Since that time, there’s been a boom in the number of people flocking to the Rocky Mountain State to get a piece of the action, either as weed connoisseurs or hopeful entrepreneurs with plans of opening their own pot shop.

WHICH LAWS GOVERN MARIJUANA IN COLORADO?

There’s two different laws regulating the sale and use of cannabis in the state.

Depending on whether you’re going to start a medical marijuana dispensary or open a retail store selling recreational weed, you’ll have a slightly different regulations to follow, though it’s certainly still a good idea to pay attention to both.

AMENDMENT 64

Passed in November 2012 and later coming into force as Article 18, section 16 of the Colorado state constitution, this is the law that garnered huge amounts of publicity and controversy in equal measure, all because it made it legal to use, buy, and grow marijuana.

What this means is that if you are over 21, you’re legally allowed to:

Grow up to six plants, with no more than half being mature, flowering plants at any time Possess up to one ounce of cannabis Give up to the same amount as a gift to someone over the age of 21.

You won’t need a medical marijuana license or anything like that to do this. We’re talking personal use here.

We’re also talking retail, taxes and commercial cultivation of the plant.

AMENDMENT 20

Which brings us Amendment 20, passed in November 2000 to regulate the cultivation, distribution and use of medical marijuana for approved patients.

Sharing some differences with the later recreational use laws, Amendment 20 still allows you to grow up to six plants, and you can still only half up to three of those flowering.

The big difference is that you’re allowed to possess up to two ounces of the stuff for medical use, and if your doctor feels that it’s going to benefit you, they can even recommend that you be allowed to grow, or at least possess, even more than that.

THE DIFFERENCE BETWEEN RECREATIONAL POT AND MEDICAL MARIJUANA The main deciding factor between opening a dispensary in Colorado serving patients with medical marijuana, or simply taking advantage of Amendment 64 to open up your own pot shop all comes down to taxes.

Recreational marijuana comes with some of the biggest taxes on consumer products in the state, with a 25% state tax on top of the usual 2.9% sales tax.

Patients with consent to buy it for their medical use from a Colorado dispensary don’t have to deal with such heavy levies on their cannabis.
