills transferable to any situation. In keeping with their importance, emphasis will be placed on them from the commencement of the course. It is important that students recognise the various components, such as description, evaluation and analysis and undertake focussed activities to ensure their understanding and ability to translate theory into practice. Activities centred on seminar discussions (for example debate as to the value of consumer law for the population as a whole)

Assessment is carried out in a variety of ways to prevent over emphasis on one or two particular skills. Problem questions, evaluation and description questions in examinations, using the skills in oral applications and through coursework will judge the students developing skills and also allow the students to be assessed in an even way, allowing students the opportunity to be assessed in ways which may play to their strengths.

It is recognised that these skills will need to be developed gradually over the 2 years and therefore the detailed guidance that the students receive in level 4 will reduce to enable the student to be independent by the end of level 5. It may be that skills such as reading and note taking will need to be addressed early on to ensure all students have the basic skills before addressing more intellectual skills such as synthesis. Formative assessment is given during the progression of the course.

Key transferable skills.

Clear and effective written communication skills are developed throughout the two years through the formative assessment of written work. This work may take a variety of forms- essays, answers to problem questions, report or letter writing. At the commencement of the course, the attention of students will be drawn to the need for effective written and verbal communication in induction and this will be further developed through seminars and students own independent study. Oral communication skills are central to this course and are encouraged through discussions, debate as well as the more formal interview techniques and presentations the students must make.

Written and oral communication is assessed at both levels to encourage students to develop those skills as tools for their advancement. They are assessed through examination, coursework and oral applications and presentations.

Information Technology is an essential part of life today and student’s skills will be developed through the requirement to submit work through word processed essays and even through more advanced techniques such as excel and computer generated activities. Formative assessment will be used throughout the course and is summative assessment takes place in the Legal Research and Writing Skills module at level 5.

Group work is encouraged at both levels but assessed only in Level 4. Formative assessment will take place in all law modules to ensure students understand what is required of them and also, as peer and self assessment will play a considerable role, how to critically evaluate theirs and others performance. Students will undertake several group presentations where they are required to give accurate feedback peer assessment, with guidance given by the lecturer to ensure fairness and accuracy. Group work is assessed only at level 4, but will continue to be used in level 5 to enable student to continue to develop and use useful employability skills.

A student as an independent and responsible learner is a key component of the course. It is accepted that at level 4, students will require considerable guidance and direction of lecturers. For example, students will receive information through lectures and be directed on activities to embed the knowledge, expand and evaluate. As time and skills progress, student will receive less guidance. By the time students reach level 6, it is anticipated that they will be autonomous to a large degree.

Practical and employment skills.

Many of the key transferable skills are also practical and employment skills. However, the 3 chosen here are skills which are transferable to any form of employment and are specifically aimed at key components of many jobs.Learning is centred on the student’s independent study and developed further with seminars. Lectures provide the framework for students who are then able to practice those skills. Tasks such as practice letter writing, presentations and accessing and incorporating guidance into simple documents will provide learning and also formative assessment opportunities.

Again, at Level 4 the guidance and assistance given by lecturers will be very much in evidence. As Students move towards and at Level 5 this guidance will not be required in the same way, allowing students to develop their own styles of letter writing and oral presentation.

By their nature, the skills are a vehicle for assessing other skills such as knowledge and understanding. Such assessments are done through examination, practical course work (presentation)

Number of assessments

Possible progression routes from this degree are numerous, in that students may choose to progress to a full honours degree and maybe a professional legal career, or may choose to go into employment at the end of the foundation or honours degree- the choice of careers being almost limitless. In consequence, to give students the widest possible skills and knowledge the intended learning outcomes (ILOs) are diverse and transferable. For example, the ability to make a speech in mitigation is simply an ability to make a persuasive argument.

In addition to skills it is vital to know that students have had the ability to understand the knowledge and as such it is considered appropriate to assess this in every module. It has been impossible to devise 1 assessment that could encompass the assessment of knowledge in the depth required together with say a plea in mitigation. Therefore there are a number of different types of assessment within the programme.

Some modules lend themselves to just 1 examination such as Law of Obligations (TORT), where the assessment is paper based. However, the module Introduction to Land law and Criminal law allows different ILOs to be assessed but over 3 assessments. Knowledge must be assessed twice and the practical skill of a persuasive argument is assessed as a plea in mitigation.Whilst there are a number of assessments, students will be working all year on a number of projects. Student will not have all their assessments at the end of the year. Coursework will be spread across the year and the case studies for land law and the portfolio for European Union Law will be assessed in different years. Practical assessments can be carried out gradually after the students have received sufficient training and formative assessment.

MODULE AIMS:To provide the foundation concepts of constitutional and administrative law, and to enhance knowledge and understanding of principles and their practical application with particular reference to the British constitution. The module examines the theoretical basis of constitutionalism and the legal principles involved in the creation of a democratic framework of power, including the protection of human rights. Teaching and learning will be delivered through a series of interactive sessions that encourage learner participation and engagement in the topics discussed. A scheme of work will be provided in induction week which details the scheduled teaching and learning approach within this module.

Self Directed 155

Undergraduates will be required to read around the subject using academic books and appropriate journals/texts related to the subject of finance with a particular focus upon the stock exchange as a source of finance. Students will also be expected to research and write the summative assessment and revise for the examination.
