Firms' hiring freeze starting to thaw, recruiters say

Law firms, including big firms, are starting to hire experienced associates and other non-partner lawyers again in

Chicago, according to two local legal recruiters.

But one recruiter cautioned that firms are hiring more temporary contract lawyers and more staff attorneys for the non-

partner track than in the past.

In requests for associates, "we are way up from where we were a year ago," said Alan J. Rubenstein, executive vice

president of Chicago Legal Search Ltd. "It really got rough last year from April through the end of September."

Now, Rubenstein said, "My phone is ringing off the hook. …We are very busy and getting phone calls, e-mails every

day now with new searches for the last couple weeks."

He said demand was healthy for associates who do corporate transactional law and corporate finance. "We are getting

searches from estate planning, labor and employment, some litigation. … Litigation is not as brisk as you would expect

post-recession," Rubenstein said. "For the most part, maybe real estate excepted, it's pretty much across the board."

Beth B. Woods, managing director for Major, Lindsey & Africa, said: "The market is starting to thaw. We are seeing an

uptick in hiring. Real estate has obviously not come back. If I had to pick an area that is sort of dead right now, it would

be that."

She said her firm had been hearing from associates who have jobs that they have been busy at work for the past six to

nine months.

Now, she said, "Law firms are going to start to bring on more people to help with excess workloads. But obviously after

massive layoffs, they are moving slowly, very cautiously, and turning to the contract [attorney] model.

"Clients are dictating relief in rates and more creative staffing solutions, such as addition of staff or contract attorneys to

complement the existing model of associates on the partner track. We've been seeing that more and more. I'd say it

started to emerge in the past six to nine months.

"Going forward, I think that's going to be sort of the trend. It's just one more tool law firms are going to have in their tool

box for staffing cases."

Rubenstein said big law firms entered the lateral associate market again only recently.

"For a while, we were getting searches from midsize firms that were busy due to their rate structure and dealing with

mid-market clients," he said.

Now, Rubenstein said, "we're getting calls from larger firms we haven't heard from in a long time, in some cases in 18

months."

He said he also noticed "a number of associates that had been victims of layoffs and had been in my resume data base

for some time, increasingly as I reach out to them, they've landed something. It might be for less money. It might be in a

different practice area than they were in previously. …

"There is still more supply than there is demand" for associates, he said, "but that imbalance is starting to even out to a

degree, and I would surmise in the next six to 12 months we may be in a position where demand is exceeding supply if

the trends we see continue."

In previous interviews with the Law Bulletin, Rubenstein has generally been an optimist. He predicted last December

that "maybe later in 2010, but certainly by 2011, I think we'll see strong demand again" for highly qualified associates.

Now, he says, "I was surprised at the pace with which things seem to be accelerating. I suspect that firms cut so deeply

during the downturn they are finding themselves very quickly short-staffed and unable to handle the rapidly accelerating

upswing."

Woods and Rubenstein said recruiting for in-house lawyers has also picked up.

Woods' comments about the available jobs were more restrained. "There are experienced lawyers that are on the

market, so most of the contract work is going to people that had experience," she said.

Many legal employers "benefited from the fact that there's experienced talent available on the market … willing to work

in staff attorney and contract attorney" positions, she said.

Woods, a former litigation partner at Williams, Montgomery & John Ltd. in Chicago, has been a legal recruiter for only

three years. She said other recruiters with 20 years' experience have told her that the legal downturn of the past year

and a half with massive layoffs was worse than previous downturns.

"Everyone agrees we're sort of on the upside of it," she said.
